City Council Docket December 8, 2025 The Waltham City Council will meet in the Council Chamber at City Hall, 610 Main Street, Waltham, MA on Monday, December 8, 2025 at 7:30 p.m. The following matters and others may be considered. Approval of Minutes Regular Meeting of November 24, 2025 Special Meeting – Tax Rate of November 24, 2025 Notice is hereby given that the City Council and the Board of Survey and Planning will hold a Joint Public Hearing in the City Council Chamber, City Hall, 610 Main Street, Waltham, Massachusetts on Monday, December 8, 2025 at 7:30 P.M. on the following proposed amendments to the Waltham Zoning Code: Joint Public Hearing Zone Change On the application of BP Bay Colony LLC and BXP Waltham Woods LLC, both C/O BXP, Inc., 800 Boylston Street, Suite 1900, Boston, MA 02199, to hereby petition the City Council for an amendment to the Zoning Ordinance of the City of Waltham under M.G.L. c. 40A, §5 and Section 7.5 of the Zoning Ordinance of the City of Waltham as follows: Proposed Amendments: I. Amend Zoning District Map to add a new overlay district over the locus titled “Mixed Innovation and Residential Redevelopment Overlay District (MIRROD)”. The locus comprised of the parcels shown on the MIRROD Overlay District Map and known as Assessors Parcels R019 001 001C, R009 002 002C, R009 002 002B, R009 002 0002, R009 002 002A, R010 001 002, R010 001 004, R010 001 005, R009 002 003; and II. Amend Zoning District Map to add a new overlay district over the locus titled “Mixed Innovation and Residential Redevelopment Overlay District 2 (MIRROD 2)”. The locus comprised of the parcels shown on the MIRROD 2 Overlay District Map and known as Assessors Parcels R056 002 019, R056 002 017, and R056 003 001; and 1 City Council Docket December 8, 2025 II. Amend ARTICLE VIII to add a new Section 8.9 — Mixed Innovation and Residential Redevelopment Overlay District 2 (MIRROD 2) in the form substantially on file with the City Clerk. Joint Public Hearing Zone Change On the application of 1265 Main Street, LLC, 77 Fourth Avenue, Suite 310, Waltham, MA 02451, to hereby petition the City Council for an amendment to the Zoning Ordinance of the City of Waltham under M.G.L. c. 40A, §5 and Section 7.5 of the Zoning Ordinance of the City of Waltham as follows: Proposed Amendments: I. Amend Zoning District Map to add a new overlay district over the locus titled “Mixed Innovation and Residential Redevelopment Overlay District 3 (MIRROD 3)”. The locus comprised of the parcels shown on the MIRROD 3 Overlay District Map and known as Atlas Map 48, Block 003, Lots 0001, 001B and 001C; and II. Amend ARTICLE VIII to add a new Section 8.10 — Mixed Innovation and Residential Redevelopment Overlay District 3 (MIRROD 3) in the form substantially on file with the City Clerk. Public Hearing Special Permit (Recessed 11/24/2025) Digital Federal Credit Union, 853 Donald Lynch Boulevard, Marlborough, Massachusetts, 01752, as Petitioner, and Waltham Crossing Nominee Trust, Fredric H. Margolis, Trustee, c/o Growth Companies, 1244 Boylston Street, Chestnut Hill, Massachusetts, 02467, as Owner, hereby petition the City Council of the City of Waltham for a modification of the special permit granted in Order No. 35340 pursuant to § 3.51 and § 3.552 of the Zoning Ordinance. Said Order granted a special permit for use pursuant to § 3.512 (Special permits for use) and § 3.635 (Drive-in customer services) to operate a standalone drive-thru automated teller machine (ATM) within the existing parking lot. The subject premises is shown in the “Atlas City of Waltham, Massachusetts” as: Page 51, Block 7, Lot 1 130 Lexington Street The above property is located entirely in a Commercial Zoning District. Public Hearing Special Permit (Recessed 11/10/25) Middlesex Integrative Medicine, Inc., 155 Federal Street, Suite 402, Boston, MA 02110 and Executive Realty Park Corporation, 29 Juniper Hill Road, Waltham, MA 02452, as Petitioners, hereby petitions the City Council for a modification and/or amendment to the special permit issued in Order # 35737: a) for a change in the floor plans and elevations to reduce the area of the floor plan from 8,079 square feet as approved in the special permit to 3,568 square feet pursuant to §3.5, § 3.51 and § 3.552 of the Zoning Ordinance of the City of Waltham; and b) to expand the operating hours of the facility to allow operation from 8:00 a.m. to 10:00 p.m. Monday through Saturday and from 8:00 a.m. to 8:00 p.m. on Sunday pursuant to §11.6(j) and 12.6(i) of the Zoning Ordinance of the City of Waltham. 2 City Council Docket December 8, 2025 The locus is known and numbered as 305 Second Avenue and is shown in the “Atlas, City of Waltham, Massachusetts 1988”, as Map 39 Block 1 Lot 15. The property is situated in a Commercial Zoning District. Communications from the Mayor 1. The Mayor respectfully requests approval of the acceptance of a gift in the amount of $5,000 from the Bird Precision Charitable Foundation in memory of Carl Cunningham to the Waltham Council on Aging. 2. The Mayor respectfully requests the acceptance of a donation in the amount of $250 from Connors and Connors LLP for the upkeep and maintenance of the Holiday Lights on the Common. 3. The Mayor respectfully requests an appropriation in the amount of $50,000 for the design services of creating a nine-hole par 3 golf course to be located at 200 Trapelo Road. 4. The Mayor respectfully requests an opportunity to go into Executive Session on Monday, December 8, 2025 to discuss strategy regarding security personnel (Purpose 4 of the Open Meeting Law). Ordinances and Rules 1. The Ordinances and Rules Committee recommends the Special Permit modification application for Middlesex Integrative Medicine Inc at 305 Second Avenue be approved. 2. The Ordinances and Rules Committee recommends the Special Permit modification application Order # 35340 for Digital Federal Credit Union at 130 Lexington Street be approved. 3 City Council Docket December 8, 2025 Finance 1. The Finance Committee recommends acceptance of a State grant in the amount of $104,048 from the Executive Office of Aging and Independence to be used by the Council on Aging be approved. 2. The Finance Committee recommends the acceptance of a grant from the Massachusetts Department of Environmental Protection for a SMRP Grant in the amount of $24,500 for the Department of Public Works be approved. 3. The Finance Committee recommends the acceptance of a gift in the amount of $1,500 from the Digital Federal Credit Union for the City of Waltham Fire Department be approved. 4. The Finance Committee recommends the acceptance of a gift in the amount of $2,000 from the Digital Federal Credit Union for the City of Waltham Police Department be approved.
