City of Waltham C OMMONWEALTH OF M ASSACHUSETTS ZONING BOARD OF APPEALS LEGAL NOTICE DATE FILED: May 27, 2025 THE ZONING BOARD OF APPEALS OF THE CITY OF WALTHAM WILL HOLD A PUBLIC HEARING IN THE GOVERNMENT CENTER, 119 SCHOOL STREET, WALTHAM, MA ON July 15, 2025 AT 7:00 P.M. ON THE FOLLOWING: Case #: 2025-21. Petitioner/ Owners: Nicholas F. and Jennifer M. Freehling. Nature of Application/ Petition: Variances and confirm existing non-conformities. Subject Matter: Petitioners intend to construct, use and maintain a single-story addition onto the existing single- family residence. Location and Zoning District: 75 Goldencrest Avenue; Residence A-2 Zoning District. Provisions of Zoning Ordinance Involved: § 3.7225 and § 4.11 Table of Dimensional Regulations. Specific Relief Sought: (1) Variance. § 4.11 states that lots in a Residence A-2 Zoning District shall have a front yard setback of 40 feet. Here, the existing front yard setback is 26.7 feet and the proposed front yard setback shall be 23.9 feet. (2) In the Notice of Decision decided on January 7, 2025, the Zoning Board of Appeals granted certain zoning relief for the locus property at 75 Goldencrest Avenue. The granting of a variance and the decision rendered therein was granted based on the site plan filed therein showing a 26.7-foot front yard setback and a rear yard setback of 52.5 feet. The decision and site land also permitted the construction of a proposed addition to the existing dwelling on the locus. The Petitioners now seek to amend so much of the Decision so that construction and use of the locus shall conform to the site plan filed herewith. The revised site plan shows the proposed addition with a front yard setback of 23.9 feet and a rear yard setback of 49.5 feet.
