Town of Vienna 127 Center Street South Vienna, Virginia 22180 p: 703.255.6341 TTY 7111 Meeting Minutes Board of Zoning Appeals Wednesday, February 19, 2020 6:15 PM COUNCIL CHAMBERS-VIENNA TOWN HALL BZA Work Session BZA Work Session BZA Work Session - Discussion on Family Day Homes The Board of Zoning Appeals (BZA) held a work session in the Council Room of the Vienna Town Hall, located at 127 Center Street, South, Vienna, Virginia, on February 19, 2020 beginning at 6:17 PM with George Creed presiding as Chair. The following members were present: Daniel Nash, Jonathan Rak, Robert Petersen, Robert Dowler, and Michael Gadell. William Daly was absent. Also attending and representing staff were Frank Simeck, CZA, Kelly O’Brien, Principal Planner, and Sharmaine Abaied, Board Clerk. The Board of Zoning Appeals met with the Town Attorney, Steve Briglia, and Planning and Zoning staff to discuss the Boards memo to the Town Attorney regarding Family Day Homes Discussion: - Does the Board have the authority to grant CUP’s per section 209 of the Town Code? - Are state licensed family day homes of more than 4 children the same as nursery schools? - Town Councils needing to amend the code to include Family Day Homes to grant them CUP’s. - Prior Zoning Administrators zoning determination regarding Family Day Homes. - Update to the Town Code and Town Councils commitment to the update. - Memo to the Mayor and Town Council requesting an amendment to the code. - Definition of Family Day Home vs. Definition of Nursery School. - Variances definiton and BZA orders.
