WALDWICK ZONING BOARD OF ADJUSTMENT FORMAL SESSION March 26, 2025 The Formal Session of the Waldwick Zoning Board of Adjustment was held on Wednesday, March 26, 2025 at 8:00 p.m. and was called to order by Adele Badalamenti, Chair, who made the announcement of adequate notice of all meetings. ROLL CALL: Mr. Nieman present Mr. Cericola present Mr. Walsh present Ms. Luppino present Mr. Wekarski present Mr. Centineo present Mr. Sanzo present Mr. Mitchell present Mr. Myerjack absent Also Present: Cliff Singer, Board Attorney Joe Mysliwiec, Zoning Officer Jim McGinnis, Board Engineer Joyce Sinclair, Board Secretary GREETINGS TO THE PUBLIC: No one appeared. APPROVAL OF MINUTES: A motion was made by Mr. Sanza and seconded by Mr. Cericola for the approval of the Minutes of February 26, 2025. The Minutes were approved as submitted. SWEARING IN OF NEW MEMBER: New Member, Bruce Mitchell, Alternate #2, was sworn in. Mr. Mitchell previously served on the Board and was welcomed back. RESOLUTIONS: DALIE 1 Salrit Avenue 24-U Block 120, Lot 9 Convert partial area of garage RESOLUTION LEONE 64 Waldwick Avenue 24-V Block 23, Lot 1 Convert Garage RESOLUTION 1 OATES 74 Moore Avenue 25-A Block 7, Lot 55 Rear 2-story Addition RESOLUTION FREEMAN 59 Bergen Avenue 25-B Block 11, Lot 10 Covered Front Porch, 2nd Story Addition RESOLUTION A motion was made and seconded for the approval of the above resolutions. A vote was taken. The above Resolutions were approved. APPLICATIONS: MILLER 71 W. Saddle River Road 25-C Block 73, Lot 2 Addition and Alteration NEW APPLICATION Bob Murphy, Architect, Frank Vyrnco, Assistant to Mr. Murphy, and John. Miller, Applicant, appeared before the Board. Mr. Murphy noted that the Applicant proposes to build a center hall colonial style home which will replace the house currently on the property that is in disrepair. The current home will be knocked down. Mr. Mysliwiec noted that the home is the second home on the left hand side near the HCA Park. They are in need of a rear yard setback. They are at 22’ and required is 35’. They are also over on floor ratio at 24.8.’ There will be an attached two car garage. Mr. Murphy described the plans and noted the attic will be used for office space. The basement will be partially finished. There will be vinyl siding on the side and rear with cultured stone and stucco in front. Mr. Mysliwiec noted that the portion of finished attic does not count as a story. The ordinance allows 2 1/2 stories. The rear yard setback variance of 22 ' and the floor ratio variance are needed due to the extra space they would like to create to accommodate their large family. There is an easement down the side and it is an awkward lot with an irregular shape. It is not undersized. The shape of the lot affects the placement of the home. Mr. Walsh noted that the back of the house backs up to HCA Park so it does not directly affect any neighbors. Ms. Luppino questioned the 2- 1/2 stories. Mr. Mysliwiec noted that under the uniform construction code, if you finish the attic the limited square footage does not constitute an actual story. Waldwick Zoning allows for a 2- 1/2 story. Mr. Centineo questioned the location of the access to the park was and it was noted that it is along the side. 2 There was no one in the audience to address this Application. The Board members noted they were in favor of the Application noting the irregular shape of the lot and that it does not encroach on any neighbors. The members felt it would be a nice improvement to the neighborhood. A motion to approve the Application was made by Mr. Sanzo and seconded by Mr. Walsh. A unanimous vote was taken. The Application was approved. MILLER 71 W. Saddle River Road SM 25-1 Block 73, Lot 2 Soil Moving Permit Mr. Murphy noted that they will be removing 487.2 cubic yards of soil and importing 724.4 crushed stone, source to be determined. The route of truck traffic will be approved by the WPD. Extra care should be taken as they are near the entrance to the park. The excavation work should take one week. Mr. McGinnis questioned the removal of trees. It was noted that the existing survey does not have the trees located. The Applicant will file for a tree removal permit. Mr. McGinnis questioned whether the soil will be needed for grading, and it was noted that it will all be taken off site, no grading is needed. There was no one in the audience to address this Application. The members were in favor of the Application. A motion for approval was made by Mr. Walsh and seconded by Mr. Sanzo. A unanimous vote was taken. The Application was approved. CABIBBO 35 Mackay Avenue 25-D Block 2, Lot 16 2nd Floor Addition over Garage NEW APPLICATION Salvadore Cabibbo appeared before the Board. The Applicant proposes to add a garage and an addition above with access through the master bedroom. Mr. Mysliwiec noted that the proposal exasperates the legal non conformity, the side yard remains, however, the front will change. The depth sideline triggers the variance. There is ample space and this is an odd shaped lot. The garage is on a slab. There was no one in the audience to address this Application. The Board was in favor of the Application and had no issues. A motion for approval was made by Mr. Walsh and seconded by Mr. Sanza. A unanimous vote was taken. The Application was approved. 3 ROSAZZA 27 Cambra Road 25-E Block 153, Lot 25 Rear Addition and 2nd Story over Garage NEW APPLICATION Lauren Rosazzo, homeowner, and Susan Berman, Architect, appeared before the Board. Ms. Berman explained that the site is in the R-1 zone on a non conforming undersized lot. The existing lot has a non-conforming width of 50’ where 100’ is required. A side yard and combined setback variances are needed. The Applicant’s goal is to provide one floor living for her two boys, age 10 and 13 who have a degenerative disease. Ms. Berman specializes in designing group homes for disabled residents and feels the design proposed will allow the Applicant’s disabled children to be more independent. There is a first floor laundry and an accessible kitchen. The existing home has poor circulation for wheelchairs, this plan opens up the home. The 2nd story will have bathrooms for the parents and future aids as needed. Mr. Mysliwiec noted that the Application exasperates a legally non-conforming dwelling in front and width. They are continuing what is there, the variances for the setbacks are existing, and they will just be going over what exists. There was no one in the audience to address this Application. Mr. Walsh noted the irregular shape of the property and that the existing home is already non-conforming to the setbacks. The Board had no issues with this Application and were in favor of it. A motion for approval was made by Mr. Walsh and seconded by Mr. Sanzo. A unanimous vote was taken. The Applications was approved. LYNCH 80 Moore Avenue 25E Block 7, Lot 59 6’ Fence NEW APPLICATION Ryan Lynch and John Lynch appeared before the Board. It was noted that the existing home was purchased in June. The Applicant would like to replace the current 6’ fence with a vinyl fence, pushing it out for more yard space. Mr. Mysliwiec noted that it is a corner lot which can have a 4' fence permitted, because the next adjacent property is facing Cortlandt Street. They would like to replace it with a solid vinyl fence 6’ fence as a 4' you can see over. Mr. Mysliwiec noted that the original fence is further in. The proposed fence will be put right on the property line. An interesting note is that the edge of pavement is 13 ft. from his property line. He has an extra 3 ft. to where the property starts. The fence will be 13' from the street. 4 There was no one in the audience to address this Application. The Board was in favor of the Application. A motion to approve the Application was made by Ms. Luppino and seconded by Mr. Sanza.
