Robinson, Jr. Town Hall, 127 Center Street, South Regular Meeting Invocation: Pastor Garry Genser, Vienna Seventh Day Adventist Church Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Linda Colbert, Council Member Pasha Majdi, Council Member Douglas Noble, Council Member Nisha Patel, Council Member Steve Potter, Council Member Howard J. Springsteen and Mayor Laurie DiRocco 2. Approval of the Minutes: A. 19-1542 Regular Council Meeting minutes of November 4, 2019, the Work Session Minutes of October 28, 2019, November 18, 2019 and December 4, 2019. Mayor DiRocco asked if there were any corrections to the minutes. There were no corrections. 3. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 5 minutes per issue and no formal action can be taken this evening) Laura Bligh, 226 Glen Avenue SW, stated that she is here tonight to follow-up on an email she sent to members of the Council on campaign financing and transparency. Discussed the importance of transparency in government. Asked Vienna Town Council to voluntarily submit the town elections to Virginia's Campaign Finance Disclosure Act. She also noted that Vienna elections are not presently subject to Virginia's "Stand By Your Ad" Law. She adds that she does not think anyone's campaign is involved in any corruption or impropriety. She concludes, as a matter of ethics and transparency, disclosure is everyone's best interest. There was no one else to speak at the evening's meeting. 4. Reports/Presentations A. 19-1544 Vienna Sustainability Challenge Awards Mayor DiRocco invited Christine Horner and members of the Conservation and Sustainability Commission to come forward. Certificate of Recognition awards were presented to 8 area businesses. They included: Joanne Ehreth Burke, CPA PLLC, The Sustainability Guys, Blend 111, Cycle Chi, Caboose Tavern, Social Burger, Purple Onion Catering Company, and Cafe Amouri. Town of Vienna Page 1 Printed on 1/29/2020 Town Council Meeting Meeting Minutes January 6, 2020 B. 20-1552 Proclamation recognizing Supervisor Catherine Hudgins on her retirement Mayor DiRocco announced that the Town will be presenting a Proclamation recognizing Supervisor Catherine Hudgins on her retirement on January 24, 2020 at the Vienna Volunteer Fire Department's banquet. Mayor DiRocco read the Proclamation. C. 20-1553 Proclamation Recognizing Bill Emerson Mayor DiRocco invited Bill Emerson and family to come forward to be recognized with a Proclamation read by Councilmember Colbert. D. 19-1550 Comprehensive Plan Edit - Transportation Level of Service (LOS) Andrew Jinks, Transportation Engineer, presented the Comprehensive Plan Edit - Transportation Level of Service including the County's Comprehensive Plan regarding level of service requirements. A. Report and Inquiries of Council Members Councilmember Colbert thanked Mayor DiRocco for all that she has done for the the Town of Vienna. She announced that she will be running for Mayor. Councilmember Springsteen thanked the Department of Public Works for their prompt response to a water main break during the holidays. He also announced that he will be a candidate for Vienna Mayor on May 5th. Councilmember Noble stated it has been a great holiday season in Vienna. He shared that he has had an opportunity to view a couple of the Madison High School girls' basketball games. He added that they are a tremendous group and winning team. Councilmember Majdi stated that he has heard that some of the leading companies that provide microtransit as a service to municipalities will provide feasibility studies for free. Requested that the Town Manager look into that option and possible grant. Councilmember Potter stated that he has spoken to the Homeowner Associations associated with the townhomes behind the Flagship project. He added that the interior lighting in the building is impacting the residents. Director Petkac stated that she would follow up on this issue. B. Report of the Town Manager Town Manager Payton reported that the Town Attorney has an update on the delivery truck noise violation issue. Town Attorney, Steve Briglia, updated the Council on the matter. Town Manager Payton continued his report stating that staff is working to improve their communication with the public when Town work is being done adjacent to residential properties and will continue to update Council. He stated that there are some changes being made at tonight's meeting regarding agenda items and motions. He added that the motions being considered will be on the screen viewed by Council. Town of Vienna Page 2 Printed on 1/29/2020 Town Council Meeting Meeting Minutes January 6, 2020 Town Manager Payton noted that the next work session is Monday, January 13 with one item on the agenda, the Multimodal Study. Mr. Payton stated that moving forward, he would like to have everything in advance in the agenda packets. He stated the only exception would be if Council reached out to add information. Lastly, Mr. Payton thanked the Town Staff for all of their hard work over the holiday season. C. Report of the Mayor Mayor DiRocco wished everyone a Happy New Year. Thanked Maggie Kain, Director of Human Resources, for organizing the Parliamentary procedure training for Council and Planning Commission. Thanked Melanie Clark, Town Clerk, and Joan Dempsey, President of the Volunteer Fire Department Auxilary, for organizing the Town's holiday reception. D. Proposals for Additional Items to the Agenda Councilmember Majdi inquired if the Multimodal Study discussion at the next work session would include Level of Services. Mayor DiRocco stated that she believed it should be and asked if there were any objections. There were no objections. E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, January 6, 2020, the Town Council met for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday, January 27, 2020 at 7:00 p.m. in accordance with Virginia Code Section 2.2-3711.A.(1), for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards and Commissions. Motion: Councilmember Colbert Second: Councilmember Springsteen Carried unanimously It was moved that Jessica Plowgian be re-appointed to the Pedestrian Advisory Committee for a two-year term. Said term shall be retroactively effective from October 17, 2019 through October 17, 2021. It was further moved that Rochele Katish be re-appointed to the Conservation and Sustainability Commission for a two-year term. Said term shall be retroactively effective from December 18, 2019 through December 18, 2021. It was further moved that George Creed be recommended to the Fairfax County Circuit Court for re-appointment to the Board of Zoning Appeals. Regular Business A. 19-1503 Award RFP 20-03, Maple Avenue Utility Undergrounding Feasibility Study, to Rinker Design. It was moved to award RFP 20-03 for a Maple Avenue Utility Undergrounding Feasibility Study to Rinker Design Associates for $99,660. A motion was made by Council Member Noble, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco B. 19-1533 Request award of IFB 19-07 Nutley Street NW sidewalk project. It was moved to award IFB 19-07 for a Nutley Street NW sidewalk project to Stonebridge Civil Corporation in an amount not to exceed $178,275 (bid + 10% contingency). A motion was made by Council Member Springsteen, seconded by Council Member Patel, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco C. 19-1534 Request approval for Alban CAT emergency generator for Town Hall. It was moved to approve purchase of an emergency generator for Town Hall from ALBAN CAT in an amount not to exceed $335,500. A motion was made by Council Member Springsteen, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco D. 19-1535 Request approval of an agreement with Fairfax County for inspection and potential repair of Piney Branch-Difficult Run trunk sewers. It was moved to approve an agreement with Fairfax County for inspection and potential repair of Piney Branch-Difficult Run trunk sewers and authorize the Mayor to execute the agreement pending final legal review by the Town Attorney. A motion was made by Council Member Noble, seconded by Council Member Colbert, that the Action Item be approved. It was moved to defer this motion to a date in the future until additional information. A motion was made by Council Member Springsteen, seconded by Council Member Colbert, that the Action Item be deferred.
