CITY OF VERONA MINUTES PUBLIC WORKS/SEWER & WATER COMMITTEE MONDAY, JANUARY 14, 2019 1. The meeting was called to order by Mr. Touchett at 5:06pm. 2. Roll Call: Present: Evan Touchett, Chad Kemp, and Sarah Gaskell. Also present: Theran Jacobson, Public Works Director; Jeff Mikorski, City Administrator; Jeff Montpas, City Engineer, AECOM; Carla Fischer, AECOM; Steve Vollenweider, resident; Bryan Kleinmaier, City Attorney, Stafford Rosenbaum; Eugene Cropp, resident. 3. MOVED by Touchett, seconded by Kemp, to approve the minutes of the December 10, 2018 meeting of the Public Works/Sewer and Water Committee. Motion carried 3-0. 4. Notes on Agenda Items 4, 5, and 6 during open session: Mr. Jacobson presented all three insurance claims that were due to the storm event that occurred on August 20/21, 2018. The City of Verona received 11 inches of rainfall in less than 12 hours. Mr. Jacobson summarized that each location was due to differing circumstances. Below is a summary of the open session discussions for each property. All three committee members were thankful of the property owners for coordinating with City staff and expressed their concerns as this was an unprecedented event. 1. Mr. Jacobson noted that the claim at 308 Valley View was due to the sanitary sewer exceeding capacity due to basement flooding along Holiday Court. All basement floor drains are connected to the sanitary sewer. The properties along Holiday Court that received water from the Lower Badger Mill Creek floodwaters where storm water entered and the system exceeded capacity due to the storm event. 308 Valley view is low point along the sanitary sewer pipe alignment and the sewer backed up into the basement. Mr. Jacobson noted that the sanitary sewer was cleaned and cured in place pipe was installed in July prior to the event so there was no maintenance issues. Mr. Vollenweider, the property owner of 308 Valley View, was present and noted the following:  His personal property insurance covered $5,000 of the total damages and he was seeking the balance.  When Mr. Kemp asked if there was ever an issue prior, Mr. Vollenweider noted that he has not had an issue in the 40 years of owning the property. 2. Mr. Jacobson noted that the claim at 415 Acadia Way is adjacent to storm water detention pond located adjacent to the old Town Hall. The storm water pond exceeded its banks and flooded the basement of the property at 415 Acadia Way. Mr. Jacobson noted that there was no known issues with the facility prior to the event as staff inspected specific storm water facilities (including the Acadia pond) the week prior in preparation for the storm event. 3. Mr. Jacobson noted that the claim at 708 Cabrillo Drive is adjacent to the newly developed Cross Point Estates. Mr. Jacobson identified that the night of August 20, the known kettle along the rear lot lines of the properties received an excessive volume of runoff water and started flowing along the side yard of 708 Cabrillo Drive. Dr. Cropp indicated that this had never occurred until the development was constructed. The property at 708 Cabrillo Drive received an inflow of runoff into the egress window the night of the August storm, flooding their basement and causing damage. Mr. Jacobson summarized the history, timeline of events, and improvements that have occurred recently, as identified in the memo included with the packet. Mr. Jacobson noted that addition grading is scheduled to occur within the next week to provide temporary improvements with full implementation of a rear lot line swale in the spring as ground conditions warrant construction. No action was taken during open session. 5. MOVED by Touchett, seconded by Gaskell, to convene in a closed session, as authorized by Wisconsin Statute 19.85(1)(g), for the purpose of conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. Touchett – aye, Gaskell – aye, Kemp – aye. Motion carried 3-0. Closed session started 5:39pm. 6. MOVED by Touchett, seconded by Gaskell, to reconvene in open session. Motion carried 3-0. Open session reconvened at 6:32pm. Kemp left at 6:33pm. 7. MOVED by Touchett, seconded by Gaskell, to recommend approval of project closeout and change order no. 1 for Project ID 2017-113, CTH M & Locust Drive Pedestrian Improvements. Motion carried 2-0. 8.
