Pledge of Allegiance to the Flag of the United States of America 1. Roll Call 2. Acceptance of the Minutes: A. 24-4738 Acceptance of the Work Session Minutes of September 9, 2024, September 30, 2024 and the Regular Meeting Minutes of October 7, 2024 The Work Session Minutes of September 9, 2024, September 30, 2024 and the Regular Meeting Minutes of October 7, 2024 were approved as submitted. A motion was made that the Action Item be approved. The motion carried by the following vote: 3. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 3 minutes per issue and no formal action can be taken this evening) Mayor Colbert opened the floor for comment from the Public. Dennis Eigal spoke stating he recently moved to Vienna to care for his elderly mother and her sister. [A number of years ago] the Town implemented permit parking along DeSale Street. The home I share with my mother and aunt is situated on the corner of DeSale Street and Cedar Lane. About fifteen years ago, permit parking signs were installed along DeSale Street from Cedar Lane to Patrick. Initially they only affected five homes (of the 20 on the street). He is asking for permit parking for the remainder of DeSale Street primarily due to overflow parking from the apartments at Cedar Lane. He understands that there is a procedure for this. He is willing to assist in any way necessary. He thanked council for listening and hopes he can get further direction on this matter. Town Manager Payton indicated that Staff will reach out to assist. 4. Reports/Presentations A. Report and Inquiries of Council Members Mayor Colbert opened the floor for comment from Council. Council Member Springsteen thanked all those involved in the construction of the Town of Vienna Page 1 Printed on 12/3/2024 Town Council Meeting Meeting Minutes - Final October 28, 2024 new stairs across from Waters Field. He also noted the addition of a concrete pad and brickwork on the corner by the Freeman Store. The Halloween Parade was successful and well attended. Council Member Springsteen requested an update on the deer issue discussed at the last Work Session. Mayor Colbert indicated that a letter of request has been sent to Hunter Mill District Supervisor Walter Alcorn. Council Member Allen indicated that she plans to continue to advocate for seniors whenever possible. She has been made aware that Hunter Mill has no Senior Citizen Center. Without this, she believes that seniors have no representation in Fairfax County. Council Member Baldwin complemented the Vienna Business Association, Town Staff and all volunteers who worked to make the Halloween Parade a success. Council Member Ramakis added her appreciation to all involved in the production of the Halloween Parade. She made special note of the excellent organization and execution of the event. Council Member Ramakis congratulated Rustic Love for inauguration of the Hearts and Home mural located on Dominion Avenue. This is the last meeting prior to Veterans Day. The American Legion Post 180 will host a commemoration on November 11, 2024 at 11:00 AM. Thank you to all veterans who served our country, with special thanks to Ray Brill. Council Member Brill remarked on the excellent Halloween parade. He also urged Council and all residents to stay abreast of the casino issue, which will likely be brought up in the next legislative session. Thank you to Council Member Ramakis for her work toward a successful Veterans Day event. Council Member Anderson reported on a successful No Casino rally and thanked fellow Council Members and the Mayor for their attendance. He urged continued contact with elected officials to reinforce the Town’s opposition. B. Report of the Town Manager C. Report of the Mayor Mayor Colbert noted that Church of the Holy Comforter has built solar panels to provide energy for the entirety of the Church. The panels themselves will provide shade for the parking lot. The Vienna Community Theater will conclude its fall performance of Moon Over Buffalo through this weekend. The new season will begin in January 2025. Vienna Volunteer Fire Department will hold their Fall Bizarre on Saturday, November 2, 2024. D. Proposals for Additional Items to the Agenda E. Closed Session Report It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on October 28, 2024 prior to the Regular Town Council Meeting in accordance with Virginia Code, Section 2.2-3711, (1), for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. And it was further moved that the Closed Session be continued to Monday November 18, 2024 prior to the Regular Meeting in accordance with Virginia Code, Section 2.2-3711, (1) for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. Motion, Council Member Ramakis; second, Council Member Springsteen. Motion carried unanimously. It was moved that John O’Keefe be reappointed to the Pedestrian Advisory Committee for a two year term. Said term to be retroactively effective from September 3, 2024 and expire September 3, 2026. It was moved that the following be appointed to the Tree Advocacy Committee for a two year term. Christopher Bredehoeft and John Shults. It was further moved that Sandy Shinn and Ken Foley be appointed for a one year term. And it was further moved that Samantha Bryant and Aditi Chandra be appointed as Student Members. Samantha Bryant appointed for a one year term effective October 29, 2024 and expire June 30, 2025; and Aditi Chandra appointed for a two year term effective October 29, 2024 and expire June 30, 2026. Motion, Council Member Ramakis; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Jessica Ramakis, seconded by Howard J. Springsteen, that this was approved.. The motion carried by the following vote: 5. Consent Agenda Mayor Colbert called for a motion on the Consent Agenda. It was moved to approve the Consent Agenda, Items A- E with the exception of Item B. Motion, Council Member Springsteen; second, Council Member Baldwin. Motion carried unanimously. Item B will be added to the Agenda as Regular Business Item D. A. 24-4735 Approval request for spending $106,073 with Fairfield Enterprises, LLC, for building improvements to the Nutley Property Yard A motion was made by Springsteen, seconded by Baldwin, that the Action Item be approved on the Consent Agenda. The motion carried by the following vote: C. 24-4704 Request to Award Invitation For Bid (IFB) 25-02 to FLB Contractors, Inc. for Construction of the Culvert Replacement at the Intersection of Nutley Street, SW, and Marshall Road, SW. Regular Business A. 24-4715 Request for approval of site plan modifications of requirements and landscape plan for proposed Vienna-Carter Library and parking garage located at 101 Maple Ave., E. Mayor Colbert called on David Levy, Director, Planning and Zoning, to present the Item for consideration. He introduced Kelly O’Brien, Deputy Director, Planning and Zoning and Representatives from the project to respond to questions from Council. The following is a summary of comments from Council: • The presented plan satisfies requirements from Board of Architectural Review (BAR) regarding invasive plant species; Continued maintenance of invasives should be included in contract; • Fairfax County will provide maintenance in easement; Fairfax Public School District will initially clear invasive plant species and work with Town arborist to select appropriate tree species; • Request additional trees to meet new Code requirements – place on Vienna Elementary School property if approved by Fairfax County Public Schools or on other Town property; • Request signage to identify bike rack location; • Modification of garage rear wall improves visual appeal; Modification will require thicker concrete, etc. resulting in need to reduce setback from 3 ft. to 2 ft.; Reduced setback will impact only the one bay furthest from the elementary school building; • Dedicated bricks will be preserved and replaced at close of construction; • NVTA grant requires that certain percent of parking is open to public; • Trees and flowers planted as part of beautification project will be removed for construction and replaced in kind; • Undergrounding utilities is not part of the project; Should include this as part of all future projects; • Solar panel placement takes best advantage of sun; • Front setback is 10 ft. despite new Code requirement of 18 ft. to accommodate future bike lanes; Tradeoff is that the sidewalk is much wider and the entrance is large and welcoming; • Front entrance beams required to support roof structure; • Tradeoffs for this project will not be considered precedent setting because each project is evaluated on its own merit. With no additional discussion on this portion of the Item, Mayor Colbert called for a motion. A motion was made to approve the requested modifications of requirements for the Vienna-Carter Library and parking garage related to front and rear yard setbacks (modified rear setback from 3 ft. to 2 ft.), tree canopy, and loading space for the property located at 101 Maple Ave., E. Motion, Council Member Springsteen; second, Council Member Baldwin. Motion carried unanimously. Mayor Colbert called on Kelly O’Brien to present the landscaping design for the Town of Vienna Page 4 Printed on 12/3/2024 Town Council Meeting Meeting Minutes - Final October 28, 2024 project. Upon finding that the proposed site plan modifications do not impair the health, safety and morals of the Town or of Chapter 18, it was moved to approve the landscape plan for the Vienna-Carter Library and parking garage located at 101 Maple Ave., E. Motion, Council member Anderson; second, Council Member Springsteen. Motion carried unanimously. Director Levy noted that this is the final time that the project will come before Council. Mayor Colbert called for a recess at 9:10 PM. Meeting resumed at 9:20 PM. A motion was made by Springsteen, seconded by Baldwin, that the Action Item be approved. The motion carried by a unanimous vote. B. 24-4733 Request approval of a sign that does not comply with the master sign plan for 144 Church St., NW, in the CS-O Church Street Vision Incentive Overlay zone. Mayor Colbert called on David Levy, Director, Planning and Zoning to present the Item for consideration. Comments from Council are summarized as follows: • Council should not be evaluating signage; • Council urged to review sign ordinance; • Recommended that all future sign requests be given similar consideration. A motion was made to approve the requested deviations from the Master Sign Plan for 144 Church St., NW, as presented. Motion, Council Member Springsteen; second, Council Member Motion carried unanimously. A motion was made by Springsteen, seconded by Anderson, that the Action Item be approved. The motion carried by the following vote: C. 24-4622 Request approval to award construction of the ARPA funded Park Street, SE, sidewalk project from the W&OD Trail to Fardale Street, SE. Mayor Colbert recognized Brad Baer, Director, Public Works to present the Item. Council comments are summarized as follows: • Narrowing the sidewalk to accommodate trees may pose problems for bicyclists and walkers; Typical sidewalk is five ft. with two ft. grass strip; Narrowing to four ft. in various sections will continue to meet ADA requirements; • Various trees along Park St. are worth taking extra care to save; Will work toward accommodating any request. A motion was made to approve an authorization of $654,013 and a purchase order to Sagres Construction Corporation for the construction of the Park Street, SE, sidewalk project as described in this report. Motion, Council Member Springsteen; second, Council Member Anderson. Motion carried unanimously. The motion carried by the following vote: B. 24-4713 Waive Town of Vienna Development Fees - New Library and Parking Garage, and Temporary Library Location In Vienna Mayor Colbert called on David Levy Director, Planning and Zoning to present the Item. It was moved to recommend that the Town waive all fees related to the construction of a new public library and parking garage at 101 Maple Avenue East, and for a temporary library location in Vienna, for a total amount not to exceed $35,000. Motion, Council Member Anderson; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Anderson, seconded by Springsteen, that the Action Item be approved. The motion carried by the following vote: 7. Meeting Adjournment With no further business before the Council, Mayor Colbert adjourned the meeting at 9:55 PM. A motion was made by Howard J.
