The Council asks that you keep your comments concise and positive. Creative criticism, presented with appropriate courtesy, is welcome. Each speaker will be allowed three minutes and a timer will notify you when your time is expired. Please begin your comments by stating and spelling your name and providing your city of residence. Harland Horton, Fresno, spoke regarding safe fireworks and fund raising. WORK SESSION AND ACTION ITEMS (as described) 1. New Employee Introductions: 22-0280 Transit Division: Roxanna Plasencia - Office Assistant Marla Bermudez - Community Outreach Coordinator Visalia Police Department: Dereck Esquibel, Police Officer David Gray, Police Officer Jose Almanza, Communications Operator Eva McClelland, Hourly Crime Lab Assistant Susanna Ferrer, Records Specialist Ashley Garibay, Records Specialist Ana Villalobos, Records Specialist Page 1 of 6 City Council Meeting Minutes - Final August 1, 2022 2. Receive the 2022 4th of July Illegal Fireworks Enforcement Detail 22-0298 Report presented by the Visalia Fire Department. Corbin Reed, Fire Marshal, provided the 2022 4th of July Illegal Fireworks Enforcement Detail Report. The citation amount for sales of illegal fireworks is $4000. No action required. 3. Council to receive a presentation on options and provide 22-0286 direction for the use of reallocation Community Development Block Grant (CDBG) Coronavirus Aid, Relief and Economic Security (CARES) Act (CDBG-CV) funds allocated to Visalia in the amount of $291,599. Melody Murch, Assistant Finance Director, provided the CDBG- CV Reallocation information. It is limited to working households for eligibility. A motion was made by Vice Mayor Brian Poochigian, seconded by Council Member Greg Collins, to approve as recommended. The motion carried by the following vote: Aye: Steve Nelsen, Brian Poochigian, Greg Collins, Brett Taylor, and Liz Wynn 4. Receive a staff presentation on the proposed local frontage road 22-0268 to be constructed with the Riggin Avenue Widening Project Mooney Blvd to Conyer Street. Diego Corvera, Engineering, provided the presentation on the proposed local frontage road to be constructed. Riggin Avenue is a designated truck route. The frontage road configuration consists of 11' to 12' lanes. The next steps are the public survey, public open house and potential return to city Council October 3, 2022. No action required. The Council asks that you keep your comments brief and positive. Creative criticism, presented with appropriate courtesy, is welcome. This is also the time for citizens to request an item from the Consent Calendar be pulled for discussion purposes. Public comments related to all pulled Consent Calendar items and Regular or Public Hearing items listed on the agenda will be heard at the time that item is discussed or when the Public Hearing is opened. Each speaker will be allowed three minutes, and a timer will notify you when your time is expired. Please begin your comments by stating and spelling your name and providing your city of residence. Brent Wynn, Visalia, spoke on behalf of the pickle ball community, Mr. Wynn has promoted beginner groups and he would like to have more pickle ball courts in Visalia. Rosalinda Alexander, Visalia, created an event and invited anyone to attend on October 22, 2022. CONSENT CALENDAR Consent Calendar items are considered routine and will be enacted in one motion. There will be no separate discussion of these matters unless a request is made and then the item will be removed from the Consent Calendar to be discussed and voted upon by a separate motion . A motion was made by Vice Mayor Poochigian, seconded by Council Member Taylor, to approve the Consent Calendar. The motion carried by the following vote: Aye: Steve Nelsen, Brian Poochigian, Greg Collins, Brett Taylor, and Liz Wynn 1. Authorization to read ordinances by title only. 22-0305 2. Authorize the City Manager to enter into a five (5) year 22-0237 maintenance contract with Motorola for dispatch radio consoles in the amount of $190,140. REGULAR ITEMS AND PUBLIC HEARINGS Page 3 of 6 City Council Meeting Minutes - Final August 1, 2022 Comments related to regular Items and Public Hearing Items are limited to three minutes per speaker, for a maximum of 30 minutes per item. The Mayor may reasonably limit or extend the public comment period to preserve the Council's interest in conducting efficient, orderly meetings. 1. Conduct the second and final hearing, adopt Resolution 22-0302 declaring results of majority protest proceedings and renewing the Visalia Tourism Marketing District. (Resolution 2022-47 required) Leslie Caviglia, City Manager, introduced Gina Reed with Civitas advisors, TMD is renewable at the end of 2022. Tonight is the final hearing. A motion was made by Vice Mayor Brian Poochigian, seconded by Council Member Brett Taylor, to approve as recommended. The motion carried by the following vote: Aye: Steve Nelsen, Brian Poochigian, Greg Collins, Brett Taylor, and Liz Wynn 2. Authorize the City Manager to award the construction contract for 22-0264 RFB 21-22-38, Fleet Maintenance Building Settlement Repair Project, to Caliber Contracting Services Inc. of Fresno, CA, in the amount of $198,225.00. Jaklin H Rowley, Assistant Engineer, provided the report and presentation to Council to request the construction contract for RFB 21-22-38. The polymer Injection System works by injecting the polymer to compact the dirt back to the compactness. The cost benefit analysis was conducted and it was determined this is the most cost effective. It is expected to last for the 30 years as guaranteed. A motion was made by Vice Mayor Brian Poochigian, seconded by Council Member Liz Wynn, to approve as recommended. A Public Hearing to consider the following actions pertaining to 22-0276 property located on the northeast corner of South Mooney Boulevard and West Meadow Avenue (Address: 914 South Mooney Boulevard), (APNs: 096-023-023 & 096-023-031): A) General Plan Amendment No. 2021-10, a request by Ming Lu Jin to change the land use designation of 5,196 square feet of a 15,261 square foot parcel from Low Density Residential (RLD) to Commercial Mixed Use (CMU). (Resolution No. 2022-46 required). B) Introduction of the first reading of Ordinance No. 2022-11 for Change of Zone No. 2021-12, a request by Ming Lu Jin to change the zoning designation of 5,196 square feet of a 15,261 square foot parcel from R-1-5 (Single-Family Residential, 5,000 square foot minimum site area) zone to C-MU (Commercial Mixed Use) zone. Josh Dan, Associate Planner, provided the report to council and requested to open a public hearing. The public hearing was opened and closed at 7:35 p.m. There were no public comments. A motion was made by Council Member Liz Wynn, seconded by Council Member Greg Collins, to approve as recommended. The motion carried by the following vote: Aye: Steve Nelsen, Brian Poochigian, Greg Collins, Brett Taylor, and Liz Wynn 4. Zoning Text Amendment No. 2022-01: A request by the City of 22-0293 Visalia to amend Visalia Municipal Code Chapter 17.56 (Historic Preservation District). Cristobal Carrillo, Associate Planner, introduced the Zoning Text Amendment. Paul Bernal, Community Development Director, explained the proposed ordinance changes to Council for the case of an increase. The public hearing was opened at 8:02 p.m. and closed at 8:07 p.m. The following citizens spoke to the item: David Farris and Walter Deissler A motion was made by Council Member Greg Collins, seconded by Vice Mayor Brian Poochigian, to approve as recommended. Zoning Text Amendment No. 2022-02: A request by the City of 22-0291 Visalia to amend the Local Register of Historic Structures, reclassifying 100 structures. Cristobal Carrillo, Associate Planner provided the Zoning Text Amendment regarding the amendment of the local register of historic structures, reclassifying 100 structures. A motion was made by Council Member Brett Taylor, seconded by Council Member Greg Collins, to approve as recommended.
