1. Resolution
A. 21-2013 Resolution for Continuity of Government
Mayor Linda Colbert read into the record the Continuity of Government. The
Resolution was approved through voice vote.
2. Invocation: Councilmember Ray Brill
Mayor Colbert recognized Council Member Brill who provided the evening’s
invocation.
3. Pledge of Allegiance to the Flag of the United States of America
4. Roll Call
Council: Council Member Chuck Anderson (via ZOOM); Council Member Ray Brill
Jr., Council Member Nisha Patel (via ZOOM); Council Member Steve Potter (via
ZOOM), Council Member Ed Somers (via ZOOM); Council Member Howard J.
Springsteen and Mayor Linda Colbert
Staff: Mercury Peyton, Town Manager; Mike D’Orazio, Deputy Director, Planning
and Zoning (via ZOOM); Steve Briglia, Town Attorney; Natalie Monkou, Manager,
Economic Development.

5. Approval of the Minutes:
A. 20-2007 Acceptance of the Regular Council Meeting Minutes of December 7, 2020 and the
Work Session Minutes of December 14, 2020.
The Regular Council Meeting Minutes of December 7, 2020 and the Work Session
Minutes of December 14, 2020 were approved with additions. A request for greater
content was made by Council Members Potter, Brill and Springsteen. Mayor Colbert
will lead discussion on the suggested change in format.

6. Receipt of petitions and communications from the Public that are not on the Agenda.

Mayor Colbert recognized Boy Scout Gavin Crombie, Pack 1139.
7. Closed Session Report
It was moved that the members of the Vienna Town Council be polled to affirm that a
Closed Session was held on January 4, 2021 virtually, via ZOOM, and in-person, in
accordance with Virginia Code, Section 2.2-3711.A.(1), and the Town of Vienna’s
Continuity of Government ordinance, for discussion or consideration of personnel
matters, specifically the discussion of appointments to Town Boards and
Commissions. It was further moved that the Certification Resolution be adopted in
accordance with State Statutes, and that the Town Clerk is authorized to execute the
Certification Resolution. And it was further moved that the Closed Session be
continued to Monday, January 25, 2021 at 7:15 PM in accordance with Virginia
Code, Section 2.2-3711.A.(1), and the Town of Vienna’s Continuity of Government
ordinance, for discussion or consideration of personnel matters; specifically the
annual performance review of the Town Manager, the Town Attorney, and the Town
Clerk.
Motion, Council member Somers. Second, Council Member Springsteen. Motion
carried unanimously.
It was moved that Leonard Ignatowski be reappointed to the Transportation and
Safety Commission for a two-year term; said term shall be effective from January 29,
2020 to January 29, 2023. Motion Council Member Somers; second Council Member
Springsteen. Motion carried unanimously.
Council Member Patel requested clarification on the protocol for appointments.
Council Member Anderson requested that in the future time be allotted for
discussion following an interview. Mayor Colbert noted that future agendas will
reflect additional time following interviews.

8. Regular Business
A. 20-1989 Re-adoption of emergency ordinance to permit temporary waivers of zoning
regulations and review for public, semi-public, and private institutions
Mayor Colbert called on Mike D’Orazio, Deputy Director, Planning and Zoning, to
provide an overview of the request.
It was moved to re-adopt an emergency ordinance, originally adopted September 4
and re-adopted on October 5, related to expanded use of institutional outdoor
operations by public, semi-public, and private institutions. This emergency
ordinance will expire on July 4, 2021.
Motion Council Member Springsteen; second Council Member Brill. Motion carried
unanimously.
A motion was made by Council Member Springsteen, seconded by Council Member Brill,
that the Action Item be approved. The motion carried by the following vote:

B. 20-1990 Re-adoption of emergency ordinance to permit a temporary waiver of zoning

restrictions for child day care in commercial zones, industrial zones, and for public,
semi-public, and private institutions in other zones.
Mayor Colbert called on Mike D’Orazio, Deputy Director, Planning and Zoning, to
provide an overview of the request.
It was moved to re-adopt an emergency ordinance related to operation of child day
care centers by existing businesses in commercial and industrial zoning districts
and by public, semi-public, and private institutions in other zones, subject to
conditions outlined by staff. This emergency ordinance will expire on July 4, 2021.
Motion Council Member Springsteen; second Council Member Patel. Motion carried
unanimously.
A motion was made by Council Member Springsteen, seconded by Council Member Patel,
that the Action Item be approved. The motion carried by the following vote:

C. 20-2001 Set a Public Hearing to consider the alley vacation of 131 Wilmar Place NW
Mayor Colbert called on Michael Gallagher, Director, Public Works, to provide
back ground of the item.
It was moved to postpone the public hearing to consider vacation of the public alley
adjacent to 131 Wilmar Place NW until Council questions can be answered and a
meeting held with the appraiser of record for the property.
Motion Council Member Patel; second Council Member Somers. Motion carried
unanimously.
A motion was made by Council Member Patel, seconded by Council Member Somers, that
the Action Item be deferred. The motion carried by the following vote:

D. 20-2002 Dominion Energy Strategic Underground Program - Easement request at 413
Tapawingo Road SW
Mayor Colbert called on Michael Gallagher, Director, Public Works, to provide an
overview of the Item.
It was moved to set a public hearing for February 22, 2021 to consider granting an
easement on 413 Tapawingo Road SW to Dominion Energy and instruct the Town
Clerk to advertise a notice of public hearing.
Motion Council Member Anderson; second Council Member Potter. Motion carried
unanimously.
A motion was made, seconded by Council Member Potter, that the Action Item be approved.
The motion carried by the following vote:

E. 20-2004 Council Acceptance of $49,290.06 in Coronavirus Relief Funds for Utility Relief
Mayor Colbert called on Marion Serfass, Director, Finance, to provide an overview

of the item for discussion. A motion was made to accept $49,290.06 in CRF utility
grant funds to assist Town of Vienna water and sewer customers.
Motion Council Member Patel; second Council Member Anderson. Motion carried
unanimously.
A motion was made by Council Member Patel, seconded by Council Member Anderson,
that the Action Item be approved. The motion carried by the following vote:

F. 21-2012 Award Marketing Contract to Marketing Firm to Provide Business Focused
Marketing Services
Mayor Colbert called on Natalie Monkou, Manager, Economic Development, to
provide a summary of the request.
It was moved to award a contract not to exceed $40,100.00 to execute marketing
services to support the business community, to Reingold, Inc. utilizing the Fairfax
County Marketing and Communications Services contract number 4400008733.
Motion Council Member Springsteen; second Council Member Anderson. Motion
carried in a 6-1 vote. Council Member Brill voted to abstain.
Council Member Anderson moved to extend the meeting. Motion carried by voice
vote.
A motion was made by Council Member Springsteen, seconded by Council Member
Anderson, that the Action Item be approved. The motion carried by the following vote:
Aye: 6- Council Member Anderson, Council Member Patel, Council Member Potter, Council
Member Somers, Council Member Springsteen and Mayor Colbert
Abstain: 1- Council Member Brill
G. 20-2000 Award RFP 21-01 Market Study & Economic Development Strategy
Mayor Colbert called for a 3-minute recess at 10:20 PM. Council reconvened at 10:23
PM.
Mayor Colbert recognized Natalie Monkou, Manager, Economic Development to
provide a summary of the request.
It was moved to award a contract for $100,000 under RFP 21-01 to execute a market
study and develop an economic development strategy for the Town of Vienna, to
Streetsense.
Motion, Council Member Springsteen; second Council Member Potter. Motion
passed in a 6-1 vote. Council Member Brill abstained.
A motion was made by Council Member Springsteen, seconded by Council Member Potter,
that the Action Item be approved. The motion carried by the following vote:
Aye: 6- Council Member Anderson, Council Member Patel, Council Member Potter, Council
Member Somers, Council Member Springsteen and Mayor Colbert
Abstain: 1- Council Member Brill
