The Council asks that you keep your comments concise and positive. Creative criticism, presented with appropriate courtesy, is welcome. Each speaker will be allowed three minutes and a timer will notify you when your time is expired. Please begin your comments by stating and spelling your name and providing your city of residence. WORK SESSION AND ACTION ITEMS (as described) 1. Receive presentation from Nielsen, Merksamer, Parrinello, Gross 21-0593 & Leoni (NMPGL) on 2021 state legislative activity and approve 2022 State Legislative Platform for the City of Visalia. This item was pulled from the agenda and postponed to a date to be determined. 2. Receive the Annual Comprehensive Financial Report (ACFR) for 21-0657 the City of Visalia for the 2020-21 fiscal year. Renee Nagel, Finance Director, Kari Williams, Financial Analyst, and Jason Montgomery, Finance Manager presented the Financial Report for FY 20/21, July 1, 2020 through June 30, 2021. A motion was made by Council Member Greg Collins, seconded by Council Member Brett Taylor, to approve the annual comprehensive Financial Report for the 2020 fiscal year. Review of Annual Measure T Compliance Audit for fiscal year 21-0658 ending 6/30/21. Kari Williams, Financial Analyst, provided the Measure T Compliance audit report. A motion was made by Council Member Greg Collins, seconded by Council Member Brett Taylor, to approve the annual measure T compliance audit for fiscal year ending 6/30/21. The motion carried by the following vote: Aye: Steve Nelsen, Greg Collins, Brett Taylor Absent: Brian Poochigian, Liz Wynn 4. Review of Annual Measure N Compliance Audit for fiscal year 21-0659 ending 6/30/21. Kari Williams, Financial Analyst provided the overview of the Measure N compliance audit for fiscal year ending 6/20/21 and reviewed the current and future projects as listed in the staff report and presentation. A motion was made by Council Member Greg Collins, seconded by Council Member Brett Taylor, to approve the annual measure N compliance audit for fiscal year ending 6/30/21. Consideration and direction regarding an update to the Caltrans 21-0670 Lovers Lane Roadway Rehabilitation and Operational Improvements Project at State Route 198. Rebecca Keenan, Senior Civil Engineer, Frank Senteno, City Engineer, Hussein Senan, Cal Trans Project Management, provided the presentation for Council review and direction regarding the Cal Trans Lovers Lane Roadway Rehabilitation (along SR 216) and Operational Improvements at the State Route 198 Interchange. Presentation by representatives from the California Department 21-0677 of Transportation (Caltrans) for consideration and direction regarding Caltrans State Route 198 east bound offramp modification project at Watson Street/Noble Avenue. Frank Senteno, City Engineer, Eric Bons, Senior Civil Engineer, Hussein Senan, Cal Trans Project Management provided the Watson Street Operational Improvement Project presentation for the east bound off ramp at Watson Street/Noble Avenue project and requested Council to provide input regarding the proposed traffic modifications prior to Cal Trans finalizing the construction documents. No action required. CONSENT CALENDAR A motion was made by Council Member Brett Taylor, seconded by Council Member Greg Collins, to approve the Consent Calendar. There will be no separate discussion of these matters unless a request is made and then the item will be removed from the Consent Calendar to be discussed and voted upon by a separate motion . 1. Authorization to read ordinances by title only. 21-0496 This Consent Item was approved as recommended. 2. Authorize the City Manager to award RFP #20-21-49 Annual 21-0582 Community Forest Maintenance Contract to West Coast Arborist, Inc. of Fresno, CA in an amount not to exceed $1,000,000 per year to perform tree maintenance services per specifications of RFP #20-21-49. This Consent Item was approved as recommended. 3. Authorization for the City Manager to enter into a contract with 21-0652 Shape, Inc. of Pleasanton, Ca as a sole source vendor to purchase four (4) 25HP, 480volt 3-phase submersible pump and motors for the Airport lift station in the amount of $200,351.40, and appropriate the funds for payment from the Wastewater Treatment Plant fund (431). This Consent Item was approved as recommended. 4. Authorization for the City Manager to enter into a sole source 21-0660 contract with Telstar Instruments for upgrades to the Water Reclamation Facility (WRF) and Sewer Collections Supervisory Control and Data Acquisition (SCADA) system in the amount of $243,329.00 and an appropriation from the Wastewater Treatment Plant fund (431). This Consent Item was approved as recommended. 5. Authorize City Manager to execute Operations and Management 21-0663 Agreement of the Plaza Park Raceway with Morse Racing Promotion LLC for one (1) year. This Consent Item was approved as recommended. 6. Annual fee waiver request from Visalia Gadabouts to utilize the 21-0672 Visalia Senior Center for the purpose of providing programs and services for senior citizens. This Consent Item was approved as recommended. 7. Authorize the City Manager to award a contract for RFB 21-22-07 21-0673 Annual contract supply & delivery of mulch for a not to exceed the annual amount of $275,100.00 to Sierra Materials and Trucking Company of Merced, CA. Authorize the City Manager to award the construction contract for 21-0676 FY 18-19 SB1 Street Rehabilitation - Walnut & Murray (RFB 21-22-11), to Don Berry Construction, Inc. of Kingsburg, CA in the amount of $2,668,774.30 (CIP 3010-72000/CP0289-999 & 2370-72000/CP0402-999 ). This Consent Item was approved as recommended. 9. Authorize the annexation and amendment of Landscape and 21-0681 Lighting Assessment District (L&LD) No. 20-04, “Walnut Park Estates”; and ordering the improvements and levying the annual assessments for Landscape and Lighting Assessment District (L&LD) No. 20-04 “Walnut Park Estates”, a subdivision located on the north and south sides of West Hillsdale Avenue between North Marcin and North Preston Streets (Resolution Nos. 2022-01, 2022-02 required). This Consent Item was approved as recommended. 10. Authorize the City Manager to submit a grant application to the 21-0682 California Department of Transportation (Caltrans) for the Clean California Local Grant Program (CCLGP) Call for Projects. This Consent Item was approved as recommended. 11. Authorize the purchase of 11 LifePak 15 cardiac monitors and 21-0686 required accessories from Stryker Corporation for the amount of $331,944.99 as approved in the American Rescue Plan Act (ARPA) project fund (6420-72000/EQ0191-999). This Consent Item was approved as recommended. 12. Introduction and first reading of Ordinance No. 2022-02, 22-0001 authorizing four (4) individual four (4) year leases for hangar space in the newly completed four (4) unit Corporate Hangar at the Visalia Municipal Airport to Robin Martella, Rick Bissat, Juan Rodriquez, and Joe Dawkins for the purposes aircraft storage, at the rate of Twenty-One Thousand Dollars ($21,000) annually each. This Consent Item was approved as recommended. 13. Second reading and adoption of Ordinance No. 2021-11, 22-0002 authorizing the conditional 35-year lease of a parcel of approximately 65,000 sq feet of unimproved property at the Visalia Municipal Airport to Aircraft Mechanical Services (AMS) Inc for the purposes of a new aircraft maintenance facility, at the rate of Twenty-Eight Thousand and Eighty Dollars ($28,080) annually. This Consent Item was approved as recommended. Presentation of the proposed 2022 Citizens Advisory Committee 21-0690 (CAC) Annual Public Opinion Survey Frank Ruiz, Citizens Advisory Committee Chair, provided the 2022 Public Opinion Survey to the Council. Mark Wall, Citizens Advisory Committee member, requested clarification on the direction provided by Council. A motion was made by Council Member Brett Taylor, seconded by Council Member Greg Collins, to continue the item to a date to be determined. The motion carried 3-0 (Poochigian and Wynn Absent). Consider the extension of Ordinance No. 2021-10, an interim 21-0685 zoning ordinance adopted as an urgency measure to regulate the location of smoke shops and tobacco shops, Citywide. (4/5’s approval of the Council required for passage.) A Public Hearing to consider an appeal of the Planning 21-0687 Commission’s approval of Conditional Use Permit No. 2021-28, a request by Caldwell-Mooney Partners II, L.P. to allow a medical use within a portion of an existing 10,200 square foot multi-tenant commercial building. The new medical clinic will be approximately 6,526 square feet in area and will be located within the C-R (Regional Commercial) zone district. The project is located at 3221 South Mooney Boulevard (APN: 121-100-054). This item is continued to the February 7, 2022 Council meeting. A Public Hearing to consider an amendment to Conditional 21-0692 Zoning Agreement No. 2021-11: A request by CenterPoint Integrated Solutions to amend Conditional Zoning Agreement No. 2003-01, removing provisions that prohibit the establishment of a “stand-alone” used automobile sales use, and adding development standards for “stand-alone” used automobile sales uses for the Visalia Auto Plaza located within the C-S (Service Commercial) Zone. The Visalia Auto Plaza is located west of North Neeley Street, north of West Camp Drive, and south of the Mill Creek Ditch (APN: 081-020-085). This item is continued to the February 7, 2022 Council meeting. CLOSED SESSION REPORT 1.
