Robinson, Jr. Town Hall, 127 Center Street, South Regular Meeting Invocation: Reverend Johnny Kurcina, Christ Church Vienna Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Linda Colbert, Council Member Pasha Majdi, Council Member Douglas Noble, Council Member Nisha Patel, Council Member Steve Potter, Council Member Howard J. Springsteen and Mayor Laurie DiRocco 2. Approval of the Minutes: A. 20-1606 Acceptance of the Regular Council Meeting Minutes of January 27, 2020, February 3, 2020 and the Work Session minutes of February 10, 2020. Regular Council Meeting Minutes of January 27, 2020, accepted with additions offered by Council Member Noble; February 3, 2020 approved as submitted; and Work Session minutes of February 10, 2020 approved with corrections offered by Council Member Potter. 3. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 5 minutes per issue and no formal action can be taken this evening) Mayor DiRocco recognized Drew Meren, 308 Edwin Lane. Mr. Meren indicated that he is speaking this evening on behalf of his wife Melanie Meren, School Board Member, Hunter Mill District. Noting there is a critical lack of Early Childhood Learning spaces in the County and he asked Council to assist with support for inclusion of such space in the design of the new Vienna library through contact with Supervisor Alcorn. Mayor DiRocco recognized local Boy Scouts from Troops 99, 976 and 162. 4. Reports/Presentations A. 20-1587 Presentation of draft design and construction agreement with Fairfax County for public parking to be incorporated into redevelopment of Patrick Henry Library Mayor DiRocco called on Mike D'Orazio, Deputy Director, Public Works and Marion Serfass, Director of Finance, to provide an overview of the draft design and construction agreement with Fairfax County for public parking to be incorporated into redevelopment of Patrick Henry Library. Approval will include both the Town of Vienna and Fairfax County Board of Supervisors. Town of Vienna Page 1 Printed on 4/6/2020 Town Council Meeting Meeting Minutes February 24, 2020 A. Report and Inquiries of Council Members Mayor DiRocco called upon Council for comments. Councilmember Patel reminded everyone of the Community Conversation scheduled for Monday, March 2, 2020 from 7:00-9:00pm. Councilmember Springsteen noted that the Bulk Pick scheduled for Saturday February 22, 2020 was postponed due to mechanical issues. It is rescheduled for Wednesday February 25, 2020. Councilmember Colbert thanked individuals involved in the yearlong effort to acquire the Roger W. Seeman Auditorium signage for the Community Center. Councilmember Potter requested a status update on the zoning project scope of services and RFP. Town Manager Payton noted that the RFP has gone out publicly for vendor response. Director Petkac remarked that five consultant firms attended the preproposal meeting. All proposals are due by March 2, 2020. Councilmember Noble requested an update on the website upgrade. Lynne Coan, Communications and Marketing Manager, indicated that the site will go live sometime in 2020. Councilmember Noble requested a written update on the schedule. He further recognized the Madison High School Girls swim and dive team who won the State Championship for the fourth consecutive year as well as the Girls Basketball team for their recent victory. Councilmember Majdi inquired about available options for speed humps on designated emergency routes such as Kingsley and Tapawingo. What is the process for acquiring this designation? Town Manager Payton asked the Director of Public Works to research this request and provide a follow-up report. B. Report of the Town Manager Town Manager Payton reminded everyone about the Community Conversation scheduled for Monday, March 2, 2020 from 7:00-9:00pm. He also noted a new initiative “On Deck with Mercury” designed to provide an opportunity for monthly outreach tentatively scheduled for every second Tuesday of each month from 6:00-8:00pm. Lastly, he indicated that the public communication document draft is currently under review. C. Report of the Mayor Mayor DiRocco reported on recent meetings with bond rating agencies. She also reminded Council to place cell phones out of reach during Council meetings. D. Proposals for Additional Items to the Agenda There were no additions to the agenda. E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session that convened on Saturday, February 8, 2020, the Town Council met for discussion and consideration of personnel matters, specifically the Town of Vienna Page 2 Printed on 4/6/2020 Town Council Meeting Meeting Minutes February 24, 2020 annual performance evaluations of the Town Attorney, the Town Manager and the Town Clerk. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to later this date Monday, February 24, 2020 at the conclusion of the regular Council Meeting in accordance with Virginia Code Section 2.2-3711.A.(1), for discussion or consideration of the acquisition of real estate property for a public purpose. A motion was made by Council Member Linda Colbert, seconded by Council Member Howard J. Springsteen, that this was approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco 5. Consent Agenda It was moved to approve the Consent Agenda as presented. A motion was made by Council Member Linda Colbert, seconded by Council Member Howard J. Springsteen, that this was approved. B. 20-1582 Request additional FY20 spending with Ferguson Enterprises, Inc. C. 20-1584 Request additional FY spending with Chantilly Crushed Stone, Inc. D. 20-1598 Appropriate funds for Davenport & Company as Financial Advisor (consent agenda) 6. Regular Business A. 20-1591 Council Approval of Revised 2020 CIP for 2020 Bond Issue It was moved to approve the Capital Improvement Plan through 2036 as revised. A motion was made by Council Member Springsteen, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco B. 20-1596 Request to approve license agreement between NOVA Parks and Town of Vienna for the construction of the Freeman Store bridge. It was moved to authorize the mayor to execute a license agreement between NOVA Parks and the Town for the replacement of the Freeman Store bridge. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco C. 20-1565 Consideration to Initiate Sidewalk Projects It was moved to authorize the Town Manager to apply to the Maud Robinson Trust for the design of the sidewalk projects on Holmes Dr. from John Marshal Dr. to Upham Place on the even side of the street; Cabin Rd from Branch Ave. to Glyndon St.on the odd side of the street; and Plum St. SW. from Cottage St. to Tapawingo on the even side of the street. It was further moved to authorize the Department of Public Works to proceed with the design work on the identified streets utilizing RFP 1901 in an amount not to exceed $500,000. A motion was made by Council Member Springsteen, seconded by Council Member Colbert, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco D. 20-1585 320 Nutley St SW Subdivision Performance Bond Reduction It was moved to reduce the public improvement bond for the 320 Nutley St SW subdivision to a 2 year maintenance bond at 10% which expires September 17, 2021. A motion was made by Council Member Springsteen, seconded by Council Member Patel, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco E. 20-1593 Request award of IFB 20-11, Piney Branch Stream Restoration - Construction and request approval of Amended Funding Agreement with Fairfax County It was moved to award IFB 20-11 to Avon Corporation in the amount of $1,377,110 (bid + 5% contingency) from account listed above and it was moved to approve the Amended Agreement with Fairfax County for the Piney Branch Stream Restoration Project and authorize the Mayor to execute the amended agreement pending final legal review by the Town Attorney. A motion was made by Council Member Patel, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco F. 20-1615 Closed Session Mayor DiRocco called the regular meeting back into order at 10:47pm. All members of Council were present. It was moved that the members of the Vienna Town Council be polled to affirm that during the second Closed Session convened this date, Monday, February 24, 2020, the Town Council met for discussion or consideration of the acquisition of real Town of Vienna Page 4 Printed on 4/6/2020 Town Council Meeting Meeting Minutes February 24, 2020 property for a public purpose. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday, March 9, 2020 at 7:15 p.m. in accordance with Virginia Code Section 2.2-3711.A.(1), for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and /or re-appointment to Town Boards and Commissions. A motion was made by Council Member Linda Colbert, seconded by Council Member Howard J. Springsteen, that the item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Majdi, Council Member Noble, Council Member Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco 7.
