Robinson, Jr. Town Hall, 127 Center Street, South Regular Council Meeting Invocation: Reverend Johnny Kurcina, Christ Church Vienna Pledge of Allegiance to the Flag of the United States of America 1. Roll Call 2. Approval of the Minutes: A. Approval of the Minutes of the Regular Meeting of November 21, 2016. It was moved to approve the minutes of the Regular Council Meetings of November 21, 2016. A motion was made by Council Member Sienicki, seconded by Council Member Voigt, that the Minutes be approved. The motion carried by the following vote: 3. Receipt of petitions and communications from the Public Ms. Margaret Schottler, 9920 Staple Run submitted a letter to Council regarding operations in C-1 commercial zones. They are currently renting kitchen usage at Molly's Yogurt to mobile food truck vendors and they received notice from the Planning and Zoning department that it is not currently allowable. They are asking that the town amend the code to allow these operations. They are also asking permission to operate temporarily while the amendment to the allowable usage is considered. Mayor DiRocco stated that they will have town staff look into this and they will put it on a Work Session to talk about how this would be and how it would be used. Mr. Payton asked Mr. Mulhern, Planning & Zoning Director, to come forward to briefly address the question of what has to be done for this operation to continue temporarily while they work with his office, if this can be done. Mr. Mulhern stated that they have talked to the owners about them working temporarily and they have to make sure that all the approvals are in place but currently it is not an allowable use in the C-1. They will talk to them further and get back to Council about what is possible. Councilmember Springsteen stated this should be discussed in a work session but he is really concerned that if it is not allowed and we grant one exception temporarily, they will potentially open the flood gates for everyone around. He is a big supporter of their business but he thinks there are major implications of doing a modification or zoning change and would like to discuss it in a work session. Local Boy Scouts from Troop 1978, 987 and1128 introduced themselves to Council, they are working on their Citizenship in the Community Merit Badge. Ms. Liz DiFrancisco, 434 Knoll St, NW, addressed Council in stating that she has sent all of them messages about a possible expansion at Green Hedges School and Town of Vienna Page 1 Printed on 2/2/2017 Town Council Meeting Meeting Minutes January 9, 2017 she has done a lot of research and touched lots of bases here in town, trying to find evidence from 1996-97 where the town had an agreement with Green Hedges about no more expansion. The Town did allow an expansion to happen in 2007. Somewhere between 1996 and 1998 there was an agreement with the Board of Zoning Appeals where properties were purchased by Green Hedges on Nutley St. She is still gathering materials on this subject and she is going to ask that the Planning Commission defer for a month so they have time to gather them. They do not want another parking lot in their neighborhood, they have enough at Green Hedges, Louise Archer, the Elks Lodge and the First Baptist Church. They are asking very nicely that 202 Lewis Street not be turned into another parking lot. She wanted to make Council aware that this is all coming down at the Planning Commission Meeting. Mr. John Runyon, 315 Courthouse Road, SW, addressed Council regarding Green Hedges and he thinks there is plenty of parking around but he thinks it would be a shame if they shot down the garden idea. 4. Reports/Presentations A. Presentation of Comprehensive Annual Financial Report Mr. Andrew Grossnickle of Robinson, Farmer & Cox Associates presented the Comprehensive Annual Report to Council. B. Presentation on Employee 457 Deferred Compensation Plan Conversion. Ms. Marion Serfass, Finance Director, explained the 457 Deferred Compensation Plan for town employees. A. Report and Inquiries of Council Members Councilmember Voigt announced that she is seeking re-election as her term will be up this year. She is looking forward to being on the ballot in May. Councilmember Springsteen thanked the Public Works Director for a request over the holiday for a sign and they were very responsive. Councilmember Springsteen mentioned that he is concerned that they have bee loading up the Planning Commission over the past several months with having meetings. They work very hard but having meetings go until 11:30 or 12:00 a.m is not good and doesn't help our image around town. He thinks they need to be very careful how they look and keep things manageable. Mayor DiRocco stated that this was brought up at the work session that they had with the Planning Commission. This is something that staff will try to adjust to try to put less public hearings on agenda's etc. Councilmember Sienicki wished everyone a Happy New Year and like Councilmember Voigt she is also running for re-election and is circulating petitions to get on the ballot. Councilmember Sienicki thanked everyone who worked so hard on First Night, the the committee, all of the town staff, Parks & Rec, Public Works and the Police Department. It was a really nice event and well attended. The Vienna Business Association (VBA) did a tremendous job on the event. Town of Vienna Page 2 Printed on 2/2/2017 Town Council Meeting Meeting Minutes January 9, 2017 Councilmember Noble further explained what Councilmember Springsteen referred to regarding the Public Works activity that Mike's team put together. They received a request at about 11:00 a.m. and the sign was installed by 5:00 p.m. so it was pretty impressive, the turn around time. Councilmember Noble also reported that the Annual Transportation Research Board meeting which consists of 10,000 people who do research and professional practice in transportation and planning. They will have everything from pipeline to railroad track, to traffic safety, traffic operations, planning development etc. One thing that has come out of that is that the current interim approval that allows the installation of rectangular rapid flashing beacon for pedestrian crossings has a patten law suit against it and the Federal Government is looking at whether or not that interim approval will be rescinded. Potential future installations of those in jurisdictions like ours might be a challenge. A decision has not been made yet but he wanted to let people know that it is a little fraught right now. B. Report of the Town Manager Mr. Payton asked the Police Chief to come forward and introduce a new Police Officer. His name is Emmanual Bulti. C. Report of the Mayor Mayor DiRocco wished everyone a Happy New Year! Mayor DiRocco thanked Parks & Rec, Vienna Police, Vienna Business Association, Michael Amouri and his whole cast of volunteers for all the time and energy they put in to making a really special First Night. It was a wonderful event. She thanked everyone that was involved, she thought it was a wonderful community activity. Mayor DiRocco thanked the Human Resource Department for hosting a wonderful employee holiday luncheon that took place at the Vienna Fire Department. She thought Rebecca Greenberg was a great MC and Dave Donahue really deserved to win the ugly sweater contest. Although it was a very close call, they really didn't know who was going to win, but the key was having the Police Chief bring out the noise measuring device to determine who truly won. It was a lot of fun and very well done. She hopes that staff had a good time and also hopes that staff realizes, based on discussions with the Directors, Town Manager and herself, how much the citizens and the Council appreciate their hard work, determination and customer service that they have provided over this last year. The town employees provide a high level of service that the citizens enjoy and appreciate throughout the year. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, January 9, 2017, the Town Council met for purposes of discussion of personnel matters, specifically the annual performance evaluation of the Town Clerk. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. A motion was made by Council Member Tara L. Voigt, seconded by Council Member Howard J. Springsteen, that this motion be approved.. The motion carried by the following vote: 5. Regular Business A. Request approval of the Vienna Sustainability Challenge It was moved to approve the Vienna Sustainability Challenge. A motion was made by Council Member Springsteen, seconded by Council Member Voigt, that the Action Item be approved. The motion carried by the following vote: B. Request to purchase a Monroe anti-icing system (brine system spreader) It was moved to award purchase of the Monroe anti-icing system in the amount of $29,828 from the account listed above. A motion was made by Council Member Voigt, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: C. Award professional services contract to Urban, LTD for provision of project management services for the Community Center Renovation and Expansion Project It was moved to award a professional services contract for the Community Center Renovation and Expansion project in the amount of $160,150 to Urban, LTD under RFP 13-05 from the account listed above. A motion was made by Council Member Colbert, seconded by Council Member Voigt, that the Action Item be approved. The motion carried by the following vote: D. Defer Public Hearings originally set for January 9, 2017 to a later date to be determined by staff, to consider Zoning Ordinance - Chapter 18 amendments to the RM-2 Zone, Definitions, and Parking Requirements. It was moved to reschedule the January 9, 2017 public hearing to a later date to be determined by staff, in order to consider amendments to the RM-2 Zone, Definitions, and Parking Requirement sections of the Zoning Ordinance as recommended by the Planning Commission. It was further moved that Council first hold a work session to further review draft Planning Commission changes. A motion was made by Council Member Voigt, seconded by Council Member Colbert, that the Action Item be approved. The motion carried by the following vote: E. Intent to adopt Zoning Ordinance amendments to the Maple Avenue Commercial Zone (MAC) It was moved that Town Council approve and adopt the proposed amendments to the Town of Vienna Page 4 Printed on 2/2/2017 Town Council Meeting Meeting Minutes January 9, 2017 Maple Avenue Corridor (MAC) portion of the Town's Zoning Ordinance. These amendments include recommendations of the Planning Commission and amendments approved by Council following its December 5, 2016 public hearing to include the re-numberings so that it is number without two number 11's, changing the acres to square feet and striking unless waived by the Planning & Zoning Director from #22. A motion was made by Council Member Voigt, seconded by Council Member Colbert, that the Action Item be approved. The motion carried by the following vote: 6.
