THE MOUNT WOLF BOROUGH COUNCIL MEETING DECEMBER 10, 2024 The Mount Wolf Borough conducted a meeting on Tuesday December 10, 2024. The meeting was called to order by President Darryl Main at 7pm. ATTENDANCE: The following Council Members were present: Pat Poet, Josh Parish, President Darryl Main, Vice President Dennis Naylor, Brian McKenna and Dan Schleig Officials: Mayor Maureen Starner, Attorney: Devon Myers, Engineer: Chris Owens, Treasurer: Jennifer Reiner, Secretary: Bonnie Bentzel ABSENT: Michael Barlett APPROVAL OF MINUTES AND AGENDA: A motion was made by: Dennis Naylor and seconded by: Pat Poet to approve minutes from November 12, 2024, Council meeting and November 26, 2024, Committee meeting. The motion was passed unanimously. A motion was made by: Dennis Naylor and seconded by: Dan Schleig to approve the agenda. The motion was passed unanimously. VISITORS: Allison Smith, Resident Ashley and Jeremy Spangler, Residents PUBLIC COMMENTS: Allison Smith and Jeremy Spangler presented to Council concerns and complaints with the Commonwealth Code. Both Allison Smith and Jeremy Spangler stated that they are trying to get a letter signed from a member of the Commonwealth Code that their insurance company is requesting, regarding the claim on their roof (which was damaged during the hailstorm over the summer). When the roof was being replaced, it was noticed by the roofers that the roof was “not up to code”. Plywood needed to be replaced for the roof to be “up to code”. Allison Smith and Jeremy Spangler stated that the insurance company will not pay for this until they provide a letter from the Commonwealth Code stating that this was a necessary repair. Jeremy Spangler did provide pictures (on his phone). Allison Smith and Jeremy Spangler stated that they spoke to Shane Topper at the Commonwealth Code, and he was unwilling to help the residents. The contractor called Pete Schilling at Commonwealth Code and Allison Smith stated that Pete Schilling hung up on the contractor. Mayor Starner agreed to send a letter to Erie Insurance Company regarding this matter and will forward a copy of the letter both to Allison Smith and Jeremy Spangler. ENGINEER’S REPORT: Chris Owens provided Council with a letter from Inch and Company. This letter is a third request for public improvement security reduction from Inch & Company dated November 25, 2024, for the above referenced Land Development Plan. Chris Owens will call and speak with Inch & Company that Council need more time to consider this request. This issue will be addressed at our January Council meeting. Chris Owens reported that the 2nd South Street Storm project proposal has been submitted for advertisement. Chris Owens reported that he will not longer be the Sewer Enforcement Officer for 2025. The new sewer enforcement officer will be Dylan Pruger as of January 1, 2025. SOLICITOR’S REPORT: Attorney Devon Myers reported open records policy has been updated. Resolution 2024-11 A resolution of Mount Wolf Borough, York County, Pennsylvania amending and restating policies and procedures relating to requests for public records and complying with open records law. A motion was made by Pat Poet and seconded Josh Parish to approve Resolution 2024-11. The motion was passed unanimously. Attorney Devon Myers reported that Barry Isett and Associates would like to add Floodplain services to our agreement with them. A motion was made by: Dan Schleig and seconded by: Dennis Naylor to approve the professional services agreement with Barry Isett and Associates to provide zoning enforcement services, rental inspection services, building code official administration services, Pennsylvania uniform construction code plan review and inspections and floodplain management service effective January 1, 2025. The motion was passed unanimously. Attorney Devon Myers asked if anyone contacted Commonwealth Code and informed them that as of December 31, 2024, at 11:59 pm they will no longer be the Building Inspectors for the Borough of Mount Wolf. President Darryl Main asked Bonnie Bentzel to compose this letter and send to Pete Schilling at Commonwealth Code. Attorney Devon Myers reported that a zoning hearing will be held on Wednesday January 15 th, 2025. ZONING OFFICER REPORT: Chris McDermott did not provide a zoning report. Bonnie Bentzel did email Chris McDermott for a report and Chris McDermott stated that he will send it tomorrow morning and Bonnie Bentzel will forward the report to all Council members. TREASURER’S REPORT: Payment of Bills ~ Report of Finances ~ Receipt of Payments A motion was made by: Josh Parish and seconded by: Dan Schleig to approve the Payment of Bills, Report of Finances and Receipt of Payments. The motion was passed unanimously. MAYOR’S REPORT: Mayor Starner reported she had a notice that the Borough was charged by the Police department regarding an abandoned vehicle on 6th street. Mayor Starner reported that the car has a flat tire and out of inspection. Mayor Starner reported that the vehicle is still located at the same location. The tire has been flat for 6 months and Mayor will let the Police know at the next Police meeting. Pat Poet asked Mayor Starner if Otterbein Church ever got a permit for the construction they are doing. Bonnie Bentzel stated that she did not see any permits come through the office for Otterbein Church. Mayor Starner stated that she did send an enforcement letter to Otterbein Church. Mayor Starner stated that she will reach out again to Otterbein Church. Mayor Starner reported that she did get a message from a resident through Facebook Messenger. The resident asked about the stray cats. A neighbor is feeding stray cats and she's tired of her dogs barking at the strays. The resident was wondering if there is anything that can be done regarding this matter. Attorney Devon Myers stated we can send a courtesy letter to the resident asking them to stop feeding the strays and if that does not work, the Borough will send an enforcement letter. President Darryl Main informed Mayor Starner to send the courtesy letter to the resident. STREETS REPORT: Dennis Naylor stated that he spoke with Deitz/Nauman and they stated that they are not sure when the Radar Signs will be placed. Dennis Naylor reported this will be the last week for leaf collection. Darryl Main reported that the Borough did get the street permit for north side of town from Columbia Gas. Mayor Starner reported that she got a follow up e-mail today regarding the road construction in the borough. Mayor Starner read the following email: “I know this is taking longer than we had originally anticipated we're trying to wrap it up as quickly as we can. I spoke Jason Loucks. Kinsley will be out today. Where we stand in completing the project Kinsley is working on services on N 3rd St. towards Chestnut Street. We are hoping this will be short term. Once the samples pass all the domain, will be put in service and then Kinsley should finish the last of the services. Account personal services council is going to have committed to address the trench lines and there would be approximately 4 to 5 that would need to be completed on those Streets, cuts will be patched just before Christmas or shortly after and the construction should be completed by the end of January.” PARKS AND RECREATION REPORT: Dan Schleig reported that he did a request from “NELL” for the baseball fields at Greiman Park. NELL is requesting to use the fields Monday thru Saturday. Attorney Devon Myers stated all baseball agreements to be sent to her for review. PROPERTY AND SERVICES REPORT: Brian McKenna reported that he had two companies come out and look at the borough building and roof. Both companies suggested to have the insurance adjustor to come out. Jennifer Reiner reported that she did reach out to the insurance company regarding this matter, and she will contact them again. A motion was made by: Dennis Naylor and seconded by: Pat Poet to authorize 2025 agreement with Klugh Animal control to provide Animal Control services in the Borough for 2025. The motion was passed unanimously. BUDGET AND FINANCE REPORT: Darryl Main reported that the borough has the 2025 budget is ready for approval. A motion was made by Josh Parish and seconded by Brian McKenna to approve the budget to be advertise. The motion was passed unanimously. A motion was made by Josh Parish and seconded Dan Schleig to authorize adoption of Resolution 2024- 9 Millage tax rate for both fire and property tax will stay at the same rate for 2025. The motion was passed unanimously. A motion was made by Josh Parish and seconded by Dennis Naylor to authorize adoption of Resolution 2024-10 to keep Hamiliton & Musser as independent auditor for 2025. The motion was passed unanimously. HEALTH AND SAFETY REPORT: Josh Parish reported that the units for Police Department are still coming down. Josh Parish reported that the Eagle Fire Company will be having their “Santa Run”. On December 21st the Eagle Fire Company will be hosting “Breakfast with Santa” and the Mount Wolf VFW will be making the breakfast. Josh Parish reported there was a fire on Holly Drive. This is not within the Borough limits, but Eagle Fire Company did response to the fire call. A special “Thank you to the Police and Fire Fighters” when they arrived, there was a resident still inside the burning building. The Police Officer went in and rescued the resident and the Fire Fighters from Eagle Fire Company went into the burning building and rescued the pets. Josh Parish reported that everyone is doing well. Josh Parish reported that the burn ban was lifted on November 27th, 2024. Mayor Starner reported that Chief Jacob Bush did step down as Fire Chief, but Mayor Starner was not sure who will be replacing him at this time. PERSONNEL REPORT: Pat Poet reported that she will meet with all employees to discuss employee salaries. Pat Poet reported that she will print off and provide Handbooks to the employees. PRESIDENT’S REPORT: No Report OLD BUSINESS: Darryl Main reminded all Council Members that the December Committee Meeting will be cancelled. A motion was made by: Josh Parish and seconded by: Pat Poet to authorize and adopt the 2025 Meeting schedule as advertised. The motion was passed unanimously. A motion was made by: Josh Parish and seconded by: Dan Schleig to authorize and adopt Resolution 2024-12 York County Hazard Mitigation Plan. The motion was passed unanimously. Darryl Main reported that the Maintenance Crew is ready for snow removal. NEW BUSINESS: No report A motion was made by: Josh Parish and seconded by Dan Schleig to adjourn the meeting. The motion was passed unanimously. The meeting was adjourned at: 9:15 pm The next Committee Meeting will be held on Tuesday December 24 has been cancelled. The next Council Meeting will be held on Tuesday January 14th @ 7 pm
