Springsteen and Mayor Linda Colbert 2. Acceptance of the Minutes: A. 22-2945 Acceptance of the Conference Session Minutes of November 30, 2021 and February 2, 2022. Minutes of the Town Council Conference Sessions of November 30, 2021 and February 2, 2022 were accepted. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 3 minutes per issue and no formal action can be taken this evening) Mayor Colbert recognized Martin Schubert, 606 Delano Dr. SE. Mr. Schubert noted that, as an advocate for the environment, he would like to address two specific issues. After reading an article in the Vienna Voice referencing Earth Hour (where lights across the globe are shut off for one hour to raise awareness about environmental conservation), he realized that this symbolic effort would have minimal impact on the problem, and more must be done. He asked Council to consider ordinances that would make a difference. Firstly, follow in the footsteps of DC and California where two cycle engines used for lawn mowers, leaf blowers, etc. have been outlawed. As an example, emissions from one hour of leaf blowing equals emissions from driving an SUV 3000 miles. He urged Council to give this consideration. Secondly, he suggested that Council consider a ban on unattended idling automobiles. He asked for reasonable legislation that would eliminate this waste of fuel. Reports/Presentations A. 22-2933 Delegate Mark Keam- Legislative Update Mayor Colbert welcomed Delegate Mark Keam to report on the current congressional session. Delegate Keam indicated that, of the nineteen legislative items on the Town agenda, he carried forward seven. Of those seven, three were passed and await a signature by the Governor; HB 700 November elections; HB 702 disclosure of lot coverage percentage at time of property sale; and HB 703 allow localities seeking special license plates to pay initial fee costs so plates could be issued immediately. Other issues are summarized as follows: • Elimination of the grocery tax remains an important item; with COVID funds it may be possible; • Eliminating the gas tax not likely due to minor impact on actual price paid by consumer; • Request continued support for returning elections to a May calendar. A. Report and Inquiries of Council Members Council Member Springsteen remarked that the PIO will issue information regarding the March 21, 2022 Public Works presentation on leaf mulching options. He also requested a tour of the Town Hall lower level prior to the Budget session on Saturday. Council Member Patel noted that she has requested an estimate from Public Works for employing an in-house storm water management inspector. Council Member Brill requested that Council reflect on the issues and sacrifices of the people of Ukraine. Council Member Potter provided a follow-up on his earlier request for greater community engagement regarding current construction projects. He has met with Town Manager Payton and Mayor Colbert to develop a plan that will be presented at this meeting. Council Member Anderson reiterated concerns with construction projects that abut residential neighborhoods, providing examples from his personal experience. He applauded steps taken by Council Member Potter and Town Staff but suggested that a longer term solution was necessary. In response to an inquiry from Council Member Patel, it was pointed out that Emily Goodman currently serves as the Town construction site inspector. B. Report of the Town Manager Town Manager Mercury Payton reported that a strategy has been established to inform residents who live near construction sites. The intent of this is to provide a venue where residents, Staff (Police, Planning and Zoning, Public Works) and construction representatives can meet on a regular basis to discuss issues related to the project. It is projected that these informational meetings will begin in the next week either in Town Hall or the Community Center. Additional suggestions by Council included: • Consideration of a fulltime temporary inspector; Town of Vienna Page 2 Printed on 5/23/2022 Town Council Meeting Meeting Minutes March 7, 2022 • Recommend site manager be present at all resident updates; • Provide residents with information from site plan so they are knowledgeable; • Request simplified list of enforcement mechanisms for these issues. Town Manager Payton also reported that an update on the sidewalk project is scheduled for March 21, 2022. C. Report of the Mayor Mayor Colbert thanked Senator Chap Peterson and all residents who attended the presentation on March 5, 2022. She also thanked Delegate Mark Keam for his presentation this evening. Council will hold its first budget conference session on Saturday, March 12, 2022. Applications for volunteer recognition are due by April 1, 2022; presentations will be held on April 19, 2022. D. Proposals for Additional Items to the Agenda None E. Closed Session Report It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on March 7, 2022 in accordance with Virginia Code, Section 2.2-3711.A.(1) for the annual evaluation of the Town Clerk. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday March 21, 2022 at 7:00 PM in accordance with Virginia Code, Section 2.2-3711.A.(1), for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. Motion, Council Member Somers; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Ed Somers, seconded by Council Member Howard J. Springsteen, that this was approved.. B. 22-2893 Request approval for spending $200,000 with Tri-State Utilities, Inc. for rehabilitation of sanitary sewer pipes throughout the service area. A motion was made by Council Member Springsteen, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert D. 22-2901 Request approval of memorandum of understanding (MOU) between the Optimist Club of Greater Vienna and Town of Vienna for use of the Vienna Community Center parking lot for the 2022 Vienna Farmers Market A motion was made by Council Member Springsteen, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert E. 22-2951 The Police Department requests approval to add $5,500 to the budget of ECS Mid-Atlantic for observation and testing services of the Police Station project. A motion was made by Council Member Springsteen, seconded by Council Member Potter, that the Action Item be approved. Regular Business A. 22-2925 Council Acceptance of $63,046.89 in Federal, State and Local Fiscal Recovery Funds (SLFRF) for Utility Relief Mayor Colbert called on Michelle Pagano-Dierkes, Deputy Director, Finance to present the Item for consideration. It was moved to approve the acceptance of $63,046.89 in federal, state and local fiscal recovery funds (SLFRF) for utility relief. Motion, Council Member Patel; second, Council Member Somers. Motion carried unanimously. A motion was made by Council Member Patel, seconded by Council Member Somers, that the Action Item be approved.
