MINUTES REGULAR TOWN COUNCIL MEETING VIVIAN TOWN HALL MEETING ROOM 112 W. ALABAMA AVE. VIVIAN, LOUISIANA MONDAY, JULY 10, 2023 6:00 P.M. CALL TO ORDER - Mayor Festavan called the meeting or order at 6:00 p.m. INVOCATION - Alderman Samuel Hodge opened the meeting in prayer. PLEDGE - Mayor Festavan led all present in the Pledge of Allegiance. ROLL CALL - VERIFICATION OF QUORUM - Board of Aldermen present for Roll Call were James Martin, Denise Alexander, Samuel Hodge, Raymond Williams, and Robert Green. Following Roll Call Mayor Festavan verified that a quorum was present. Also present were other elected officials and/or staff members: Ronnie Festavan - Mayor, and Douglas Dominick - Town Attorney. APPROVE AGENDA - Motion to approve the Agenda as presented was made by Robert Green, seconded by Raymond Williams; all approved. 1. PUBLIC COMMENTS - There were none. 2. MONTHLY FINANCIAL REPORT - Financial report including budget-to-actual comparisons was presented by Mayor Festavan. Following the report and discussion, motion to accept as presented was made by James Martin, seconded by Samuel Hodge; all approved. 3. APPROVAL OF MINUTES - Motion to approve the Minutes for 1) the June 12, 2023 Regular Council Meeting and the June 29, 2023 Special Called Meeting together in globo, as a unit, was made by Raymond Williams, seconded by Samuel Hodge; all approved. 4. THE BOARD OF ALDERMAN WILL CONSIDER THE ADOPTION OF RESOLUTION # 2 OF 2023 OF THE TOWN OF VIVIAN, LOUISIANA - A Resolution to authorize individuals to approve the adoption of plans and policies, and appointments and authorization of individuals for compliance with the LCDBG, Louisiana Community Development Block Grant, regulations/requirements. Motion to adopt Resolution # 2 of 2023 was made by Samuel Hodge, seconded by Raymond Williams; all approved. 5. THE BOARD OF ALDERMAN WILL CONSIDER THE ADOPTION OF RESOLUTION # 4 OF 2023 OF THE TOWN OF VIVIAN, LOUISIANA - A Resolution to authorize Mayor Ronnie Festavan and Police Chief Ryan Nelson to sign and execute a settlement and mutual release agreement between MPERS, the Municipal Police Employees Retirement System, and the Town of Vivian and to otherwise provide with respect thereto. Motion to adopt Resolution # 4 of 2023 was made by Raymond Williams, seconded by James Martin; all approved. ZONING, CONDEMNATION & CODE ENFORCEMENT MATTERS - A. FINAL CONDEMNATION HEARING(s) - - THE BOARD OF ALDERMEN WILL REVIEW THE FOLLOWING FOR FINAL CONDEMANTION: E/2 OF LOTS 2, 3 & 4, BLK 7, CHRISTIAN HTS. ADDN., VIVIAN. Caddo Parish, Louisiana geographical number 221626-120-0031-11, with a municipal address of 405 East Bailey St., Vivian, LA 71082. Page 1 of 2 Cont’d from Page 1 of 2: Zoning/Condemnation Officer Bobby Smith presented his report indicating that the owners had made progress and it was his recommendation that this matter be continued to review at the next Town Council Meeting. Motion to continue this matter for review at the August 14, 2023 regular Council Meeting was made by Denise Alexander, seconded by Raymond Williams; all approved. - THE BOARD OF ALDERMEN WILL REVIEW THE FOLLOWING FOR FINAL CONDEMANTION: 308 W. Moore St., Vivian, LA 71082. Zoning/Condemnation Officer Bobby Smith presented his report indicating that the owner had made significant improvements and that the ditch needed to be cleaned out. Chris Tems, owner, was present and indicated that he would clean the ditch out. A motion was then made by Denise Alexander and seconded by Robert Green to continue this matter for review until the next Town Council Meeting date on August 14, 2023. All members voted in favor. B. ZONING/CONDEMNATION REPORT - Zoning / Condemnation Officer Bobby Smith was present and provided a written and oral report to the Council and others present, then followed up with discussion on the addresses and violations included in the report: 1) 9384 Hosston Rd.. 2) 201 Edward Dr., 3) 121 Milner St.. 4) 213 E. Arkansas Ave. - Motion to place the property on the Condemnation list was made by Raymond Williams, seconded by Samuel Hodge; all approved. 5) 415 W. Kentucky Ave.. 6) 407 W. Nevada Ave. - Motion to REMOVE the property from the Condemnation list was made by Denise Alexander, seconded by Robert Green; all approved. 7) 800 S. Pardue St. - Motion to place the property on the Condemnation list was made by Denise Alexander, seconded by Raymond Williams; all approved. 8) 520 W. Georgia Ave. - Motion to place the property on the Condemnation list was made by Denise Alexander, seconded by Raymond Williams; all approved. 9) 425 S. Pecan St. - Motion to place the property on the Condemnation list was made by Denise Alexander, seconded by Raymond Williams; all approved. 10) 250 E. Texas Ave. - Motion to place the property on the Condemnation list was made by Denise Alexander, seconded by Raymond Williams; all approved. 11) 226 E. California Ave. - Motion to place the property on the Condemnation list was made by Denise Alexander, seconded by Raymond Williams; all approved. 12) 224 E. Missouri Ave. - Motion to place the property on the Condemnation list was made by Denise Alexander, seconded by James Martin; all approved. 13) 304 E. Oklahoma Ave. - Motion to place the property on the Condemnation list was made by Denise Alexander, seconded by Raymond Williams; all approved. C. CODE ENFORCEMENT REPORT - Code Enforcement Officer, Debra Ramage, was present to give her written and verbal report. She reported that for the period of January to June of 2023 a total of 51 Grass/weeds cases were opened and 42 closed, and a total of 60 Litter/debris cases were opened with 52 closed. Officer Ramage was asked about the status of 325 W. Arkansas Ave. and was also asked to check on the following 3 (three) properties: 1723 N. Pine St., 324 E. Alabama, and 9794 Upper State Line Rd.. MAYOR’S REPORT - Mayor Festavan gave a report on the following: 1) the plans for the new Police department/complex have been received. ANNOUNCEMENTS BY BOARD OF ALDERMEN - Robert Green asked if there was any further news on the swim complex. ADJOURN - Motion to adjourn was made by Robert Green, seconded by James Martin; all present, as Samuel Hodge left the meeting prior to the vote, approved.
