Roll Call Mayor Seeman called the meeting to order at 8:00 p.m., all members of Council were present. Present: 7- Council Member Laurie Genevro Cole, Council Member Laurie A. DiRocco, Council Member Edythe Frankel Kelleher, Council Member Michael J. Polychrones, Vice Mayor Carey J. Sienicki, Council Member Howard J. Springsteen and Mayor M. Jane Seeman 2. Approval of the Minutes: Regular Meetings of October 28, 2013 and November 4, 2013. It was moved to approve the Minutes of the Regular Meetings of October 28, 2013 and November 4, 2013 as submitted. A motion was made by Council Member Cole, seconded by Council Member DiRocco, that the minutes be approved. The motion carried by the following vote: Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman 3. Receipt of petitions and communications from the Public Mr. Bob McCahill, 429 Center St. North and president of the Northeast Vienna Citizens Association addressed Council regarding the appearance and safety of cables and things from telephone poles etc around town,specifically in the neighborhood around John Marshalll Dr., NE. He presented some photos of the areas of concern. They placed a call to Fairfax County and they were told that it may be Vienna's responsibility but they would drive by and take a look. So far they have heard nothing back from them. This is just a point of inquiry, something that doesn't have to be taken care of right away but they would like to find out what the protocal is for not having these things laying around. Mr. Johnson of Public Works stated that these are not Town of Vienna things but they will get with the proper company and have them removed or adjusted. It is usually Verizon FIOS or Cox, they are the usual culprits. Mr. John Runyon, 315 Courthouse Road SW addressed Council about an issue with signs at James Madison HIgh School for voting. Voters that are new have no idea where to go and vote at the school, which is around the back of the building, so they left. He has complained to Elections, they put up small signs but they are a disgrace. Mayor Seeman agreed with Mr. Runyon, the signs are too small and flimsy and if its windy you can't even read the signs. Parking is also an issue. A local boy scout from troop 152 introduced himself to Council, he is working on his Communications Merit badge. 4. Reports/Presentations A. Mayor Seeman and Susan Stillman, Chairman of the Community Enhancement Commission presented Fall awards to a few Vienna families recognizing them for their Halloween Decorations. The families were as follows: The Blevins family of 516 Center St. North; the Coles family of 326 Adahi Road SE; the Markley family of 113 Locust Street SW; the Vilardo family of 202 Pleasant Street SW and the Matalas family of 709 Glyndon Street SE. An award was also given to Jeff Palmer of Spokes Etc. for the new wall mural of the side of the store. A. Report and Inquiries of Council Members Councilmember DiRocco reminded citizens about Vienna Business Saturday that is being held on November 30, 2013. All of the businesses will be open and some will be having special things going on. She encourages citizens to considering shopping locally on Vienna Business Saturday. Councilmember Sienicki reminded citzens that the Treasurey of Art is being held at the Vienna Community Center on Friday, Saturday and Sunday, November 22nd - 24th. Councilmember Cole thanked Mr. McCahill and NEVCA for the meeting they held, it was very well attended. They hosted a very good presentation from the Connector Bus Outreach progam about the new routes in Town and when it might be starting . As part of that meeting the Vienna Business Association presented them with an award for being a parade sponsor. NEVCA has been very engaged and is running the CHO Food Drive again and people should look for drop points around Town . Councilmember Springsteen asked if the presentation on the mini roundabouts could be posted on the website so people can view it. Mayor Seeman stated that it was a good idea but maybe they should wait until the Tranpsoration Safey Commission takes it up so that people don't think it is going to happen right now. It still has to go through the Transportation Safety Commission. Councilmember Springsteen thanked Dennis Johnson the Public Works Director for dealing with some of the leaf controversy, he was very quick in responding to citizens and they were very happy. B. Report of the Town Manager No report. C. Report of the Mayor Mayor Seeman reported that she received two letters from Cathy Baroque and Carol Lewis who are the monitors and managers of the Bowman House. thanking the Parks & Recreation employees for all the help they provided for their pottery Town of Vienna Page 2 Printed on 2/4/2014 Town Council Meeting Meeting Minutes November 18, 2013 show and sale at the Bowman House; Missy Adams, John Bixby, Jamie Clear, Ron Crawford, Brian Harrington, Sam Lilly, Tony White and Terry White. These Town employees helped them set up and carry things to and from their cars, it was service above and beyond. Mayor Seeman also reported that she had the honor of going to Flint Hill Elementary School for their program called "Let Freedom Ring." She thought it was kind of nice that the kids are in school for Veterans Day so they can have these programs, it helps them understand what Veteran's Day is really all about. Mayor Seeman also reported that she has some nice pictures that she received from Mr. Don Chumley of the BZA, that he took during the Wildwood Park dedication. Mayor Seeman announced that the Town of Vienna has received a Silver Certification Award for successfully implementing environmental policies and taking practical actions to reduce carbon emissions from the Virginia Municipal League Green Government Challenge. The award was prsented to the Town during the VML Conference, Councilmember Sienicki, Councilmember DiRocco and Councilmember Kelleher were there to accept the award. D. Proposals for Additional Items to the Agenda Item G. was moved up to be done right after the Public Hearing. E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday November 18, 2013, the Town Council met for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to Monday, December 16, 2013, at 7:15 p.m. in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. Motion: Councilmember Kelleher Second: Councilmember DiRocco Abstained: Councilmember Polychrones and Mayor Seeman Carried 5-0 It was move that Walter Basnight be re-appointed to the Planning Commission for a two year term. Said term is to begin December 5, 2013 and to expire December 5, 2015. Jane Seeman A. 2014 Legislative Agenda The Town Council held a duly advertised public hearing to consider the Proposed 2014 Legislative Agenda. Mayor M. Jane Seeman called the hearing to order at 8:25 p.m. with the following members of Council present: Laurie G. Cole, Laurie A. DiRocco, Edythe F. Kelleher, Michael J. Polychrones, Carey J. Sienicki and Howard J. Springsteen. Also present were, Mercury Payton, Town Manager, Steven D. Briglia, Town Attorney, and Melanie J. Clark, Town Clerk. Mayor Seeman stated that Council has held a Work Session with Senator Chap Petersen and Delegate Mark Keam to discuss with them on what the Town of Vienna Legislative Priorites are for the General Assembly. Mr. Briglia, Town Attorney stated that based on the input from Council and the Senator and Delegate he changed the order around. With some of the comments that Council had said he put, the reduction or illimation of the B Pole tax as #1 since this will have the most fiscal impact on the Town. There were no comments from the public. It was moved to close the Public Hearing at 8:27 p.m. Motion: Mayor Seeman Second: Councilmember Cole. Carried unanimously- Poll Vote It was moved to adopt the proposed Legislative Priorities as presented. Regular Business G. Request for approval of a final plat and requested public improvements waiver for the resubdivision of 350 Church Street NE in the RS-16 zone. Filed by Jordan Land Design, LLC, on behalf of 350 Church Street LLC owner. Said application has been filed by Jordan Land Design, LLC, Engineer, on behalf of 350 Church Street LLC owner. A motion was made by Council Member Cole, seconded by Council Member DiRocco, that the Action Item be approved. The motion carried by the following vote: Aye: 6- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman Nay: 1- Council Member Polychrones C. Request to award final design contract for Nutley Street SW culvert replacement. It was moved to award a $80,110.20 design contract to Whitman Requardt & Associated, LLP for the Nutley Street SW Culvert Replacement from CIP Account number 200408-48801. It was further moved authorize the Mayor to sign a letter to Fairfax County requesting their assistance to initiate improvements to the Virginia Center Lake to reduce flooding in the Town. A motion was made by Council Member Cole, seconded by Council Member Polychrones, that the Action Item be approved. The motion carried by the following vote: Aye: 6- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Council Member Springsteen and Mayor Seeman Nay: 1- Vice Mayor Sienicki A. Request for approval of outside printing costs and postage costs from Datamatx. It was moved for the approval to purchase outside printing services for Business License bills from Datamatx for $1,329.00 from account 10246-46015. It was further moved to purchase postage from Datamatx for Vehicle License bills totaling $3,000 and Business License bills totaling $800 from account 10246-45203 and for Water and Sewer bills totaling $12,000 from account 50133-45203. A motion was made by Council Member Kelleher, seconded by Council Member DiRocco, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman B. Request Council appropriation of FY 2012 - 2013 encumbrance balances and carry forward request into the FY 2013 - 2014 General Fund budget. It was moved for approval of a supplemental appropriation in the amount of $34,487.26 to the General Fund expenditure accounts as specified in the attached list from the General Fund encumbrance reserve balance. It was further moved for approval of a supplemental appropriation in the amount of $21,172.00 to the General Fund expenditure accounts as specified in the attached list from the General Fund carry forward reserve balance. The motion carried by the following vote: Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman D. Request to adopt Train Station parking lot agreement. It was move to adopt the Resolution supporting an exchange of a conservation easement on unopened Ninovan Road SE in exchange for NVRPA expansion of public parking at the Vienna Train Station. A motion was made by Council Member Cole, seconded by Council Member DiRocco, that the Action Item be approved. The motion carriedunanimously. Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman E. Request to award a contract to RDA for Maple Avenue traffic signal reconstruction design. It was moved to award a $23,500 contract to RDA under RFP 12-01 for Maple Avenue traffic signal reconstruction design at Center Street and Courthouse/Lawyers intersections. A motion was made by Vice Mayor Sienicki, seconded by Council Member DiRocco, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman F. Request to award a sewer lining contract to AM-Liner. It was moved to award a $310,000 sewer lining contract to AM-Liner based upon Prince William contract SA 1213 using funds from account 200541-48803. A motion was made by Council Member Cole, seconded by Council Member Kelleher, that the Action Item be approved.
