Robinson, Jr. Town Hall, 127 Center Street, South Regular Meeting Invocation: Reverend Eric Song, Church of the Good Shepherd Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Linda Colbert, Council Member Pasha Majdi, Council Member Douglas Noble, Council Member Nisha Patel, Council Member Steve Potter, Council Member Howard J. Springsteen and Mayor Laurie DiRocco 2. Approval of the Minutes: A. 19-1450 Approval of the Regular Council Meeting Minutes of September 16, 2019. It was moved to approve the Regular Council Meeting Minutes of September 16, 2019 as submitted A motion was made by Council Member Majdi, seconded by Council Member Colbert, that the Minutes be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco 3. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 5 minutes per issue and no formal action can be taken this evening) A Local Boy Scout from Troop 345 introduced himself to Council, he is working on his Citizenship in the Community Merit Badge. Mr. Dennis Rice, 412 Glyndon St. NE, addressed Council to provide an update on his property of 380 Maple Avenue West. He and his partner have been meeting with the Assisted Living group and believe they will have a plan to present to the town and the citizens meeting soon. 4. Reports/Presentations A. 19-1426 Recognition of the 50th Anniversary of Boy Scout Troop 1539 Mayor DiRocco recognized Boy Scout Troop 1539 for their 50th Anniversary and presented them with a Proclamation. B. 19-1449 Recognition of Laine Hyde and Walter Basnight for Their Years of Service to the Town Town of Vienna Page 1 Printed on 10/22/2019 Town Council Meeting Meeting Minutes September 30, 2019 Mayor DiRocco presented a Recognition of Service to Ms. Laine Hyde and Mr. Walter Basnight on their many years of service to the Town of Vienna. A. Report and Inquiries of Council Members None B. Report of the Town Manager Mr. Payton reported that at the last Town Council meeting there was mention of an interaction that a resident had with the Water & Sewer department of the Finance Department. The matter was looked into and the information was passed on to Council. He is very happy with the way the Finance Department handle the issue. C. Report of the Mayor Mayor DiRocco reported that Oktoberfest is this coming Saturday and she hopes to see everyone there. It is from 11:00 a.m. - 7:00 p.m. on Church Street. Mayor DiRocco also reported that Council will not be having their meeting the first week in October because they will be done in Roanoke for the Annual Virginia Municipal League Conference. Mayor DiRocco also reported that the Homecoming Parade will be happening this Friday at 2:30 p.m. Part of Maple Avenue will be shut down for about 45 minutes. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened Monday, September 23, 2019, the Town Council met for discussion or consideration of personnel matters, specifically Town Board and Commission openings. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to later this date, Monday, September 30, 2019 at the conclusion of the regular meeting, in accordance with Virginia Code Section 2.2-3711.A.(3), for discussion or consideration of the acquisition of real property for a public purpose. Motion: Councilmember Colbert Second: Councilmember Noble Carried Unanimously It was moved that David Patariu be appointed to the Planning Commission for a two-year term. Said term shall be effective from October 1, 2019 through October 1, 2021. It was moved that Brian Land be appointed to the Pedestrian Advisory Committee for a two-year term, said term shall be effective from October 1, 2019 thru October 1, 2021. Motion: Councilmember Colbert Second: Councilmember Noble Carried unanimously This item was approved as shown. 5. Regular Business A. 19-1443 Adoption of changes to Town Code Chapter 1, Section 1-9.1, Fee Charged for Passing Bad Checks to Town It was moved to adopt changes to the Vienna Town Code, Chapter 1, Section 1-9.1, Fee Charged for Passing Bad Checks to Town as proposed and it was further moved to direct the Town Clerk to publish a notice of adoption. A motion was made by Council Member Patel, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco B. 19-1444 Adoption of changes to Town Code Chapter 6, Article 8, Section 6-74.1, Small Purchase Procedures It was moved to adopt changes to the Vienna Town Code Chapter 6, Article 8, Section 6-74.1, Small Purchase Procedures raising thresholds for purchase order and quote requirements as proposes and it was further moved to direct the Town Clerk to publish a notice of adoption. A motion was made by Council Member Springsteen, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco C. 19-1412 Mashie Subdivision Performance Bond Extension Request It was moved to extend the public improvement bond for the Mashie Drive Subdivision for an additional 18 months, to expire April 30, 2021. A motion was made by Council Member Noble, seconded by Council Member Colbert, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco D. 19-1431 Request award of IFB 20-08 for Construction and Demolition Debris Disposal and request FY20 spending Town of Vienna Page 3 Printed on 10/22/2019 Town Council Meeting Meeting Minutes September 30, 2019 It was moved to approve award of IFB 20-08 to Broad Run Recycling LLC (primary) and Waste Management of VA (secondary) and to approve FY20 spending in the amount of $195,000, which includes the $49,675.05 spent year to date with Broad Run. A motion was made by Council Member Springsteen, seconded by Council Member Noble, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco E. 19-1448 Microtransit Concept No Action was taken on this item. F. Second Closed Session Meeting recessed into Closed Session at 9:25 p.m. The Regular Meeting was called back into session at 10:22 p.m. It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, September 30, 2019, the Town Council met for discussion or consideration of the acquisition of real property for a public purpose. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday, October 21, 2019 at 7:00 p.m. in accordance with Virginia Code Section 2.2-3711.A.(1), for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards and Commissions. Motion: Councilmember Colbert Second: Councilmember Noble Carried Unanimously A motion was made by Council Member Linda Colbert, seconded by Council Member Douglas Noble, that this was approved as shown. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco 6.
