Robinson, Jr. Town Hall, 127 Center Street, South 1. Resolution A. 21-2270 Resolution for Continuity of Government Mayor Linda Colbert read into the record the Continuity of Government. The Resolution was approved through voice vote. 2. Invocation: Pastor Lydia Posselt of the Emmanuel Lutheran Church of Vienna Mayor Colbert recognized Pastor Lydia Posselt of the Emmanuel Lutheran Church of Vienna who provided the evening’s invocation. 3. Pledge of Allegiance to the Flag of the United States of America 4. Roll Call Present: 7- Council Member Chuck Anderson, Council Member Ray Brill Jr., Council Member Nisha Patel, Council Member Steve Potter, Council Member Ed Somers, Council Member Howard J. Springsteen and Mayor Linda Colbert 5. Approval of the Minutes: A. 21-2283 Acceptance of the Regular Council Meeting Minutes of April 26, 2021 and the Conference Session Minutes of April 19, 2021. The Regular Council Meeting minutes of April 26, 2021 and Town Council Conference Session minutes of April 19, 2021 were accepted by voice vote. A. 21-2283 Acceptance of the Regular Council Meeting Minutes of April 26, 2021 and the Conference Session Minutes of April 19, 2021. Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert 6. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 3 minutes per issue and no formal action can be taken this evening) Council Member Patel congratulated fellow Council Members whose children graduated recently. Council Member Potter extended happy birthday wishes to fellow Council Member Somers. 7. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on May 17, 2021 virtually, via ZOOM, and in-person, in accordance with Virginia Code, Section 2.2-3711.A.(1), and the Town of Vienna’s Town of Vienna Page 1 Printed on 6/10/2021 Town Council Meeting Meeting Minutes May 17, 2021 Continuity of Government ordinance, for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointments and/or reappointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to later this date, Monday, May 17, 2021 at the conclusion of the regular Council meeting in accordance with Virginia Code, Section 2.2-3711.A.(3), and the Town of Vienna’s Continuity of Government ordinance, for discussion or consideration of the acquisition of real property for a public purpose, as well as discussion and consideration of personnel matters; specifically the discussion and consideration of individuals for appointment and/or reappointment to Town Boards and Commissions. Motion, Council Member Somers; second, Council Member Springsteen. Motion carried unanimously. It was moved that Bob Robinson be reappointed to the Conservation and Sustainability Commission for a two-year term. Said term shall be effective from June 3, 2021 until June 3, 2023. It was moved that James Sullenger be reappointed to the Bicycle Safety Committee for a two-year term. Said term shall be effective from June 4, 2021 until June 4, 2023. It was moved that Sally Jean Pena be reappointed to the Transportation Safety Commission for a two-year term. Said term shall be effective from June 18, 2021 until June 18, 2023. It was moved that Loginn Kapitan be reappointed to the Transportation Safety Commission for a two-year term. Said term shall be effective from June 18, 2021 until June 18, 2023. It was moved that Donna Smith be reappointed to the Transportation Safety Commission for a two-year term. Said term shall be effective from June 18, 2021 until June 18, 2023. Motion, Council Member Somers; Second, Council member Springsteen. Motion carried unanimously. 8. Consent Agenda A motion was made by Council Member Nisha Patel, seconded by Council Member Howard J. Springsteen, that the Consent Agenda be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert A. 21-2257 Proposed renewal of agreement between the Northern Virginia Regional Park Authority, the Northern Virginia Model Railroaders, Inc. and the Town of Vienna for the operation of the W&OD Trail Vienna Railroad Station. B. 21-2267 Request additional FY21 spending with Arthur Construction utilizing IFB 20-03 and Town of Vienna Page 2 Printed on 6/10/2021 Town Council Meeting Meeting Minutes May 17, 2021 IFB 17-03. C. 21-2263 Resolution to Issue Vehicle and Equipment Replacement Financing for FY 2021-22 9. Regular Business A. 21-2269 Approve Spending with Spotted MP To Partially Cover Vacant Communications Manager Position It was moved to approve additional spending with Spotted MP not to exceed $12,500 to provide communications services from the account listed above. Motion, Council Member Patel; second, Council Member Springsteen. Motion carried unanimously. A motion was made that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert B. 21-2256 Request approval of MOU between Town of Vienna and Rotary Club of Vienna for 2021 Viva Vienna Festival Mayor Colbert recognized Rotary Club members AJ Oskuie, Viva Vienna Chair, Gunner Spafford and Brian Billett to provide an update on the upcoming Viva Vienna Festival. A motion was made to authorize the Mayor to execute the attached MOU between the Town and Rotary Club of Vienna for the 2021 Viva Vienna Festival. Motion, Council Member Patel; second, Council Member Springsteen. Motion carried unanimously. A motion was made that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert C. 21-2254 Intent to Adopt Real Estate Tax Rate for FY 2021-22 It was moved to approved Items 9C, 21-2254 Intent to Adopt Real Estate Tax Rate for FY 2021-22 and Item 9D, 21-2255 Intent to Adopt FY 2021-22 Water and Sewer Rates. Motion, Council Member Springsteen; second, Council Member Potter. Motion passed unanimously. A motion was made that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert D. 21-2255 Intent to Adopt FY 2021-22 Water and Sewer Rates A motion was made that the Action Item be approved. It was moved to adopt the $43,221,000 FY 2021-22 operating budget. It was further moved that of the said total, $26,563,700 be appropriated for General Fund expenditures; $5,373,980 be appropriated for Debt Service Fund expenditures; $10,816,600 be appropriated for Water and Sewer Fund expenditures; and $466,720 be appropriated for Stormwater Fund expenditures. It was further moved to hold in reserve $530,000 of funds derived from general fund revenue as a general fund reserve until such time as the Town Council authorizes release of these funds by Council action. And it was further moved that the Town Clerk be authorized to advertise a Notice of Adoption. Motion, Council Member Anderson; second, Council Member Springsteen. Motion passed unanimously. A motion was made that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert F. 21-2262 Consider Unfreezing Portion of 2021-22 Budget Mayor Colbert called on Director Serfass to clarify the Item. It was moved to unfreeze $434,300 from the FY 2021-22 budget representing salary increases and education, training and travel costs. It was further moved to award a salary increase of 3% to eligible employees retroactive to April 1, 2021. Motion, Council Member Anderson; second Council Member Springsteen. Motion passed unanimously. A motion was made to recess for five minute at 9:09 PM. Motion, Council Member Springsteen; second, Council Member Somers. A motion was made that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert G. 21-2304 Second Closed Session Mayor Colbert called the meeting back to order at 11:09 PM. Town of Vienna Page 4 Printed on 6/10/2021 Town Council Meeting Meeting Minutes May 17, 2021 It was moved that the members of the Vienna Town Council be polled to affirm that a second Closed Session was held on May 17, 2021 virtually, via ZOOM, and in-person, in accordance with Virginia Code, Section 2.2-3711.A.(3), and the Town of Vienna’s Continuity of Government ordinance, for discussion or consideration of the acquisition of real property for a public purpose.
