Town of Vienna 127 Center Street South Vienna, Virginia 22180 p: 703.255.6341 TTY 7111 Meeting Minutes Board of Architectural Review Thursday, November 18, 2021 7:30 PM COUNCIL CHAMBERS-VIENNA TOWN HALL Continuity of Government - Electronic Participation BOARD OF ARCHITECTURAL REVIEW November 18, 2021, Meeting Minutes The Board of Architectural Review met Thursday, November 18, 2021, at 7:30 pm in the Vienna Town Hall at 127 Center St S. and Via Zoom Webinar. Chairman Roy Baldwin, Michael, Patty Hanley, Paul Layer, and Linda van Doorn were present in Council Chambers or via Zoom. Principle Planner Kelly O’Brien and Board Clerk Sharmaine were present in Town Hall. Mr. Baldwin called the meeting to order. Roll Call Ms. van Doorn, Mr. Layer, Mr. Baldwin, Mr. Cheselka and Ms. Hanley were present. Continuity of Government - November 18, 2021 Resolution for Continuity of Government Second: Mr. Cheselka Ayes: Ms. van Doorn, Mr. Layer, Mr. Baldwin, Mr. Cheselka, and Ms. Hanley Approval of the Minutes Old Business 211 Mill St NE - Dulles Kitchen & Bath - Exterior Modification Item No. 1: Request for approval of a sign and building modification for Dulles Kitchen and Bath, located at 211 Mill Street NE, Docket No. PF- 555101-BAR, in the CM Limited Industrial zoning district, filed by Mustafa Ozdemir of Dulles Kitchen & Bath. Mr. Johan Saygi was present to represent the application. Ms. Hanley asked about the spec sheet for the schlutter. Mr. Saygi stated there was only one kind and it was standard with a metal edge banding. Ms. Hanley asked Mr. Layer to describe a schlutter and stated that if Mr. Saygi is using something similar, the Board may approve the application. Mr. Layer stated he felt alternated two option would be better as it would avoid the staining and would cover the seams. He also stated it should project out to protect from the rain. Mr. Saygi stated he could bring in a sample and the specs as there is only one brand of schlutter. Ms. van Doorn stated she liked the black framing of the doors and asked that would be used above as well. Mr. Saygi stated he was not adding black framing as there is existing framing. Mr. Cheselka stated his choice of Behr paint could be a problem because it is not a good quality exterior paint due to its high-water content. It may only last a few years before requiring maintenance. Mr. Saygi stated they would match the approved color to a Sherwin Williams brand paint for the final coat. Mr. Baldwin stated he would not be voting in favor of the application as he felt the proposal was not harmonious with the Masonry Hall and Cube Smart. It is also visible from Church St. as well as being near Vienna Presbyterian Church and the Freeman Store which are old iconic town structures. He stated the futuristic style would clash with the buildings he mentioned. Ms. Hanley made a motion to approve the request for approval of exterior modifications for Dulles Kitchen and Bath, located at 211 Mill Street NE, Docket No. PF- 555101-BAR, with the condition that alternate number 2 is to be used and schlutter will be provided to staff Motion: Ms. Hanley Second: Mr. Layer Ayes: Ms. van Doorn, Mr. Layer, Mr. Cheselka, and Ms. Hanley Nays: Mr. Baldwin Motion passes: 4 to 1 435 Maple Ave W - Hawk & Griffin - Exterior Modifications Item No. 2: Request for approval of exterior modifications for Hawk & Griffin Public House, located at 435 Maple Avenue W, Docket No. PF-69-20-BAR, in the C-1 Local Commercial zoning district; filed by Thomas Kyllo of Vienna Pubs LLC. Mr. Tom Kyllo was present to represent the application. Mr. Kyllo explained the changes to the approved plans. First, the flooring in the outdoor seating area was proposed as flagstone, but due to several issues, including budget issues it was decided to have a concrete slab. Second, the proposed fence was to be fabricated resin. That type of fencing was not available, and the black attracted the heat from the sun and there was no cover for the patio area. The wood is natural which will allow for curing through the winter months and to apply a finish in the spring. Third, a sunshade was added to reduce heat and light in the patio area during the day. Fourth, the lighting had been approved, but a final product had not been presented to the Board. The final change was the addition of a British phone box. Mr. Cheselka recommended a Cedar tone for the fence finish as it will hold up well and the color would complement the other colors on the building. Ms. Hanley stated the Board could include the fence color finish in the approval so Mr. Kyllo would not need to return unless he wanted to make a revision. Ms. van Doorn commented that the flagstone would look nicer. Mr. Kyllo expressed the budgetary constraints as the reason for changed to brushed concrete that was scored as Town of Vienna Page 2 Printed on 3/4/2022 Board of Architectural Review Meeting Minutes November 18, 2021 well as the needs for handicap access and the heat gain that would happen in that area. Mr. Layer requested a cut of the Cedar tone color if that is what is decided on and approved by the Board. Mr. Baldwin asked for the Kelvins of the lighting. Mr. Kyllo stated it was a level, Kelvin. Mr. Layer made a motion to approve the request for exterior modifications for Hawk & Griffin Public House, located at 435 Maple Avenue W, Docket No. PF-69-20-BAR, with the condition the fence be stained Cedar tone and drop off a spec to staff. Motion: Mr. Layer Second: Mr. Cheselka Ayes: Ms. van Doorn, Mr. Layer, Mr. Baldwin, Mr. Cheselka, and Ms. Hanley Motion passes: 5 to 0 436-438 Maple Ave E - Wolftrappe Shops - Exterior Modifications Item No. 3: Request for approval of signs and building modifications for Wolftrappe Shops, located at 436-438 Maple Ave E, Docket No. PF-630699-BAR, in the C-1 General Commercial zoning district, filed by Daniel Orlich, property owner. Mr. Daniel Orlich and Victoria Orlich were present to represent the application. Ms. Orlich stated they would be installing new windows and doors with anodized bronze frames. The existing wooden exterior panels would be replaced with Hardie panel that would be painted with Almond Roca color. Ms. Hanley asked if there would be a separate application for the signs. Ms. Orlich stated the tenant would apply for the sign. Ms. Hanley asked about the transition from the hardiepanel if the intent was to end on the front face and Ms. Orlich stated yes. Ms. Hanley asked if there would be an overlap at the transition of the Hardie panel. Ms. Orlich stated they would put an edge panel. Mr. Cheselka asked if the brick surrounding the window would change. Ms. Orlich said no. Mr. Baldwin asked if the hardipanel would be painted in factory or on site. Ms. Orlich stated it would be painted on site. Mr. Baldwin inquired about the painting to which Mr. Cheselka stated it would be acceptable as they were using a pre-primed wood. The paint that was proposed to be used was Sherwin Williams. Mr. Cheselka encouraged possibly priming one more time. He also asked if the paint would be semi-gloss or matte. Ms. Orlich stated it would be a matte color and they would prime the panels one more time. Mr. Cheselka made a motion to approve building modifications for Wolftrappe Shops, located at 436-438 Maple Ave E, Docket No. PF-630699-BAR as submitted. Mr. Gary Brent was present to represent the application. Mr. Cheselka shared some concerns about the lack of color contrast but had not objections to the application. Mr. Baldwin inquired about the distance between the proposed sign and the neighboring sign. Mr. Brent stated it appeared to be around 7 feet between the two signs. Ms. Hanley made a motion to approve the request for approval of signs for Asurion, located at 136 Maple Ave W, Docket No. PF602866-BAR, as submitted Motion: Ms. Hanley Second: Mr. Cheselka Ayes: Ms. van Doorn, Mr. Layer, Mr. Baldwin, Mr. Cheselka, and Ms. Hanley Motion passes: 5 to 0 142 Branch Rd SE - Big Buns - Signs Item No. 5: Request for approval of building mounted signs for Big Buns, located at 142 Branch Rd SE, Docket No. PF-637880-BAR, in the C-2 General Commercial zoning district, filed by Tony Rogers of Ark Signs, project contact. Kevin Barry was present to represent the application. Ms. Hanley questioned the expletive that is hiding in the D#*! Mr. Barry stated the branding is Big Buns, Damn Good Burgers. The ownership group thought it would be more family friendly. Mr. Layer asked for color confirmation for the signs, one with green letters and the other would be white with black returns, Mr. Barry stated that was correct and the green was more teal, not green and the returns were anodized bronze per the shopping centers requirements. Mr. Layer inquired about the portion of the sign that was to be profanity. Mr. Baldwin stated there was no specific prohibition towards and words or combination of words. There is a portion in the preamble of the Architectural Design Code section of the Town Code stating “...safety, morals, and general welfare of the citizens.” Mr. Layer thought it may not be in the sign ordinance. Ms. O’Brien stated the towns sign code does not meet current sign code standards as it, legally, should be content neutral. Ms. van Doorn asked if it would be equivalent to bleeping a person in broadcasting. Mr. Barry stated the original branding says, “Damn Good Burgers”, and in an attempt to be more family friendly, the chose “D#*! Good Burgers” which could be interpreted as “Darn”. It is the logo for their restaurant which is growing in in Northern Virginia. Mr. Baldwin agreed with Mr. Barry that he too did not want to offend people and the word is a curse word and many would find it objectionable. He continued stating he did not want objectionable words on commercial signs in town. Mr. Cheselka agreed and was concerned about precedent setting. Mr. Layer stated the design standards were for a those of a good well designed suburban community due to potential property value. There was continued discussion regarding the language for the proposed sign. Ms. O’Brien stated revised drawings showing the 3500 kelvins as well as the staff report. Ms. Hanley asked if the company had any flexibility with the sign. Mr. Barry stated the phrase was trademarked and it would be rolled out with the other franchise material. Signage is imperative to the brand. Mr. Barry stated he was open to suggestions, but felt the symbols were not indicative to profanity. Mr. Barry stated he had no comments other than what can be done to expedite the sign. Ms. van Doorn had suggested deferring the application to another date. Ms. Hanley suggested the sign could be approved with the elimination of the symbols and a revision could come back before the Board the following month with an application that the owners would support. Mr. Barry stated he could accept the approval and perhaps reapply with something else. Mr. Baldwin stated that if there was a need for a sign immediately, they could have temporary sign that just stated Big Buns Good Burger. Mr. Barry stated, currently, their temporary banners already say “Damn” or the censored logo “D#*!”. Ms. Hanley inquired as to the spacing and if there needed to be a decision regarding the spacing of the letters to allow for flexibility. Mr. Layer stated that they would need to leave the space to allow for the flexibility. Mr. Layer asked if they would be okay with “D*!” Mr. Barry stated that could be an option, but he could not make the decision as he would have to leave that up to the parent company. Ms. Hanley made a motion to approve building mounted signs for Big Buns, located at 142 Branch Rd SE, Docket No. PF-637880-BAR, with the exclusion of the D#*! to be revised and resubmitted at later date. Motion: Ms. Hanley Second: Mr. Layer Ayes: Ms. van Doorn, Mr. Layer, Mr. Baldwin, Mr. Cheselka, and Ms. Hanley Motion passes: 5 to 0 Mr. Layer stated Mr. Barry could reach out to staff regarding potential revisions. 222 Maple Ave W - Subway - Sign Item No. 6: Request for approval of signs for Subway, located at 222 Maple Ave W, Docket No. PF642612-BAR, in the C-2 General Commercial zoning district, filed by Chang Lee of Samsung Sign, project contact. Mr. Minh Lee was present to represent the application. The Board had no questions. Mr. Cheselka made a motion to approve the request for a sign for Subway, located at 222 Maple Ave W, Docket No. PF642612-BAR Motion: Mr. Cheselka Second: Mr. Layer Ayes: Ms. van Doorn, Mr. Layer, Mr. Baldwin, Mr. Cheselka, and Ms. Hanley Town of Vienna Page 5 Printed on 3/4/2022 Board of Architectural Review Meeting Minutes November 18, 2021 Motion passes: 5 to 0 Mr. Baldwin asked for any corrections to the minutes. Ms. van Doorn stated she had sent corrections to the clerk and the corrections had been made. Mr. Baldwin stated the minutes were accepted. Mr. Layer discussed the meeting minutes requesting them be in more summary form. He continued stating that he’d like the Board to give unanimous consent to the summation of the minutes with the understanding that if a Board member felt something was omitted, they would contact the clerk to have that put in the minutes as long as they were to remain a summation and not verbatim minutes. There was continued discussion regarding summation of minutes. Meeting Adjournment Mr. Cheselka made a motion to adjourn the meeting. Mr. Layer seconded the motion.
