Robinson, Jr. Town Hall, 127 Center Street, South Regular Meeting Chairperson John Russo of the Vienna Baha'i Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Laurie Genevro Cole, Council Member Laurie A. DiRocco, Council Member Edythe Frankel Kelleher, Council Member Michael J. Polychrones, Vice Mayor Carey J. Sienicki, Council Member Howard J. Springsteen and Mayor M. Jane Seeman 2. Regular Meeting of November 18, 2013, the Work Session of November 18, 2013 and December 9, 2013 Councilmember Cole asked that the minutes be separated out. She made a suggestion for a change on the December 9th Work Session Minutes where the closing paragraph should read t"he Director of Parks & Recreation"not Director of Public Works. Subject to that change it was moved that the minutes of the November 18, 2013 and December 9, 2013. It was moved to postpone the approval of the Regular meeting of November 18, 2013 to allow the Clerk to review the software. The new software did not generate the maker and the seconder of the motion. A motion was made by Council Member Cole, seconded by Council Member DiRocco, that the minutes be approved. The motion carried by a unanimous vote. 3. Receipt of petitions and communications from the Public A local boy scout from Troop 1128 introduced himself to Council. He is working on his Citizenship in the Community Merit Badge. Mr. George Creed, 217 Audrey's Court, SE addressed Council to express a real concern about the support that they did not get from Verizon after the last storm . (see video for full discussion) Mr. Matt DiFiore, 207 Owaissa Court addressed Council regarding issues of the the By Right development of 223 Tapawingo Road, SE, also known as 901 Glyndon St. (see video for full discussion) Mr. George Creed, 217 Audrey's Court announced that everything is coming together for the Vienna First Night. Reports/Presentations A. Distinguished Budget Presentation Award Mayor Seeman presented Mrs. Gwen Riddle with the Distinguished Budget presentation award for the current budget. It was received from the Government Finance Officers Association. This award is the highest form of recognition in governmental budgeting. B. Report and Inquiries of Council Members Councilmember Kelleher reported that she had attended a meeting in Richmond on the Governor Elects Transition Council on Local Government. A few issues were discussed, one was local tax stabilization. Chairman Bulova was there and stated that the County determined that with the elimination of the BPOL tax the County would raise the tax rate 7 cents to make up for that. Vienna would probably also have to raise taxes 7 cents which would mean a total tax increase of 14 cents on Town residents if the BPOL tax goes away without some substitute for it. The other interesting statement that was made was the City of Suffolk had come in for a Charter change because they wanted to go to direct election of their Mayor and the General Assembly in their infinite wisdom also moved their election to November for them, Suffolk is not very happy about it but they are stuck with it. Councilmember Sienicki thanked the Vienna Community Band for a wonderful job and especially the Mayor's performance. She also extended an invitation for a breakfast on January 4, 2014 at the Vienna American Legion Post 180 for a Day of Service. It will be held from 8:00 a.m. to 11:00 a.m. Councilmember Cole read an email that she sent out to Council earlier in the evening regarding her decision not to run for re-election in 2014. C. Report of the Town Manager Mr. Payton asked that Dennis Johnson introduce his new employee in Public Works. Mr. Johnson introduced Seth Heffner as the new Water Quality Engineer. He will spend half his time on utility issues and half his time on stormwater MS-4. Mr. Payton thanked the Parks & Recreation Department, the Department of Public Works and all the emergency services staff and personnel that worked on the recent events that we had. On top of the snow and ice that they had to deal with they also had several water main breaks that went on for several days. D. Report of the Mayor Mayor Seeman wished everyone Happy Holidays to everyone! E. Proposals for Additional Items to the Agenda F. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, December 16, 2013, the Town Council met for purposes of discussion of personnel matters, specifically the Town of Vienna Page 2 Printed on 2/4/2014 Town Council Meeting Meeting Minutes December 16, 2013 interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to later this date, Monday, December 16, 2013, at the conclusion of the Work Session which is to follow this Regular Council meeting in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the findings of the recent classification and compensation study. Motion: Councilmember Kelleher Second: Councilmember Cole Carried Unanimously-Poll vote It was moved that Shirley Damon be re-appointed to the Board of Architectural Review for a two year term. Said term shall be in effect from December 15, 2013 through December 15, 2015. It was further moved that James Cudney be re-appointed to the Vienna Town /Business Liaison Committee for a two year term. Said term shall be in effect from December 7, 2013 through December 7, 2015. Motion: Councilmember Kelleher Second: Councilmember DiRocco Carried Unanimously- No poll vote F. Closed Session Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman 6. Regular Business A. Request to accept the Comprehensive Annual Financial Report (CAFR) for fiscal year ending June 30, 2013. It was moved to accept the Comprehensive Annual Financial Report for the fiscal year ending 6/30/2014. A motion was made by Council Member Polychrones, seconded by Council Member Kelleher, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman B. Request to award contract for Center Street South reconstruction. It was moved to award IFB 14-11, Center Street South Reconstruction, to A & M Town of Vienna Page 3 Printed on 2/4/2014 Town Council Meeting Meeting Minutes December 16, 2013 Concrete Corporation in the amount of $508,176.50 from account 200422. A motion was made by Mayor Seeman, seconded by Council Member Kelleher, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman C. Request to award Nutley Street and Courthouse Road traffic signal and sidewalk contract. It was moved to defer this item until the first Regular Meeting in January so that other bidders can be notified of the adjustments. A motion was made by Council Member Cole, seconded by Mayor Seeman, that the Action Item be deferred. The motion carried by the following vote: Aye: 5- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones and Mayor Seeman Nay: 2- Vice Mayor Sienicki and Council Member Springsteen D. Request to approve Echols Street SE resolution. It was moved to approve the Echols Street Resolution and authorize the Mayor to execute. A motion was made by Vice Mayor Sienicki, seconded by Council Member Cole, that the Action Item be approved. The motion carried by a unanimous vote. Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman E. Request to award Ninovan Road SE sidewalk construction contract to American Contractors, Inc. It was moved for award of IFB 14-13, Ninovan Road SE Sidewalk Construction, to American Contractors, Inc. in the amount of $18,755.00 from account 200414-48803. A motion was made by Council Member Springsteen, seconded by Council Member Polychrones, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Cole, Council Member DiRocco, Council Member Kelleher, Council Member Polychrones, Vice Mayor Sienicki, Council Member Springsteen and Mayor Seeman 7. Meeting Adjournment A motion was made by Mayor Seeman, seconded by Council Member Cole, that the meeting be adjourned. The motion carried by a unanimous vote.
