Washington, D.C. 20004 On Monday, May 13, 2019, Councilmember Kenyan R. McDuffie, Chairperson of the Committee on Business and Economic Development will hold a public hearing to consider Bill 23-0116, the "Warehousing and Storage Eminent Domain Authority Act of 2019," Bill 23-0117, the "Underground Facilities Protection Amendment Act of 2019," and Bill 23-0135, the "Power Line Undergrounding Program Certified Business Enterprise Utilization Amendment Act of 2019." The stated purpose of }3ill 23-0116 is to authorize the acquisition through the exercise of eminent domain of certain property located on W Street, NE for warehousing and storage purposes. The District government has a significant need for warehousing and storage equipment, records, property, and supplies, and the District's need nearly exceeds the current capacity. at its owned , facilities. The property on W Street, NE, east of Brentwood Ro~d, has. been identified as a stronR site for warehousing and storage purposes. The stated purpose of Bill 23-0117 is to amend the District's excavation safety law, the Underground Facilities Protection Act of 1980 ("UFPA"), to better protect underground facilities such as gas and water lines. Currently, UFPA may only be enforced in the District of Columbia Superior Court however, this bill would grant the Department of Consumer and Regulatory Affairs enforcement powers. Lastly, the stated purpose of Bill 23- 0135 is to clarify and update certain provisions of the Electric Company Infrastructure Improvement Financing Act of 2014 to expand contracting opportunities for certified business enterprises. The bill would amend the 100% goal in the current law to award the DC power line underground program (DC PLUG) construction contracts to certified business ent~rprises in the District rather than just businesses in the District that may not be certified. For witnesses who are unable to testify at the he~ing, written statements will be made part of the official record.
