Personnel Committee Official Meeting Minutes October 19, 2015 – 6:00 p.m. Present: Allen, Bell, Filut, Pollnow Excused: Vaccaro Also present: Rebecca Ewald and Chief Mueller Filut called the meeting to order at 6:08 p.m. Pollnow moved and Allen seconded to approve the August 17, 2015 with minor corrections. Motion carried. The Committee discussed the updated Deputy Treasurer and Utility Clerk position description. The Committee discussed that the prior Deputy Treasurer/Clerk position when it was combined the job description required that certification through the Clerk and Treasurer’s Institute in Green Bay which is a one week commitment for three years. There is no statutory requirement that the deputy clerk and deputy treasurer obtain this certification. It was discussed that training and certifications should be evaluated annually by the supervisor and budgeted accordingly when necessary. This may change with positions as they evolve. Filut moved and Pollnow seconded to approve the descriptions for Deputy Clerk & Court Clerk and Deputy Treasurer & Utilities Clerk with the deletion of a certification requirement, as none were required by state statute. Motion carried. Filut moved and Bell seconded to recommend approval of the employee assistance contract for 2016, requesting the Administrator to request a quote from Aurora for a three year contract and forward the alternative quote to the Village Board. Motion carried. On May, 18, 2015 the Personnel Committee met regarding the rescue lieutenant job classification, see minutes attached. The Committee recommend Village Board approve (2) full-time Captain’s with a pay range of $24-$26/hour with funding from anticipated additional rescue revenue in 2015. After this item was discussed, the Fire Chief considered an alternative option, (2) part time dayshift positions daily that could be staffed by several individuals. Individuals filling this position each shift would receive $7.50 hourly. If a call is received during their shift they would also receive their hourly rate based upon qualification while on the call. It was noted that funding for these positions would be paid for utilizing existing revenues. Pollnow moved and Allen seconded to recommend the positions to the Village Board. Motion carried. The Chief reviewed an organizational chart reflective of the lieutenant position above that also reflects the desired level of staffing for the department. It may not be feasible to have the department staffed to this capacity, but it is the desired level. Allen moved and Filut seconded to table this item until November when a draft Standard Operating Guideline may be reviewed by the Committee to support the recommendations discussed at the meeting. Motion carried. Pollnow moved and Allen seconded to adjourn into closed session pursuant to WI Statute 19.85(1)(c) and (e) and to discuss employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility, to deliberate or negotiate over the purchase of public property, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session: specifically, to discuss health insurance benefits for specific employees and to discuss potential changes to the carrier, coverage and cost of the current health insurance plan; and pursuant to Wisconsin Statute s. 19.82(1), 19.85 (1)(e) and 19.86 to review Teamster No. 43 union proposal by roll call vote: Allen – aye Bell – aye Filut – aye Pollnow – aye The meeting adjourned into closed session at 8:15 p.m. Pollnow moved and Bell seconded to reconvene into open session at 8:55 p.m. Motion carried. PERSONNEL COMMITTEE Monday, October 19, 2015 6:00 P.M. The Personnel Committee will hold a meeting on Monday, October 19, 2015, at 6:00 p.m. in the Village Hall, 123 N. River Street, Waterford, WI. AGENDA Call to Order Approval of the Minutes 1. Review and act on August 17, 2015 minutes. Old Business 2. Review and provide a recommendation on Deputy Treasurer/Utility Clerk job description. a. This revised description was accidently not included in the August meeting packet.  The Committee is requested to provide a recommendation on the revised description. 3. Review and provide a recommendation on the Deputy Clerk/Court Clerk job description. a. This revised description has been reviewed by the Clerk and Municipal Judge as was a description listed for update after conclusion of the municipal court analysis in 2014 to be reflective of changes in time allocation, split equally between Deputy Clerk and Court Clerk duties, and the tasks associated with revised protocols for municipal court.  The Committee is requested to provide a recommendation on a revised description. 4. Review and provide a recommendation on employee assistance program. a. Last year the Village moved forward with contracting with Aurora to provide an Employee Assistance Program (EAP). b. The Village Board requested the agreement to reflect a one year term with the option of extension. They also desired to review the usage of the program prior to moving forward with additional years and a comparison of cost to what it would be for the Village to pay for individual services or have one set rate annually. c. Contract cost for 2015 was $2,264 and include 4 hours of on-site educational programs such as management or employee enrichment trainings. The fee also includes unlimited in-person overview trainings and supervisory orientations. Local office for the program is in Wauwatosa. As discussed in 2014 the program provides the following: i. Crisis response services are available 24/7 and will come on site for an unlimited number of hours. They will provide us with procedures to follow to measure what resources are needed. ii. Agreement is annual from date identified. Aurora agreed to a three year set rate, but did note they rarely have increases for service. iii. Yes, they will do orientations on multiple shifts, different times of the day of an unlimited number included in the annual fee. d. The Village has completed one year with the employee assistance program and the following is a description of usage.  The Committee is requested to provide a recommendation on continuation of the program. New Business 5. Review and provide a recommendation on rescue lieutenant job classification. a. On 5/18 the Personnel Committee met with the Personnel Committee regarding the rescue lieutenant job classification, see minutes attached. The Committee recommend Village Board approve (2) full-time Captain’s with a pay range of $24-$26/hour with funding from anticipated additional rescue revenue in 2015. b. The Fire Chief will be present at the meeting to review this concept and get input from the Committee.  The Committee is requested to discuss and possibly provide a recommendation on staffing for the rescue position. 6. Review and provide a recommendation on organizational structure of the fire and rescue department. a. Attached is a description of the current organizational structure. The Chief will provide proposed revisions at the meeting for the Committee’s consideration.  The Committee is requested to provide a recommendation on the proposed structure. 7. Update on meeting with medical director for rescue department. a. On 10/13 the Village Board listened to an educational session led by the rescue department’s medical director Dr. Schultz. Attached is a spreadsheet of the various levels of pre-hospital emergency care. The Village is currently licensed to provide care at the Advanced Emergency Medical Technician (AEMT) level.  This is informational only. No action required. Closed Session 8. Posted 10/16/15, 5:00 p.m. Personnel Committee Unofficial Meeting Minutes August 17, 2015 – 6:00 p.m. Present: Allen, Bell, Filut, Pollnow, Vaccaro Also present: Lori Peternell and Rebecca Ewald Filut called the meeting to order at 6:00 p.m. Pollnow moved and Bell seconded to approve the May 18, 2015 with minor corrections. Motion carried. Filut provided an update on the advertisement of the snow removal position. The Committee reviewed the position of the Deputy Treasurer & Utility Clerk wages. The job description was not included in the packet so it will be provided at the following meeting. The Committee reviewed the election worker wages for consideration for 2016. Peternell updated on the proposed Department of Labor changes to overtime rules. It is unknown when this item will be taken up by the federal government for action. The Administrator updated on the minimal rate increase for life, AD&D and short term disability insurance. As discussed previously with the Committee and Village Board, no changes would be made to this item until health insurance was reviewed in 2016. Pollnow moved and Vaccaro seconded to adjourn into closed session pursuant to Wis. Stat. 19.85(1)(c) to review wages and compensation of Village employees and for the purpose of considering Teamster No. 43 union proposal in accordance with Wisconsin Statute s. 19.82(1), 19.85(1)(e) and 19.86 by roll call vote: Allen – aye Bell – aye Filut – aye Pollnow – aye Vaccarro The meeting adjourned into closed session at 6:36 p.m. Vaccaro moved and Allen seconded to recommend a wage increase for the Deputy Treasurer & Utility Clerk effective upon approval by the Village Board to $16.39. Motion carried. Bell moved and Allen seconded to recommend the election workers hourly rate be set at $9/hr and chief election inspectors $10.50/hr. effective January 1, 2016. Motion carried. Vaccaro moved and Pollnow seconded to request the Administrator to confer with legal counsel regarding the interpretation of the CPI utilized for negotiations with Teamster No. 43. and provide the information to the Village Board for review and possible action by the Village Board. Motion carried. Allen moved and Pollnow seconded to recommend a 15% employee contribution for health insurance premiums for 2016. Motion carried. Respectfully submitted, Rebecca Ewald Village Administrator DEPUTY TREASURER & UTILITY/DPW CLERK GENERAL GOVERNMENT AND DEPARTMENT OF PUBLIC WORKS REGULAR FULL TIME, NON-EXEMPT For duties as Deputy Treasurer this position reports to the Village Treasurer, and is responsible for assisting the Treasurer, Administrator and Building Inspection Offices as directed. For duties as the Utility Clerk this position reports to the Director, and is responsible for assisting the Department of Public Works as directed. Village Hall office hours are Monday – Friday 8:00 a.m. to 5:00 p.m., in addition to evening meetings. Essential Duties and Responsibilities · Provide secretarial and clerical assistance to Director and Assistant Director. · Primary staff coordinator for the Public Works & Utilities Committee, preparing agendas, packets and minutes. · Maintain filing system and destruction or records for the department. · Assisting the Director and Treasurer with preparation of the annual budget. · Prepares the quarterly billing for the utilities. · Prepare and files Consumer Confidence Reports (CCR). · Preparing delinquent water and sewer bills and forwarding to Treasurer to be placed on tax roll. · Assist the Treasurer Director with preliminary, annual audit and public service commission reports. · Prepare and execute final readings, shut offs, disconnects and reconnects of water meters. · Process connection and impact fees from new construction. · Respond to telephone, walk-in and electronic information requests from the public, questions, complaints and refer to appropriate personnel when appropriate. · Issue weed notices as requested from Director and follow up the weeds notice. · Record safe samples and coordinate mailing of water samples; coordinate pickup and track water samples for delivery confirmation. · Filing water and sewer information in property files. · Record lights out when requested. · Assist with Village name badges as needed. · Prepare information for the newsletter and public information materials as directed. · Coordinate and prepare the annual recycling calendar and vendor communication with disposal agencies. · Processing of banner permits, community building and park rentals, and special event permits. · Other tasks as assigned. Special Requirements & Skills The previous job description for Deputy Clerk/Treasurer stated that certification as a Deputy Clerk and Treasurer was required. There is no certification for a Deputy Treasurer. Will this position be required to be certified as a Treasurer? To my knowledge when there is a full-time Treasurer the Deputy does not also obtain certification. UTILITY/DPW CLERK SPECIAL REQUIREMENTS AND SKILLS Knowledge of general accounting methods. For duties as the Court Clerk this position reports to the Municipal Judge and is responsible for assisting the administration of the municipal court. Village Hall Office hours are Monday – Friday 8:00 a.m. to 5:00 p.m. in addition to evening meetings. Essential Duties and Responsibilities • Receive telephone and walk-in information requests from the public and handle any counter business. • Provide secretarial and clerical assistance to the Administrator, Clerk, Treasurer, Inspectors and Judge. • Attend continuing education for all areas as required. • Other duties as assigned. Support to the Court Clerk Duties in the following areas: • Download all citations from WIJUS to Quick Clerk. Reconcile WIJUS download with physical citation copies; ensure all citations are received from the deputies and that they were processed accurately with the proper Court Jurisdiction. Inform Sheriff Supervisor of any errors. • Maintains accurate records for the Court including the docket of the Court proceedings and receipt book showing the fines and fees collected in each case. Record receipts in Quick Clerk and prepare a receipt for every payment received. • Schedules, prepares and mails notices to defendants for pre-trials, trials and review hearings, notify defendants, and those summoned to court, in a timely manner of Court appearances and inform them of penalties for failure to appear. • Organizes cases having overdue fines and those which are summoned to court for indigency hearings. • Forwards past due cases to the Court Collection Agency as directed by the Municipal Court Judge. • Prepares the Municipal Court Monthly Financial Report that lists all fees to be paid to the State Comptroller's office and other parties. Distributes fines collected for restitution payments to victims and warrant fees to Racine County Sheriffs Office. • Prepares subpoenas and summons for witnesses scheduled to testify at Court hearings. • Prepares arrest warrants at the direction of the Municipal Court Judge and in compliance with state law and Court policy and forwards to Racine County Sehriffs Office • Notifies Municipal Court Judge of telephone pleas, requested postponements or settlements regarding pending cases. • Prepares and mails notices for new court dates, requested continuances or fine payment extensions. • Effectively communicates Court procedures to defendants and assists them with obtaining legal documents as needed. • Prepares schedules and reviews alcohol assessment forms with necessary defendants and forwards to appropriate state assessment agency. • Staffs Court office during Court Administration hours, every Thursday from 9 am to 1 pm. • Prepares and attaches plea negotiation cover sheet to each case scheduled for court. • Be present during Court sessions on 3rd Tuesday and Wednesday of every month, check in each party, record any amended state statute and fine amount according to plea negotiation in QC, receive fine payments, set up payment plans, issue adjournments, pre-trials, trials or other various notices as directed by Municipal Court Judge and Village Attorney and maintain order. Record all trials with electronic device and maintain recorded file for possible appeal requests. • Records, generates and mails all guilty by default notices to defendants after court, including past due parking ticket notices. • Records, generates and mails Registration Suspension Forms and payment to DOT for parking citations 60 days past due. Send satisfies to DOT when payment is received. • Electronically transmits adjudications for all traffic cases and underage drinking citations to DOT. • Forwards copies of all documents to both Village Attorneys and the Defense Attorney for all cases scheduled for pre-trial and trial. • Is in compliance with state law; performs other duties such as delivering all case documents, appeal bonds and transcripts to the County Court upon appeal. • Develops, manages, and maintains all data processing of Court records. • Prepares statistical reports for the Municipal Court Judge, Village Board, the State Comptroller, and others; prepares other financial reports including the weekly cash deposit. • Reviews new City ordinances to ensure that all new enforcement ordinances are implemented and processed in accordance with Court policy. • Prepares annual calendar of court dates for approval by the Municipal Court Judge. • Annually updates the Village of Waterford Deposit Schedule. • Performs other related duties as requested by the Municipal Court Judge. Pre-Court • Organization of cases scheduled for initial appearance and review hearings. • Organization of cases having overdue fines and those which are summoned to court for indigency hearings. • Arrange to have sufficient change for parties paying fines by cash. • Organization of cases where parties have previously paid by mail and holding of payments received. • Compilation of correspondence from parties or attorneys regarding pending cases. • Advise Judge as to telephone pleas, requested postponements, or settlements regarding pending cases. • Prepare notices for new court dates or payment extensions. In Court • Be present in Court Tuesday and Wednesday sessions. • Locate files for parties that appear and attach pretrial sheet to each file. • Collect fines and write receipts for parties paying fines on the day of Court. • Answer any telephone calls which may occur. • Contact witnesses in cases of last minute trial settlements. • Prepare and go over alcohol assessment forms with parties. • Address envelopes and default cases. • Monetary count of fines collected. • Compilation of warrant cases and overdue fine letter cases as organized by Judge. • Monitoring of tape during trials. • Issue adjournments and set up payments plans for individuals who appear in court as directed by the Village Attorney or Judge. Post-Court • Bank deposit of fines collected. • Submit transaction detail to Village for disbursements to agencies. • Transmittal of citation convictions and alcohol assessment orders to Department of Motor Vehicles. • Compilation and balancing of court docket/fines sheet for cases handled. • Prepare overdue fine letters using our form letter. • Prepare warrants using our warrant form. • Forward copies of citations and incident reports to Village Attorneys for cases scheduled for pre-trials and trials in the following month. • After Village Attorneys have decided which witnesses they intend to have testify at trial, prepare witness subpoenas using the Village form. • Advise Judge as to parties apprehended on warrants. • Collect fines and restitutions received during the month. • Assist the judge in updating roster of partial fines and restitutions. • Issue first and second parking notices for late parking tickets. • Prepare vehicle registration suspension forms for overdue parking tickets and submit to the Wisconsin Department of Transportation. Motion carried. The Committee reviewed the joint fire employment application for applying for three departments: Eagle Fire Department, Mukwonago Fire Department and Waterford Fire Department. Mueller stated that all three departments seek part time employees that may desire to work in multiple departments given their various schedules and availability. This is another attempt to increase the poll of eligible applicants for part time work for the fire and rescue department and increases awareness of applicants regarding the availability for employment. The application has been reviewed by legal counsel and recommended amendments were incorporated into the application. Pollnow moved and Bell seconded to recommend Village Board approval of the joint fire employment. Motion carried. The Fire Chief was present to ask the committee to consider the promotion of two full time EMS positions. When the previous full time EMS officer left the Chief tried to creatively fill that position with three part time employees. This plan has not produced the results that he was looking for and that the department needs. This plan did allow the promotion of two professional EMS persons to the position for a strong push off, however the addition of 24 hours to their 56 hour work week has created some negative consequences. One of the EMS Lieutenants could not keep up with the hours and has resigned and the other two are not keeping up with their expected two twelve hour shifts per week. This has created more work for the two Lt's that remain and the Chief. The three part time lieutenant positions created some consistency if the three of them each worked two twelve hour’s shifts each week. Now we are only getting two people 2 to 3 days a week total. This lack of consistency means that the Chief is the consistency component resulting in him working well over 40 hours per week instead of the 27 hours a week that he committed to. The Chief cannot find a way to reduce his hours and still maintain our service level without more consistent help. Because of the lack of consistency the department is always behind on quality assurance review. Reports get backlogged and when an EMS Lieutenant does work they are forced to spend the majority of their time behind a computer screen doing quality assurance. As we move this EMS system forward toward higher levels of care it is essential that we have strong leadership. This position is anticipated to work an estimated additional 12 hours/week that include trainings, and Sunday crew duties. To accommodate for this, the proposal represents a pay range from $24-$26/hour. The 2015 budget represents a total cost of $80,453 for (3) part-time rescue lieutenants. If approved, staff recommends utilizing rescue billing and collections revenue to cover the additional costs that will be incurred in 2015. The Chief recommended reclassifying the position from a Lieutenant to a Captain. The Committee requested clarification from the Personnel attorney on whether the job classification could be either an exempt or non-exempt and how to accommodate for the additional hours over 40/week could be incorporated into the position. Allen moved and Vaccaro seconded to recommend Village Board approval of (2) full-time Captain’s with a pay range of $24-$26/hour with funding from anticipated additional rescue revenue in 2015. The Committee requested the Chief to research comparable wages in other communities and provide to the Village Board as part of the recommendation. Motion carried. Filut moved and Vaccaro seconded to adjourn at 7:45 p.m. Motion carried.
