2. Resolution
Mayor Colbert stated that the meeting is being conducted in accordance with the
continuity of Government modified meeting procedure. Council voted unanimously
in favor of the resolution.
A. 20-1832 Resolution for Continuity of Government
A motion was made that the Action Item be approved. The motion carried by the following
vote:
Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member
Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert
3. Regular Business
A. 20-1815 Emergency ordinance regarding a temporary waiver of zoning restrictions for child
day care in commercial zones, industrial zones, and for public, semi-public and private
institutions in other zones.
Mayor Colbert called on Kelly O’Brien, Principal Planner, Planning and Zoning to
provide an overview of the request. Ms. O’Brien indicated that existing business in
Vienna have expressed interest in filling the demand for day care services during the
COVID-19 pandemic. However, an emergency ordinance is required to allow these
businesses to operate and offer such services.
The attached proposed emergency ordinance will be valid only for establishments
located in commercial and industrial zoning districts where they already are
approved to operate by right and for other public, semi-public and private
institutions in other zones. This ordinance will give the Town Manager authority to
issue temporary emergency commercial child day care use permits to existing Town
of Vienna businesses in commercially zoned districts who meet specific guidelines.
Town Attorney Briglia, in response to Council Member Patel, indicated that the
Town would not assume any liability for these facilities. Fairfax County Depart of
Health will serve as the enforcement agency. He further clarified that the emergency
zoning approval is valid for 60 days. If approved tonight the ordinance would be

advertised and extended to January 31, 2020.
It was moved to approve an emergency ordinance pursuant to operation of child
day care centers by existing businesses in commercial and industrial zoning
districts, and for public, semi-public and private institutions in other zones, subject
to conditions outlined by staff.
And it was further moved that the Town Clerk advertise a Notice of Intent to Readopt
this Emergency Ordinance for a period to expire January 31, 2021, at the September
14, 2020 Town Council meeting. Motion made by Council Member Brill; second by
Council Member Potter. Motion carried unanimously.
A motion was made by Council Member Brill, seconded by Council Member Potter, that
the Action Item be approved. The motion carried by the following vote:
