Robinson, Jr. Town Hall, 127 Center Street, South 1. Resolution A. 21-2154 Resolution for Continuity of Government Mayor Linda Colbert read into the record the Continuity of Government. The Resolution was approved through voice vote. Invocation: Councilmember Ray Brill Mayor Colbert recognized Council Member Brill who provided the evening’s invocation. Pledge of Allegiance to the Flag of the United States of America 2. Roll Call Council: Council Member Chuck Anderson (via ZOOM); Council Member Ray Brill Jr., Council Member Nisha Patel (via ZOOM); Council Member Steve Potter (via ZOOM), Council Member Ed Somers (via ZOOM); Council Member Howard J. Springsteen and Mayor Linda Colbert. Staff: Mike Gallagher, Director, PublicWorks; Steve Briglia, Town Attorney (via ZOOM). Present: 7- Council Member Chuck Anderson, Council Member Ray Brill Jr., Council Member Nisha Patel, Council Member Steve Potter, Council Member Ed Somers, Council Member Howard J. Springsteen and Mayor Linda Colbert 2. Acceptance of the Minutes: A. 21-2102 Acceptance of the Regular Council Meeting Minutes of February 22, 2021, March 1, 2021 and March 8, 2021, and the Conference Session Minutes of March 8, 2021. A motion was made that the Minutes be approved. The motion carried by a unanimous vote. 4. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 3 minutes per issue and no formal action can be taken this evening) There were no petitions or communications from the public. 5. Closed Session Report Mayor Colbert recognized Council Member Somers. It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on March 22, 2021 in accordance with Virginia Code, Section 2.2-3711.A.(1), and the Town of Vienna’s Continuity of Government Town of Vienna Page 1 Printed on 4/13/2021 Town Council Meeting Meeting Minutes March 22, 2021 ordinance, for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment or reappointment to Town Boards or Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday, April 12, 2021 at 7:15 PM for discussion and consideration of appointment or reappointment to Town Boards or Commissions. Motion, Council Member Somers; second, Council Member Springsteen. Motion passed unanimously. It was moved that Mark Landers be appointed to the Town Business Liaison Committee for a two-year term; said term shall be effective from March 23, 2021 to March 23, 2023. It was further moved that Cindy Weinberg be appointed to the Conservation and Sustainability Commission for a two-year term; said term shall be effective from May 1, 2021 to May 1, 2022. And it was further moved that Ken Barry be appointed to the Bicycle Advisory Committee for a two-year term; said term shall be effective from March 23, 2021 to March 23, 2023. Motion, Council Member Somers; second, Council Member Springsteen. Motion carried unanimously. 5. Consent Agenda Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert A. 21-2125 Request to set a public hearing for April 12, 2021 regarding the FY 2021-22 operating budget B. 21-2126 Request to set a public hearing for April 12, 2021 regarding FY 2021-22 water and sewer rates C. 21-2127 Request to set a public hearing for April 26, 2021 regarding the FY 2021-22 real estate tax rate D. 21-2088 Set a public hearing to consider alley vacation of 131 Wilmar Place NW Town of Vienna Page 2 Printed on 4/13/2021 Town Council Meeting Meeting Minutes March 22, 2021 E. 21-2140 Request formal approval of an emergency procurement to increase by $4,000 the current purchase order by $4000 with Siemen’s Industries for HVAC services, bringing the total cost to $33,874. F. 21-2110 Police Station - Gas Service Line Relocation G. 21-2128 Approve an increase in spending for temporary help with VAPFS, LLC-Hire Strategy 7. Regular Business A. 21-2155 Re-adoption and extension of the Continuity of Government ordinance It was moved to re-adopt and extend the Continuity of Government ordinance approved by Town Council at its April 13, 2020 meeting. The re-adopted ordinance shall be good for a period of up to an additional six months, until September 31, 2021, from its current expiration of March 31, 2021. Following an amendment offered by Council Member Brill and seconded by Council Member Springsteen, the motion read as follows: It was moved to re-adopt and extend the Continuity of Government ordinance approved by Town Council at its April 13, 2020 meeting. The re-adopted ordinance shall be good for a period of up to an additional six months, until September 30, 2021, from its current expiration of March 31, 2021. It was further moved to direct the Town Clerk to advertise a Notice of Adoption of the Continuity of Government ordinance. Motion, Council Member Anderson; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Anderson, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert B. 21-2074 Request approval for cable access channel equipment upgrades It was moved to approve procurement upgrades as described for the Town of Vienna cable channel in an amount not to exceed $119,285.40. Motion, Council Member Springsteen; second, Council Member Anderson. Motion carried unanimously. A motion was made by Council Member Springsteen that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert C. 21-2105 Request additional spending for Park St NE sidewalk improvements for right-of-way services It was moved to approve additional spending in the amount of $61,000 with Whitman, Requardt & Associates for the Park St NE sidewalk improvements project Town of Vienna Page 3 Printed on 4/13/2021 Town Council Meeting Meeting Minutes March 22, 2021 for right-of -way services. Motion, Council Member Anderson, second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Anderson, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert D. 21-2109 Award IFB 20-10 construction contract for Old Courthouse Road NE sidewalk It was moved to award the contract for an Old Courthouse Road NE sidewalk project to Sagres Construction Corporation in an amount not to exceed $1,402,691 (bid + 10% contingency). Motion, Council Member Potter; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Potter, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert 8.
