B24-0170 – “NEW STUDENT LOAN BORROWER BILL OF RIGHTS AMENDMENT ACT OF
2021”

On Monday, October 25, 2021, Councilmembers Kenyan R. McDuffie, Chairperson of the
Committee on Business and Economic Development, and Councilmember Charles Allen,
Chairperson of the Committee on the Judiciary and Public Safety, will hold a joint public hearing
to consider B24-0170, the “New Student Loan Borrower Bill of Rights Amendment Act of 2021”.
This bill would add affirmative protections for student loan borrowers. Notably, this bill would,
among other things:
• Require the District’s Department of Insurance, Securities and Banking to automatically
certify student loan servicers;
• Ensure borrowers obtain answers to inquiries submitted to their student loan servicers,
along with notice when their loans are transferred or sold to new student loan servicers;
• Proscribe private education lenders a set of responsibilities regarding disability discharge
and cosign release;
• Prohibit student loan servicers from misleading, deceiving, or otherwise harming
borrowers; and
• Require a revision of the Student Loan Borrower Bill of Rights by October 1, 2022.

The Committees invite the public to testify remotely or to submit written testimony. Anyone
wishing to testify must sign up in advance at BusinessEconomicDevelopment@dccouncil.us, or
by phone, and providing their name, phone number or e-mail address, organizational affiliation,
and title (if any), by 5:00 p.m. on Thursday, October 21, 2021. Witnesses are encouraged to
electronically submit written testimony in advance of the hearing to
BusinessEconomicDevelopment@dccouncil.us. Public witnesses will participate remotely; the
Committees will follow-up with witnesses with any additional instructions on how to provide
testimony through a web conferencing platform.
All public witnesses will have a maximum of three minutes to testify. The length of time provided
for oral testimony may be reduced or extended at the discretion of the Committee Chairs.
The Committees encourage the public to submit written testimony to be included for the public
record. Copies of written testimony should be submitted by e-mail to
BusinessEconomicDevelopment@dccouncil.us. To be included in the record, please indicate that
you are submitting testimony for this hearing in the subject line of the e-mail. The record for this
hearing will close at 5:00 p.m. on Tuesday, October 26, 2021.
For accommodation requests, including spoken language or sign language interpretation, please
BusinessEconomicDevelopment@dccouncil.us of the need as soon as possible, but no later than
five (5) business days before the proceeding. The Council will make every effort to fulfill timely
requests. However, requests received less than five (5) business days prior to the hearing may not
be fulfilled and alternatives may be offered.
