Giordano, Mayor I hereby certify that the above Resolution was adopted by the Mayor and Council of the Borough of Waldwick at its Regular Meeting of May 27, 2025. _________________________________ Kelley Halewicz, RMC/CMC Municipal Clerk Council Member Motion Second Ayes Nays Abstain Absent Brennecke Cericola-Drake Martinello Ramundo Ritchie Weber Mayor Giordano Reso book  MAYOR AND COUNCIL OF THE BOROUGH OF WALDWICK Bergen County, New Jersey RESOLUTION NO. 2025-167 (Page 1 of 2) Support of the Major Richard Star Act WHEREAS, the Major Richard Star Act (H.R. 2102) represents a bipartisan effort to address a significant injustice, ensuring that veterans injured in combat receive the full benefits they rightfully deserve for their service; and, WHEREAS, Major Richard Star was an Iraq and Afghanistan veteran who, after exposure to burn pits during his service, received a diagnosis of lung cancer; and, WHEREAS, due to his diagnosis, Major Richard Star was forced to retire before completing 20 years of service and was therefore unable to collect his retirement and disability benefits; and, WHEREAS, for every dollar of disability pay they receive, veterans with less than 20 years of service and a disability rating of less than 50% will have their retirement pay reduced by a dollar; and, WHEREAS, an estimated 50,000 retired service members are ineligible for concurrent benefits under the current rules; and, WHEREAS, according to the Congressional Budget Office, in 2022, the average offset was approximately $1,900 a month; and, WHEREAS, the Major Richard Star Act would remove these restrictions and ensure that all service members who have medically retired can receive full access to retirement pay and Department of Veterans Affairs disability benefits; and, WHEREAS, after dying from his battle with lung cancer in 2021, Major Richard Star’s widow claimed that his greatest goal was to get legislation passed providing for the removal of these restrictions; and, WHEREAS, the United States owes these benefits to its veterans regardless of the cost associated with their allocation. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick urges the Congress of the United States to support the Major Richard Star Act (H.R. 2102) to allow medically retired service members to receive full access to their much-deserved retirement pay and benefits; and, BE IT FURTHER RESOLVED that a copy of this Resolution shall be sent to Senator Cory A. Booker, Representative Josh Gottheimer, Assemblymembers Robert Auth and John V. Giordano, Mayor I hereby certify that the above Resolution was adopted by the Mayor and Council of the Borough of Waldwick at its Regular Meeting of May 27, 2025. _________________________________ Kelley Halewicz, RMC/CMC Municipal Clerk Council Member Motion Second Ayes Nays Abstain Absent Brennecke Cericola-Drake Martinello Ramundo Ritchie Weber Mayor Giordano Reso book, CA, CFO  MAYOR AND COUNCIL OF THE BOROUGH OF WALDWICK Bergen County, New Jersey RESOLUTION NO. 2025-174 (Page 1 of 2) Authorizing the Borough of Waldwick’s Tax Collector to Prepare and Mail Estimated Tax Bills in Accordance with P.L. 1994, c. 72 WHEREAS, N.J.S.A 54:4-66.2 allows for a governing body of a municipality operating on a calendar fiscal year to use an estimated 3rd quarter tax bill if it is determined that the Tax Collector will be unable to complete the mailing or delivery of tax bills by June 14th; provided that the estimated and reconciled tax bills shall be mailed by June 30th and September 30th respectively; and, WHREAS it is anticipated that the Borough Tax Collector will not be in receipt of a certified tax rate in enough time to be able to complete the mailing and delivery of real property tax bills by June, 14, 2025 as is required by law; and, WHEREAS, the CFO/Tax Collector has requested that the Council provide her with the latitude to submit estimated 3rd quarter real property tax bills in the event that a certified tax rate is not received in a timely basis, which would allow the Tax Collector to complete the mailing and delivery of real property tax bills by June 30, 2025; and, WHEREAS, the CFO/Tax Collector has computed an estimated tax levy in accordance with N.J.S.A. 54:4- 66.3 and has signed a certification showing the tax levy for the previous year, and the range of permitted estimated tax levies; and, WHEREAS, in accordance with Chapter 72, P.L. 1994, the Tax Collector requests the Council approve the estimated tax levy of $50,584,573.86 at a tax rate of $2.287; and, WHEREAS, the above levy and rate have been calculated on a worksheet that is attached hereto and made a part hereof by reference; and, WHEREAS, the above levy amount falls between the mandated estimated range required by N.J.S.A. 54:4- 66.3(1) and approval will enable the Borough to meet its financial obligations, maintain the tax collection rate, provide uniformity for tax payments, and maintain necessary cash flow to avoid interest expenses on borrowing. NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the Borough of Waldwick, in the County of Bergen and State of New Jersey on this 27th day of May, 2025, as follows: 1. The Borough of Waldwick Tax Collector’s is hereby authorized and directed to prepare and issue estimated tax bills for the Borough for the third installment of 2025 taxes. Motion: __________ Seconded: __________ Roll Call: Council Members: Roll Call: _____ _____ _____ _____ _____ _____ _____ Brennecke Cericola-Drake Martinello Ramundo Ritchie Weber Giordano Ordinance No. 2025-#13 AN ORDINANCE TO AMEND CHAPTER 20 POLICE DEPARTMENT, SECTION 4 APPOINTMENT OF OFFICERS TO CREATE THE POSITION OF SPECIAL LAW ENFORCEMENT OFFICERS AND SETTING FORTH THE QUALIFICATIONS, POWERS AND DUTIES OF THE SAME WHEREAS, the State of New Jersey adopted N.J.S.A. 40A:14-146.8, known as the Special Law Enforcement Officers Act (“SLEO Act”); and, WHEREAS, the SLEO Act authorizes a municipality to create the SLEO position and authorizes the municipality to appoint a certain number of Class III SLEOs within the municipality, for among other duties, to provide safety and security within the Borough’s schools; and, WHEREAS, the Governing Body of the Borough of Waldwick is desirous of creating these positions within the Borough of Waldwick; and, WHEREAS, in conjunction with the Waldwick Board of Education, the Borough is seeking to appoint two (2) SLEOs for the upcoming 2025-2026 school year as a pilot program, and will review the same at the conclusion of the year. NOW, THEREFORE, BE IT ORDAINED, by the Governing Body of the Borough of Waldwick, County of Bergen, State of New Jersey as follows: Section 20-4.1 through 20-4.8 be adopted as follows: § 20-4.1. Special Law Enforcement Officers – Class III In accordance with the provisions of P.L. 1986, c.2, of the New Jersey Statutes, N.J.S.A. 40A:14-146.8 et seq., there is hereby created the position of Special Law Enforcement Officer Class III for the Borough of Waldwick, Bergen County, New Jersey. § 20-4.2. Qualifications. In order to be eligible for appointment to the position of a Special Law Enforcement Officer Class III, each applicant must: A. Must be at least 18 years of age; B. Be a resident of the County of Bergen during the term of appointment; C. Be able to read, write and speak the English language well and intelligently and have a high school diploma or its equivalent; D. Be sound in body and good health; E. Be of good moral character; F. Have not been convicted of any offense involving dishonesty or which would make him/her unfit to perform the duties of this position;  G. Have successfully undergone the same psychological testing that is required of full-time police officers in this municipality; H. Be a retried law enforcement officer who is less than 65 years of age; for the purposes of this subsection, a law enforcement officer shall not be considered retired if the officer’s return to employment violates any federal or state law or regulation which would deem the officer’s retirement as not being bona fide; I. Have served as a duly qualified, fully trained, full-time officer in any law enforcement position eligible for participation in the Police and Firemen’s Retirement System or in any federal or bi- state law enforcement agency or as a member of the State Police and was separated from that prior service in good standing (for purposes of this requirement, “good standing” shall exclude a retirement resulting from injury or incapacity); J. Be physically capable of performing the function of the position, determined in accordance with Police Training Commission guidelines; K. Possess a New Jersey Police Training Commission Basic Police Officer Certification, New Jersey State Police Academy Certification, or other proof of basic police training approved by the Police Training Commission; L. Have completed the training course for safe school resource officers developed pursuant to subsection a. of section 2 of P.L.2005, c.276 (N.J.S.A. 52:17B-71.8); and M. Is hired in a part-time capacity. § 20-4.3. Appointment. A. Pursuant to N.J.S.A. 40A:14-146.10, the Mayor, subject to the approval of the Council, by annual appointment by resolution, may appoint no more than four (4) Special Law Enforcement Class III Officers to work in the Borough schools. Special Law Enforcement Officers shall be appointed for terms not exceeding one year. Appointment may be revoked by the Governing Body, for cause, after adequate hearing, unless the appointment is for four months or less, in which event the appointment may be revoked without cause or hearing. Nothing herein shall be construed to require reappointment upon the expiration of the term. B. Special Law Enforcement Class III Officers answer to the Chief of Police or his/her designee and shall be in compliance with N.J.S.A. 40A:14-146.10 and all other applicable New Jersey law, Attorney General guidelines, Prosecutor directives, and Borough rules regulations, policy and procedure. § 20-4.4. Powers and Duties. A. Special Law Enforcement Class III Officers shall be authorized to exercise full powers and duties similar to those of a permanent, regularly appointed full-time police officer while providing security at a public or nonpublic school on the school premises during hours when the school is normally in session or when it is occupied by school students or their teachers. While on duty in the jurisdiction of employment, an officer may respond to offenses or emergencies off school grounds if they occur in the officer’s presence while traveling to a school facility, but an officer shall not otherwise be dispatched or dedicated to any assignment off school property. The use of a firearm by an officer of this class shall be authorized pursuant to the provisions of subsection b. of section 7 of P.L. 1985, c.439 (N.J.S.A. 40A:14-146.14). An officer of this class shall not be authorized to  carry a firearm while off duty unless the officer complies with the requirements set forth in subsection 1. of N.J.S.A. 2C:39-6 authorizing a retied law enforcement officer to carry a firearm. B. A Special Law Enforcement Class III Officer shall be employed only to assist the Police Department with security duties at public and nonpublic schools and shall not supplant a law enforcement officer employed pursuant to the provisions of N.J.S.A. 18A:17-43 or a safe schools resource officer employed pursuant to the provisions of section 3 of P.L.2005, c.276 (N.J.S.A. 18A:17-43.1). C. A Special Law Enforcement Class III Officer appointed pursuant to the provisions of P.L. 1985, c.439 (N.J.S.A. 40A:14-146.8 et. seq.) shall not, based on this appointment, be eligible for health care benefits or enrollment in any state-administered retirement system. § 20-4.5. Compliance with legislation of Police Department. All duly authorized Special Law Enforcement Officers shall be subject to the rules and regulations governing the Police Department of the Borough of Waldwick as adopted by previous ordinances, including, by description but not limitation, the Standard Operating Procedures Police Manual of the Borough of Waldwick. § 20-4.6. Supervision and direction. A. A Special Law Enforcement Class III Officer shall be under the supervision and direction of the Chief of Police or, in the absence of the Chief, another superior officer designated by the Chief of Police and shall perform his/her duties only in the Borough of Waldwick, unless in fresh pursuit of any person pursuant to Chapter 156 of Title 2A of the New Jersey Statutes. B. The Special Law Enforcement Class III Officer shall comply with the rules and regulations applicable to the conduct and decorum of the permanent, regularly appoint police officers of the Police Department, as well as any rules and regulation applicable to the conduct and decorum of special officers. § 20-4.7. Training. No Special Law Enforcement Class III Officer shall commence his/her duties until he/she has completed the training as required under N.J.S.A. 40A:14-146.11, as amended from time to time. § 20-4.8. Uniforms. The uniform of Special Law Enforcement Class III Officers shall be determined by the Chief of Police and shall be in compliance with N.J.S.A. 40A:14-146.12. The uniforms shall be furnished at the expense of the Borough. Special Law Enforcement Class III Officers shall be issued a badge and identification card, and other supplies and equipment as required to wear or utilize in the course of his/her duty assignments. It shall be the responsibility of each Special Law Enforcement Class III Officer to have, at all times, a complete and minimum inventory of such equipment and uniform as required by uniform regulations. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Waldwick, that: 1. The Borough of Waldwick hereby vacates any and all rights that they may have in the utility easement, pursuant to the provisions of N.J.S.A. 40A:12-13(b)(4) that was established pursuant to the recorded deed of record in Deed Book 2997, page 489 annexed hereto as Exhibit A. 2. The Borough has consulted the Borough Engineer, the Department of Public Works Supervisor and the Water Supervisor who have conducted a review of the property and determined that the Borough has not installed any utilities within the easement area and all are recommended that the easement can be vacated without any detriment to any rights the Borough may have in the easement. 3. The Borough has determined that whatever interests that they may have to the subject utility easement have no value. 4. The Mayor, Borough Administrator, Borough Clerk and Borough Attorney are hereby authorized to draft and execute any and all documents to effectuate the intent and purpose of this Ordinance. 5. Annual Salary for Mayor: payment periods. A salary of Two Thousand Five Hundred Dollars ($2,500) per year, payable in equal quarterly installments with the first payroll in March, June, September and last payroll in November shall be paid to the Mayor of the Borough of Waldwick. Motion: ______ Seconded: ______ Roll Call: _____ _____ _____ _____ _____ _____ _____ Brennecke Cericola-Drake Martinello Ramundo Ritchie Weber Giordano Ordinance No. 2025-#16 AN ORDINANCE TO AMEND SECTION 1, ENTITLED “ESTABLISHMENT; MEMBERSHIP” OF CHAPTER 20 ENTITLED “POLICE DEPARTMENT” TO INCREASE THE NUMBER OF PATROL OFFICERS FROM 13 PATROL OFFICERS TO 14 WHEREAS, N.J.S.A. 40A:14-118 grants the Borough the power to establish a Police Department and to set forth a line of authority as well as the number of members of the same; and, WHEREAS, the Governing Body of the Borough of Waldwick periodically reviews and makes certain adjustments to the department and to the composition of the Department. NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Borough of Waldwick, Bergen County, State of New Jersey that they are desirous of increasing the number of patrol officers from a total of 13 to 14; and, BE IT FURTHER ORDAINED, that Section 20-1 be amended as follows: § 20-1 Establishment; membership. A. There is hereby established in and for the Borough of Waldwick a Police Department which shall consist of the following 21 22 positions. There shall be one Chief of Police, two Lieutenants, five Sergeants, and 13 14 police officers. In addition, there may be a one-to-one relationship of police officers who are in training to take the positions of existing police officer(s) who have given notice of a specific retirement date which is not greater than six months from the date the replacement officer is hired. Once a police officer of any rank has elected to take their retirement and to accept any of the benefits including, but not limited to, terminal leave, accumulated sick time, vacation time or personal days, then and in that event, they cannot change their mind and seek to return to active duty, nor can they withdraw their application for retirement. BE IT FURTHER ORDAINED, that if any section, sub-section, paragraph, sentence, or any other part of this ordinance is adjudged unconstitutional or invalid, such judgment shall not affect, impair, or invalidate the remainder of this ordinance; and, BE IT FURTHER ORDAINED, that this ordinance shall take effect after final adoption and publication as required by law.
