Town of Vienna Charles A. Robinson Jr. Town Hall 127 Center Street South Vienna VA, 22180 Meeting Minutes Town Council Meeting Monday, June 12, 2023 7:30 PM Charles Robinson Jr. Town Hall, 127 Center St. South Special meeting for Code Create called by the Mayor & Council 1. Roll Call Councilmember Patel was absent for the first part of the meeting. Present: 7- Council Member Chuck Anderson, Council Member Ray Brill Jr., Council Member Nisha Patel, Council Member Steve Potter, Council Member Ed Somers, Council Member Howard J. Springsteen and Mayor Linda Colbert 2. Reports/Presentations A. Report and Inquiries of Council Members Mayor Colbert opened the floor for reports from Council. Council Member Somers stated that he will not run for reelection to Council. Council Member Anderson reported that his proposed pickleball resolution will be on the agenda of June 20, 2023. He also noted that Liberty Amendments month begins June 17, 2023. The Juneteenth kickoff will take place at noon at the First Baptist Church. Council Member Anderson thanked Council Member Somers for his hard work and service to the Town. Council Member Springsteen thanked Council Member Somers for his dedication to the Town, remarking on the wealth of knowledge he brought to the Council. Council Member Potter expressed his appreciation for Council Member Somers service and for his knowledge and eloquence on matters of importance to the citizens of Vienna. Council Member Brill noted Council Members Somers depth of Knowledge and extended his appreciation for the hard work. Mayor Colbert noted that the first Chilin on Church will be held this Friday, June 16, 2023. She also commended the Madison High School Athletics department for their successful spring. Mayor Colbert remarked that she has worked with Council Member Somers since he served as a Town Commissioner. He has brought his unique outlook and vision to the Council and will be missed. She thanked him for his dedication and effort on behalf of the Town. Town Manager Payton stated that he has enjoyed working with Council Member Somers over the past number of years and has appreciated their partnership. Closed Session Report Mayor Colbert called on Council Member Somers to provide the Closed Session Report. It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on June 12, 2023 in accordance with Virginia Code, Section 2.2-3711.A.(1), for discussion or consideration of the acquisition of real property for a public purpose or the disposition of publicly owned property where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the public body. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Tuesday, June 20, 2023 at 7:00 PM in accordance with Virginia Code, Section 2.2-3711.A.(1), for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions and the discussion of Council appointments to local committees. Motion, Council Member Somers; second, Council Member Springsteen. Motion carried A motion was made that this was approve. The motion carried by the following vote: Aye: 6- Council Member Anderson, Council Member Brill, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert Absent: 1- Council Member Patel 3. Regular Business A. 23-3841 Code Create Vienna: Review of Draft Chapter 18 - Zoning and Subdivision Ordinance for Referral to Planning Commission and Joint Public Hearing Mayor Colbert recognized David Levy, Director, Planning and Zoning, to present the Item for consideration. Director Levy introduced Kelly O’Brien, Deputy Director, Planning and Zoning and thanked her for her dedication and effort during this process. The current draft of the revised Vienna Zoning Code Chapter 18 has incorporated updates based on input from Council, the Planning Commission and community members over the past two and half years. Councils task is to choose to move forward with the draft as is or return for further revision. A summary of Council Comments follows. • Draft reflects that Staff consciously included revision requests by Council; Evident through inclusion of standards for bicycle parking; • Section 18-220 RMU Dimensional Standards, re: 18-220.1 two unit attached dwellings, states 30% open space - 35% was discussed; • Section 18-220 RMU Dimensional Standards, re:18-220.1b Cottage Courts, states Town of Vienna Page 2 Printed on 7/11/2023 Town Council Meeting Meeting Minutes June 12, 2023 unit size of 1800 sq. ft. standard – suggest square footage to mirror the recent build at Maple Avenue and Park St. (approximately 2100 sq. ft.); • Religious assembly requires a conditional permit due to the fact that many are located in residential areas, resulting in high impact on neighbors (traffic flow, parking, etc.); • Avenue East and Avenue West building placement standards of 18 ft. are measured from the right of way (typically an additional 10 ft.); Open space standard is 15% minimum – Check to determine if Council asked for greater than 15%; • Consider identifying grandfathered MAC projects (on map); • Consider if the plus or minus three feet lot deviation should be narrowed; • Consider whether patios constructed of permeable materials should be excluded from lot coverage of a certain size (does not contribute to runoff); • Consider whether to add encroachment standards for covered decks; • Double check allowable units per acre for all multifamily dwellings. Director Levy noted that all comments from Council will be compiled into a list that will be brought back to Council for final consideration in August, 2023. With no additional comments from Council at this time, Mayor Colbert called for a motion. It was moved to refer the attached draft Chapter 18 - Zoning and Subdivision Ordinance to the Planning Commission, with a request for its input and recommendations, and it was further moved to set the dates for the joint public hearings of the Town Council and the Planning Commission for July 10, 2023 and July 12, 2023, and direct the Clerk to advertise the public hearing and staff to conduct outreach to the community. The public hearing will remain open for written comment until July 26, 2023. Motion, Council Member Patel; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Patel, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert 4. Meeting Adjournment Mayor Colbert called for a motion to adjourn at 8:15 PM. Motion, Council Member Patel; second, Council Member Anderson. A motion was made that the meeting be adjourned.
