. Village of Walden Board of Trustees Regular Meeting August 21, 2018 Mayor Rumbold called the regular meeting of the Village of Walden Board of Trustees to order at 6:30pm. On roll call the following were: Present: Mayor Sue Rumbold Deputy Mayor Faith Moore Trustees Brian B. Sebring Larry Kraus John Ramos Dan Svarczkopf Lynn E. Thompson Absent: Also Present: John Revella, Village Manager Marisa Kraus, Deputy Clerk Dave Donovan, Village Attorney Manager Revella wanted to note a couple things before his report. One thing is The Village had an opportunity to get a second football trip, Jets vs Titans on December 15 th. At a discounted rate because we have the other, Jets vs Bills, in November. Not currently in the budget, but should easily break even. With permission from the board. Manager Revella added that he did get a letter of resignation from the clerk, effective yesterday and the attorney can discuss the implications of that for the board. Attorney Donovan explained that NYS Village Law 3-312 deals with filling of office vacancies, when those offices are filled by election or appointment. Vacancies in an office caused by other than expiration of term shall be filled by the mayor. So, its mayor’s appointment for the balance of the clerk’s term. Manager Revella said that at the next planning board meeting, there may be, if necessary an application regarding a potential retail site. Dean may waive depending on the interpretation of last approval, but if you know the area of Stewart’s and Subway, there’s another lot approved there. Village Manager’s Report  Had some CSEA negotiations and have some more coming up after Labor Day. August 21, 2018 1  .  Met with Mayor, Deputy Mayor and other Trustees regarding different department matters.  Summer camp went well. Concluded last week. There’s been some good use with different parks. There’s been discussion with the town regarding potential shared services with a couple different departments in the village. Will discuss later on the agenda.  Went through some litigation with the Special Counsel regarding insurance claims. Will go over that in executive session.  Went over audit and account balances with the Treasurer.  Covered for a couple different departments for vacations.  Meeting with PESH over potential trainings, discussed those with our insurance carrier.  Went over the consent order with the engineer and DEC. Met all the criteria, next step is being worked on now.  Minor issue on East Main St. with the syphons and that is one of the areas we are working on with the engineer and DEC to correct. There are back flow issues with grease in the lines.  So everyone is aware, the presentation for the vote for the county shared services is on Aug 28th.  National Night Out, our Village played a big role in making it a success.  We hosted the NYCOM Conference here. Different village officials from here and other areas came. The role of village officials and ethics were some of the topics.  Still going through the comp plan.  Have a minor committee review coming up next week and then a full review the first week in September.  Going through with DOT, the Ulster Ave project. Other issues coming up, have a meeting this week with the regional coordinator for the roads in the village, the sidewalk project, traffic signals and crossings. Trustee Ramos asked if the DOT can repaint the crosswalk lines near Wait St. Manager Revella said that they were supposed to do the painting when they did stop bars, but they didn’t. The person that is coming is in charge of that and that is definitely something will talk to him about because they didn’t do the one on Orchard St. either. Manager Revella wanted everyone to be aware of the letter that was sent to the Town of Montgomery regarding bridges on Hill St. and the lack of motivation to get those repaired. Did get a response today, from their counsel, that it’s on the top of their agenda to push forward and they have RFP’s for that project. Deputy Mayor Moore asked if there was any response from FEMA from the storm damage. Manager Revella replied no. Approval of July 17, 2018 Minutes Deputy Mayor Moore made a motion to approve the July 17, 2018 Minutes. Seconded by Trustee Ramos. All ayes. Motion carried. August 21, 2018 2  . Trustee’s Committee Reports Village Offices Liaison – Trustee Svarczkopf Trustee Svarczkopf reported that we applied for security grant and officially got in. Hopefully will receive $50,000 or so to upgrade server, Wi-Fi etc. Most of the taxes have been collected. Met with the office about moving the Clerk. Mayor Rumbold asked the timeline for the application. Village Treasurer Kelly said that mid-September they’d let them know for sure whether or not they have the grant. Town of Montgomery & Library Board liaison – Trustee Kraus Trustee Kraus reported that he talked to Ginny. Summer was busy with the kids with the reading programs. Had a bid go out for the children’s room, but nobody replied because it was so small of a project. She’s going to send it out again. September 5th is the first day of school, they’re going to host a Boo Hoo breakfast for the families. Planning and Zoning Boards as well as the Building Department Liaison – Trustee Thompson Trustee Thompson reported that our Code Enforcement Officer is still down from injury. Dean has been exceptionally busy trying to do his regular work and keeping up with what Jay usually does, especially mowing the lawns. Parks and Rec have been good reporting to Dean about certain properties and residents have been calling too. Vicki is anxious to start training the new secretary. Hoping to start interviews at the end of the month. Dean has sent out first batch of Fire & Safety letters. Didn’t think anyone has responded yet. Manager Revella said few people have responded. Some people weren’t aware even though received the prior letter from us in February and March. Trustee Lynn added that he still moving along with the fire safety inspections. He does have the paperwork but still has some questions about defining the difference between unoccupied and abandoned properties. As far as Dean knows, there are 8 properties involved. They still have plans for her to go to work with him just haven’t been able to coordinate. At the last Zoning Board meeting, there was some discussion but won’t go into detail because Becky Pearson will present when she is prepared. General conversation about working on our Comp Plan and there is some feelings that our zoning is a bit restrictive and now is a good time to review some of our codes. She had an opportunity to go to the Town of Montgomery with Trustee Kraus and met with Mr. Woznick, Highway Super Intendant. She had sent him an email with about 30 pictures about some issues on the Rail Trail and also brought up the Hill St. Bridge. It’s a contentious issue and there have been discussion about it even being repaired. She doesn’t know how the residents in Walden would feel about that and would like to invite him to a village board meeting and can address the board and the residents can come out and speak about how they feel about the bridge never being opened. Will see if he replies. Mr. Winchell is aware and is focusing on the bridge. Hopefully they are going to get a plan in place before end of year. August 21, 2018 3  . Mayor Rumbold asked Becky Pearson if she was prepared to address the zoning issue tonight since it was on the agenda. Becky Pearson said she can talk a little bit about it so the board had an overview, but she still wanted to talk to her board first to make sure they wanted to go in that direction, but doesn’t think there’s going to be an issue, but think something is necessary. She said she can go into the background of it if the board would like. Mayor Rumbold explained that she never got a formal request from her board to address it. She said the last time they spoke, she didn’t have a consensus from her board that it need to come there. Becky responded that her board meets after theirs, so she wouldn’t get it until the second meeting in September. Mayor Rumbold told her to send a formal request. And then asked if they were at an impasse with this issue. Becky answered no. The conversation came up because of what’s happening before the board right now and their attorney had mentioned ways to possibly rectify that and didn’t have the board discussion that night, but did have 2 board members from the village board there. The law was in 2002 and was done basically because people were not coming before the planning board and were getting site plan approvals and not going through the proper channels. Mayor Rumbold asked if she was going to be prepared to send a formal request to this board by our next board meeting. Becky replied yes, as long as her board chooses to do that. Mayor Rumbold explained that they spoke before and she was going to let her know when you wanted this on the agenda and apologized that it’s here prematurely but we’re not trying to circumvent them or jump the gun because one board member was afraid that we were circumventing the zoning board because they as a board haven’t even decided that they wanted it to come before us. Becky said they will have meeting on the 6th of September and will have it to the village before their next meeting. Mayor Rumbold said to send the request to the village manager or herself, that as the zoning board chair, she is making a request for the village to an issue about zoning. Mayor Rumbold requested Chairwoman Pearson to be put on the agenda for the next meeting. Police Department and Justice Department Liaison – Deputy Mayor Moore Deputy Mayor Moore reported that National Night Out was an outstanding success. Recognized Fred Perna and his team at DPW as well as the Parks and Rec Department and our Treasurer, Kelly Kelly, as she took on the task of taking in all the donations and paid all the bills as well as Police Officers, Sgt Werner and Officer Dudas, who took the August 21, 2018 4  . lead on that. Officer Montanaro and Officer Reynolds in capacity of other municipalities that they work for were all part of the unit to make it a huge success as well other people that sponsored and donated. Officer Kolvenbach is back to work. So, if you see him, please welcome him back. Officer Galeno recently finished his bicycle training. Officer Dudas is getting ready for his radar training. Sgt Herlihy will be doing breathalyzer instruction at the academy. Trustee Thompson and herself have been working with the Police Dept and the Building Dept to make sure that anything that is being reported as to conditions that the Police Officers are seeing. She know that there are still a couple of issues on Highland Ave and Sgt Werner is taking care of them. Reviewed the gas and mileage and they are good. Mayor Rumbold wanted to confirm that Officer Dudas would be able to do the course. Manager Revella said yes. Recreation & Parks Department and Valley Central School Board Liaison – Trustee Ramos Trustee Ramos reported that he will meet on Thursday with the school superintendent in preparation for the 2018-2019 school year. He would like to extend his congratulations to who is the new assistant principal in Walden. Parks and Rec had a fantastic year. 369 kids, 50 staff, no hiccups. Staff was phenomenal. Can’t thank them enough for their dedication ability to take on these children during the height of the heat when we had it. DPW Liaison– Trustee Sebring Trustee Sebring reported that he spoke with Fred on Friday. The guys did an outstanding job at National Night out, setting up stages and bringing the lights back and forth and help picking up the trash. As well as the Park and Rec guys. DPW did street sweeping, repair catch basins, sewer flushing’s. Some of the guys at DPW were working numerous jobs that were given to them. The Water Dept installed 19 meters. Mayor Rumbold spoke with Supervisor Winchell from the Town of Montgomery, also about Hill St. Bridge that Trustee Thompson spoke to Mr. Woznick about. She said that it seems Mr. Woznick is unaware of the agreement that the Town of Montgomery signed as far as their maintenance for the Rail Trail. She asked if they had a copy of it to forward it to both Mr. Winchell and Mr. Woznick to make him aware that they are indeed responsible for maintenance. Manager Revella believes that he might have email with Mr. Woznick attached to it as well. Mayor Rumbold added that the Hill St. Bridge, despite the letter that the Village Manager sent to the Town of Montgomery, Mr. Woznick is disputing the need to repair that bridge because he doesn’t feel that our citizens are negatively impacted because that bridge has been closed for years. She asked if Mr. Woznick lived in the Village of Walden. Manager Revella said no. He lives in Maybrook. Mayor Rumbold asked Trustee Thompson if he had looked at the bridge. August 21, 2018 5  . Trustee Thompson replied, not recently. She asked him if he had come over to look at the Rail Trail after she had sent him the 30 photographs of what she considered to be unacceptable repairs and he had not gone to look at it. Mayor Rumbold said she was not sure where Mr. Woznick came to the conclusion where our residents don’t need that bridge. She tried to address it with Supervisor Winchell. He did state it at the last town board meeting. Trustee Kraus added that Mr. Woznick said that there’s another way the residents can get in and out. That’s what he used as an excuse. Trustee Thompson also mentioned the business owners by Stewart’s, now that there’s potential for another business, he disputed also that that’s had any impact on their business. She told him that she didn’t think it had and she had talked to those people and it makes more congestion on Rt 52 because some people would use the other entrance/exit and they can’t do that. Mayor Rumbold said that at the board’s pleasure, it would be a good idea to send Mr. Woznick a personal invitation to come see the Village Manager and Trustee Thompson or Trustee Kraus to familiarize himself to the area and talk to residents who could tell him what that bridge means to them in that area. Trustee Thompson told him that said she’d check in with him in a week to see if he was accepting of our invitation. Mayor Rumbold said that maybe if they put it in writing, he would come and actually tour the area and find out why they are so insistent that the bridge be taken care of. Trustee Kraus added that Mr. Woznick also said that he doesn’t get some emails. He suggested to send it to clerk and then the clerk sends it to everyone. Manager Revella said we should send it officially to Clerk Stickles. Trustee Kraus stated that he’s just going by what he says. Trustee Thompson said that she would be happy to be to be the courier. Public Comment on Business of the Board Mary Ellen Matise said that Charlie Woznick is an elected official. Thing is he has to be treated like a resident. Village residents have to go to a town board meeting and put Charlie Woznick on the spot. He is only going to do what he wants to do. He does not follow the direction of the supervisor. The village residents need to take the bull by horns, people from Hill St, people from Sherman, people on Union, people on East Main St, people who are going to be effected by the development of the retail, even the retailers, they should all go to a town board meeting and put it on record. Sending emails to him means nothing. He’s an official and he only has to respond to the public. Trustee Kraus commented that he also said it’s his board and it’s not in the budget. August 21, 2018 6  . Mary Ellen said she knows. But if you’re looking towards next year’s budget, which starts Jan 1st and start preparing now. Manager Revella added that they have plenty of money. Mayor Rumbold said maybe he zones out and doesn’t remember getting the emails. Mary Ellen said that he’s his own boss and has his own secretary who handles his agenda for him. The thing to do is get it in the budget for next year and then he has to act on it. Trustee Kraus mentioned that he also said that there are so many other priorities. Mary Ellen commented on the zoning issue. She was not saying that she wants to give up her power. Their power is to identify the problem. This is the second major zoning issue that they have come across that seems to be a problem in our code. The zoning board has no power to change code. They’re identifying the problem as they see them. Mayor Rumbold said that their Chairwoman will bring it to the village board. She said she needed to speak to the attorney for clarification. It’s premature to talk about it unless the zoning board comes to them for help to rectify an issue. Also have the comp plan and these things need to be discussed there. She’s trying to follow protocol and not discuss an issue halfway, would rather discuss it thoroughly with all the information that they need. Mary Ellen said that’s why they had 2 village board members come to their meetings. Mayor Rumbold asked who invited the board members. Mary Ellen said that Trustee Thompson has been coming and she invited Trustee Svarczkopf. Trustee Svarczkopf disagreed and said that we’re the legislators and if we see an issue, he doesn’t see why they need to ask. Mayor Rumbold said because it’s the protocol. They can dig out the minutes, because we got in trouble with the planning board and zoning board for discussing things that aren’t level that they hadn’t asked them to do. Mary Ellen said that they have asked repeatedly for a tri-board meeting and have not had one. The tri-board meeting is the proper time to bring up different issues. They have asked for one in the past. Mayor Rumbold questioned who they asked. Mary Ellen replied that Chairwoman Pearson has asked in the past 2 years. Mayor Rumbold said that last discussion she remembers was liaison Hoffman who discussed it and there wasn’t anything that needed to be discussed. She said that she was not going to set up a tri-board meeting so they can sit and play cards. August 21, 2018 7  . Mary Ellen said that would have had 2 issues that they would have discussed at a tri-board meeting. Mayor Rumbold asked to what end. They are going to discuss it during comp plan. That’s when these issues come up. Mary Ellen said the comp plan will take longer. Mayor Rumbold wanted to hear from the chairperson about how many times that issue came up and is the applicant aware that they can come to the board and not even talk to the zoning board? Mary Ellen said that their board hasn’t made a decision. Mayor Rumbold said that she wanted them to discuss something that they haven’t made a decision on. Mary Ellen questioned what they are doing, are the tweaking this law for him and then tweak it for someone else. No, fix it and then its uniform or everybody. Mayor Rumbold said that that’s when the zoning board says that they’re at an impasse. We don’t want to tweak it or change it for 1 person. Make a presentation of the issue to the village board and make their case. It’s not up to the village board to make their case for them. Mary Ellen said that it’s up to them to make a case for themselves, if they see that it needs to be changed. Mayor Rumbold said that that’s why they listen to the presentation from the zoning board that will explain to them what the issue is. We don’t attend those meetings and that’s why the chairperson from their board comes to us with the issues they are having, the laws in question, how it’s been dealt with and they need the law changed and need the village board to act and help them do it. Mary Ellen said these things are going to play into the comp plan. She doesn’t want it to take 6 months for the nonconforming use. Not fair to resident. Mayor Rumbold said to make it their business at their next meeting. Make a presentation. Chairwoman can talk to counsel, speak to her own board to make sure this is the direction hey want to go into and if they refuse and they still feel that this needs to be done, the Village Board has all information from her, then the Village Board can act. Trustee Svarczkopf added that he thinks what she was saying was that they don’t have to wait for a request from their board. 2 legislators on the Village Board saw an issue to discuss and he feels like they are not discussing that issue because they’re waiting on a board that, in the end are not the legislators there, shouldn’t have to make a request for them to see an issue. Mayor Rumbold questioned how many times they have had this issue. August 21, 2018 8  . Trustee Svarczkopf didn’t think it matters. Mayor Rumbold said that we have changed laws because we didn’t wait and then had to change them again. Trustee Svarczkopf understands that and that’s why we should have the discussion. Even if it effects 2 of our residents, but they have to move out of the village because we can’t give them what they need. Doesn’t understand why we can’t have the discussion because we are there to help. Mayor Rumbold gets why he may not understand. Deputy Mayor Moore said that she wasn’t at that Zoning Board meeting because she went to the town board meeting pertaining to issues that are happening with the town and is relying on the Zoning Board to discuss their issues. Mary Ellen said that this is just public comment, this is not part of their agenda. She questioned why the map of the proposed 200 buses was in the packet. Manager Revella said she wanted it in the packet. Mayor Rumbold added that it’s “J, Outside Water/Sewer Discussion”. Mary Ellen said that she would never have thought that applied to the map. Becky Pearson questioned the letter from Rod Winchell for shared services with park and rec. Manager Revella said that it’s for discussion, “I” on the agenda. Becky said that she did see the bus survey. Wondered if the village had a traffic survey done. Manager Revella said that they have about half of them and almost double from last year. Becky thinks there should be a traffic study. Added that she didn’t see a plan for the Millspaugh Subdivision in the packet. Manager Revella said that has nothing to do with village board. It’s on the Planning Board’s agenda. There’s a request to have water wells as oppose to village water. Becky commented that if they’re allowed to have a well then she is going have a well in her backyard to bypass village water rates. If there’s no law, what’s the plan, how much usage, where’s it going to go, what’s going to happen? Manager Revella stated that in the law, it’s the village managers right to allow a well or not. Becky asked if they would read the law to her. Manager Revella said if they need to. August 21, 2018 9  . RJ Smith, East End Bus, said they have a contract with Valley Central and Wallkill School District. The bid was awarded last January, contract signed in February and started transporting students for summer school, July 1st. In those few short months had 150 buses, hired 200 staff, final some locations. This is 2nd generation in the business has about a thousand buses in multiple locations. In order to accommodate a facility with a shop for repairs, corporate offices, training center, driver’s lounge. Looking to improve the administrative facility, the driver and training center, the training is going on daily. The plan at the Amthor location is to bring the administration, training and corporate offices there, which are now over in Maybrook. The Amthor’s site is serviced by individual wells they have been tested and they work and have adequate supply. With the increase of employment, the septic can’t accommodate. With a commercial site like that, would be better to have ties into the sewer system. Asking the board for consideration to let East End Bus contract with the Village for sewer services as an outside user and will explore in the future water service. He added that the with the transition of 2 school districts, 150 brand new buses, most are propane powered buses, the smaller buses are gas powered. All buses have air conditioning, security, GPS. There was a little glitch with Valley Central in beginning with getting kids to school on time. Changes in the schedule were corrected and got worked out. Saved district money 7.5 million dollars. Would appreciate the board’s consideration to facilitate this. Action Items Resolution 8-18-19: Adopting a Standard Work Day for the Village of Walden Manager Revella explained for retirement purposes, have to set a standard work day. When newly elected officials come on, they do an analysis of how many hours they work so they can come up with what a standard work day is, so they know what to report to retirement. It’s only for elected and appointed officials. Trustee Svarczkopf asked that’s what got him at 6 hours min per day. Manager Revella said yes. Deputy Mayor Moore wanted clarification that it was only for elected and appointed officials. Manager Revella said that’s correct. Trustee Svarczkopf made the motion to approve the Resolution 8-18-19: Adopting a Standard Work Day for the Village of Walden. Seconded by Trustee Ramos. 6 ayes. 1 abstention (Mayor Rumbold). Motion carried. Introductory Local Law: Amending Section 291-3 (Weight Limits on Certain Streets) Attorney Donovan wanted to speak on 291-3 & 291-4 together. Some issues with overweight vehicles that were on some village streets. The original version of this local law may have just contained that street. Had subsequent conversations with the chief and the village manager and was discovered that the existing section 291-3, was not all inclusive. There should have been multiple other streets that should have been part of it. There is also 291-4, truck parking exclusion, should be a prohibition against parking on streets when there’s a weight limit. It was then morphed into making sure they had an all-inclusive August 21, 2018 10  . list for section 291-3 and then repeat that list in section 291-4. There are 118 streets that are going to have that parking prohibition as well as the weight prohibition. The amendment to 291-3 is the additional roads to the existing 291-3 and the 291-4 is the all- inclusive with all the 118 streets. Mayor Rumbold asked if he wanted the public hearings to be separate. Attorney Donovan said they’re different local laws so they should be separate. Just thought it would be easier to explain at the same time. He wanted to jump to 291-5. That was originally a discussion to allow exclusion for one truck to be parked, owned by the property owner, to be parked on the street. Chief has recommended against it. Didn’t think he needed the exclusion. Mayor Rumbold asked if the board was okay with deleting D. Deputy Mayor Moore said she was oaky with deleting D. There’s no change to it at this time. Manager Revella confirmed that it will remain as is. All agreed Mayor Rumbold stated that D is off agenda. Trustee Sebring said that 291-3 didn’t have Valley Ave. Attorney Donovan said 291-3 is an addition. Mayor Rumbold added that there are certain streets listed already on 291-3, Valley Ave is one of them. These are the additional streets. Valley Ave is in the original law, this is the amendment. Attorney Donovan commented that 3 and 4 will now be the same. There were hardly any streets in 291 – 3. Trustee Thompson wants to make sure the wording is correct on 291-3. It doesn’t say anything about village trucks but the other one does. Attorney Donovan said that 291-3 is in addition to the streets that are there. Trustee Sebring pointed out that it says Elberton St and Elberton Ln. Manager Revella said the existing code had some streets that were wrong and corrected some on the one code. Mayor Rumbold asked to vote on it and make sure the accuracy of the spelling is correct. Attorney Donovan said yes. Trustee Svarczkopf asked how big a 5 ton vehicle is and if a moving truck would be August 21, 2018 11  . included. Deputy Mayor Moore stated that’s when 291-5 would come in. Deputy Mayor Moore made a motion for Introductory Local Law: Amending Section 291-3 (Weight Limits on Certain Streets) for Public Hearing. Seconded by Trustee Ramos. 6 ayes. 1 abstentions (Trustee Svarczkopf). Motion carried. Introductory Local Law: Amending Section 291-4 (Weight Limits on Certain Streets) Deputy Mayor Moore made a motion for Introductory Local Law: Amending Section 291-4 (Weight Limits on Certain Streets) for Public Hearing. Seconded by Trustee Thompson. 6 ayes. 1 abstention (Trustee Svarczkopf) Motion carried. Introductory Local Law: Amending Sections 298-2 & 298-9 (Amending Water Code) Attorney Donovan said this modification comes out from the request of DPW Superintendent and Village Manager. He was advised that we’ve had some issues. Currently, the homeowner is responsible for the meter on the property to the curb stop. This would extend the obligation to the corporation stop at the main. So, if there’s a problem, the property owner is responsible from the meter to the main. The other thing is, sometimes, if there’s a leak or someone is working on the lateral, sometimes that repair can cause a leak between the curb and corporation stop. This would give the Superintendent, or designee, the authority to require both sections to be replaced. Mayor Rumbold asked if this was common with other municipalities. Attorney Donovan said in terms of the meter to corporation stop, yes. In terms of requiring other lengths of pipe, no. Trustee Svarczkopf questioned, isn’t it a smart thing to do, if you’re going to dig and replace one portion to just replace all of it? Attorney Donovan said that Fred would say yes. Trustee Sebring added that sometimes if the homeowner has to replace from the meter to the curb stop, you’ve disrupted village side of curb stop, which belongs to the village to repair, which should be the homeowner, because they stopped at the curb stop and disturbed the other side. Manager Revella added that it often causes a leak on the other side. Right now, we mandate that for sewer lines. The Village of Montgomery also requires the full length of water to be maintained by owner. Trustee Svarczkopf asked of any significant cost. Who pays for the paving? Manager Revella said it depends on who digs it up. Trustee Svarczkopf said that if now it’s his responsibility as a resident to replace that entire pipe, he is now going to pay for the replacement of the pavement. Manager Revella said yes. August 21, 2018 12  . Trustee Svarczkopf asked what the estimated costs would be. Manager Revella said depending on the contractor and the length of pipe, on average from $3500 to $6000 for replacement of the entire line. Most of the time if someone goes and does it, they pay the contractor to do the whole thing anyway. And when we touch it, we can’t go past it, we end up causing a problem for them sometimes because we can only touch from the main to the curb stop. When you put new lines in, the homeowner or whoever the builder is, has to put the entire line in as well. It’s not like its something new and going forward it’s a benefit. If it’s a problem with your line, you should fix it. Shouldn’t be bought by the village. Trustee Svarczkopf agrees with the benefit of it, but just wanted to know how much it was to then repave after. Manager Revella said sometimes right now, they’re digging to the curb stop, they’re going into the road, because sometimes the curb stop is in the road. It depends on the house. Some are in sidewalks, some are in the curbs, some are in the road. Mayor Rumbold asked if it ever worked the other way. If we do a repair in the road, does it effect the homeowner? Manager Revella said that it could. Trustee Sebring questioned if it would be to our advantage to put on the amendment the kind of fittings that the village requires. Attorney Donovan suggested reading the addition to section 298-9 because he has sent it to Fred for review, but there are some technical specifications in that paragraph. Trustee Sebring said that it should be on this, so it would have everything. Mayor Rumbold said that those 2 letters would be added to the original. Then when you look in the book, there it’s all going to be. All we’re doing is making the amendment, adding I and J. Becky Pearson asking to explain it again. Changing the whole thing to be homeowner’s responsibility? Manager Revella said yes. Becky asked if it’s the same with the sewer. Manager Revella replied that the sewer has been like that. Becky thinks, as a resident, the taxes should be paying for that. Manager Revella said the taxes don’t pay for water and sewer fees. Becky said exactly. She pays water and sewer and it should be paying to fix that pipe. August 21, 2018 13  . Manager Revella told her that it’s for fixing the main, not for fixing your own personal services. Deputy Mayor Moore made the motion for Introductory Local Law: Amending Sections 298-2 & 298-9 (Amending Water Code) for Public Hearing for September 4, 2018 at 6:30pm or as soon after as can be heard. Motion carried. Award Bid: DPW Grading & Paving Installation Manager Revella said that he doesn’t have a copy, it was emailed. They recommended the low bidder, Ward Paving. $126,460.00 Trustee Sebring made a motion to approve to Award Bid: DPW Grading & Paving Installation. Seconded by Trustee Ramos. All ayes. Motion carried. Surplus Items: Mayor Rumbold read the list of surplus items. *See attached list Trustee Svarczkopf asked if we had no use for them anymore. Manager Revella said that they work for some of the vehicles we do have but they don’t work for our purposes. For example, the air filled skid steer tires, they cause too much bounce in the machine while driving and using it, so they now have solid core tires. Trustee Sebring made a motion to approve to sell Surplus Items. Seconded by Deputy Mayor Moore. All ayes. Motion carried. Shared Services Discussion Manager Revella said that there was a discussion over a year due to a program the governor put out that tried to incentivize shared services amongst municipalities. Could be village to village, village to city, could be county wide. The 2 issues that were all agreed at committee level were potential with sharing with school districts or fire districts. We did reach out to the school and fire districts to see if there was anything we can do with them for shared services, for example, we could all buy paper together at a cheaper cost maybe and have a central location to purchase and redistribute and other things of that nature. The school district said they participated through the Boces representative that was there. But there wasn’t much substance to that. Radio system is going county wide. That will give radios to our emergency services. Other items some maybe useful to us and some may not. The Fleet wash in Town of Wallkill is too far for us to be much use. Some minor things that the Town and Village of Goshen are doing. GIS systems. He talked about the assessor’s office. The county was willing to take over assessments for the entire county and do assessment services including reevaluations and to save and eliminate funds from all the towns. Equipment. Grant writing, which the County would be willing to do. Several other things were discussed like dispatching. August 21, 2018 14  . Mayor Rumbold said she didn’t know exactly what the governor’s plan says, but once the county votes on the shared services, there are some that most can do together. Asked if there are penalties if you don’t participate. Manager Revella said no. You only get awarded for participating and showing savings. For example, say if the Village of Walden participated in a program, county wide, to do building dept permits. And it costs us $300k this year to do it, but because we do it through the county, it only cost us $150k. The State would match that savings and we split it. It doesn’t have to be county wide. Walden can do a plan with the Town of Montgomery, as requested by Rod Winchell for parks dept services. That can be part of the county wide plan to be submitted to the governor for that same program. He talked with the town supervisor about things that may work for us, like dispatching, finance dept. Whatever we think of to try and help. In the past we discussed the police dept as well. Not cut back on the level of services, but cut back on the cost of the services would be helpful. Trustee Thompson asked if something can be added later, if it isn’t on the initial list. Manager Revella said no. Once it goes before the legislature, that’s the list for the year. Next year can make a new list. Trustee Thompson questioned if we discussed with the other 2 villages, small things like paper, office supplies. Can we put that in for just our own Town of Montgomery area? Manager Revella said that we already share in with DPW shared service and mutual agreements with police dept’s equipment, etc. We all said that we are in favor doing that county wide. So, we can’t do it twice. Mayor Rumbold said the Meeting is 28th and she is going to go and vote. She asked the board if they are in favor of adopting the county plan that she cast her vote, yes. Trustee Sebring made a motion to approve Shared Services. Seconded by Trustee Ramos. All ayes. Motion carried. Outside Water/Sewer User Discussion Trustee Svarczkopf asked how much it would cost to tie into the village sewer. Manager Revella said that it would be their cost. John Lynch, owner and operator of East End Bus, said that it would be a total of 200 buses, including spares and field trip buses. The state consolidated both districts as one contract. Trustee Svarczkopf asked how many buses were in that site last year. John replied, close to 85. Trustee Svarczkopf stated that it would be more than doubling the traffic. John said that right now, both districts are split between Maybrook and Walden. August 21, 2018 15  . RJ Smith said that is subject to site plan approval, which they have to do to include traffic study through the town. Trustee Svarczkopf asked if we ever separated water sewer before. Manager Revella answered, yes. Trustee Svarczkopf knows that our sewer plant is already doing too much every day and is concerned about the increase of work. Attorney Donovan stated that the requirement to provide services outside of the village would need a form of analysis from the engineer to show the capacity to accommodate not only the new user, but also the village. Trustee Svarczkopf asked who would be doing that study and if they had to pay for it. Attorney Donovan said that it sounds more difficult than it is because you know what is available in the village and what it’s zoned for. The health department has pro forma, how many rooms, gallons per day or for what type of business. Then there’s going to be an analysis from the engineer. Trustee Svarczkopf questioned that since that hasn’t happened, they couldn’t make a decision even if they wanted to. Attorney Donovan said that if they have insufficient capacity then they can’t do it. Mayor Rumbold commented that they already know from the plans, for instance Kidd Farm, already had to reserve for that much capacity even though a shovel hasn’t been turned. The capacity is already figured in to what we already have. Even though it’s not operational, we have to save that. Manager Revella said that we can also say in favor or not in favor, pending analysis, cost etc. Trustee Svarczkopf asked if they were opposed to the idea 120 more buses, that’s not their place? Manager Revella answered, no. Mayor Rumbold added that they can raise an objection to the planning board, the Town of Montgomery. Let them know that they don’t want bus traffic in village and they can take it into consideration or not. Trustee Thompson was interested in something that Mary Ellen pointed out, infringing near the Tin Brook. Manager Revella said the argument leads him to favor hooking up to our sewer instead of having more septic in that area, potentially contaminating our water source. August 21, 2018 16  . Trustee Thompson asked if there was going to be some kind of environmental study done. Attorney Donovan said that in front of the Town of Montgomery Planning Board, there has to be some sort of review. Mayor Rumbold questioned if it’s ever been discussed to have that property annexed into village. Manager Revella wasn’t sure if it came up in their discussion. Trustee Svarczkopf asked if they have properties like this that purchase water and sewer. Manager Revella said that they have properties that just purchase water, not sewer. There are numerous homes on High Meadows, first house on River Rd, 2 houses on 52. Added that 151 Coldenham Rd has a drive way in the village and has village rates. Deputy Mayor Moore asked about the total number of employees would be at that location. John Lynch said probably 225. Deputy Mayor Moore questioned if they would be here longer with the driver’s lounge and more area for them to be, even though they are split between locations. John Lynch replied that they would not be there longer but will be allowed to go. A lot of them have mid-day jobs, Boces runs, so they’ll be in and out, but need a place to check in. Deputy Mayor Moore wanted to confirm that this particular location was for them to work on buses or to pick them up and leave. John Lynch said that there is a small lounge now there now. There is a mechanic and driver’s there, dispatcher there that do have water/sewer. Trustee Ramos asked how many buses are slated for Wallkill. John Lynch said about 80 right now. Looking at a good portion of that being Wallkill and another 10 for Valley Central. Most of Valley Central routes come out of Maybrook. Trustee Ramos questioned if they explored any Wallkill sites. RJ Smith said they have but will say that over 50 years, Valley Central operation has been Wallkill. Trustee Ramos asked about capacity criteria. Attorney Donovan said sufficient capacity and the plan for build out. Trustee Sebring questioned about the building that faces 52, where the different businesses are, are they going to own whole property. August 21, 2018 17  . John Lynch said that they were discussions and negotiations about it with Amthor, but right now, there are tenants in there and if they don’t get sewer then it will be a dead issue. RJ Smith added that the tenants won’t be displaced, there’s a building in the back that’s occupied right now, where the shop was, they moved out and East End moved in. There’s another building that’s vacant and would be renovated into offices. The intention is to be by tire shop. It is an employment generator that operates at full capacity 180 days a year. The rest of the time it’s employees in office and shop. Only traffic during summer is for school trips. Trustee Sebring asked how many bays in the repair shop. John Lynch said there would 7 and 2 on the back to fit the bigger buses. Trustee Sebring commented that that has water and sewer in there. John Lynch said if they include the buses from Maybrook, the cesspool won’t hold capacity. RJ Smith said some other business can go in there and be objectionable because of what they do is permitted in the zoning and be a threat to the environment and Tin Brook, but if they tie into the sewer, DOT is there on a weekly basis with inspectors, not only for the buses but for the operation itself. Has permits with the DEC, DOT, Dept of Education. Trustee Sebring asked how far back on the south side of property that abuts Amthors would they own. John Lynch said they would buy the whole thing, 9 acres, which go right up to the park. Trustee Ramos asked about the existing septic system capacity. John Lynch said he didn’t know, it’s been there for years. RJ Smith added that he knows where it is, but don’t know the degree or the size of the tanks. Was installed and repaired and added to as the business grew. Trustee Ramos asked what they are going to do with the existing system, with the possibility of this event happening. RJ Smith said everything will be disconnected and shut down. Trustee Ramos wanted to be assured that DEC will inspect it, claim it dissolved. John Lynch said that’s the intent. Trustee Sebring asked about the small pond. RJ Smith said it drains from the pond and over to the Tin Brook. August 21, 2018 18  . Trustee Sebring stated that he would like to see study done first to see what sewer capacity is left in the village. Trustee Svarczkopf asked they can change the amount for outside rates. Manager Revella said that they can modify by contract. Trustee Svarczkopf stated that he doesn’t want to pay for the study. Attorney Donovan said that they can indicate to the applicant that any cost associated with that would be theirs. RJ Smith assumed that the village engineer knows the capacity of the plant and what excess capacity there is. They know they are probably at about 3000 gallons a day. Can’t redo septic. Heavy ground. Not sand or gravel. Trustee Sebring asked if they had any comments from the neighbor from the Town of Montgomery. John Lynch said not yet. Trustee Sebring said that they fought to stop Amthor from putting a bigger building in and they won. John Lynch said that they had discussions with the town. They’re there, existing and zoned. RJ Smith added that if they get tripped up, they’ll go elsewhere. Deputy Mayor Moore asked the Village Attorney what their options were. Attorney Donovan said that they can do nothing and think about it or they can elect to move forward with some analysis from the engineer in regards to the capacity with an agreement from the applicant that they will pay for the work. Manager Revella added subject to attorney’s negotiation review of the contract for service. Trustee Svarczkopf would like a study done before vote. Trustee Kraus agrees. Trustee Thompson would like to proceed with investigating further. Thinks there’s decent opportunity for the village, but understands all the concerns. Trustee Ramos agrees. Thinks it’s a win, especially for the school district and the kids, but have to keep close ties on what they’re analyzing and the reports are forthcoming and accurate and no ambiguity. Does agree with the studies, the DEC and attorney’s review of the package. August 21, 2018 19  . Trustee Sebring would like the study done for the sewer capacity and a study done for the number of buses coming through Walden. RJ Smith said the traffic study would be done concurrent with the town review. Can’t proceed with that if they don’t have sewer. Deputy Mayor Moore asked how long it would take to have a conversation with the engineer to find out the capacity. Manager Revella said tomorrow. There would be a contractual agreement with the outside user. Would have to draw a contract up, review it and make sure it’s in their best interest. Attorney Donovan said that in the past is that if they’re satisfied with sufficient capacity, and then adopt a resolution and they indicate that they are willing to provide the service at cost. Then take that to the Town of Montgomery Planning Board, get their site plan approvals. If they don’t get approval, they’re not going to buy sewer from the village. Trustee Svarczkopf confirmed that the board can’t write that up until the next board meeting. Manager Revella asked what their time frame was. RJ Smith would like to be in there September 1st. But are working with the town, workshops, working on the plans and were told not to go into full design until they resolved the sewer issue. Trustee Sebring asked why the process wasn’t started earlier. RJ Smith said they started last year. Trustee Sebring responded that it just came on the Town of Montgomery agenda now. RJ Smith said they were just negotiating to expand at this location. John Lynch is negotiating to buy the entire site and will renovate and rejuvenate the whole site and invest a lot of money there. Manager Revella informed them that the next Village Board meeting is September 4th, which is before the town board meeting. 161 Millspaugh Court Subdivision Discussion Manager Revella said he wanted to let the board know that he was approached to allow a 3 lot subdivision to have wells. He doesn’t want to and is telling them no. Just wanted to let the board know that he’s telling them no, if they have any reason why he shouldn’t say no. They are extending the sewer main down with some minor pumps that we will not be responsible for. We will be responsible for minor extension of the sewer main from manhole to manhole. Doesn’t see a need to have wells there. Mayor Rumbold asked who made the request. August 21, 2018 20  . Manager Revella said the developer. Their logic was because of the distance from current water main. If there’s no point from the board to say otherwise, he’s going to continue with the way he was already going to respond. The other concern was that local law allows the village manager to waive that anyway and doesn’t think it’s appropriate and might want to consider a change. Trustee Sebring mentioned that when he sat on the planning board, they had an applicant to put houses there. They were supposed to go back to the health dept, but never did. So, the project was dropped because of non-participation. He added that with wanting free wells, his vote is no. Mayor Rumbold questioned if the cost is the factor. Does he think it’s going to cost less to drill 3 wells? Manager Revella said yes. It may be an issue with dept of health standards as well. Trustee Svarczkopf asked if it should go in front of the Planning Board. Manager Revella answered, no. To waive someone’s requirement to be tied to the village water system should be the board’s decision, not the manager’s decision. Mayor Rumbold said to continue to say no and then we can change the law. Deputy Mayor Moore asked what the local law number was. Attorney Donovan said 298-36. Trustee Svarczkopf asked if he was making that decision now. Manager Revella said that he has to. Set Second Football Trip – Jets vs Titans on December 15, 2018 Manager Revella asked if it was ok to do the second football trip. Mayor Rumbold said she doesn’t see why not. We got the tickets at a discount. Manager Revella stated that 16 break’s even. Deputy Mayor Moore asked how many seats were on the bus. Manager Revella said 55 seats. Trustee Ramos made a motion to approve the second football trip on December 15 th, 2018. Seconded by Trustee Thompson. All ayes. Motion carried. Trustee Svarczcopf wasn’t sure we discussed “L”. He said it was discussed in public comment. Mayor Rumbold said we also discussed it when Trustee Thompson made her report. August 21, 2018 21  . Trustee Svarczkopf understands that but everything else on the agenda gets a talking point and here it’s one of those public gets to speak, no one else does and we skip over it. Deputy Mayor Moore asked who is making the presentation, is it Trustee Thompson as the liaison? Is it the Chairwoman of the Zoning Board? Is it you? Who is bringing something to us to discuss? Trustee Svarczkopf said he is making the request for it to come up for us to discuss. Mayor Rumbold added that Chairwoman Pearson is on the agenda for next meeting. She’s going to get a consensus from her board to bring it here. If she doesn’t get a consensus, she can still come and explain to us what issues they’ve been having, why she believes that it needs to come here. And then this board can decide to change or get more information. Trustee Svarczkopf wanted it on public record that he doesn’t feel it was given the consideration that every other thing on this agenda gets. Mayor Rumbold said that we discussed your issue 3 times tonight. Discussed it when Trustee Thompson gave her report, during public comment and just discussed it again. Your issue got more consideration than any of the other items. Trustee Svarczkopf disagrees. Public Comment Anita Vandermark, 76 Highland Ave, asked if we were doing anything for 9-11 this year. Manager Revella said that the board had decided to do it at 5 year anniversaries, so it will be 2021. Anita mentioned that 26 Highland has been a lot of furniture and garbage that has been put out. It’s almost blocking sidewalk. Deputy Mayor Moore asked if it was still out today Manager Revella answered, yes. He received a call today about it. Anita added that it’s very unsightly. It seems to be growing. Manager Revella commented that it’s growing for a good reason. He said that they will address that and get rid of it. Anita said that the senior citizens can’t use firehouse for a couple months. They will try to utilize Wooster for that purpose. Mary Ellen, 54 Gladstone, commented that in the future, when making the agenda, if this said, Amthor User Discussion - East End Buses, that would have given some information for the public. August 21, 2018 22  . Manager Revella said that there was supposed to be another paper that didn’t make the packet. Mary Ellen asked if they use water to wash the buses. Because her comment is that maybe we should also sell them water. We’ll sell water at twice the rate and that’ll help offset the cost of sewer. It’s just a way to offset the cost of sewer. Manager Revella said that the one positive thing is they would have to extend the main. But there are other factors to consider. Mary Ellen commented on the parking limits on certain streets, who’s going to weigh the vehicles? Manager Revella told her that we have 2 cops that know commercial vehicle traffic laws and are able to determine weight. They can look up the vehicle registration as well. Becky Pearson, 167 Walnut St, asked about the Amthor property and where the employees are going to park. There’s 200 employees, is there room for them to park? She knows it’s part of the Planning Board site plan. It’s not just the buses traffic studies. Mayor Rumbold wanted her to know that we have written numerous letters to the Town of Montgomery about different issues and most of the time, they don’t even enter the letter into minutes. Everything is in the hands of their Planning Board. We are going to send them correspondence with any issues that we have with this project. Manager Revella mentioned that she will be at next meeting. The first meeting in September. Mayor Rumbold added that of us will be there. Becky said she’s thinking of the 200 more cars and where they’re parking and more exhaust. And if you allow that, what precedent does it set for the property across the street that’s slated for development? Do you then have to allow water and sewer to them? Manager Revella said it’s case by case. Mayor Rumbold added that you have to do that because of your capacity. We could allow this project, given all the numbers that we have, we may not be able to entertain anyone else, because we are at our capacity. It has to be case by case. Trustee Sebring mentioned that they wanted to have streets from the village into the town and was turned down. When they did Watkins property, the village side of that acreage, they gave a deal. So, no building is going to happen behind Dean’s house and those other houses. Manager Revella said the village owns a portion of that property. Conservation easement. Becky is just thinking about the future. Once one thing sets into another. It’s not just for today, it’s for our future and what we want we want it to look like. August 21, 2018 23  . Mayor Rumbold said that’s why the comp plan is important. Becky asked how the introductory laws come before the board as a law without any discussion. She has talked about it many times. Manager Revella said that it doesn’t cost anything to have it done. Becky thinks the procedure is wrong. This board is here to make those decisions, that’s your job, your role. Not to say the manager wants to put a law in and gives it to the attorney to write and it’s done. That’s not how it goes. Manager Revella said yes. He can do it. The board can review it and do what they want with it. Mayor Rumbold said that’s how we get it on the agenda to discuss it. Becky said you already have a law before you discussed anything. Mayor Rumbold added that we have a law already on the books and we’re talking about an amendment to an existing law. Becky asked where the discussion was to amend the law to what you wanted it to be. Mayor Rumbold replied, tonight. Had it on the agenda to discuss. Becky said yes and you already had a law written. Mayor Rumbold that’s to show you what it would look like. And the board can say they don’t want to amend the law after they discuss it. Becky asked if the place at Amthors would be a brownfield. Manager Revella said no. He has personally seen to phase 3 on the environmental report. Trustee Thompson questioned what a brown field is. Becky said is a piece of property that had lots of chemicals. Manager Revella said the DEC went through phase 3. They looked at the whole property, 3-4 years ago and isn’t sure what’s been done since then. Becky asked where we are at with the house on Scofield St with the porch that’s ripped off. Manager Revella said the owner has an open permit. Unfortunately, he’s allowed to sit there for a while. Becky added that should be another thing to look at, because those open permits can sit there forever. Payment of the Audited Bills August 21, 2018 24  . Deputy Mayor Moore made a motion to pay the audited bills. Seconded by Trustee Thompson. All ayes. Motion carried. Correspondence Trustee Thompson mentioned the trip she took to Potsdam. The people they discussed the fluoride with were very grateful for our input and they say thank you and we are welcome to return to their village at any time. Trustee Svarczkopf said he got an email from an app developer about a recycling app for Walden. Where they can weigh cans and drop them off and get money for them. Miscellaneous Comments from the Board of Trustees Trustee Thompson said she had 3 residents ask her why Main St, especially West Main St, has an over growth of weeds coming up along the curb and sidewalks. Second person complained about the same problem on South Montgomery. And the other person was complaining about things on streets throughout the village, Walnut St was one. She told her that there’s a spray schedule but wasn’t sure when that was. Manager Revella said that the homeowner’s are responsible to do that as well on their sidewalks. Trustee Thompson said that to one of them. They did not know that. Maybe at some point we can put that on the village calendar, like some other things. People are complaining it’s bad. Mayor Rumbold said that the spray that we use are non-toxic. Trustee Thompson suggested maybe a discussion with one of the agencies for an alternative product. Manager Revella said that we have a licensed DEC sprayer on staff. We can inquire. Trustee Svarczkopf asked if the Code Enforcement Officer out? Mayor Rumbold said he’s still injured. Manager Revella said they have people that reports to Dean. Trustee Thompson commented about how often we consider change services that we received. The elevator in this building is disgusting. Is there any way to put a small bulletin board in elevator, so we’re not taping things inside the elevator? Mayor Rumbold said that we had one and it was in chunks on the floor. Deputy Mayor Moore wanted to publicly say that the Student Youth Employment Program had their graduation. And thanked Tara Bliss for her volunteer efforts and program. September 1st is the 22k Walk. The family BBQ to raise money for Sophia. Sept 21st is the RDAC hosting. Areas on Main St. all the way down to South Montgomery will be incorporated in that. Wanted to publicly say that residents in that area are receiving letters August 21, 2018 25  . from Orange County Rural Development, please respond, it’s not a scam. We really are willing to help you assist with work outside your house pull weeds, doing mulch, painting your porch. Is willing to take any volunteers to come help for the day. Walden Community Council pot luck dinner was great. In reviewing the budget lines, where we are for June and July, had some conversations with the department heads today and will continue with liaisons as well. Trustee Ramos commented that he’s sorry he won’t be here for the 22k. The camp picnic was a huge success. Had over 350 people. Some of the candidates decided to stop by. Supervisor Winchell was there. It was very well attended and the kids had a blast. Manager Revella said they had the Back Pack Giveaway. Over 500 back packs were given away. Mayor wanted to make it clear that we are going to send a letter to the town planning board, if this board decides if we have issues. Manager Revella said yes. Mayor Rumbold asked if they did a traffic study when they allowed the company to go to Amthor’s to begin with. Manager Revella said that he doesn’t recall but believes they did consider it at the time before they went to that use and found that they were permitted for a certain number of vehicles without any study. Mayor Rumbold added that Walden hosted a NYCOM meeting. It was really successful. Had finger foods for the participants. It was good meeting. She thanked Trustee Thompson for getting them to come here, it was really an honor to have them here and they want to come back to the Village of Walden. National Night Out was great. Had a little rain, but once that cleared, everyone had a good time. The Village of Walden did take a lead role in getting that done. We’re going over finances to see how that worked out and make adjustments if we need to.
