PRESENT: Mayor Steve Nelsen, Vice Mayor Brian Poochigian, Councilmember Greg Collins,
Councilmember Brett Taylor. ABSENT: Councilmember Liz Wynn
Government Code Section 54953(b) provides the rules of teleconferencing for City Council
meetings. Vice Mayor Brian Poochigian will participate in the November 21, 2022 Visalia City
Council meeting via teleconference. The address of the teleconference location is 5901 W.
Beech Ct., Visalia, Ca 93277. The public can attend and participate from the teleconference
location. *For the record, Vice Mayor Brian Poochigian was in attendance at the November
21, 2022 meeting.
CALL TO ORDER WORK SESSION - 4:00 PM
The meeting was called to order at 4:00 p.m.
PUBLIC COMMENTS
Citizens are now invited to comment on issues within the jurisdiction of the Visalia City
Council. The Council asks that you keep your comments concise and positive. Creative
criticism, presented with appropriate courtesy, is welcome.
Each speaker will be allowed three minutes and a timer will notify you when your time is
expired. Please begin your comments by stating and spelling your name and providing your
city of residence.
Bill Huott, Visalia, thanked Council Member Greg Collins for his years of service and
commented on volunteering to pick up trash to keep the city clean.
Jerry Williams, Visalia, also volunteers to pick up trash and helps his elderly neighbor by
keeping the sidewalk clear of debris.

1. Continue discussion on the Civic Center Phase II: Public Safety 22-0431
Office Building (PSOB), Police Services Building
(Evidence/Training/Crime Lab), and City Council Chambers
Project and consider providing further direction on building
orientation and placement.
Jim Wirick, LPA Design Studios provided a visual exercise for Council to see a
mock up of the building orientation and placement for the Civic Center Phase II:
Public Safety Office Building (PSOB), Police Services Building
(Evidence/Training/Crime Lab), and City Council Chambers.
A motion was made by Vice Mayor Brian Poochigian, seconded by Council
Member Brett Taylor, to proceed with the recommended changes discussed
during the visual exercise. The motion carried by the following vote:

within the jurisdiction of the Visalia City Council. The Council asks that you keep your

This is also the time for citizens to request an item from the Consent Calendar be pulled for
discussion purposes. Public comments related to all pulled Consent Calendar items and
Regular or Public Hearing items listed on the agenda will be heard at the time that item is
discussed or when the Public Hearing is opened.

Frank Ruiz, Chair of the Citizens Advisory Committee (CAC) requested a partnering of the
CAC with the Parks & Recreation Commission to organize a 2023 Earth Day event.
Irene Lapin, expressed concern regarding feral cats and the trap and release program not
being utilized enough to be effective. One reason is due to a shortage of veterinarians and the
existing veterinarians in the area charge $400 for sterilization.
CONSENT CALENDAR
Consent Calendar items are considered routine and will be enacted in one motion. There will
be no separate discussion of these matters unless a request is made and then the item will be
removed from the Consent Calendar to be discussed and voted upon by a separate motion .
A motion was made by Council Member Brett Taylor, seconded by Vice Mayor Brian
Poochigian, to approve all items on the Consent Calendar. No items were pulled for separate
discussion. The motion carried by the following vote:

1. Authorization to read ordinances by title only. 22-0154
2. Authorize the City Manager to award the construction contract for 22-0405
the widening of the intersection of Visalia Parkway Widening at
Mooney Boulevard to Avison Construction of Madera, CA in the
amount of $1,804,777. (CIP 3010-72000/CP0408-999).
3. Authorize the City Manager to award and enter into a contract 22-0411
with Mintier Harnish, planning consultants, for an amount not to
exceed $81,928, to prepare Zoning Ordinance Standards for
Accessory Dwelling Units and Planned Residential
Developments.

4. Request authorization to record the final map for Sequoia Bend, 22-0422
Unit 1 subdivision, located along the south side of East Goshen
Avenue between North Cain and North Virmargo Street (51 lots);
and also request authorization for the formation of Landscape
and Lighting Assessment District 22-06 and authorization for
ordering the improvements and levying the annual assessments
for Landscape and Lighting Assessment District No. 22-06.
(Resolution Nos. 2022-60 and 2022-61 required). APN:
098-142-057, and 098-330-006.
5. Authorization to accept the California Department of Alcoholic 22-0425
Beverage Control’s ABC-OTS Grant Program funded by The
Office of Traffic Safety (OTS) through the National Highway
Traffic Safety Administration (NHTSA) and authorize the Chief of
Police to execute and appropriate $30,000 in overtime
expenditures for details targeting alcohol-related crimes through
enforcement, education, and compliance checks with businesses
engaged in the sale of alcohol in the city of Visalia. In addition,
adopt Resolution 2022-62 for the administration of the grant.
6. Authorize the appropriation of $45,056 for FY 2022/23 and 22-0426
$34,922 for FY 2023/24 of the California Healthcare, Research,
and Prevention Tobacco Tax Act Grant award totaling $101,746.
The Grant is effective July1, 2021, through June 30, 2025.
7. Authorize City manager to award an annual janitorial supplies 22-0378
contract, not to exceed $185,500 annually, to Home Depot
Institutional. The City will piggy-back on the Omnia contract with
the University of California contract #2020002299.
8. Request by Councilmember Liz Wynn for Council to approve 22-0432
adding an agenda item for discussion regarding a formal policy
regarding short term rental properties in the City of Visalia.
9. Authorization for the Mayor to sign a letter to be sent to the 22-0433
appropriate State and Federal representatives and agencies in
support of Kaweah Health and their request for State support.

1. Public Hearing and Introduction to Ordinance Nos. 2022-14 and 22-0399
2022-15 for the 2022 Building and Fire Code adoption noting
significant changes in the 2022 Building and Fire Code and
discussing impacts upon the building community.
Jason Huckleberry, Assistant Community Development Director, provided an
overview of the 2022 Building Code noting significant changes and explained the
impact on the building community.
Every three years, the State adopts new codes (known collectively as the
California Building Standards Code) to establish uniform standards for the
construction and maintenance of buildings, electrical systems, plumbing
systems, mechanical systems, and fire and life safety systems.
Corbin Reed, Fire Marshal, provided the Fire Code portion of the 2022 Building
and Fire Code adoption with significant changes.
A motion was made by Vice Mayor Brian Poochigian, seconded by Council
Member Brett Taylor, to approve as recommended. The motion carried by the
following vote:

2. Public Hearing: Authorization to accept and appropriate $67,507 22-0392
for the 2022 Edward Byrne Memorial Justice Assistance Grant
(JAG) Program through the Bureau Justice Assistance (BJA);
approve the Memorandum of Understanding with Tulare County
for the Visalia Police Department JAG 2022 Joint Purchase
Program and appropriate $12,273 from the State COPS Fund for
the purchase of a replacement explosive ordinance disposal suit
for the Central Valley Regional Bomb Squad and crime lab
equipment for the Visalia Police Department.
Liz Ybarra, Financial Analyst, requested Council to conduct a public hearing for
the Edward Byrne Memorial Justice Assistance Grant (JAG) Program through
the Bureau Justice Assistance. The public hearing was opened at 8:09 p.m. and
closed. There were no public comments.
A motion was made by Council Member Brett Taylor, seconded by Vice Mayor
Brian Poochigian, to approve as recommended. The motion carried by the

3. Public Hearing (the second of two) to appropriate $4.3M of 22-0400
Measure N Funds and authorize the City Manager to execute an
agreement with Forcum/Mackey Construction Inc. of Ivanhoe, CA
in the amount of $5,670,000 for the Construction of Visalia Fire
Station No. 56 (No. 1410-72000/CP0346-999).
Jaklin Rowley, Assistant Project Manager, explained the need for the second
public hearing under the rules of Measure N and requested for Council to open
and conduct the second public hearing to authorize the $4.3M appropriation
from the Measure N funds. The public hearing was opened at 8:11 p.m. and
closed. There were no public comments.
A motion was made by Council Member Greg Collins, seconded by Council
Member Brett Taylor, to approve as recommended. The motion carried by the
following vote:

4. Public Employment (G.C. 54957) Title: Public Works Director 22-0427
Leslie Caviglia, City Manager, requested for Council to approve the selection of
Nicholas Bartsch as the new Public Works director.
A motion was made by Council Member Greg Collins, seconded by Vice Mayor
Brian Poochigian, to approve as recommended. The motion carried by the
following vote:
