Approval of the Minutes: Approval of the Regular Meeting Minutes of February 23, 2015 and March 16, 2015 and the Work Session Minutes of February 9, 2015 and March 9, 2015. It was moved to approve the Regular Meeting Minutes as amended of February 23, 2015 and March 16, 2015 and the Work Session Minutes of February 9, 2015 and March 9, 2015. A motion was made by Council Member Sienicki, seconded by Council Member Attanasi, that the Minutes be approved as amended. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco 3. Receipt of petitions and communications from the Public Mr. Don Chumley, 219 Ceret Court, addressed Council regarding house numbers on Maple Avenue as well as defining where the blocks begin (ie. 300 block, 400 block). He recommends to Council that they ask the Merchants along there to put their house numbers on their shops and also to consider adding something to the street signs that define what block you are coming to. He was very frustrated when he was trying to find a business and thinks this would help. Reverend Craig Burns, Pastor of Vienna Assembly of God, addressed Council regarding the Ayr Hill sidewalk project from Dominion to Center Street that will be coming to Council and he wanted to let Council know that he is in full favor of the engineering study. He has met with the Department of Public Works and they said they could envision the possiblity that the church would not lose their trees, their sign or the edge of their parking lot. Loretta Roby, 203 Mashie Drive, shared a photo of a car that was involved in a car crash at the interesection of Hine and Follin. She asked that Council please do something about the intersection. Mayor DiRocco stated that the re-design of Follin Lane will improve some of the site lines and that should help. A local Boy Scout from Troop 152 introduced himself to Council. He is working on the Citizenship in the Community Merit Badge. 4. Reports/Presentations Proclamation for Volunteer Recognition Day. Mayor DiRocco presented the Proclamation for Volunteer Recognition Day being held on April 14, 2015. A. Report and Inquiries of Council Members Councilmember Sienicki reported on a few things that will be happening in Vienna this month. The first event is on April 18th and 19th when Historic Vienna Inc. will be having their annual book sale at the Vienna Community Center. On April 23rd will be the Vienna Green Expo at the Vienna Community Center featuring Solarize Vienna. Then on April 25th the Fire Department will be holding their annual Taste of Vienna from 11:00 a.m. - 8:00 p.m. and on April 26th, Historic Vienna Inc. will be hosting the annual Walk On The Hill from 2:00 p.m.- 5:00 p.m. Councilmember Sienicki highlighted two wonderful ladies; one is Veronica Day who is a skeleton athlete in the Olympics and she is going again for her next trial in the Olympics. She was a Madison High School graduate and went on to Elon and is now an Olympian. The other lady is Kelly Koshuta who has received All-Met in Girls Basketball Player of the Year. She wanted to give a shout-out to these lady athletes. Councilmember Sienicki wanted to say thank you so much for the grand opening of the Merrifield Center Services which had an opening ceremony, and they offer wonderful services to people in need. Councilmember Kelleher reported that the Town lost another really good friend, Paul Snodgrass who was the head of HVI for a long time has passed away. Councilmember Kelleher thanked Councilmember Sienicki for announcing all the wonderful events and reported that she will miss every single one because she is going away to visit her son in England. They will be gone from April 17th - May 2nd. Councilmember Colbert reported that the Relay for Life held an event on the Town Green and it was a lovely event. She thanked Council for attending. Councilmember Colbert also thanked, on behalf of the Madison Track Coaches, Craig Chassie and Mike Colbert, DPW and Parks and Recreation and Police for providing all the cones to the Mad K race. B. Report of the Town Manager Mr. Payton introduced the new Director of Planning and Zoning, Mr. Patrick Mulhern. Mr. Mulhern addressed Council stating that he was thrilled to be here. He Town of Vienna Page 2 Printed on 6/17/2015 Town Council Meeting Meeting Minutes April 13, 2015 has a great staff to work with and that he and Matt Flis, Deputy Director, will be a great team working together and he is really looking forward to helping Council make great decisions for the Town Citizens. He complimented Mr. Flis on everything he has done. He can see all the great things that he has done, he is a great asset to the Town and we are very fortunate to have him. Mr. Payton thanked the Parks and Recreation Department for all their hard work on Glyndon Park renovations. Mr. Payton congratulated Mr. Briglia for being given the Honor Role award from Vienna Little League. C. Report of the Mayor Mayor DiRocco reported that the Town has received a grant to cover 80% of a mini roundabout at the intersection of Park Street and Locust Street. The mini roundabout was proposed about a year ago by the Transportation Safety Commission. She thanked the TSC and the Department of Public Works for all their hard work, this is a really creative option that the TSC came up with for a very challenging intersection. Mayor DiRocco thanked Cathy Salgado, John King and the entire Parks and Recreation Department for all their hard work in preparation for the ceremony for Bill Cervenak. She thinks he was very honored, excited, and touched by the whole thing. Mayor DiRocco also mentioned that Steve Briglia is now on the Honor Role for Vienna Little League. Mayor DiRocco also reported that Supervisor Hudgins husband, Willie Hudgins, has passed away. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, April 13, 2015, the Town Council met for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to Monday, April 27, 2015 at 7:45 p.m. in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards and Commissions and/or for discussions of openings on Boards and Commissions. A motion was made by Council Member Edythe Frankel Kelleher, seconded by Council Member Emil Attanasi, that this item be approved. Public Hearings Public Hearing on FY 2015-2016 Proposed Budget. Mayor DiRocco called the Public Hearing to order at 8:30 p.m. The Town Clerk called the role and all members of Council were present. Ms. Karen Spence, Finance Director, explained that this is the budget hearing for fiscal year 2015/16 proposed budget. This has presented to the Mayor and Council as well as the residents. The proposed budget has been reviewed by Council during the Work Sessions of March 21st and 23rd. Today was the date that has been set and published for the Town of Vienna residents to give their input. The internal process this year was similar to last year where a target was given to each Director for their operations, exclusively salaries. This target was the same as last year so there was no increase in the target that was given to them. All additions to programs or new programs were submitted as unmet needs which was for Council's review and will continue to do that at the optional Work Session meeting of April 20th. The proposed budget for FY15/16 is a total of $33,219,690.00. In detail the General Fund is $23,206,050, Debt Service expenditures is a little over $2.6 million, Water and Sewer fund expenditures are just about $7 million and Storm Water fund is $382,000. This is for the normal fiscal year which runs July 1st thru June 30th. The proposed budget is based upon the same tax rate as last year and the year before so this is three years running with the same tax rate of $0.2288 for $100 value. As a work in progress she has provided Council a draft work sheet that has items that were discussed at the Work Session and obviously will continue to review it at the April 20th Work Session for their final decision. Mayor DiRocco asked Ms. Spence if the $0.2288 is the highest rate and they can also reduce the rate if they desire? Ms. Spence said absolutely, it was advertised at the $0.2288 but they can certainly go down. In fact as part of the draft they do have the quarter penny reduction in there. Obviously there have been other numbers that have been discussed but in this draft that they were given does include that first increment of a quarter penny reduction which would take them to $0.2263 per $100 value. Mr. David Swink, 500 Wallker Street SW, addressed Council stating he was a board member of the Fairfax' County Tax Payer's alliance and also the webmaster. Mr. Swink stated that he is highly amused, of course, by the $0.2288 rate stays the same. Its very nice for Fairfax County and Vienna to consistently raise rates by sticking to inflation only, in other words increasing assessments. In Fairfax County's case, of course, this year was 3.6%, Town of Vienna gets a 5.2% increase over the last year, according to the Town Managers report. He is very much amused by this "keeping the same tax rate" because it means nothing. The Virginia Code says "though shall not raise more than 1% per year or you will have a public hearing." He sent an email to Council, which he read as follows: "I am bewildered by Vienna's proposed 5.2% effective tax increase over last year. Like the County, Vienna maintains the base tax rate from the previous year. And like the County, Vienna has to comply with Virginia code, which requires that public hearings are required if taxes increase more that 1% from the previous year. But whereas assessments county-wide increased taxes an average of Town of Vienna Page 4 Printed on 6/17/2015 Town Council Meeting Meeting Minutes April 13, 2015 3.6%, Vienna's much higher average assessments would increase taxes an average of 5.2%. (A combination of Vienna Metro and the ever-expanding number of McMansions!). Furthermore, as my "40 years" document shows (see below), Vienna taxes are not based on specific needs, but purely as a relative steady 20-26% of the Fx Co tax bill. So last year's 20.55% take will likely expand into the 22-24% range this year." In closing he stated that this year to year increases in Fairfax County are generally gobbled up to supply raises and increase benefits, operational expenses stay about the same. In both cases the question becomes; how long can your tax base support such extravagances it has to stop sometime. Fairfax County has been losing the middle class for a long time now and Vienna, of course, is part of Fairfax County. He thinks they could adjust the tax rate down to 20 or 21 to keep the actual physical taxes in line with inflation. It was moved to close the Public Hearing. Motion: Councilmember Springsteen Second: Councilmember Colbert Carried Unanimously It was further moved for the approval of the Fiscal Year 2015-2016 Budget as amended, and that the Town Clerk be directed to advertise Notice of Intent to Adopt at the Council meeting of May 11, 2015, following the Town Council’s consideration of the Real Estate Tax Rate. A motion was made by Council Member Sienicki, seconded by Council Member Springsteen, that the Action Item be approved. Regular Business Increase Expenditure for Datamatx for Water and Sewer Outsourced Bill Printing and Postage. It was moved to approve increasing the expenditure for Datamatx to $26,700 in the Water and Sewer Fund. A motion was made by Council Member Majdi, seconded by Council Member Kelleher, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco Request the Award of Contact RFP 15-04 For Auditing Services. It was moved to award the auditing services contract to Robinson Farmer Cox under RFP 15-04. A motion was made by Council Member Springsteen, seconded by Council Member Majdi, that the Action Item be approved. Application filed by Joshua Marshall, Land Design Consultants, on behalf of Satpal Singh Sahni and Carolyn Jackson Sahni, property owners. It was moved for the approval of the Final Plat and specific modifications and waivers from the Vienna Town Code (includes waiver from installation of street improvements) for Onondio Cove, a resubdivision of six contiguous parcels within Block 10, Onon'dio Subdivision, into eight lots. This approval is further conditioned upon the formal approval of the proposed partial vacation of Ninovan Road, SE as requested by the applicant. Application filed by Joshua Marshall, Land Design Consultants, on behalf of Satpal Singh Sahni and Carolyn Jackson Sahni, property owner. A motion was made by Council Member Attanasi, seconded by Council Member Sienicki, that the Action Item be approved. It was moved to adopt the Ordinance to Vacate the portion of Ninovan Road SE, east of Tapawingo Road and adjacent to 911 Ninovan Road SE, accept payment of $21,306.00 from Satpal Sahni of Swan Homes, LLC for the vacated portion, and authorize the Mayor to execute. The Ordinance to Vacate is specifically conditioned upon the approval by the Town Council of the proposed Onondio Cove Subdivision and consolidation of the vacated right of way with the Subdivision Plat.
