Trustee Taylor: Nothing, my apologies to the board for running late my apologies to the residents, obviously the meetings at 6:00 o'clock I should have been here my apologies but other than that I don't have anything at this time. Mayor Pearson: Right so I have one thing and it was the web page, I talked to you about the web page. Village Manager: Yeah, on November 13th we have a meeting with the web designer at 3 o’clock. Mayor Pearson: OK is that a redesign and does it have to change from word to gov. is that happening at the same time or not. Village Manager: So, this is redesigned and reconfiguring things and making sure links are right that kind of stuff we're going through now before that transition so. Deputy Mayor Thompson: So, is it you and the clerk going to the meeting with them for web design or people from other departments, how are you doing it? Village Manager: So, the clerk and I for sure and we invited Trustee Kyle. Mayor, you are welcome to come and one other board member, that's not more than 3, it’s a Thursday 3:00 o'clock. Mayor Pearson: OK. Village Manager: So, one other person if they want to come, just make sure we coordinate that so we're not four. Mayor Pearson: All right so that's all I have for that. So, approval of minutes. Mayor Pearson: Anyone who wants to make a motion to accept the minutes for October 7th, 2025, and October 21st, 2025. Mayor Pearson: All in favor? Ayes: (Oct. 7, 2025) Deputy Mayor Thompson, Trustee Mishk, Trustee Baker, Trustee Taylor Ayes: (Oct. 21, 2025) Deputy Mayor Thompson, Trustee Mishk, Trustee Baker. Abstain: Trustee Taylor for the October 21, 2025, meeting Mayor Pearson: Anyone want to make a motion to pay the bills? Trustee Mishk: I'll make a motion. Mayor Pearson: Is there a second? Trustee Taylor: I’ll second. Mayor Pearson: Any discussion? Village Attorney Cappello: What is this for? Village Manager: The riverfront park they did 200 thousand worth of work, but the grass is not coming in. They tried to remedy it twice. And it hasn't been successful so. Village Attorney Cappello: I guess the other option is to say you are holding that money to do it, give it one more time, but you would hold the amount it would cost for you to do it. Deputy Mayor Thompson: Yeah, that was my only question, is the amount that she is suggesting reasonable? Village Manager: The engineer said it would be 8,500.00, that was the quote he got from the landscaping company. Village Attorney Cappello: Then you could add a contingency to start taking care of that. Usually, contingency is like 15% or 20%. Deputy Mayor Thompson: Yeah, I'm OK with holding it. It's the amount that I'm questioning. Is that a reasonable number how do we determine the number. Village Manager: If you say up to double whatever we're allowed to legally do, we'll do. Deputy Mayor Thompson: Is that what you want to do mayor? Mayor Pearson: I would say that. Are all the left-over things cleaned up like the fencing? That to me is part of their agenda to clean that. Village Manager: It is. Mayor Pearson: That would be my only concern again. Trustee Baker: If seed isn't taking root there is sod an option? Deputy Mayor Thompson: How about we go with a no grass suggestion? Low maintenance and maybe less money. Trustee Mishk: Do I need to amend my motion? Mayor Pearson: I would say yes. Trustee Mishk: I am amending the motion to pay all the bills except part of that bill. Trustee Taylor: Was that broken down? Deputy Mayor Thompson: It was I remember looking at it. Village Manager: Yeah, that's on here. Trustee Taylor: So that portion of the proverbial contract has not been completed to our satisfaction, correct? Village Manager: That's correct. Trustee Taylor: Is there a problem with the soil there? Village Manager: It could be. Be we don't know. Mayor Pearson: But they don't know. Trustee Taylor: We have not investigated that? Village Manager: I did it the first time and it was an issue with the soil. Trustee Taylor: Really what do we do with the issue. Village Manager: They came in with more soil and seed, but it didn't hold the second time. Trustee Taylor: Well, there's a problem with the soil I mean that it’s not going to resolve the issue if there's a problem with the soil I'm talking about is there a chemical issue involved with the soil. Village Manager: Oh, I don’t know. Mayor Pearson: Well, I would say up to double. What do you say Gerry it is your motion. Trustee Mishk: Can we do it next year for the double? Mayor Pearson: I don’t know if we can double it next year. Trustee Mishk: I would say we hold off paying the bill entirely until next meeting. It's only 2 weeks away. And then we come up with a better number. Village Manager: That is up to you guys. Mayor Pearson: Who would come up with a better number John? Village Manager: Yes. Deputy Mayor Thompson: And the contractor, right? Trustee Mishk: So again, my motion is that we pay all the bills except for Consorti. Mayor Pearson: All right and is there a second Deputy Mayor Thompson: I’ll second. Mayor Pearson: All in favor? Aye: Deputy Mayor Thompson, Trustee Mishk, Trustee Baker, Trustee Taylor. Mayor Pearson: Public comment? No one on the list Mayor Pearson: Okay, alcohol waiver for Christine. Anyone want to make a motion to approve? Trustee Mishk: I'll make a motion to approve. Trustee Taylor: I’ll second. Mayor Pearson: Any discussion? All in favor? Aye: Deputy Mayor Thompson, Trustee Mishk, Trustee Taylor, Trustee Baker Mayor Pearson: Alright, the budget transfers. Anyone have any questions? Trustee Mishk: Initially I questioned the unallocated insurance. Then Jean explained to me what it was. Mayor Pearson: OK. What is it? Village Manager: Our liability policy. Village Manager: So when we get the budget done our policy doesn't go until June 1st so we're estimating and we usually get a percentage so the case going to go about this percent it's sometimes a little bit off depending on if we add or subtract vehicles and property values increasing or decreasing so that's going to be off a little bit it's not too bad. But it’s almost 200 grand so it's only off by that much it’s not a big percent. Mayor Pearson: Can you go over the increases at the bottom? Treasurer: So, the first one is property maintenance. We'll be doing, for the first time I’ve been here, I don't believe it's been done before, they're charging the resident for retaining wall. Village Manager: When the board approved the work to be done at 60 Main Street, for example that's being charged here or boarding up 75 Maple and doing the water line that's being charged here those things are being charged for the property maintenance. Treasurer: So, what's happening is that we get the bill we're paying the bill and we're charging the residents so it's going to be reimbursed back, so you must raise the revenue line and the expense line at the same time. With that I want you to know current revenue for property maintenance is about 80 grand. It was anticipated for 40,000 basically doubled for that line by raising it by the amount that's on there it will be up to 133862 which I'm pretty sure will come in. Treasurer: So, education National Night Out that's a donation. So, the Police Department got donation up 1350, they’re saying we've got a donation so we're going to raise our expense line by that amount because we did not budget for that donation so now, we're raising it, so you must raise the revenue to balance the budget It's the same thing. Mayor Pearson: Parks and recs? Treasurer: Same kind of thing. But it was deposited prior year. In net. Actually. He went to Lowe's in June for the flooring. Mayor Pearson: Questions about anything? Anyone wants to make a motion to accept the budget transfers? Deputy Mayor Thompson: I’ll make the motion. Trustee Baker: I’ll second Mayor Pearson: All in favor? Aye: Deputy Mayor Thompson, Trustee Taylor, Trustee Mishk, Trustee Baker Mayor Pearson: Introduction law for events. And you have the motor vehicle traffic. Any questions, any thoughts? I have a couple there needs to be a correction on the first section. There should be 291. And then it says 15 definitions I couldn't find that in ours in our code if you look at our code it Does have a 15 already and 16 already so I'm not sure? I don’t know if they can be in the park on that one. We did talk about parks back further Village Attorney Cappello: It was to be a new section. Mayor Pearson: So do we just want to make up a new number. Village Attorney Cappello: Yeah, it would be chapter to a new article go down. Village Manager: So which articles, last one? So, it would be 12, yeah article 12. Deputy Mayor Thompson: John, the fines are 38 OK. Village Manager: That's right. Mayor Pearson: Go over number 330 on number 291 old 16. Village Attorney Cappello: Yep, the first part is from the vehicle and traffic law itself it says no person shall operate an E-bike, including electric scooter on any public land or property other than a highway exclusive of any greenway adjacent to or connected with the highway. So that's the end of what vehicle and traffic vehicle and traffic law says only on streets public highways so I included because you said potentially you would and it does say you can designate trails or so I said this is what I had and then any trail designated by the village any operation on the village designated trail should be limited to class one and Class two E- bikes only which I think is consistent with vehicle and traffic law while they define the class. And I included this class one and Class two bikes only I said between the hours and 7:00 AM and sundown because you can do hours but that's just what I put in there if you wanted to do later or something and subject to all other requirements that vehicle and traffic law but it's up to you whether to allow them at all, whether to change it if you wanted to. Mayor Pearson: any comments from the board. Nothing you’re all good with it? Okay. Mayor Pearson: Thank you, moving on to sidewalk sales and yard sales. I did have some things. 228 4A. is there a time frame on that like sunup to sundown? Village Manager: Yeah. The first line right here hours. Mayor Pearson: Yes, do we want to leave that in there? Or not for sure. That's not in there but we're leaving that. I'm just going to add this okay. Village Attorney Cappello: Yes. Deputy Mayor Thompson: Aren't we just going to add what we're changing? Village Attorney Cappello: Yes, Oh yeah wait I said should be embedded in, yeah, I think this should be amended to include. Trustee Baker: And if I'm not mistaken that you had said 4-yard sales in addition to the 2 not just the 2 and 4 for a total of 6. Deputy Mayor Thompson: That's what I thought, there a total of 6 was that not right? Village Manager: Change it from 3 or 4. Deputy Mayor Thompson: And the other laws were 6 and we said we didn’t want 6 because we already have 4. So, we get 6 with 2 village wide yard sales. Mayor Pearson: Correct. Village Attorney Cappello: I'm just going to add and write out just so the whole thing is there instead of there. Village Manager: Reword it, yes. Deputy Mayor Thompson: And we are going to leave the hours the same, yes correct. Village Attorney Cappello: Unless you want to change it. Village Attorney Cappello: It’s amended to only have 1,2, and 3. But then how are you going to keep track of who’s holding 4 or 6? So, it doesn’t require you to have a permit, but you do have to fill out that form so you can keep track. Mayor Pearson: Correct yeah now receiving that we were changing 228 dash 4 a that maybe you finally hadn't changed a different number we were changing that whole month number that's all. And we talked about the violation, nothing for the first one and $75 for the second. Village Attorney Cappello: Yeah, now I did have a question on that Is that in a year or is it cumulative? Mayor Pearson: I would say a year. Village Attorney Cappello: Because if every year I can hold that extra one and I'm just going to get a warning I'll see you thank you for the warning and I'm going to have it and I'll start again next year. Mayor Pearson: Like January to January. In a calendar year. Deputy Mayor Thompson: Okay. Mayor Pearson: Are you putting it under 224 A? Village Manager: 2286 penalties. Trustee Taylor: And the clerk is going to be responsible for tracking this what about the signage who's tracking that? Sign-ups? Mayor Pearson: Well, the sign-ups have always been done by the police and the building department. Village Manager: Building department, that's right. Village Attorney Cappello: I did have one other question for you I put I was going back and forth on this I think each household should I need to know there's lot each you know what I say each person then because they could have 12 you know. Deputy Mayor Thompson: I think for fairness you have to say household. Mayor Pearson: Yes, I would say. Village Manager: You must make a motion to hold the public hearing for yard sales on December 2nd. Mayor Pearson: Anyone want to make the motion? Deputy Mayor Thompson: I’ll make a motion that we hold that yard sale public hearing on the same date December 2nd. Trustee Baker: I’ll second. Village Manager: Let's make sure we made a motion for the last one as well so I'm not sure if you voted for the E bike public hearing. Village Manager: Alright we'll do it again. Deputy Mayor Thompson: I’ll make the motion for the public hearing on E-bikes Trustee Baker: I’ll second. Mayor Pearson: All in favor? Aye: Deputy Mayor Thompson, Trustee Taylor, Trustee Mishk, Trustee Baker. Mayor Pearson: Alright thank you. 74 West Main Street update. Village Attorney Cappello: The gate is open and the applicant’s attorney met with them getting a title company to look for which I'm certain they're going to confirm that it's a village alleyway so. And that it will be up to the applicant as long as it's open if they want to change it to come to you and convince you that they can make a better deal for you that would make you happy but it would be there for their burden, the fence issue is a little more complicated I'm going to be meeting with the building department and a couple other attorneys from our office are going to be meeting to go over enforcement actions in and making sure things are cited OK it's a little more complicated because there was a building permit and a certificate of compliance issued for it so there could be an issue of whether the building inspector had the ability to waive a site plan requirement for a fence so to look into that a little bit longer but in the meantime the access is there so whether that fence would have to go back to the planning board for an amendment of the site plan or whether we can pursue a violation take it down is still to be determined. Mayor Pearson: Sewer vault repair John. Village Manager: OK, this is unfortunate but necessary so there is a pump vault that is failing in the sewer plant if it fails then we don't have a sewer plant functioning we'd have to bypass which is not good thankfully there are a couple projects that have funds remaining that we could utilize. If you get the letter hopefully, I'll read it for the public to hear. Is the sewer plant pump vault failing? The cost of repairs across the $250,000.00 there are funds of about 130,000 in a sewer plant generator which is made part of the grant project which is separate so that will be funded on that anyway and the other part is INI funds are there remaining 124,000. So, the request is to utilize those 2 funds to pay for this vault that's necessary. Mayor Pearson: Are we allowed to just take those funds and use them somewhere else, or do we have to get approval? Village Manager: You must vote for it you have to approve that nobody else can approve that but this board. Mayor Pearson: Okay, pleasure of the board Bill anything. Trustee Taylor: Yeah, John, what explains its failure but explain that. Village Manager: So, the sewer vault pump. It's a huge motor they can't get parts for it to fix it so it needs to be replaced to replace it they have to put in a new motor which doesn't fit with the piping that's currently there so that's a retrofit piping into this new motor and the vault it's confined space which is why it's a little bit more costly. Trustee Taylor: So, this has been failing for a while I guess. Village Manager: The other one failed we replaced it last year now this one 's failing it's been maybe a month. Trustee Taylor: And what's the time frame on that. Village Manager: That I don't know they have to get the pump ordered I mean so tomorrow morning the pump could be gone. Youd be bypassing correct. Trustee Taylor: So, there's a level of urgency attached to this how I'm not sure how this pump is like. Mayor Pearson: I wondered how long they last. Village Manager: Most of the pumps at the plant are about 30 years 25 to 30 years so hopefully it'll last just as long. Village Manager: There's lots of pumps down there, tons this is a vault the vault pump there's 2. Deputy Mayor Thompson: Is this what you have been talking about a couple days ago? I think at that time it maybe could be repaired but the cost of repairing it was outrageous, so it was just better to replace. Village Manager: We were hopeful, but the company says they can't even get the parts to do the repair now. Deputy Mayor Thompson: OK so we're out of that option which sounded like kind of a silly option anyway. Village Manager: It would have been a waste of money, well that was because they were going to go into a temporary repair correct that was going to be like almost 50,000 and its not a long-term fix. Deputy Mayor Thompson: I don't see where we have a lot of options Mayor Pearson: Gerry anything? Trustee Mishk: I don't think we have a choice. Mayor Pearson: Cheryl. Trustee Baker: nothing. Mayor Pearson: So how soon? Do we have to order parts? Village Manager: I'm not sure how long the order will be, they need approval before they can order it, but they did have it specked out so I know what they need so once they put the order in hopefully it's quick. Mayor Pearson: Okay, board. Does anyone want to make a motion to take that money and spending and take it out of those 3 places and move it over. Trustee Mishk: I'll make that. Motion. Trustee Taylor: I’ll second. Village Manager: As per the letter from Lanc and Tully it’s 130,000.00 for sewer plant generator, the other is 124,000.00 from the INI capital fund. Mayor Pearson: Anymore discussion? Okay, all in favor? Aye: Deputy Mayor Thompson, Trustee Taylor, Trustee Mishk, Trustee Baker. Mayor Pearson: Moving onto code review, we are at cannabis. Mayor Pearson: I'm fine with how its fraise unless people want to Opt in but I don't think I want to make that decision today. Village Manager: So, moving to 114. Mayor Pearson: Moving to 114 called safety zones. Everybody's fine. I would like to talk about houses that have child safety zones. Is there anything we can put in a code that would say, make it stronger for police or code enforcement. Village Manager: I don't know I mean if one part is this drug free school zone which is already the strongest that you can have the other is the child safety zones we have because we had somebody on the registry list that lived across street military school for a short time and that really was impetus for the local off the time I don't know how much more you can do with that do you know. Yeah. Mayor Pearson: I'm just trying to tighten up. Village Manager: Well right now we have 500 feet from these areas which will be daycare and schools, nursery schools, preschools. Trustee Mishk: I think there's enough laws in the books in the state law that would address this, it just must have the people to enforce it. Village Manager: You can add the drug-free school zones into this. Deputy Mayor Thompson: If we're allowed to even do that? Mayor Pearson: Maybe we can do that. Deputy Mayor Thompson: Are we allowed to do that? Village Attorney Cappello: I mean if they're violating the law by having illegal drugs, they're violating the law anyway you can enforce crime. Village Attorney Cappello: I mean I'll check to see if there's anything you can do but I don't know what zone is going to be any stronger. Mayor Pearson: Moving on everybody 's okay with that? Okay, moving on to 117 I'm fine with that too that was just pretty much and if you do go back to the fences for the penalties. Deputy Mayor Thompson: John, do you know how many clothing bins we even have left in the village we got rid of a lot of that. Village Manager: Now I believe there's one I'm not sure if there's one in the fire house, those 2 yeah, Firehouse and MPB the only two I know of. Deputy Mayor Thompson: MPB has one. Village Manager: Yes. Deputy Mayor Thompson: Because I think we got rid of the rest of them. Mayor Pearson: Okay moving on to Olley Park lighting. Village Manager: Yeah, I just wanted to give you a heads up, the contractor was going over the lighting and the pedestals with the engineer so he couldn't give us a solid bid yet he's working on that with him. To make sure. He has all the information to give him some good the lights the type of lights is the ones that the board talked about where they're like almost like motion censored so it's like you would like a night sky unless there's somebody pulling in the lights will come on as you go pull in or walk through the lights will come on otherwise they'd be off so they wouldn't be pollution at the park. That's not the issue the heads aren't the issue it's the pedestal that's the issue making sure the pedestals are going to work the way he has them with the conduit, he is going to get back to us on that. Mayor Pearson: Thank you. Alright now public comment anyone who's public. Maryellen: *Inaudible* Resident: So I just had a couple of questions I have seen that the cannabis law you guys are discussing it and I was a little concerned about if you were to opt in at all but my first question is if you were going to start working on setbacks and which parcels would be subject to that is that going to be out in the public like actually showing that and say OK these are the setbacks from I believe there's 3 schools in our district. Village Manager: Map was done with those circumferences, but the zones weren't on it so I asked him to underlay it with the zones and just getting that map put together with those layers, so it’s complicated he did do the circles. He missed two of the churches. Resident: If I'm going to be living a block from a dispensary, how's that going to affect my property. That is something that you know we're taxpayers we're paying for all your jobs. Mayor Pearson: I think where we left off is waiting for the map to get the zoning. And then the board will have a discussion whether we want to opt in or not. So, we're just taking it one step at a time. We are happy you are here please come to all our meetings we'd love to have the public come. Resident: Well, it’s hard you know a lot of us have working jobs, so it is hard to make every meeting. Mayor Pearson: You can always send letters and emails we're going to do what you all want but we need to hear from you because then we'll have to make our decisions on what we think is the best. Resident: No and I agree with that but it's like this is a big thing like once you're in you're in and I think the majority of people need to have to have a say in it. Trustee Taylor: You're exactly right, there has to be extensive conversation and input by the residents this affects 7000 people in the village not just 3000 because of this particular area so I don't think any discussion as far as opting in or to opt out can take place without extensive input from the residents of this village that's my position. Deputy Mayor Thompson: I was away for Halloween first time I've missed Halloween in the village in 45 years but I heard it was amazing and everybody had a good time and the haunted house thing was a big hit and the Halloween decorations of the residence I got a lot of pictures sent to me they were amazing so everyone out there who decorated thank you. And that’s really all I have. Trustee Taylor: No other than once again apologies for showing up late you know sometimes things get in the way. *Treasurer Degon and Village board have a conversation regarding bank recs.* Mayor Pearson: So, my problem is when I talked about time clocks, I wanted them for management it wasn’t for payroll, but my discussion is the cost of time clocks versus a payroll system is going to be different. That’s what I’m looking for. Manager Revella: You’re not wrong but the issue is going to be what is the point of the time clock if it is not communicating with our payroll system. Trustee Baker: why wouldn’t you want to just streamline it and get it done Mayor Pearson: Well, that is up to the board, not up to me, I have my own thoughts. Trustee Baker: I just don't understand the logic of just having one piece and then ignoring the other part. Mayor Pearson: I’m not. Trustee Baker: Kind of. Mayor Pearson: Not really if we don't have the money for it how can I ignore it. If I knew where the money came from then maybe I would say maybe but where does it come from? We don’t know. Village Manager: This year? You would utilize that fund balance code that you have, called contingency account that is where we come this year next year is a budget for it. Treasurer: So when we talk about payroll system I want everyone to understand it is more about being compliant and on time and efficiency of peoples jobs we waste so much time and manual entry and I know that other departments might look at it and say like well if there's money for a payroll system then there should be money for my needs I understand that. But if we're not getting timely, it's effects our operation of business. And if anyone leaves and someone else comes in, you want to be set up for success. You want the turnover to be fine you don’t want it to be like this. Mayor Pearson: I would like to make a motion to have ZBA and planning board files kept as paper. I think the paper files need to be kept, everybody wants to put everything on the computer I understand, but ZBA, especially with being judicial I feel should be left to paper. Trustee Mishk: I’ll second that. Deputy Mayor Thompson: I agree with you that we should do paper and digital because some of these records, for example I’ve been asking for the Beazer map, and no one can find it. Mayor Pearson: I would like to amend my motion; my motion would be to make sure that all applicants have paper files for keeping and digital for zoning and planning board. Trustee Mishk: I’ll second. Mayor pearson: Okay, any more discussion? Village Attorney Cappello: I think the village manager should come up with a policy that would address both issues. Mayor Pearson: So, I don't need a motion? Village Attorney Cappello: Yeah, but when you have a motion, you can adopt the policy Mayor Pearson: Okay, all in favor? Aye: Deputy Mayor Thompson, Trustee Taylor, Trustee Mishk, Trustee Baker. Mayor Pearson: Think that's it. And that's all I have. Mayor Pearson: So Executive session? Village Manager: I do have 2 attorney-client matters, one is for 51 Capron Street, and one is for a commercial rehab loan application. Mayor Pearson: Okay and we have an employment history with an employee. Trustee Baker: I’ll make a motion. Trustee Mishk: I’ll second. Mayor Pearson: All in favor? Aye: Deputy Mayor Thompson, Trustee Taylor, Trustee Mishk, Trustee Baker.
