Chair Mr. Baldwin called the meeting to order at 7:30 p.m. Roll Call: Mr. Baldwin, Mr. Cheselka, Ms. van Doorn, Ms. Hanley, and Mr. Layer were present. Approval of the Minutes The September 21, 2023, meeting minutes and the work session minutes for September 28, 2023, Patrick Henry Library and October 13, 2023, Vienna Courts were accepted into the record as submitted. Regular Business: Town of Vienna Page 1 Printed on 11/21/2023 Board of Architectural Review Meeting Minutes October 19, 2023 BAR23-434 300 Center St S - Waters Field - Exterior Modification - Revision Request to revise previously approved exterior modifications for Waters Field Press Box located at 300 Center St S. Docket No. PF-760159-BAR, in the PR, Park and Recreational zoning district, filed by Brandy Wyatt, Dept. of Parks and Recreation., project contact, on behalf of Paul Scott, Fairfax County Public Schools. Applicant Present: Brandy Wyatt The applicant proposed replacing the Waters Field Press Box stairs with pre-fabricated aluminum stairs using the same footprint as the original stairs. She is looking to get approval for the material. Mr. Layer asked for a photograph of the building to understand better where the stairs would be placed. He stated that he passed by the site and couldn’t figure out the location of the stairs. Ms. Abaied commented that the applicant provided documents that show the site and framing plans initially drawn when they considered replacing the stairs with like-in-kind wood. The documents were provided to the board for review. Ms. Wyatt explained that the original stairs were located on the dug-out side of the press box. The stairs went up to the second level to a green door. The original stairs were removed because an architectural firm condemned them. She understands how it can cause confusion not having stairs currently in the location where the new stairs would be installed. Her drawings showed the old stairs and how the stairs would be installed. She commented that the drawings were from the like-in-kind wood stairs they were considering and mentioned that after speaking with Fairfax County, they decided to use pre-fabricated stairs instead. A picture was presented for clarification on the location. The applicant stated that the dugout faces the Waters Field, and the stairs will face the street towards the fire department. There was a discussion on how the proposed stairs showed a little further out toward the road and how the old stairs used to go up to a door, which has changed because, on the proposed stairs, the landing takes you over to get to the door. The applicant replied that there would be a bigger landing, but only by a little. The discussion continued. Ms. Hanley inquired about the framing plan included in the application. It was clarified that the framing plan in the application was for the stairs they were considering to be like-in-kind wood with a footprint similar to the proposed pre-fabricated aluminum stairs. The applicant stated they are using the same footprint shown on the framing plan, just changing the material. Ms. Hanley asked whether they would use the old landing or material. Ms. Wyatt confirmed they would not use the same landing or material previously torn down. Furthermore, the applicant explained that they provided the plans to Fairfax County and asked for the stairs to be in the same footprint as those torn down. Fairfax County visited the site for measurements and completed the order according to their and the town's measurements. Ms. Wyatt noted that she is aware that some adjustments will be needed due to the code. Mr. Layer expressed concern about the footprints being different. To better understand, Ms. Hanley approached the madden to highlight the differences between the footprints, including the landing and the proposed stairs showing further out towards the road and the shed previously on site, which the applicant confirmed would be removed. Mr. Layer noted that before, you could not get behind the stairs, and now, with the proposed scope of work, Town of Vienna Page 2 Printed on 11/21/2023 Board of Architectural Review Meeting Minutes October 19, 2023 you can go behind the stairs in between the dugout, which is concerning to him, as well as not having the full ramifications for the ADA. Ms. Wyatt said that Fairfax County was made aware of the ADA concerns. Fairfax County and their ADA coordinator researched and determined that based on the ADA code 206.2.3.1, an accessible route was not required for the building, and they met the ADA compliance by providing the accommodations needed. Ms. Hanley asked about the material for the landing. She voiced her concern about having mud puddles underneath and suggested using gravel. She asked the applicant what their plan was to keep the ground stabilized. Ms. Wyatt responded that she would have to defer that to the Parks superintendent, Jeremy Edwards. She mentioned they’re generally working on drainage around the building to keep the water away from it, along with the gutter system they installed and some grading. Mr. Baldwin asked if samples were submitted. Ms. Wyatt said she was not provided with a sample and described the material/color as a brushed aluminum look. Mr. Layer stated he wants to make it known that for any application that comes in and does not satisfy the code, which requires plan elevations, sections, and showing what the proposed scope of work looks like in the building, he would not approve it. The board needs to know what they are reviewing and not have to piece it together. He noted that applications are coming in without fulfilling the requirements. Mr. Cheselka made a motion to approve the revision previously approved for exterior modifications for Waters Field Press Box located at 300 Center St S. Docket No. PF-760159-BAR, as presented. Mr. Layer proposed an amendment to the motion. He stated that the next application that comes through would have to show the criteria required by the code and show plans, elevations, and sections in scale with dimensions in detail. Mr. Cheselka accepted the amendment. Ms. Abaied asked Mr. Layer if he would like the motion to be part of the item's motion or make it a separate motion. Mr. Layer replied he wanted it to be for the stairs and that he would possibly make a separate comment on it at another point. Applicant Present: Nawar Al Saad Ms. Al Saad wants to change the sign’s wording from Cupcakes and Blooms of Vienna to Norah Boutique. Mr. Cheselka asked if the lumens would be the same for the panel sign, to which the applicant said yes. He said the sign was big but understood that the applicant was replacing what was already there and noted that it would be visible for the drivers to see the sign from the road. Mr. Baldwin told the applicant that if she wanted to try something different or add colors to her sign, she could. The applicant responded that she wanted her sign to match the rest of the building. With no further questions or concerns, a motion was in order. Ms. van Doorn made a motion to approve the new signs for Norah Boutique, located at 527 Maple Ave W., Docket No. PF-1004382-BAR, in the C-1 Local Commercial zoning district. Motion: Ms. van Doorn Second: Ms. Hanley Vote: 5-0 Motion Carried BAR23-436 448 Maple Ave E - The Mixx Delight - Sign Request for approval of a new sign for The Mixx Delight, located at 448 Maple Ave E, Docket No. PF-1104545-BAR, in the C-1 Local Commercial zoning district; filed by Cleopatra Burke of Fastsigns Fairfax, Project Contact. Applicant Present: Cleopatra Burke The applicant proposes replacing the current sign panel with a new one. The applicant stated they are using green aluminum for the face, which would be routed out to show the white acrylic behind the panel, allowing the lights to show through. Samples were provided for the board to review. With no questions or concerns, a motion was in order. Ms. Hanley made a motion to approve a new sign for The Mixx Delight, located at 448 Maple Ave E, Docket No. PF-1104545-BAR, in the C-1 Local Commercial zoning district. Applicant Present: Ya Zhang The applicant described her proposed sign. The word “Vivi” will be on top, measuring 18 inches, “bubble tea” will be in the middle, measuring 10 inches, and the three skull logo will be at the bottom, measuring 11 inches. Some samples were provided to the board for review. Mr. Baldwin inquired about the samples for red and gold colors on the skulls, which the applicant stated she did not have available. Ms. van Doorn asked for clarification on the kelvin level since the application stated 2700, the specifications showed under 3000 kelvins, and the staff memo said 2700-3000 kelvin. Ms. Zhang explained that initially, the kelvin level was going to be higher than 3000, but she received comments from staff recommending that she lower the kelvin level. The applicant discussed the staff's comment with the contractor, who agreed to go under 3000 kelvins. Mr. Cheselka commented on the sun possibly bleaching the white letters, turning them gray. Mr. Layer noted that the returns would be bronze, giving it a pop. Mr. Baldwin asked the applicant if the three skulls were part of her logo, and she responded yes, she wanted to make the sign fun. Mr. Baldwin asked staff if any information was available that described the gold and red color used for the skulls. Ms. Abaied stated that she did not receive any information for those colors. Ms. Hanley recommended that the applicant provide the information to be added to the application. Mr. Baldwin inquired about the window sign. The applicant stated that the window sign displaying “coming soon” is temporary and will be coming down. Mr. Cheselka made a motion to approve the new sign for Vivi Bubble Tea, located at 233 Maple Ave E., Docket No. PF-1126670-BAR, in the C-2 General Commercial zoning district with the following provision: •The applicant is to provide the gold and red color information to staff to be added to the application. Applicant Present: Ken Padgett Mr. Padgett stated that the proposed sign would replace the loyal companion sign from the previous pet store. He described the sign as having green faces, purple trim, and bronze returns with a white tagline and a corporate purple and white paw print logo. The sign is internally illuminated. The applicant also proposes replacing the under-canopy sign in the exact location of the existing one. Mr. Cheselka questioned the kelvin level being 7100. The applicant said he understood that the recommended kelvin level range is from 3000-3500; however, the national manufacturer suggested he ask the board for approval of the 7100 kelvins, and if it were not approved, then they would comply with the maximum kelvin level recommended by the board. The discussion continued. Mr. Cheselka and Mr. Layer recommended having the kelvin level at 3000 and the lumen level at 150; all members concurred. Lastly, Ms. van Doorn commented that the limitation would also be applied to the under-canopy sign. Mr. Padgett responded that they were not touching the illumination on the under-canopy sign. Ms. van Doorn made a motion to approve the new signs for Wag & Wash, located at 144 Maple Ave W, Docket No. PF-1106987-BAR, in the C-2 General Commercial zoning district with the following requirements: • The kelvin level is limited to 3000, and the lumen level is to stay the same as described in the application. Motion: Ms. van Doorn Second: Ms. Hanley Vote: 5-0 Motion Carried Town of Vienna Page 6 Printed on 11/21/2023 Board of Architectural Review Meeting Minutes October 19, 2023 BAR23-439 377 Maple Ave W - The Maple Room - Exterior Modifications Request for approval of revisions to previously approved exterior modifications for The Maple Room, located at 377 Maple Ave W, Docket No. PF-698964-BAR, in the C-1 Local Commercial zoning district, filed by John Gaston, Paramount Construction Services, LLC. Project contact. Applicant Present: John Gaston Mr. Gaston presented the proposed modifications that included the following: • Front tower light fixtures • Exterior emergency light fixtures • Soffit light fixture replacement • Canopy lighting • Deck ambient lighting (strip lighting under the railing) Mr. Cheselka wondered about the lumen level for the 32 watts shown for the front tower light fixtures on the application. Mr. Gaston stated he did not know how to convert watts to lumens but noted that the lights were not bright and were dimmable. Ms. Hanley stated she was not concerned with the brightness of the tower lighting since they’re on a dimmer facing Rd 123. She also commented in favor of the deck lighting on the railing since it would help people see when they’re getting in and out of their seats. She asked if it would get turned off at night, and the applicant replied that there is a manual switch you can use to turn it off at any time. Ms. van Doorn asked if the changes listed on the application were changes they had completed, then realized they needed approval from the board. Mr. Gaston said they knew they would change the soffit since it was from 1978, which is why it was included in the architectural plan, but he was unsure if it needed to be presented to the board. Ms. van Doorn voiced her concern about this being the third item presented to the board already completed, looking for approval. She was trying to understand why it kept occurring. The applicant stated he is now aware that whether an item is on the architectural plan, they still need to submit a BAR application for the board to review. Mr. Layer commented on the previous discussion about watts and lumens. He provided clarification on the subject. He said that according to the chart he was looking at, 32 watts would equal 3200 lumens. He noted the difference between watts, lumens, and kelvin levels. Watts is power; kelvins is color and lumens output intensity. They all have different scales and different ways of understating it. He wants to ensure that the applicant stays within the 3000-kelvin level as stated, and if it is 32 watts, then it should be dimmed down to an appropriate level. Mr. Baldwin agreed with Mr. Layer and Mr. Cheselka’s concern about the light being too bright and noted that it would probably be part of the motion. Mr. Cheselka made a motion to approve the revisions to previously approved exterior modifications for The Maple Room, located at 377 Maple Ave W, Docket No. PF-698964-BAR, in the C-1 Local Commercial zoning district with the following conditions: • The lighting is to be dimmed down to ambient lighting. Still, he noted he believes the application has high lumen numbers and told the applicant to ensure to have them dimmed down. Ms. Abaied noted that she was the one who included the wattage on the application by utilizing the information the applicant provided. BAR23-440 400 Council Dr NE- Townhome - Exterior Modifications 7: Request for approval of exterior modifications for the property located at 400 Council Dr. NE, Docket No. PF-1121011-BAR, in the RTH Townhouse zoning district; Ziba Kehyari-Linden, Linden+Kehyari Associates, LLC., Project Contact. Applicant Present: Ziba Kehyari-Linden The applicant stated she proposed replacing the two existing windows at the rear of the first-floor structure with a sliding glass door. She explained that the sliding glass door would provide access to the future deck and highlighted that the owners currently have a platform on the ground level that would be removed. The future deck would be installed above the area where the platform is presently located. Ms. Hanley asked what would replace the ground-level platform, and the applicant said it could be gravel because grass would not survive. It was recommended to have a large flagstone at the base, to which the applicant agreed and stated they would have steppingstones. Ms. van Doorn asked if the deck would be in a separate application. Ms. Abaied clarified that the board does not review for decks, but they do review for exterior modifications, which would be the proposed glass sliding door and the two exterior light fixtures on the application. It was explained to the applicant that she would have to submit the permit review plans to the town for the door and the deck after receiving approval from the board for the exterior modifications. Mr. Cheselka stated that the request was a standard change and that access would be needed to get to the deck. He said the proposed change was a great idea. Ms. van Doorn made a motion to approve the exterior modifications for the property located at 400 Council Dr. NE, Docket No. PF-1121011-BAR, in the RTH Townhouse zoning district. Motion: Ms. van Doorn Second: Mr. Cheselka Vote: 5-0 Motion Carried Town of Vienna Page 8 Printed on 11/21/2023 Board of Architectural Review Meeting Minutes October 19, 2023 BAR23-441 131 Church St- NE - NOVA Parks - Exterior Modifications Request for approval of exterior modifications for the property located at 131 Church St NE, Docket No. PF-1134365-BAR, in the PR, Park and Recreational zoning district: Leslie Herman, Director of Parks and Rec, Town of Vienna, Project Contact. Applicants Present: Leslie Herman Ms. Herman stated that the Parks and Recreation Department is seeking approval from the Board of Architectural Review to install four outdoor musical instruments on NOVA Park's property at 131 Church St NE near the Caboose. Vienna Public Art Commission received permission from the council to install the four outdoor musical instruments, and the council completed a sound check to ensure they were okay with the noise level. Nova Parks has also approved the musical instrument to be placed on their property. Ms. Herman said that the town and Nova Parks are working to develop a license agreement to identify the musical instruments' maintenance, liability, and ownership. She noted the manufacturer of the instruments is Park Warehouse and that they would contract a company to assemble and install the musical instruments. The flowers (musical instruments) will face the W&OD trail. Town Park staff will install 6 by 6 timbers and a stone dust bed in the 8 by 20 foot area, and the paver walkway leading from the caboose will provide handicap accessibility to the stone dust path. The musical instruments will be installed into the ground in a 10 inch diameter hole 3 feet deep with concrete. Ms. van Doorn asked if the flowers would be painted pre-finished, and the applicant said yes. Mr. Layer commented that the musical instruments are interesting and would add lively quality to the area. He said that in the future, the application should show the path, the railroad ties, the extent of where the railroad ties are, and the spacing between the musical instruments. This information is required for the board to make their evaluation. Ms. Hanley agreed with Mr. Layer’s comment. She asked what the ground cover around the flowers would be when completed. Ms. Herman said it would be a stone dust bed to keep the ground hardened and less muddy when it puddles and help stabilize the area for wheelchair access. The discussion continued. Mr. Baldwin asked if color samples for the stem and pedal were provided for the board to review. Ms. Herman said she provided specifications for the size of the pedals. She did not receive color samples from the manufacturer. Mr. Baldwin asked if it was possible to request the color samples so that when it’s time to fix any damages, the town staff would know exactly what is being replaced. Ms. Leslie replied she would check with the manufacturer. Lastly, Mr. Baldwin wondered how the musical instrument worked. The applicant explained that there was a wire with a drumstick that the kids would bang on the pedal to produce a musical sound. There was a discussion about the stone dust path picture showing nice curbs that would be impacted when using the 6 by 6 timbers because it creates a square shape. Ms. Hanley asked if they contemplated keeping the curbs. Ms. Leslie said that she pointed that out to the park maintenance supervisor, who said that when the metal ridges are laid against a grassy area where it’s weed-whacked or mowed, they tend to get hit and bend, which damages them and makes it difficult to keep them looking nice. Mr. Baldwin asked if the musical instruments (flowers) were sturdy. Ms. Herman said it is very sturdy, and they’re considered playground equipment. They would do monthly playground inspections to ensure everything is working. If anything breaks, they would be Town of Vienna Page 9 Printed on 11/21/2023 Board of Architectural Review Meeting Minutes October 19, 2023 responsible for taking it out of commission while it is being replaced to ensure public safety. Mr. Baldwin asked if electricity was involved, and the applicant said no. Lastly, it was asked if signs would be used to attract parkgoers. Ms. Leslie said that the Vienna Public Art Commission is putting up a sign saying “coming soon,” but they have not discussed putting a permanent sign. The discussion continued. Ms. van Doorn made a motion to approve the exterior modifications for the property located at 131 Church St NE, Docket No. PF-1134365-BAR, in the PR, Park and Recreational zoning district. Mr. Layer proposed an amendment to the motion. He added that in the future, the application is to include a plan showing all built elements. The timbers are to be pressure-treated, laid in stone dust, and installed with galvanized spikes and round edges. Ms. van Doorn accepted the amendment. Motion: Ms. van Doorn Second: Ms. Hanley Vote: 5-0 Motion Carried Recess 8:52 p.m. – 9:00 p.m. There was clarification on the conditions of the motion stated for item number 8. Town of Vienna Page 10 Printed on 11/21/2023 Board of Architectural Review Meeting Minutes October 19, 2023 BAR23-442 127-133 Park St NE- Vienna Courts - Exterior Modification Request for approval of exterior modifications for Vienna Courts, located at 127 – 133 Park St NE, Docket No. PF-983578-BAR, in the RM-2, Multi-Family, Low-Density zoning district, filed by Patty Hanley of BFR Construction Company, project contact. Ms. Hanley recused herself from the item as she is one of the applicants for the project. Applicants Present: Steve Bukont and Patty Hanley The applicants attended two work sessions before the Board of Architectural Review meeting. Mr. Bukont described the changes made after the last work session, including the selection of the Pennsylvania Sedge plant and Little Bunny grass for the landscaping in front of the retaining wall on Park St. Ms. Hanley noted that once the Pennsylvania Sedge plant is fully grown, it can be maintained twice a year. Additional samples were provided for the board to review, which included the asphalt shingles, bricks, sandstone, flagstone, stackstone, stucco, and the color pallet for each building. The applicants explained where the materials would be used and noted that they are removing the landscape lighting from the application until further notice. Ms. van Doorn asked if they were using manufactured stone or actual stone. Mr. Bukont replied that they were using real stone. Ms. van Doorn wondered about the garage view when coming up to Park St and asked if they had a picture showing the view. Mr. Bukont referenced the image labeled “right” on the elevations/material document for building # 3. He explained that he moved the architectural element around the corner and provided details on the change. He also showed the board members the location of the retaining wall located on Park St, turning around the corner, as well as the landscape layout. Ms. van Doorn asked if buff cement would be used; the applicant said no and assured that the only cement exposed on the building would be the bottom four inches and said that they are lowering the siding around all the foundations so the fake brick cast foundation material won't be visible. Mr. Layer asked for the elevation of the garages. Mr. Bukont said that each of the buildings has its rear elevation. He noted a slight variation between the 32-foot and 40-foot wide units. The 40-foot wide unit has a 16-foot wide door and triple windows. On the narrower units, there is a 9-foot door and double windows. Buildings 1,2 and 10 are 32-foot wide units. Mr. Bukont added that another minor variation on most buildings, between each garage, due to the slope of the site, is an 8-inch difference in slab elevation, and it was noted that the 9-foot will have tandem parking. The discussion on the elevations and siding continued. Mr. Layer then asked what color the garage doors would be. The applicant said all garage doors will be black aluminum with frosted glass. Following the discussion on the elevation and siding, Mr. Bukont explained that all units would have a sunroom (three-season room), which most face Maple Ave. The three on Park St. face the common drive alley, and unit 12 faces the drive aisle. All the sunrooms face toward the commercial area, away from the residential neighborhood. After the applicant described the surrounding areas, the board approached the table with the materials to review and better understand where the materials were being used. Ms. Hanley referenced the landscaping plan to show the board where the railing would be. Mr. Bukont said the railing would follow along the retaining wall in the front as needed, up the stairs, on the side of the stairs, and most of the porches in the front-facing Park Street and at the corner of building number 4. He also noted that they would have a grippable handrail around the handicap ramp. The discussion continued. Mr. Layer made a motion to approve the exterior modifications for Vienna Courts, located at 127 – 133 Park St NE, Docket No. PF-983578-BAR, in the RM-2, Multi-Family, Low-Density zoning district, filed by Patty Hanley of BFR Construction Company, with the following stipulations: • The addition of the Pennsylvania Sedge plant and Little Bunny grass in front of the retaining wall. • The removal of the landscaping lighting from the application. Landscape lighting is to be submitted at a later date. Motion: Mr. Layer Second: Ms. van Doorn Vote: 4-0 Motion Carried The board discussed Code Section 4-9(a) Mr. Layer stated that the code specifically says that when there is an attachment to a building or a structure, the board is to receive architectural plans. He described architectural plans as in-scale plans, elevations, sections in detail, and specifications. Mr. Cheselka believes this would benefit the board. Mr. Layer clarified that he was not referring to building signs as signs are a two-dimensional flat plane, which, most of the time, the sign drawing is done by a professional in a way the board is accustomed to. The discussion continued. Mr. Layer made a motion that every applicant is to submit a set of architectural plans, meaning elevations, sections in detail, and specifications, when the application is about a building, not a sign.
