(Limited to 3 minutes per issue and no formal action can be taken this evening) Mayor Colbert opened the floor for comments from the public. Penny Oszak, 221 Nutley St., NW I would like to discuss development standards for various zones in the Town. I raised these issues during Code Create but don’t believe I was able to get my point across. Specifically this relates to walls adjacent to various properties. The standard requires a wall where commercial/industrial use abuts a single-family zone. There is language in Article 5B about community/public/institutional uses where a wall may be required. “All land zoned in avenue center, east, west, etc…..” (basically all commercial districts) a wall would be required. However, community/public/institutional uses cannot be built in those zones, so that effectively eliminates the need of a wall. I would like something in the code that requires a wall when these uses abut residential. Maryam Dadkhah, 609 St. SE. I would like to thank Council for your pervious vote to begin sharpshooting (for deer control) in Town locations and to ask you to consider archery [as an alternative]. I live next to Wildwood Park with many deer. Deer overpopulation is a problem in Fairfax County, as confirmed by the latest report by Wildlife Management. Since I moved to Vienna, learning how to manage deer became my interest. Along the way, I interacted with deer management experts and learned that archery is the primary and most effective tool for deer management. Archery has been shown to be a safe and effective tool to control deer in high-density areas. The Fairfax County archery program has had no safety incidents since its inception in 2010. I would like to have a presentation about this program. I have talked with Jay Peters, who helped establish the County program. He has agreed to such a presentation for Council. Kathryn Wiseman, 87711 Litwalton Ct., I wanted to share a recent experience with our deer. I come to you as an animal lover, but we have created a situation where the deer population is out of balance. We built our homes on their land and have planted landscaping that further attracts them. On January 15, I was traveling on Center St. and encountered a group of deer. After slowing to allow passage, a second set appeared that I hit with my car. I called the nonemergency number to ask that the most seriously injured be put down, but was placed on hold. No one came out to provide assistance. Two days later I checked to see if the deer had been removed. Vultures had taken most of the poor animal. It is our responsibility, as stewards of the environment, to try to bring things back in to balance. It is much more humane to cull the deer through skilled hunting. Wanda Van Der Nat, 357 Holmes Dr., NW Just like the last two speakers, I have the same problem. I’m here to urge you to seriously consider the archery program for deer control. I saw the County presentation and am aware of its success. I too have hit a deer with my car. I am a member of the Ayr Hill Garden Club. We have installed thousands of dollars’ worth of plants in the Salisbury Springs Garden and we are constantly fighting the deer. As we try to educate our community through the planting of unique native plants, the deer take over. I urge you to consider this program for control. We must think of our greater environment. Bill Mims, 222 Talahi Rd., SE I want to make a few brief comments about the Annex property. I am a pickleball player. Pickleball is perhaps the fastest growing recreational sport in the country. We are building a new Annex without any new pickelball court space, but a huge swimming pool. Aquatic sports are growing but not at the rate of pickleball. I believe that in the next five years it will be seriously out of balance if we go ahead as proposed. Secondly, solar panels. There may be a reason I don’t know about, but why are we not adding solar panels on the Annex? Third, traffic congestion. Center Street during certain parts of the day is a pretty busy place. This Annex will add a huge amount of traffic, so what are Councils plans for traffic mitigation? Jessica Plowgian, 203 Battle St., SW I’m here to encourage you to consider requiring citizens and homebuilders to shovel their sidewalks after a snow storm. We are now two weeks after the snowstorm and Town of Vienna Page 2 Printed on 5/21/2025 Town Council Meeting Meeting Minutes January 27, 2025 as of this morning before the sunshine and warmer temperatures there are still multiple sidewalks all throughout Town that are coated in a thick layer of ice. I myself fell last week while walking my dog. I’ve seen students on their way to school falling on the sidewalk and struggling to get down the street. The Town of Vienna has made a very significant investment in expanding our sidewalk network over the past few years and I feel that allowing those sidewalks to languish covered in ice for weeks on end goes against the values of trying to make this a walkable Town. I absolutely understand that not everyone can shovel their sidewalk, however there are multiple local businesses that offer snow removal. If cost is an issue, I understand the Community Center maintains a list of teens looking for service hours. If you consider requiring this, I certainly think that a letter to residents informing them of these available resources would be appropriate. I absolutely believe that builders should be required to shovel in front of their properties. This morning I saw two active sites that had not been shoveled. I shared these concerns with the TSC and they indicated plans for looking into it. I came tonght to share this with you so that you are aware others throughout the community are talking about this issue as well. Avril Garland, 917 Hillcrest Dr. I would like to add my support to what was just said about the sidewalks. Regarding the deer, I also support all that has been said earlier tonight. I volunteer at Southside Park and this fall we didn’t even ask for any plantings because the deer just eat whatever we put out. Mark Nulty, 417 East St., SE The deer problem is significant; they eat everything in the yard. I believe bow hunting should be implemented. It’s been very successful for Fairfax County. If we could relax the “no projectile” rule here is Vienna, then people could do this in the parks and on their private property. In addition, regarding snow shoveling, it’s tough when the ploughs throw all the snow up onto the sidewalk. It turns to ice immediately and is impossible to shovel. Matt DiFiore, 207 Owaissa Ct. SE The Service Request System. We’ve had this for several years now and it has recently become more functional. The problem is that when they are closed down, the response doesn’t tell us anything. The questions is, how does the Town use it? Is it periodically reviewed by the Town Manager? By Staff? If work orders are still open, why close the job out in the SRS? I’m concerned that work orders might be dropped. Council Agenda Items. The content isn’t as important as the context. So if there are changes in something, then citizens need to see the process, not just the end result. Work Session Acoustics. The acoustics for these sessions are terrible. It’s hit or miss on the recordings to whether you can hear what is discussed. Sidewalk Clearance. There’s lots of talk about this. The Town states it is a courtesy yet it also touts walkability. This should be required at least in the commercial areas and sidewalks that abut parks should be cleared by the Town. Mark Mabee, 904 Cooper Ct. SE. The past speakers brought up snow removal and I would like to comment. Walking up Park St. I see that the snowplow has pushed snow onto the sidewalk. I live at the end of a downhill cul de sac. The snowplow pushes all the snow downhill (in front of my house). The problem is that this is also where the street drain is located. So every night sheets of water run through the cul de sac toward the drain, and turn to ice. I ask that the Town not push the snow over the storm drains; it would be much safer for everyone. Reports/Presentations A. 25-4860 Proclamation for Vienna Youth Soccer Day Mayor Colbert read into the record a proclamation identifying January 17, 2025 as Vienna Youth Soccer Day. A. Report and Inquiries of Council Members Mayor Colbert opened the floor for Council comments. Council Member Baldwin stated that it was his honor to attend the Martin Luther King celebratory events at First Baptist Church of Vienna, January 20, 2025. Council Member Springsteen reported on the status of the Library project, indicating that bids will not likely be in until March 2025. This information will help Council determine the Towns cost share for the parking structure. He further reported that the SRS Vienna Connect System is very useful and works much better than a telephone call. B. Report of the Town Manager Town Manager Payton called on Police Chief Jim Morris to provide an update on the deer management program. Chief Morris indicated that the request is still with Fairfax County. An upcoming work session will address necessary code changes to allow for deer remediation in the Town as well as deterrence to resident feeding of deer. With respect to archery hunting, the Town will work with Fairfax County, who has the best program in the jurisdiction. Many Vienna parks are too small to hunt with bow due to restrictions related to distance from structures, etc. Once the Town begins working with Fairfax County, should the County believe there are areas where bow hunting can be conducted safely, a proposal will be brought before Council. Data on deer/automobile accidents available for the Town reveals roughly one per year. This number reflects police accident reports of the event. A more accurate number is available through the department of public works deer carcass pickup – approximately 40 per year. Town Attorney Briglia stressed that residents need to understand the difference between archery hunting and sharpshooting. Sharpshooting, in this instance, is not considered hunting, it is a remediation program not bound by the hunting season. It is a far more targeted program. Currently the delay with the County is due to the requirement of an Memorandum of Understanding. The State of Virginia carries a law that forbids feeding wildlife. If the Town receives a complaint, animal control is dispatched to investigate. If the problem continues, the Game Warden is sent as a follow-up. The current plan is to adopt the State code for Vienna. Town Manager Payton thanked Chief Morris for the information. Town Manager Payton introduced the new Director of Economic Development, Nichole Toulouse. Tony Mull, Director, Information Technology, introduced the new Deputy Director. Report of the Mayor Mayor Colbert reported that she has been appointed as the representative for all Towns on the Northern Virginia Transportation Authority. She stressed that Vienna continues to fight the passage of the Casino bill currently making its way through the state legislature. Finally, she noted that the local government day for Virginia Municipal League is scheduled for January 30, 2025. D. Proposals for Additional Items to the Agenda A motion was made to move Regular Agenda Item A. 25-4846 Amendment to Town Code Chapter 6, Section 6-33 Levy to Increase the Meals Tax Rate from 3% to 4% for a Period of 10 Year Period to precede Item 5. Public Hearings. Motion, Council Member Anderson; second, Council Member Springsteen. Motion carried unanimously. Absent, Council Member Allen. Council Member Baldwin noted his intent for a future agenda item entitled Draft Ordinance Concerning Images and Likenesses in Council Chambers. The goal is to adopt policy that aligns with the nature of Town government as set forth in the Town Charter. He requested time at the second meeting in February for discussion of the Item. E. Closed Session Report It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on January 27, 2025 at 6:30 PM in accordance with Virginia Code, Section 2.2-3711, a(1), for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to later this evening, Monday January 27, 2025 after the Regular meeting in accordance with Virginia Code, Section 2.2-3711, a(3) for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. Motion, Council Member Baldwin; second, Council Member Springsteen. Motion carried unanimously. Absent, Council Member Allen It was moved that Daniel Nash be recommended to the Fairfax County Circuit Court for reappointment to the Board of Zoning Appeals. And it was further moved that Brenda Burns be reappointed to the Town Business Liaison Committee for a two year term. Said term shall begin January 30, 2025 and expire January 30, 2027. Absent, Council Member Allen. This matter was approved 5. Public Hearings A. 25-4848 Public Hearing on the Necessity of Public Improvements within the Windover Heights Historic District adjacent to and/or on the property located at 348 Windover Avenue NW. Mayor Colbert called the public hearing to order at 8:30 PM. All Council Members were present with the exception of Council Member Ramakis, joining remotely and Council Member Allen, who was absent. Mayor Colbert called on David Levy, Director, Planning and Zoning, to present the Item for consideration. Director Levy introduced Andrea West, Zoning Administrator for the project. No previous meetings or work sessions have been held related to this property. However, the Town Council did consider the necessity for public improvements in Windover Heights at a public hearing held on March 18, 2024. Davis Chau, the applicant and owner of the property located at 348 Windover Avenue NW, is proposing to demolish the existing single-unit detached house and construct a new single-unit detached house in the RS-16, single-unit detached residential zoning district. On such projects throughout Vienna, Section 18-402, Frontage Improvements, requires the construction of certain public improvements. Within the Windover Heights Historic Overlay District (WHHD), however, per Town Code Sec. 18-237.2., the Town Council must decide whether such improvements are necessary, after having received a recommendation from the Windover Heights Board of Review (WHBR). In late 2023 and early 2024, the same process for review occurred in response to proposed redevelopment at 288 Windover Avenue NW. The WHBR recommended against the construction of the public improvements; and, in March 2024, the Town Council decided not to approve such construction. The property owner agreed to address stormwater on site at a level greater than what is normally required. Mayor Colbert opened the floor for comment from the public. Penny Oszak, 221 Nutley St. NW. I have no objection to the “no sidewalk” plan in the historic district. I am, however, disturbed about homeowners in the district building “parking bays” along the curb front. This becomes dangerous for bikers and walkers who are required to skirt the bays by moving into the street. I tried to find out what process has allowed these bays to be built, but now believe the homeowners just do this on their own. I don’t believe this is what you want for the historic district. Whether you approve sidewalks or not please don’t allow this to continue. Aldis Lusis, 446 Windover Ave. NW. I am a long Vienna resident and a proponent of sidewalks. I walk up and down the avenue three to four times each week. With current construction, it is especially treacherous. By skipping property haphazardly, we’re just kicking the problem down the road. Motion, Council Member Springsteen; second, Council Member Motion carried unanimously. Absent, Council Member Allen. The following includes a summary of discussion comments from Council: • Recommend discussing parking bays in a works session; • Parking bays initiated by homeowners; • Residents do not want curb and gutter but express concern about stormwater management; Stormwater management would be constructed where parking bays are located; • As this is Town property, Town has authority to regrade these shoulders and replace the sod; • If don’t want these parking bays to appear randomly throughout Town, this must be uniformly enforced; • Cannot allow these parking bays to continue, especially as the Town promotes the idyllic nature of this district; • Windover Heights Board of Review requested infrastructure vision from Staff; Vision statement would provide context for decision making around ad hoc parking strips or parking bays; • Must expedite creation of timeline for vision development so Council has framework for consideration of these issues; • Currently discussing ways to fund a community engaged process; • Overall policy should be discussed regarding pedestrian traffic on Windover Avenue; • No sidewalk engineering plan for the road under discussion so cannot require escrow for curb and gutter; If money were put in escrow for sidewalk, it would remain in escrow until Town made a determination that there was a necessity for a sidewalk. Mayor Colbert called for a motion on the Item. A motion was made move that public improvements are not necessary adjacent to 348 Windover Avenue NW, in association with the proposed redevelopment plan per the requirements of Town Code Section 18-402, Frontage Improvements, and that staff may approve a site plan without the standard street profile design. Motion, Council Member Anderson; second, Council Member Springsteen. An amendment was made to add the language “with the condition that all efforts shall first be made to preserve trees in the frontage of the lot.” Amendment, Council member Baldwin; second, Council Member Springsteen. Amendment carried unanimously and will be added to the original motion. Absent, Council Member Allen. Amended motion carried unanimously. Absent, Council Member Allen. A Council Member requested, for the record, that should frontage trees not be preserved, replacement with cedar trees be considered. Mayor Colbert called for a break at 8:55 PM. All Council were present with the exception of Council Member Ramakis, joining remotely and Council Member Allen, who was absent. Mayor Colbert called on David Levy, Director, Planning and Zoning and Andrea West Zoning Administrator, to present the Item. January 1, 2024, the adopted Chapter 18 of the Vienna Town Code became effective. During the code update process, certain topics were identified as "pinned" items that, for various reasons, would need to be addressed after the updated Chapter 18 was adopted. Staff met with the Town Council over several sessions from February through May 2024 to review the “pinned” items and receive guidance, including the priority of addressing the proposed edits. On October 7, 2024, Council reviewed a list of the identified highest priorities. Staff also proposed various Code language changes based upon the first nine months of code application. Mayor Colbert opened the floor for comment from the public. Cathrine Welch, 412 Knoll St., NW I am asking you to vote for the zoning updates, specifically Article 5B Section 18-561 that provides buffer for residents that abut land with community/public/institutional use. The only buffer we currently have is a six-foot privacy fence built by our homebuilder, and a handful of trees. Although our personal fence provides a partial site barrier, we have zero sound buffer. We hear all of the noise of the children playing outside, which all too often includes honest to goodness shrieking. Our dog is limited in time she can spend in the yard because the children’s noise agitates her. We routinely find soccer balls in our back yard as well. Our fence is inadequate to block outdoor lighting that Green Hedges leaves on overnight. I certainly don’t need further barriers to my sleep. Green Hedges is planning to submit yet another application for a CUP modification. I, as a resident, am asking that you please pass the zoning code tonight and make it effective immediately and for those accepted. Thank you. Aldis Lusis, 446 Windover Ave., NW I want to speak in support of the buffer zones Article 5B Section 18-561. Windover Avenue is a noisy place as is. We recently had a change in our environment. We found that what is effectively a buffer, the alley and the newly erected fence, isn’t much help in deterring the noise. It provides very little deterrent to the noise, leaving us with little by way of reasonable quality of life and back yard existence. I really do hope this legislation is passed and becomes part of any CUP going forward. Matt DiFiore, 207 Owaissa Ct. SE I submitted these comments earlier to Council. • I was unable to find a definition of an ALU [in the newly amended Chapter 18]; • Also missing is a definition for a gazebo; • Section 18-855 4.A includes a statement “However, the provisions of this section Town of Vienna Page 8 Printed on 5/21/2025 Town Council Meeting Meeting Minutes January 27, 2025 shall not apply to a licensed business which on June 26, 1970, was regularly engaged in business as an automobile dealer, salvage dealer or scrap processor.” This language should be eliminated, as there are no longer any such businesses in the Town. Zhang WenSong, 424 Knoll St. NW I am here to ask you to pass the new code update, specifically Section 18-561. My house is right next to Green Hedges School. We only have a link fence separating the playground from my home. We often have issues where balls and toys land in our yard and we are asked to retrieve them. We would like to ask the Town to help protect the peace and good relations with our neighbor. We ask you to pass the zoning code updates effective immediately. Harry Proctor, 245 Nutley St., NW I am here to request the same code section passage as those who have spoken before me. We also live next to Green Hedges. I am concerned about the noise but also the plans for two-way traffic, which may cause additional traffic and headlight problems. I would like to see this zoning code update adopted. Elizabeth DiFransisco, 434 Knoll St., NW Like my neighbors, I abut Green Hedges School. We would like to ask you to look at Article 5B Section 18-561; the table is missing that provides for buffers and fences for neighbors abutting community/public/institutional uses. Right now, we have a chain link fence on both sides of our property that abuts Green Hedges. We’ve installed slats to give ourselves privacy. We then added a second layer of buffering with windscreens. Finally, we added 15 feet of plantings on our side because the children throw rocks and sticks over the fence. Not including the table in the code is a detriment to the entire neighborhood. We reminded zoning staff on several occasions but it still slipped through the cracks. We also ask that when it is included that it become effective immediately. Green Hedges has an application in the works and should the chart not be in the code the neighbors are left with no recourse for privacy. Penny Oszak, 221 Nutley, NW I also own property that abuts Green Hedges School on two sides. I fortunately have a wood stockade fence but that does not block out the car lights (where a parking lot is proposed). We hear everything and have balls etc. coming over the fence. The Code does provide us with a measure of protection, so we urge you to pass this update. The table was inadvertently missed and we hope this will be included with passage. Item 13 Section 18-407 Swimming Pools and Outdoor Hot Tubs, which seeks to clarify regulations for interior lots and corner lots, was found to be unclear. Council requested that Staff return the Item for further discussion to include visuals. A motion was made to approve the amendments to Chapter 18 of the Town Code, as shown in Attachments 4 through 15, with the exception of Item 13 in Attachment 3 and to direct the Town Clerk to advertise the Notice of Intent to Adopt. Regular Business A. 25-4846 Amendment to Town Code Chapter 6, Section 6-33 Levy, to Increase the Meals Tax Rate from 3% to 4% for a Period of 10 Years Mayor Colbert reminded Council that a Work Session was held January 21, 2025 for additional discussion and consideration regarding the proposed Aquatics and Fitness Center. The outcome was a recommendation to defer vote on this item until August 25, 2025. A motion was made to defer Item A. 25-4846 Amendment to Town Code Chapter 6, Section 6-33 Levy, to Increase the Meals Tax Rate from 3% to 4% for a Period of 10 Years to the Town Council Meeting of August 25, 2025. Town Manager Payton noted that Staff is prepared to develop strategy for a capital campaign to support the Aquatics and Fitness Center project, if that is the wish of Council. The plan would be presented to Council by the end of March 2025. Following nonverbal approval to move forward, it was stated that Nichole Falceto, Deputy Director Parks and Recreation will take the lead. The request will provide for a partnership to allow First Baptist Church to staff the kickoff parade for Liberty Amendments Month 2025. Town Manager Payton thanked Dr. Vernon Walton, Pastor, First Baptist Church for his assistance with this event. He noted that efforts are under way to contact neighboring jurisdictions for involvement in the event.
