Robinson, Jr. Town Hall, 127 Center Street, South Invocation: Reverend Brett Isernhagen, Ephiphany United Methodist Church Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Tara Bloch, Council Member Linda Colbert, Council Member Pasha Majdi, Council Member Carey J. Sienicki, Council Member Howard J. Springsteen, Mayor Laurie DiRocco and Council Member Douglas Noble 2. Approval of the Minutes: A. 18-1113 Approval of the Regular Minutes of November 19, 2018 and the Work Session Minutes of October 22, 2018. It was moved to approve The Regular Minutes of November 19, 2018 as submitted. Motion: Councilmember Sienicki Second: Councilmember Colbert Carried Unanimously It was moved to approve the Work Session Minutes of October 22, 2018 as submitted. Motion: Councilmember Sienicki Second: Councilmember Colbert Abstain: Councilmember Noble Motion carried The motion carried as shown above. 3. Receipt of petitions and communications from the Public that is not on the Agenda. (Limited to 5 minutes per issue and no formal action can be taken this evening) Mr. Howard Serig, 621 Hine St. SE addressed Council regarding a rundown property located at 627 Hine St. SE. The property has been unoccupied for over two months and is in disrepair. It is becoming an eye sore and to his knowledge there is no effort being made to take care of things. The grass is almost 3' high and there are leaves and limbs on much of the lot. He is asking Council that they use any powers that they have to investigate this problem and see what can be done to get the owner to at least do some maintenance work. Also to make sure this property is looked at every now and then so that it is not a potential attraction to the bad elements that sometimes do enter this community. He provided an information sheet to the Town Clerk. Mayor DiRocco reported that Council received a letter that asked to be put into this Town of Vienna Page 1 Printed on 1/8/2019 Town Council Meeting Meeting Minutes December 10, 2018 part of the agenda regarding the status of the Marco Polo Site property from Chuck and Laura Anderson, 125 Pleasant St. NW. Mr. Payton asked Ms. Cindy Petkac Planning & Zoning Director, to provide an update. He also stated that they have had contact on this matter with the owner of the property and they will begin proceedings this week. Ms. Petkac stated that she did forward the email chain to Council that Frank Semick, Zoning Administrator, has been in discussions with the owner, Doug D'Alexander and since the fire and the investigation has concluded they provided notification to Mr. D'Alexander that he could proceed with getting a demolition permit. He has indicated that he had a couple of bids but has never proceeded to follow up in getting the utilities capped offed or to file the permits. They have been trying to work with him to move this process forward but unfortunately it has not. They are ready to move forward in initiating the blight proceedings. Mr. Payton stated according to State Code it calls for him to send a letter to the property owner which he is going to do this week and with that it begins a 30 day clock on them to remedy the situation. 4. Reports/Presentations A. 18-1076 Certificate of Appreciation for DH Scarborough Mayor DiRocco presented a Certificate of Appreciation to DH Scarborough to thank her for her time serving as the Town Business Community Representative to the Town's Local Administrative Retirement Committee. She served from July 6, 1995 to October 11, 2018. B. 18-1101 Vienna Sustainability Challenge Awards Ms. Susan Stillman, Chair of the Community Enhancement Commission and Ms. Leslie Herman, Director of Parks and Recreation presented the Vienna Sustainability Challenge Awards to the following businesses: •Joanne Ehreth Burke CPA PLLC •Caboose Brewery •Caffe Amouri •Cycle Chi •Insight Shop •Metro Scooters •Purple Onion Catering Co. •Social Burger •The Sustainability Guys C. 18-1102 Vienna Native Garden Recognition Ms. Susan Stillman, Chair of the Community Enhancement Commission and Ms. Leslie Herman, Director of Parks & Recreation presented the Vienna Native Garden Recognition Awards to the following: Chae Gilmer Victor Mendes and the Vienna Vintner Michael & Jessica Plowgian D. 18-1097 Presentation of 2018 Comprehensive Annual Financial Report (CAFR) Mr. Andrew Grossnickle of Robinson Farmer & Cox presented Council with the 2018 Comprehensive Annual Financial Report (CAFR). Report and Inquiries of Council Members Councilmember Springsteen asked if the property that was brought up by Mr. Serig was a neighbor of Councilmember Nobles and if the property was a candidate for blight discussion. Mayor DiRocco stated this is something that has to be researched by staff. Councilmember Noble stated it hasn't been maintained for a period of time and having the Zoning Administrator look at is the next step. B. Report of the Town Manager Mr. Payton reported that they did have a meeting with the owners of Keller regarding the Community Center and it progressed well. As of right now they are at a good place that is good for the town. C. Report of the Mayor Mayor DiRocco thanked the Parks & Recreation Department for a wonderful Church St. Stroll. She also thanked Historic Vienna Inc. and the Vienna Volunteer Fire Department for helping to get Santa to the stroll on time, the beautiful decorations and the many activities. Mayor DiRocco also thanked the Town Business Liaison Committee for organizing the 2nd Annual Holiday Decorating Contest for the businesses in town. There were over 25 businesses that participated and they all had lovely decorations. They did have to pick a top winner which was Bards Alley. Since they won she will be working at Bards Alley on Wednesday, December 12th, starting at 5:00 p.m. It is their Winedsay, their Wednesday Wines Day. She hopes everyone will come out and join her, it should be fun. Mayor DiRocco also mentioned this was the last meeting in 2018 and wished everyone a Happy Holiday Season and a wonderful New Year. She hopes everyone can join them at the Holiday Reception on Friday, December 14th in the Council Chambers from 4-6 p.m. There will be wonderful food and music and hopes to see everyone there. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the first Closed Session convened this date, Monday, December 10, 2018, the Town Council met for personnel matters, specifically, the interviewing of an individual for consideration of re-appointment to a Town Board or Commission. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to later this date, Monday, December 10, 2018 at the conclusion of the Regular Council Meeting, in accordance with Virginia Code Section 2.2-3711.A.(3) for discussion or consideration of the acquisition of real property for a public purpose. A motion was made by Council Member Springsteen, seconded by Council Member Bloch, that the Action Item be approved. The motion carried by the following vote: Aye: 5- Council Member Bloch, Council Member Colbert, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco Nay: 2- Council Member Majdi and Council Member Noble B. 18-1092 Consideration of Allowing Continued Use of Temporary Classroom Trailers at Louise Archer Elementary School, Located At 324 Nutley Street NW Attachments: FCSB-Louis Archer ES Renewal-2018.11.26 Application Package_71554028_1 Adopted FY 2019-23 CIP_0 Upon a finding that the public health, safety, and welfare of the Town will not be impaired, It was moved to extend approval for use of two temporary public-use classroom trailers at Louise Archer Elementary School for two additional years from the date of August 22, 2018. A motion was made by Council Member Bloch, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Bloch, Council Member Colbert, Council Member Majdi, Council Member Sienicki, Council Member Springsteen, Mayor DiRocco and Council Member Noble G. 18-1095 Intent to adopt amendments to Chapter 6, Finance and Taxation, Article 8, Procurement Attachments: Town of Vienna_Chapter 6 Finance Taxtation_112918 Ordinance of 11-19-18 accept changes It was moved to adopt recommended changes to the Vienna Town Code, Chapter 6, Finance and Taxation, Article 8, Procurement as presented, and I further move to direct the Town Clerk to advertise a Notice of Adoption. A motion was made by Council Member Springsteen, seconded by Council Member Bloch, that the Action Item be approved. The motion carried by the following vote: Aye: 6- Council Member Bloch, Council Member Colbert, Council Member Sienicki, Council Member Springsteen, Mayor DiRocco and Council Member Noble Nay: 1- Council Member Majdi H. Second Closed Session Meeting Recessed into Closed Session at 9:50 p.m. Mayor DiRocco called the Regular Meeting back to order at 10:49 p.m. The Town Clerk called the roll and all members of Council were present. It was moved that the members of the Vienna Town Council be polled to affirm that during the second Closed Session convened this date, Monday, December 10, 2018, the Town Council met for discussion or consideration of the acquisition of real property for a public purpose. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution.
