Springsteen, Council Member Carey Sienicki and Council Member Tara L. Voigt Pledge of Allegiance to the Flag of the United States of America 1. Roll Call 2. Approval of the Minutes: A. Approval of the Minutes of the Regular Council Meeting of November 16, 2015 and the Work Session Minutes of October 26, 2015. It was moved to approve the minutes of the Regular Council meeting of November 16, 2015. Motion: Councilmember Sienicki Second: Councilmember Voigt Carried unanimously It was moved to approve the Work Session minutes of October 26, 2015 as amended. A motion was made by Council Member Sienicki, seconded by Council Member Voigt, that the Minutes be approved. Receipt of petitions and communications from the Public None 4. Reports/Presentations A. Report and Inquiries of Council Members Councilmember Sienicki thanked Historic Vienna Inc. for a wonderful display inside the Freeman Store. The Ayr Hill Garden Club has done a wonderful job of decorating and making it very festive for the Holidays. Town of Vienna Page 1 Printed on 1/8/2016 Town Council Meeting Meeting Minutes December 14, 2015 Councilmember Sienicki also thanked Parks and Recreation and the Community Enhancement Commission for making "E Recycling" a successful event. Councilmember Kelleher announced that she will not be seeking re-election in 2016. B. Report of the Town Manager Mr. Payton thanked Parks & Recreation, the Police Department and anyone else that helped make the Holiday Stroll a successful event. Mr. Payton introduced Mr. Brad Macomber who is the Construction Manager for the Community Center renovation project. Mr. Johnson, Public Works Director continued the introduction. C. Report of the Mayor Mayor DiRocco reported that there is a neighborhood Robotics Team called the Vulcan Broncos and as part of their first Lego League Trash Tech competition they researched different ways to line a pizza box to catch the grease so the box can be recycled. They reached out to Church Street Pizza for assistance and to test their ideas. The Vulcan Broncos won their regional Robotics Challenge competition that was held at George Mason University and went on to win a Judges Award for scientific method at the DC Virginia State first Lego League Competition in Harrisonburg, VA on December 6th. The teams coach is John Davidson who lives in Vienna. He has a team of eight boys between 5th and 7th grade. Mayor DiRocco thanked Melanie Clark and Joan Dempsey for creating a beautiful Holiday Reception. Melanie organized the entire event and Joan Dempsey provided all of the delicious desserts, they did a great job! The James Madison Madrigals and the Thoreau Chamber Choir performed for the event and they did a beautiful job! It was a really great and festive event! Mayor DiRocco thanked the entire Town of Vienna staff for their hard work and dedication over the past year. The Town Employees provided valuable services and a high level of customer service to the residents. She put a list together of the accomplishments of 2015 and the list is pretty long. The Town managed over thirty large infrastructure projects, installed millions of dollars in sidewalks, maintained a strong sanitation program, re-lined over three thousand feet of water and sewer lines, managed about a hundred residential redevelopment projects, had the first two MAC applications, offered residents a Solarize Program, maintained the Town's AAA Bond rating, instituted a new Health Care system that stabilized costs, had very few IT problems throughout the whole year, kept citizens safe and had Police presence in high traffic areas, had an AMAZING 125th Birthday Celebration and a really lovely Evening in White in September, started renovation of the Community Center that will expand it and add a full size gymnasium, renovated the dog park, re-turfed Waters Field, added lights to Glyndon Park, kept the town looking beautiful throughout the whole year and many more as well as doing the regular jobs of all the services throughout the year. She thanked the Town Manager, Town Attorney and the Town Clerk who pretty much had their hand in all those things in someway. She is very grateful for the employees who continue to be creative and think of new ways to provide service. As they head into 2016 the Town will continue to improve services and find ways to continue to be a strong and healthy community. She also thanked all the volunteers on the Town's Boards and Commissons, their service is so valuable and their time and positivie energy is greatly appreciated. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the first Closed Session convened this date, Monday, December 14, 2015, the Town Council met for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards or Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to later this date, December 14th, 2015, at the conclusion of the regular Council meeting in accordance with Virginia Code Section 2.2-3711A(19), discussion of reports or plans related to the security of any governmental facility, building or structure, or the safety of persons using such facility, building or structure. Motion: Councilmember Kelleher Second: Councilmember Majdi Carried unanimously It was moved that Sharon Baum be re-appointed to the Transportation Safety Commission for a two-year term. Said term shall be in effect from January 4, 2016 through January 4, 2018. It was further moved that Beth Eachus be re-appointed to the Transportation Safety Commission for a two-year term. Said term shall be in effect from January 9, 2016 through January 9, 2018. Motion: Councilmember Kelleher Second: Councilmember Sienicki Carried unanimously A motion was made by Council Member Edythe Frankel Kelleher, seconded by Council Member Pasha Majdi, that this item be approved. Regular Business A. Request for approval on a final plat for the proposed two-lot subdivision of existing Parcel 1, First Addition to Beulah Heights, on property located at 409 Beulah Road NE and in the RS-12.5, Single-Family Detached Residential and RS-16, Single-Family Detached Residential zones. (Recommended new addresses are 409 and 411 Beulah Road NE). It was moved that Council finds the proposed subdivision and Final Plat for the Town of Vienna Page 3 Printed on 1/8/2016 Town Council Meeting Meeting Minutes December 14, 2015 two-lot subdivision of an existing lot located at 409 Beulah Road NE and in the RS-12.5 (55%) and RS-16 (45%), Single-Family Detached Residential zones (recommended new addresses of 409 and 411 Beulah Road NE) to be in compliance with Chapter 17 of the Code of Vienna and move for the approval of the Final Plat as submitted. Application filed by Jordan Land Design, LLC, Engineer on behalf of JDA Custom Homes, property owner. A motion was made by Council Member Voigt, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt B. Versailles Gallery Signage. It was moved to approve the Versailles sign plan application A motion was made by Council Member Kelleher, seconded by Council Member Springsteen, that the Action Item be approved. Proposed Resolution and Requirement for Conflict of Interest Disclosure Affidavits for use by Applicants in Land Development Activity. It was moved to approve the proposed Resolution directing the Director of Planning and Zoning and Town Attorney to promulgate the appropriate form affidavits for use by parties making applications for rezoning, site plan modifications, subdivisions, conditional use permits, and/or variances in a format substantially similar to the format currently used by the Fairfax County. A motion was made by Council Member Kelleher, seconded by Council Member Voigt, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt D. Salt Brine Memorandum of Understanding. It was moved to approve the Salt Brine Memorandum of Understanding with City of Fairfax and authorize the Mayor to execute. It was further moved to approve the expenditure of funds in an amount not to exceed $5,000 from the account referenced in the Town Manager's Recommendation. A motion was made by Council Member Springsteen, seconded by Council Member Colbert, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt E. Request to award IFB 16-09, Maple Ave Paving Contract. Town of Vienna Page 4 Printed on 1/8/2016 Town Council Meeting Meeting Minutes December 14, 2015 It was moved to award IFB 16-09, Maple Avenue Repaving to A & M Concrete, of Dulles VA, in the amount of $444,584 from the account number listed. A motion was made by Council Member Voigt, seconded by Council Member Majdi, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt F. 301 & 303 Niblick Drive SE Performance Bond Reduction Request. It was moved to accept the 301 & 303 Niblick Drive SE subdivision public improvements and approve reduction of the bond to a two-year maintenance bond of $4,602.56. A motion was made by Council Member Sienicki, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt G. Increase funds to Follin Lane SE reconstruction contracts. It was moved to increase the Follin Lane construction contract with Jeffrey Stack, Inc. IFB 16-02 by $285,800 using accounts listed above. It was further moved to increase the Follin Lane engineering services contract with Urban, Ltd. RFP 13-05 by $15,000 using the account listed above. A motion was made by Council Member Colbert, seconded by Council Member Majdi, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt H. Request approval of payment to Keller Brothers, Inc. from contingency funds for project expenditures for the Vienna Community Center renovation and expansion. It was moved to approve payment of an amount not to exceed $33,794.22 for community center change orders to Keller Brothers, Inc., from the account referenced in the Town Manager's recommendation. Meeting recessed into the second Closed Session at 8:55 p.m. A motion was made by Council Member Voigt, seconded by Council Member Sienicki, that the Action Item be approved. Second Closed Session Mayor DiRocco called the meeting back to order at 9:08 p.m. The Town Clerk called the roll and all members of Council were present. Town of Vienna Page 5 Printed on 1/8/2016 Town Council Meeting Meeting Minutes December 14, 2015 It was moved that the members of the Vienna Town Council be polled to affirm that during the second Closed Session convened this date, Monday December 15, 2015, the Town Council met for purposes of discussion of the acquisition of real property for a public purpose. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to Monday, January 4 2016, at 7:30 p.m. in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically discussion or consideration of procedures for performance reviews for specific public appointees, in this case the Town Clerk. A motion was made by Council Member Edythe Frankel Kelleher, seconded by Council Member Tara L. Voigt, that this item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt 6.
