. Village of Walden Board of Trustees Regular Meeting October 2, 2018 Mayor Rumbold called the regular meeting of the Village of Walden Board of Trustees to order at 6:30pm. On roll call the following were: Present: Mayor Sue Rumbold Deputy Mayor Faith Moore Trustees Brian B. Sebring Larry Kraus John Ramos Dan Svarczkopf Lynn E. Thompson Absent: Also Present: John Revella, Village Manager Marisa Kraus, Deputy Clerk Dave Donovan, Village Attorney Mayor Rumbold wished Trustee Ramos a happy birthday. Manager Revella introduced new full time Officer Rios. Village Manager’s Report  Building Dept. has had a lot going on with inspections, registrations for landlords, fire and safety, permits. Hired Darlene Ciardullo to assist in hopes to take over when Vicki Kurtz retires.  Had a Workers Comp audit with NYSIF. Village Treasurer was helpful making sure we were given just consideration by the auditor and hopefully will have a reduced bill in our final audit finding.  DPW has been busy patching and getting ready for winter. Fuel tanks installed and back on at DPW.  Harvest Fest prep took a lot of time from Rec and Parks, DPW and the Police Dept. Weather was great. Ground was wet, but was easy to deal with.  Treasurer put in AUD. Treasurer and Village Manager both covered the office while both Deputy’s went to NYCOM, which was beneficial.  Engineer went over bids for different projects and time lines. Contract signing with the town for the Pine St Pump Station and paving the DPW.  Village Planner is going over the comp plan. Hopefully by November will have something for the board. October 2, 2018 1  .  Attend the beginning of the Spruce Up event by RDAC and Sonyma. Deputy Mayor did a great job setting up and cleaning up some properties. Helpful to the entire Village.  Met with Supervisor Winchell regarding the Rail Trail, shared services and Hill St Bridge. They have engineer picked for the bridge.  CSEA negation went well. Made some more progress. Will have a couple questions for the board in executive session tonight. Trustee Svarczkopf said he is hoping on next water mailing, to have another notice that we passed the law and they need to be aware and maybe make precautions. Manager Revella stated that we have room on bills. Deputy Mayor Moore asked if the cleaning at Wooster’s been addressed. Manager Revella said yes, but the flag. Will need a lifter. Deputy Mayor Moore questioned if the fire and safety inspection fees were being responded to. Manager Revella said that we have gotten more fees in than we have gotten inspections done already. Approval of September 18, 2018 Minutes Trustee Ramos made a motion to approve the September 18, 2018 Minutes. Seconded by Deputy Mayor Moore. All ayes. Motion carried. Trustee’s Committee Reports Village Offices Liaison – Trustee Svarczkopf Trustee Svarczkopf reported that we are still waiting on the Cyber Security Grant. They said we’d have an answer mid-September, but it’s later. We did get a bill for the software so we need to make a decision on that. Treasurer put in the AUD. Thanked Manager Revella for helping out and the office seems to be doing well. Town of Montgomery & Library Board liaison – Trustee Kraus Trustee Kraus reported that he met with Ginny and she is hoping to get replies on the bid. She is also working on upping the contributions to library from the town and also the county. Planning and Zoning Boards as well as the Building Department Liaison – Trustee Thompson Trustee Thompson reported that she met with Dean and Mr. Revella and went over the fire and safety inspections. They are on target. Trying to streamline some paperwork. Talked about abandoned properties. There’s 22 altogether and 14 were sent out. Did welcome Mrs. Ciardullo at the Building Dept. She’s very enthusiastic and hopefully a quick study and Vicki will be able to retire as planned. Went to the Planning Board meeting. The Zoning Board meeting was cancelled. Town of Montgomery meetings are going well. We decided that one person go to their board meetings and one person will go to their work. The person that goes to the work meeting knows what’s coming up at the next board meeting, so we can go prepared. This week’s discussion will be budget, police cars. October 2, 2018 2  . Stopped to see Mr. Woznik, but wasn’t there. His secretary said that he did receive the invitations, but has yet to reply. Police Department and Justice Department Liaison – Deputy Mayor Moore Deputy Mayor Moore reported that she met with Chief. Reviewed vehicle reports, all vehicles are in rotation. They are preparing for the Halloween Fire and Safety program at Walden Elementary on October 30th and 31st. Officer Rios will be leading up and would like to welcome her as a new full time employee. Recreation & Parks Department and Valley Central School Board Liaison – Trustee Ramos Trustee Ramos had nothing to report. DPW Liaison– Trustee Sebring Trustee Sebring reported that he spoke with Fred. They’ve been busy sweeping the streets, cleaning debris and leaves around the catch basins. Patching pot holes. Guys have been busy in preparation for primary work to be done before the blacktop. Water Dept installed 9 new meters. Repaired water service on Valley Ave. Put out notices for next phase for replacement meters. Mayor Rumbold asked if they have a list or schedule to make sure every catch basin is checked. Trustee Sebring said that he will ask. Manager Revella added that it’s not a regular schedule. They go by route. Mayor Rumbold said that she will be attending the Town of Montgomery meeting. Planned on asking them about the Hill St Bridge but the engineered checked it. Manager Revella said that they hired an engineer to have it checked. Mayor Rumbold asked if there’s been traffic driving over the Hill St Bridge. Manager Revella replied, the first bridge not the second. Mayor Rumbold was told by Trustee Thompson that the Planning Board has an application in front of them for that area by Stewart’s. Would any of those documents mention the flow of traffic from Hill St Bridge that wasn’t going to come out on route 52. Manager Revella said that he’s not sure what the current documents say, but will see what Planning Board says when they do the next review. Mayor Rumbold said that the contention was that it was the bridge to nowhere and we didn’t really need it in the Village, but if that business originally listed the flow of traffic from that bridge, would think that it would keep the flow of traffic from bottlenecking in that area of 52. Manager Revella added that it’s always good to have more than one. October 2, 2018 3  . Trustee Thompson mentioned that if it does get crowded, people from the other businesses in that lot would opt to go out the other way. Mayor Rumbold read community events into minutes Public Comment on Business of the Board Becky Pearson, 167 Walnut, asked if there will there be discussion on the Amthor Prop. Manager Revella said that it’s been tabled. Becky questioned if they discussed money and how will they monitor what they’re doing and how they are going to pump the water and sewer. Mary Ellen Matise, 54 Gladstone, commented that it would have been nice if the members of the Zoning Board had copies of Mr. Donovan’s memo with his changes to Zoning Code 305.54(D)2. Action Items Outside Water/Sewer – Amthor Property Tabled Zoning Code 305.54(D)2 Manager Revella said that the Village Attorney prepared Local Law versions to see what route we want to go. He can explain what the differences are. Attorney Donovan said that the last time we discussed making modifications, 305.54(D)2, the issue being that an enlargement of a conforming use to a non-conforming building could require a use variance. The long local law makes the modification to be clear that an evaluation to allow a conforming use in a non-conforming building would be an area variance in the proposed 305.54(D)2. Also made some modifications to existing A, B and C. Based upon comments that were received by the Zoning Board members to eliminate the language where it talks about the 50% of replacement cost. Will leave it to the Zoning Board whether they think it’s appropriate or not. Hope that modification will make it easier for applicant and easier for the Zoning Board. Did leave in and it’s up to you to for requirement for referral to the Planning Board. Did send copies to Rob Dickover, who sits with the Planning Board and Zoning Board and Dean Stickles. Rob had comments that were incorporated in the draft. The other local law repeals 305.54C. Talks about general standards. Preemption means that the locality can’t adopt a legislation that’s inconsistent or different from state law. Could leave it in because it’s not different from state law or you could take it out because it’s redundant. Mayor Rumbold wanted to make sure that Mr. Dickover has the drafts to share with the Zoning Board. Attorney Donovan said that he sent it to him last Thursday. Sent copy to John and Dean. Trustee Svarczkopf asked if the redundancy will become a problem if the state decides to change the law. Attorney Donovan replied, potentially. October 2, 2018 4  . Trustee Svarczkopf questioned if it would be in our interest to not deal with it twice. Attorney Donovan said no harm no foul. Might have to change some language because it makes a reference to C-1, 77-12B of the NYS Village law. Not a big deal. There is always that potential and you can always repeal it at that time or you can just do it now. Manager Revella said that if you’re going to change anything, might as well do it now. Attorney Donovan said he wasn’t sure if he captured what you wanted to do with 305.54(D)2. Manager Revella asked if it’s the board’s pleasure to repeal the whole thing or try to fix what we have. Attorney Donovan clarified that he was talking about repealing 305.54C. D - talks about specific types of variances. That’s not preempted by state law. Thought you might want to keep that, because that would give the ability for certain types of applications to go to the Planning Board. Deputy Mayor Moore asked if Dean reviewed and commented. Manager Revella said yes. Trustee Thompson questioned if it’s just for 1 or 2 family, there’s no need to bring it to the Planning Board. Building Inspector Stickles said that right now with site plan, you’re not required to go to the Planning Board. Would stay with Zoning Board. Mayor Rumbold wanted to make sure that it addresses the concerns Mr. Dickover had and that this conforms to what they were trying to do. Attorney Donovan said that he did give some suggestive modifications and did incorporate that into this draft. Mayor Rumbold doesn’t want to change a law that doesn’t achieve what the intent was for. Manager Revella will email a copy to Becky. Becky said that he knew what we were trying to do. Skimmed through it tonight. It’s 2 completely different laws. Attorney Donovan commented that the one repeals 305.54C. You can do that and the other one. Deputy Mayor Moore thinks that the confusion may have been that the packet included the 1st draft before Attorney Dickover’s suggested changes. Attorney Donovan said draft 2 has Attorney Dickover’s comments. October 2, 2018 5  . Deputy Mayor Moore said that there’s a draft #2 that would be to repeal 305.54C. Draft #2 for 305.54D with Attorney Dickover’s comments. Manager Revella added that the Building Inspector’s comments were regarding section 3 to subsection C. Attorney Donovan said that he didn’t know if you want to add Planning Board requirements. Would repeat the language from C except for changes to a single or 2 family residence. Trustee Svarczkopf mention that draft 2 still has reference to subsection C. Attorney Donovan said that he wanted it to stay independently, so if you go ahead with the repeal of 305.54C, that would just change the variance pursuant to NYS Village Law 7-7. Mayor Rumbold asked if they want to scratch the Planning Board off subsection B. Deputy Mayor Moore said the first question would be if they want to repeal 305.54C. And if our choice is to repeal, then we can go ahead and approve 305.54D. Trustee Svarczkopf would like to eliminate subsection C and go from there. Trustee Kraus agreed. Trustee Thompson agreed to repeal 305.54C. As long as the Zoning Board and Building Inspector are happy about draft 2. Deputy Mayor Moore agreed to repeal 305.54C and make to make the changes to 305.54D to be consistent and to not include the Planning Board in it and to allow the Zoning Board Chairwoman the opportunity to take a look at it. Next step would be a Public Hearing. Trustee Ramos agreed. Trustee Sebring agreed to repeal 305.54C and draft #2. Becky asked if repealing would effect anything else. Attorney Donovan said that the only thing repealing is the part that mirrors the NYS Village Law. 305.54(D)2 is going to get revised now. Will give it back to John, the board and the Zoning Board in a day or 2, to get the Zoning Board’s comments and you’ll have it in front of you at the next meeting. Mayor Rumbold asked Becky if they would have their comments by our next meeting. Becky said she would have them comment on their own and back to John. It’s pretty much where we were talking about. Manager Revella added that he’s not sure how time sensitive. If the board doesn’t set a October 2, 2018 6  . public hearing today for the next meeting, there’s not going to be another until the middle of November. Becky said that she doesn’t have a problem setting a hearing because you’re gonna get that information back and some of the members can speak at the public hearing. Haven’t had time to sit and read it. Attorney Donovan said that the local law has to be in final form 8 days before public hearing. Better practice if you know exactly the local law you’re scheduling the public hearing for. Mayor Rumbold said that we will wait until we get comments from the Zoning Board. Attorney Donovan added to get the revisions that we talked about. Budget Transfer Manager Revella said that we had some issues with our generators in Sewer Dept. and will continue to have them as we go through and comply with the DEC consent order. Upgrading and monitoring for maintenance and trying to get the functional, functioned. We are over budget on that line and would like to transfer $1500 from the contingent account. Deputy Mayor Moore made a motion to approve Budget Transfer. Seconded by Trustee Sebring. All ayes. Motion carried. Comprehensive Policy Package Trustee Thompson read page 70, letter Q about alcohol and non-prescription drugs. Manager Revella said that if someone is operating machines, they shouldn’t be using drugs. Trustee Svarczkopf asked if it was alcohol and non-prescription drugs. We’re reading is you can’t use alcohol. You can’t use non-prescription drugs. Manager Revella added that we have a section regarding prescription drugs as well. Trustee Thompson mentioned the comment about non-prescription drugs is bothersome. Shouldn’t say Over-The-Counter. Shouldn’t be there at all. Trustee Svarczkopf asked what was the intent of it. Manager Revella said that you shouldn’t be taking drugs that are not prescribed for you. Trustee Thompson asked about the section on dates changing for contribution towards benefits. Don’t recall choosing those dates. Manager Revella stated that they are already in place. Regarding insurance. Trustee Thompson said she was confused on the June 1, 2018 change because didn’t remember discussing that. October 2, 2018 7  . Manager Revella said that we didn’t, it was proposed. Page 59 has the drug free work place. We will send it out to the PBA, CSEA and Dept heads to make sure there’s no other comments or concerns. Public Comment Becky Pearson, 167 Walnut, asked Trustee Thompson about when she had issues with the Village supplying OTC drugs in their medicine cabinets. Trustee Thompson said that it was part of the concern but have not been able to get an absolute answer from PESH, OSHA, Legal, NYCOM. Becky questioned if the board can then make the decision to have it or not. Trustee Thompson said no, because we were led to believe that it’s a requirement by the governing agencies, but it’s nowhere in writing. Manager Revella added that PESH said it’s a good idea to have it there, but doesn’t cite a specific rule. Becky said that some people can’t take allergy meds. Who makes those regulations? Trustee Thompson said that we can’t just make those things. There are governing bodies saying that these are the rules you abide by and they come to do an inspection and find something different, we can get cited. Becky questioned where we are with the clerk. Mayor Rumbold said the same place as the last time. Becky asked if there was no public discussion whether it’s part time, full time, how much is the pay. Mayor Rumbold stated that we haven’t come to that conclusion yet. Did ask for input from the board because they are her colleagues and thought that it was important that they have input in the process. It is her appointment. Becky asked how she is going to go about the appointment. Mayor Rumbold said that she is still waiting for input from her colleagues. Don’t have to rush. There will be public discussion on it. There doesn’t have to be any public discussion, can just make the appointment. Doing this to be open and transparent and have colleagues join in to make this appointment. Becky brought up street opening and water. Thought it would be on agenda again. Mayor Rumbold stated that she didn’t get any request to put it on the agenda. Becky commented that she still doesn’t understand on why. If paying the water and sewer bill, it’s a maintenance. It’s my project to my street and I’m paying that to maintain those streets. October 2, 2018 8  . Mayor Rumbold stated that you pay the village to provide access to water and sewer. You’re not paying us for is what we didn’t installed to begin with. When your house was built, the Village did not install those laterals. There was access in the street to water and sewer. The contractor who built the homes then provided laterals that went from the home to the main. Becky asked what the procedure and policy is for a water main break. My water main breaks on a Friday afternoon. Trustee Kraus said to call John. Mayor Rumbold added to call DPW or Water Dept. Deputy Mayor Moore said that it is no different when it broke. You still, as a homeowner, regardless if it broke where it connects to your house or where it connects to the main, that’s still your water service line. So, at 3 o’clock on a Friday, you would still have to call a contractor and DPW. Attorney Donovan added that the local law was adopted by board. Just changes who pays for it. Otherwise it’s the same. From curb stop to the main is the obligation of the homeowner. Becky asked if she had to use who the Village wants or can she use her own person. Deputy Mayor Moore said that you would call a contractor just the same as you would before we passed this local law. As a homeowner you’re responsible. If my line breaks I’m responsible for calling someone to come fix it. Becky asked if someone is there to inspect it when it gets fixed. Deputy Mayor Moore said that it’s just the same as if you need to replace your front porch and you file for a building permit. You would then contact DPW. Manger Revella added that they would review the work. Mayor Rumbold said that once they get the permit, they are told what procedures there are. Deputy Mayor Moore said that it is no different than any other project that would be done through the building department. Becky asked about blacktop. What happens when I have to dirt and put some blacktop and it goes down and 6 weeks later you put more blacktop on. Is that something that I have as well? Or does the village do that? House on Walnut just had a water line done and the Village was up there after this law was done and probably repacked that piece of property. Manager Revella wanted to clarify that once the project has been signed off as completed by the person inspecting it, it’s no longer the homeowner’s obligation. October 2, 2018 9  . Deputy Mayor spoke from experience from having to replace the lateral at the RDAC office. Had to dig up the road, they were responsible for all of that. They put in the stone. Let it sit for few weeks, put in more stone to make sure it was compacted correctly. Was all open until it settled. Then was able to have the blacktop done. It was a good 6 weeks that it was stone so it can settle. Becky questioned if that was the policy this board has set. Mayor Rumbold said that if you have a contractor that understands what it’s takes to be paved. They understand that you’re going to have an area settle and possibly have to put more stone in. It’s the contractor responsibility. Trustee Svarczkopf said that it has to be inspected to make sure it was done right. We don’t care who you hire as long as the work is done right. Trustee Sebring added that when your house is built, the water line is put in from the house to the street. Same way with the sewer line. But if the sewer line goes bad and it collapses in and none of that sewer can go out, you have more of a problem with it backing up into your house than this water that you’re talking about. Becky believes that the sewer should change as well. Trustee Sebring said no, it shouldn’t. You bought the house. It goes to the mains. Every house that’s given a certificate of occupancy has to go to each main. That’s part of the house. Becky said that we weren’t paying for it at that time. Manager Revella said that you paid the contractor to put it in, you paid the price when you bought it. Becky said that she paid to have water and sewer lines paying for water. Paid to have that service in this Village and not getting that service. Mayor Rumbold said that you are asked to maintain something that we never installed. The contractor attached your service in your house to the mains. Becky questioned the legalities of contractors working on the Village pipes. Mayor Rumbold said that they are working on your pipe. All they’re doing is connecting it to our service. Becky asked why this law changed now. Manager Revella responded that he didn’t know when the law changed. Mr. Millspaugh recalls in the 60’s-70’s and said it was always on the homeowner. Not sure why or when exactly it changed. Becky asked about the street that was just done and if the homeowner paid for that blacktop. October 2, 2018 10  . Manager Revella stated that procedure was done before the law was in effect. Becky asked if anyone talked to the VFW about that project. Manager Revella said yes. Anita Vandermark, 76 Highland, asked if there will there be hydrant flushing in October. Manager Revella said yes. There is one employee on vacation this week. Anita added that she is really dismayed at the last meeting, the gentleman was not happy with street decorating in Walden and no one made a comment. Our Parks and Rec Dept does a wonderful job, Beautification Dept, Community Council does a great job. Mayor Rumbold said that her understanding was that he was talking about the empty store fronts. Deputy Mayor Moore said that’s how she understood it as well. Mary Ellen Matise, 54 Gladstone, passed out a flyer and hoped some people can attend for Hope for the Hudson. See’s there is a provision for it about emergencies if your sewers backing up in your house or there’s no water in your tap, that’s an emergency and falls under the emergency clause in Chapter 256. If they don’t, then it takes 48 hours to work on water line. It’s October 2nd already, there’s this whole issue with excavating in reasonable time and this time of year, no permits after November 1st until March 1st, there’s no way to fix it. Trustee Sebring said that there’s cold patch for the winter time. Mary Ellen commented that you can’t expect it to last through ice and snow. Says you do have someone doing this and that is looking into this. Manager Revella said that there is one property owner that’s been cited for not doing it in a timely manner and their bond is going to be pulled on 23 Ridge. Mary Ellen said that it’s already been 4 months and should have been settled by now. Manager Revella said that they were given until October 15th to do the work or it’s going to be done and charged back to them. Representative speaking for Celina Mariano, 127 Walnut St, said that on September 8th, a tree limb fell on her car causing nearly $2700 in damages. The tree was located between sidewalk and street. Not our tree or the landlord’s. Read Walden Village Code Chapter 256. Have a weather report, it was a calm night. Wanted to see who’s responsible. Manager Revella stated that he has responded to an email. Attorney Donovan said that it’s a little difficult to have a public discussion when there’s a potential for a claim to be filed as to has rights and responsibilities. Generally speaking the Municipality is not responsible without notice. Not familiar with the facts of this case. My October 2, 2018 11  . job is to give advice to the Village Board. Don’t want to give advice in public forum that may be used or deemed to be inappropriate if there is a claim in the future. Celina’s Representative said that the Village has since cut the tree down. Asked the attorney for a statement. Attorney Donovan said that his role is to give advice to the Village Board, so can’t say anything more than said this evening. If the Village Board has any questions for me, can discuss that in the appropriate forum. Celina’s Representative asked if there is anything in writing that they can get. Attorney Donovan asked if a claim has been made. Manger Revella said not officially. Have email correspondence. Attorney Donovan said to let him consider the matter and get back to the board. Payment of the Audited Bills Trustee Ramos made a motion to pay the Audited Bills. Seconded by Trustee Sebring. All ayes. Motion carried. Correspondence Trustee Thompson said that she received an email from Mary Ellen asking about a property on Gladstone and Clinton and did forward it on. Deputy Mayor Moore said that she received an email from T-Mobile, but ignored it. Miscellaneous Comments from the Board of Trustees Trustee Thompson commented on the paving of the roads. Last time a water main broke on the hill, live on the corner of Prospect and Riverview, the Village repaired it and it was top of hill, it was winter and knew it couldn’t be blacktopped. The area didn’t get packed down. DPW put the orange cones. Plows knew to go around. At some point the cones were picked up, we got an ice storm and the plow forgot and dug up the road. Wasn’t a major issue and spoke with Manager Revella and Superintendent Fred Perna and asked to put the cones back. Fred was nice and had the cones back and as soon as the weather permitted, they came and fixed the road. Communication is key. If you talk to right people, it’s not an end of the road thing. Sorry if people think things take too long sometimes and think that people don’t care about their needs. Deputy Mayor Moore thanked the Village and everyone that participated in the Spruce Up event. Able to successfully spruce up 21 properties. There is still some work going on at the skate park and 5 additional properties. Once we have complete count of the expenses, there is a possibility that we are looking for additional properties in the Village that need some outside work done. Great job by the Walden Community Council and the Recreation and Parks Dept. and everyone that took part in Harvest Fest. Thanks to Fred and his entire Dept. for everything that they do. They have a very thankless job. Trustee Ramos thanked the Parks and Rec, Walden Community Council. They did a phenomenal job. There was a lot of mud. Field looks pretty good. Food vendors were ecstatic. Few issues with their heavy vehicles on soft turf. Guessing about 4,000 people October 2, 2018 12  . showed up. It was a beautiful day. Fireworks were great. Attended the OC Association of Towns and Villages, the law enforcement community and their 1 priority is school safety. Commit to providing best the best service possible for children. Trustee Sebring commended the Parks and Rec and the Walden Community Council. A lot of work goes into it. Seemed like they had more vendors than the years before. Mayor Rumbold was at Harvest Fest from 8am and the staff worked feverishly because we didn’t want cars on the field. They loaded and unloaded and helped set up. The vendors appreciated it. Things seemed to go like clockwork. Can’t say enough about that committee. They meet all year long. They’re going to meet and start planning next year’s event. Debbie Robb, the Chairperson of the committee and every member of that committee, tries to think of everything. This year we got cooperation from the weather. Everyone had a wonderful time. Manager Revella added that they had some baked goods. Mayor Rumbold announced that there’s going to be a free event, America’s #1 School Presenter at VCHS on October 25th at 7pm. Everyone is invited. Motivational speaker, Mark Mero, coming to speaking to parents and kids. Thanks to RDAC and Sonyma and Deputy Mayor Moore for organizing the cleanup. It was a lot of work, but we had a great time. A lot of the property owners and neighbors came out and thanked us for doing what we were doing. Really made the neighborhoods look much better. Glad to see so many banks show up to help. Deputy Mayor Moore added that they couldn’t have done it without sponsors. Angry Orchard stepped up immediately and are a very generous sponsor. Even had to create a level of sponsorship for them. Nice to see the businesses giving back to the community. Anita added that there was an email that came thru, but they were very impressed with the opening ceremony. Deputy Mayor Moore asked if they know if the community blood drive would come back when their vehicle is fixed. Manager Revella isn’t sure, will have to reach out. Judge Mishk commented that there is one coming up in Montgomery. Executive Session Trustee Ramos made a motion to enter into executive session to discuss CSEA Negotiations and Personnel.
