Robinson, Jr. Town Hall, 127 Center Street, South Regular Council Meeting Invocation: John Russo, Jr. Vice Chairman of the Local Spiritual Assembly of the Baha'is of the Town of Vienna Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Tara Bloch, Council Member Linda Colbert, Council Member Pasha Majdi, Council Member Douglas Noble, Council Member Carey J. Sienicki, Council Member Howard J. Springsteen and Mayor Laurie DiRocco 2. Approval of the Minutes: A. 17-597 Approval of the Minutes for the Regular Council Meetings of August 21, 2017 and September 11, 2017 and the Work Session Minutes of June 12, 2017 and August 21, 2017. It was moved to approve the minutes for the Regular Council meetings of August 21, 2017 and September 11, 2017 and the Work Session minutes of June 12, 2017 and August 21, 2017 as submitted. A motion was made by Council Member Sienicki, seconded by Council Member Springsteen, that the Minutes be approved. The motion carried by the following vote: Aye: 7- Council Member Bloch, Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco 3. Receipt of petitions and communications from the Public Mr. Eddie Paruchabutr, 103 Patrick St. SW addressed Council regarding the parking issue they are still experiencing with non-resident and commercial vehicle overflow parking from Vienna Park Apartments. He explained some of the issues they have been having and asked Council if they could re-look at permit parking. Chief Morris stated that they did do the traffic/parking study and as Lt. Taylor had explained it does not meet the requirements by code. Mayor DiRocco asked that they look into doing the study again to see if this time frame is different from February and maybe it will hit the mark and qualify. The town will do what they can to give them some relief. A local Boy Scout from Troop 979 introduced himself to Council. He is working on his Communications Merit Badge. 4. Reports/Presentations Town of Vienna Page 1 Printed on 10/24/2017 Town Council Meeting Meeting Minutes September 25, 2017 A. 17-598 Recognition of State Champions Mayor DiRocco recognized teams and individuals who won state championships or were the runners up. They do this to honor the hard work and dedication involved in accomplishing such a feat. The teams recognized were the James Madison Girls Swim and Dive team, the James Madison Girls Softball team, the James Madison Boys Cross Country team, the Vienna American 10 year old All Star team, nicknamed "the Red Fury" and members of the Vienna Rugby team. B. Resolution for the 200th Anniversary of the Birth of the Baha’i Faith Mayor DiRocco presented a Proclamation to the Vienna Assembly of the Baha'i's recognizing the 200th Anniversary of the Birth of the Baha'i Faith. C. Proclamation for Energy Efficiency Day 2017 Councilmember Bloch presented a Proclamation recognzing October 5, 2017 as Energy Efficiency Day in the Town of Vienna. D. 16-554 Proclamation for the 120th Anniversary of the “Little Library” Councilmember Sienicki presented a Proclamation recognizing the 120th Anniversary of the "Little Library." A. Report and Inquiries of Council Members Councilmember Majdi asked Mr. Tony Mull, Director of IT, to provide an update on "Help Vienna" specifically on the residential construction module which is a big part of the new service the town is providing. He thanked Mayor DiRocco and Mercury Payton for their leadership with Help Vienna and getting the Munis module set up. He has been particularly interested in the residential construction module that was in response to some activism from local citizens a few years ago. He is very proud of the town's response to that activism and although it took some time he thinks they have something that looks like it is productive. Councilmember Bloch reported that she had the pleasure of going on the Mayor's walk recently and it was very lovely. They walked past a couple of parks and knows one of the Mayor's goals this fall is to walk through more parks encourages citizens that are around on Friday mornings at 9:30 to join the Mayor for her walk. Councilmember Colbert recognized staff member John Wooden who was recently inducted into the VYI Hall of Fame. He coached football for VYI for a very long time. Councilmember Sienicki congratulated Lynne DeWilde our Communication and Marketing specialist and former Council member Edythe Kelleher for becoming Leadership Fairfax 2018 team members. Councilmember Sienicki reported that Oktoberfest is being held on October 7, 2017 from 11:00 a.m. - 7:00 p.m. It is a family friendly event and hopes everyone will come out. Councilmember Springsteen asked what status is with the Bey Lounge. Mr. Briglia stated that the review of their conditional use permit expires by operation of the order so it is going to be reviewed in November at the regular scheduled meeting of Town of Vienna Page 2 Printed on 10/24/2017 Town Council Meeting Meeting Minutes September 25, 2017 the BZA. Councilmember Springsteen asked if 435 Orchard has gotten their certificate of occupancy yet or has the drainage issue not been fixed. Mr. Gallagher stated that he has been out of the office and will have to check on the status. Councilmember Springsteen reported that both Saturday with the dedication of the Community Center and Sunday with the Police event were phenomenally attended. Everyone did a great job with these events. Counilmember Noble asked Mr. Gallagher for a quick update of the Wildwood Park stream restoration project. Mr. Gallagher stated they have finished the stream restoration portion but does not believe they have done the final plantings that may wait until the spring. They are getting ready to re-lay the trail to be an eight foot wide asphalt trail vs. the three foot wide. B. Report of the Town Manager Mr. Payton recognized and thanked Ms. Leslie Herman, Director of Parks & Recreation, for organizing the celebration for the ribbon cutting of the Community Center. It has been a very long process but Leslie has worked very hard with her team and staff. The event was organized very well and he appreciates all their hard work. Mr. Payton asked Ms. Marion Serfass to introduce her new Deputy Director Michelle Pagano-Dierks. C. Report of the Mayor Mayor DiRocco thanked Ms. Leslie Herman and the Parks & Recreation staff for a wonderful dedication. It was a really fun event and people are very excited to be in the new space. People didn't just come in and look, they hung out and just wanted to spend time. She believes the Community Center is going to be the central hub of the community. She is very excited for it to be open permanently to the public. Mayor DiRocco also thanked the Police Department for a very fun filled and well attended Cops and Kids Fun Run. She believes there was over 400 kids and that does not include the adults that signed up. She gave a special thanks to Lt. Art Sylmar, Sgt. Pat Kiley, MPO Juan Vasquez and Dispatchers Amy Milliman, Ruth Rohr and Jennifer Dinges for all the time and energy they put in. Mayor DiRocco reported that the Town Council will not be meeting next Monday because many of them will be at the Virginia Municipal Leagues Annual Conference in Williamsburg. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, September 25, 2017, the Town Council met for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment Town of Vienna Page 3 Printed on 10/24/2017 Town Council Meeting Meeting Minutes September 25, 2017 to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday, October 16, 2017 at 7:00 p.m. in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards and Commissions. Motion: Councilmember Bloch Second: Councilmember Sienicki Carried Unanimously It was moved that Michael Cheselka be re-appointed to the Board of Architectural Review and the Windover Heights Board of Review for a two-year term. Said terms shall be retroactively effective from July 31, 2017 through July 31, 2019. It was further moved that Paul Layer be re-appointed to the Board of Architectural Review for a two-year term. Said term shall be effective from October 2, 2017 through October 2, 2019. And it was further moved that Theresa Bachman be re-appointed to the Windover Heights Board of Review for a two-year term. Said term shall be retroactively effective from September 15, 2017 through September 15, 2019. This item was approved as shown above. Regular Business A. 17-581 Request Council appropriation of FY 2016-17 encumbrance balances and carry-forward funds into the FY 2017-18 General Fund budget It was moved to approve a supplemental appropriation in the amount of $74,450 from the FY2016-17 General Fund encumbrance reserve balance to FY2017-18 General Fund expenditure accounts as specified in the attached list. It was further moved to approve a supplemental appropriation in the amount of $50,550 from the FY2016-17 General Fund carry-forward reserve balance to FY2017-18 General Fund expenditure accounts as specified in the attached list. A motion was made by Council Member Sienicki, seconded by Council Member Colbert, that the Action Item be approved. A motion was made by Council Member Springsteen, seconded by Council Member Bloch, that the Action Item be approved. The motion carried by the following vote: Aye: 6- Council Member Bloch, Council Member Colbert, Council Member Noble, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco Nay: 1- Council Member Majdi E. 17-584 Request to award IFB 18-09 for Nutley St SW Repaving It was moved to award IFB 18-09 for Nutley St SW repaving to Arthur Construction, of Dulles VA in the amount of $630,000. A motion was made by Council Member Springsteen, seconded by Council Member Bloch, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Bloch, Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco F. 17-579 Marshall Road Sidewalk Design Contract Increase It was moved to increase funding for the RDA Marshall Road design contract by $10,841.33. A motion was made by Council Member Bloch, seconded by Council Member Springsteen, that the Action Item be approved. A motion was made by Council Member Noble, seconded by Council Member Bloch, that the Action Item be deferred. The motion carried by the following vote: Aye: 7- Council Member Bloch, Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco H. 17-563 Andrew Minor Subdivision Partial Bond Reduction Request It was moved to approve partial bond reduction for completed improvements at the Andrew Minor Subdivision project to a surety amount of $101,800, to be held until issuance of the last occupancy permit, at which time the bond will be reduced to a two-year maintenance bond. A motion was made by Council Member Bloch, seconded by Council Member Noble, that the Action Item be approved.
