Public Works & Utilities Committee- OFFICIAL Village of Waterford September 15, 2014 – 4:00PM Present: Members Baker, Houston and Chairperson Koeller Excused: Members Goldammer and Nash Also Present: Jeff Dolezal, Carol Ewald and Cary Norbert Chairperson Koeller called the meeting to order at 4:00PM. Motion made by Houston, seconded by Baker to approve the minutes from the August 18, 2014 meeting. Motion carried 3-0. The Committee reviewed the Amendment to the Special Event Permit for the River’s Edge Art Walk sponsored by Absolutely Waterford. Motion made by Houston, seconded by Baker to recommend Village Board approval of the Amendment to the Special Event Permit for the River’s Edge Art Walk. Motion carried 3-0. The Committee reviewed the Special Event Permit for the Walk to School sponsored by St. Thomas Aquinas School. Carol Ewald was present for questions. Motion made by Baker, seconded by Houston to recommend Village Board approval of the Special Event Permit for the Walk to School. Motion carried 3-0. The Committee reviewed the request from WE Energies to install a new pedestal at the Ten Club Park. As part of the Hwy 83/20 reconstruction a new traffic signal will be installed at the corner of Main Street and 1st Street in Mid November. To provide service to the new DOT traffic control box WE Energies will need to install a new pedestal and extend new underground cable to the northeast about 50’ to the north property line. The remaining cable would be installed on the DOT parcel. Motion made by Houston seconded by Baker to recommend Village Board approval to install the new pedestal. Motion carried 3-0. Discussion was held on the Whitford Park Rental Agreement/Permit reimbursement policy for the cleaning bond when Village personnel are contacted after hours. The contract currently states “If an emergency arises please call Racine County Dispatch at 534-5166. Should Village personnel be called for non-emergency assistance after hours, a $50 fee will be charged to the lessee.” Director Dolezal will occasionally have an employee on duty at Whitford Park for a few hours on the weekends. If an employee that is already on the clock and is contacted by a customer who has rented the facility, should there is still be a $50 fee? Director Dolezal suggested changing the agreement to read “Should Village personnel be called in for non-emergency assistance after hours, a $50 fee will be charged to the lessee.” Motion made by Baker, seconded by Houston to recommend Village Board approval to add the word “in” to the Whitford Park Rental Agreement/Permit for more clarification. Motion carried 3-0. Discussion was held on removing the Village employees name from the Whitford Park Rental Agreement/Permit. Page two of the agreement currently says “Cleaning – When you enter the center and the room, please check around for any unusual damage or dirtiness. If this situation exists, call Jim Bergles 210-1208 to report this.” Director Dolezal requested the above sentence be removed from the agreement. If the customer has an emergency or requires assistance they should contact the Racine County Dispatch at 534-5166. Motion made by Houston, seconded by Baker to recommend Village Board approval to remove the sentence. Motion carried 3-0. Discussion was held on the purchase of a new snow plow truck. The new truck will replace the 2002 International Plow truck that was scheduled to be replaced this year and is currently funded at $130,000 in the DPW Large Equipment Capital Budget. Director Dolezal provided the cost to purchase a new one from Lakeside International for: 1. Purchase price of truck chassis $84,975.00 2. Up fit plow, wing and dump body 63,193.00 3. Trade in value of current truck -18,000.00 4. Total: $130,168.00 Dolezal will negotiate the trade in value. He is also waiting for prices from two other competitors and will provide those to Village Board at the 9/22 meeting. The truck will have to be ordered so it will be approximately 5 months before the Village would receive it. Motion made by Baker, seconded by Houston to recommend Village Board approval to purchase a new snow plow truck from the company with the lowest price. Director Dolezal gave his report. They are starting cross walk painting this week; hydrant flushing will begin the first week in October; the DNR rep appointed to the Village has moved on so he will be working with someone new; the meter change out program is going good. The Committee reviewed Special Plan Commission Minutes for August 1, 2014; Plan Commission Minutes for August 20, 2014; Baxter & Woodman’s September monthly report. Public Works & Utilities Committee September 15, 2014 4:00 P.M. The Public Works & Utilities Committee will meet on Monday, September 15, 2014 in the Village Hall, 123 N. River Street, Waterford, WI. Call to Order Public Appearances & Permits Approval of Minutes 1. Review and act on August 18, 2014 meeting minutes. Unfinished Business New Business 2. Review and provide recommendation of amendment to the Special Event Permit – River’s Edge Art Walk Oct 10th sponsored by Absolutely Waterford. a. The initial Special Event Permit was approved by this Committee at the April 21, 2014 meeting. b. Absolutely Waterford has submitted a request to include the use of the empty lot located at the southeast corner of 83 and 20 (where Martini Mo’s was located) for a musical addition to the River’s Edge Art Walk on October 10th. c. There will be a number of musicians, a generator and instruments. There will also be a temporary tent installed with tables and signage for the event.  The Committee is requested to review and provide recommendation on the amendment to the special event permit. 3. Review and provide recommendation of Special Event Permit –Walk to School on Oct 8th sponsored by St. Thomas Aquinas School.  The Committee is requested to review and provide recommendation on the special event permit. 4. Review and act on WE Energies request to install a new pedestal at the Ten Club Park property. a. Review and act on the Whitford Park Rental Agreement/Permit reimbursement policy for the cleaning bond. a. A customer rented the Whitford Park pavilion for a family picnic scheduled for Sunday August 17th. She paid the required fee of $75.00 for resident and $150.00 cleaning bond to reserve the facility. b. The customer did not pick up the key at Village Hall, as the contract states, by 5pm on Friday August 15th. She went to Whitford Park on Saturday August 16th to make arrangements with Mark Collins (DPW Employee) or Mike Borchardt (Waterford Youth Baseball organizer) to unlock the pavilion for her picnic on Sunday. She happens to know both individuals personally. c. The Rental Agreement/Permit states “If an emergency arises please call Racine County Dispatch at 534- 5166. Should Village personnel be called for non-emergency assistance after hours, a $50 fee will be charged to the lessee.” A copy of the Rental Agreement/Permit is included in your packet for review. d. Staff refunded the customer $100 of the cleaning bond after deducting the $50 fee for Village personnel’s non-emergency assistance after hours. 1 e. Occasionally Director Dolezal will have an employee on duty at Whitford Park for a few hours on the weekends. Katy Engels was present for questions. Motion made by Baker, seconded by Nash to recommend Village Board approval of the Special Event Permit for the Waterford Fall Harvest Festival. Motion carried 5-0. The Committee reviewed the Special Event Permit for the Lions Chicken BBQ sponsored by the Waterford Lions Club. Motion made by Houston, seconded by Goldammer to recommend Village Board approval of the Special Event Permit for the Lions Chicken BBQ. Motion carried 5-0. The Committee reviewed the Special Event Permit for the Pancake Breakfast sponsored by the Waterford Lions Club. Joe Huelskamp was present for questions. The Committee reviewed the Special Event Permit for the Waterford Union High School Homecoming Parade and Fireworks sponsored by the Waterford High School. Keith Brandstetter, Shannon Clarksen and Sue Plato were present for questions. Motion made by Houston, seconded by Goldammer to recommend Village Board approval of the Special Event Permit for the Waterford Union High School Homecoming Parade and Fireworks. Motion carried 5-0. Motion made by Nash, seconded by Goldammer to move item #7 up on the agenda. Motion carried 5-0. Gene Tess was present to discuss his concerns about the 2 hour parking restrictions on the west side of 2nd Street. Due to the current two hour parking signage, his tenants have no where to park on the west side of 2nd Street across from his properties at 113–115 and 119 south 2nd Street. Parking is only allowed for two hours at a time between the hours of 6AM to 6PM except for Sundays and holidays. The Committee discussed completely removing the signage and how that would affect the surrounding business owners. Houston said if there is push back from the business owners the Committee would have to revisit the signage. Motion made by Nash, seconded by Houston to recommend Village Board approval to remove the 2hr restriction from the pole south to Elizabeth Street. Motion carried 5-0. Motion made by Baker, seconded by Nash to approve the minutes from the July 21, 2014 meeting. Motion carried 5-0. Update was given on the current condition and locations of the banner poles. The Village provides non-profit organizations an opportunity to advertise their events free of charge using three different locations throughout the Village. Director Dolezal has replaced the existing poles with much sturdier 4x6 posts at all three locations and they look great. Director Dolezal explained the Wisconsin DOT Lane Closure Procedures for state highways. It was brought to the Village’s attention that permits must be obtained from the Department of Transportation any time a state highway within the village is: closed, detoured or uses temporary signage, directional signage or banners. This would include special events such as parades, celebrations, street fairs, races, movie or television production, and other activities officially supported by the municipality. The two state highways within the Village this affects are Highway 83 & 20 3 (West Main St and 1st St). Director Dolezal will require specific information from the event planner so he can submit a request to obtain the necessary permits. This information is then relayed to the Wisconsin Lane Closure System (WisLCS) and shared with other WisDot applications such as 511 Traveler Information, Statewide Traffic Operations Center (STOC), Advanced Traffic Management System (ATMS), Email Lists, Oversize/Overweight (OSOW) permitting, Construction Maps, Special Project Websites and WisDOT websites. The permit requires that the Village take full responsibility and liability for all closures of these roads including utilizing state approved signage and barricades. The Village currently does not have the required signage and barricades to close roads in accordance with the state requirements. The Lion’s Club 4th of July parade is the largest road closure requiring the most significant amount of barricades so the parade leaders have offered to construct state compliant barricades for utilization at this parade and for utilization by other organizations that conduct parades in the Village. Director Dolezal gave his report. He explained the sanitary survey report and this is required every three years by the DNR. Overall, the Village is in very good condition with only a few deficiencies that need to be corrected. Dolezal will be meeting with the DNR to request an extension on the compliance deadline. The TDS fiber optic project is in process. Absent: Craig Kosut. Also Present: Laurene and David Schroeder, and Deanna and Tom Vlach. The meeting was called to order at 8:00 a.m. by Chairman Tom Roanhouse. Public Hearing David Schroeder provided a brief summary of his Conditional Use Permit application submitted for 816 Ela Avenue, Unit E for his new business called Midwest Panther. Motion made by Bryant, seconded by Christensen to close the public hearing for the conditional use permit for Midwest Panther for 816 Ela Avenue, Unit E. Motion carried. Deanna Vlach provided a brief summary of her Conditional Use Permit application submitted for 826 Mohr Avenue, for her business, Geneva Healthcare. She also indicated that the ventilation system is under review for the building and she is working with HVAC professionals, an architect and the Village building inspector. The Plan Commission was requested to review and act on conditional use permit application submitted by Geneva Healthcare to move and open their business at 826 Mohr Avenue. Motion made by Christensen, seconded by Perez to approve the conditional use for Geneva Healthcare for the location at 826 Mohr Avenue with the condition that the ventilation meet the requirements per manufacture specifications and to add more landscaping on the west side of the building to screen the business from the residential area across Buena Park Road. Correspondence The Plan Commission was provided a copy of an email From Tina Chitwood, RCEDC Staff, that contained a follow up reply from WisDOT regarding the lighting/streetscape plans. Bryant moved to adjourn, seconded by Christensen at 8:21 a.m. Motion carried. 18 Village of Waterford PLAN COMMISSION MINUTES August 20, 2014 Chairman Roanhouse called the meeting to order at 6:00 p.m. Attendees: Tom Roanhouse, Tom Christensen, Gonzalo Perez, Howard Bryant, Bil Luth, Craig Kosut, Dennis Gahagan. Others attending: Rebecca Ewald, Marcia Hasenstab, Jeff Dolezal, and many other residents. Public Hearing A public hearing was conducted regarding the Conditional Use Application for Waterford Metal Recyclers – Matthew & Mitchell Joas Proponents for the conditional use were Daniel Donegan, Plan Commissioner and resident of the Village of East Troy; Dave Jones, 623 Annecy Park Circle. Opponents for the conditional use were Judith Salas – Miller, 703 Willow View Drive; Ken Krueger, 634 Annecy Park Circle; Jim Phillips of River City Auto Body at 814 Bakke Avenue; Bruce & Anita Parnau, 789 Still Pond Drive; Ken Neu, 613 Annecy Park Circle Park; Deborah Madsen, 908 Stone Circle Court; Michael Mitchell, 806 Willow Bend Drive; and Edmund Kielpinski at 624 Annecy Park Circle. Period of Public Comment - Cary Norberg presented a petition to keep the Waterford Safety building at 122 N. 2nd Street for what it is currently being used which is a Fire/Rescue and Safety, Do not change the safety building to a bar, restaurant, convention center, banquet hall or anything else besides a park with green space and stop pursuing or allowing the acquisition or conversion of any private property in the Village for the purpose of a pedestrian/bike trail or riverwalk. Minutes Motion made by Kosut, seconded by Christensen to approve the August 1, 2014 Special Plan Commission Minutes. Old Business The Village did not receive funding for the bridge outlooks or pathway from the Transportation Alternative Program. The Village has asked the DOT for a meeting to review the applications. No action taken on this agenda item. New Business The Commission members were requested to review and act on the Conditional Use Application for 812 Bakke Avenue for Waterford Metal Recyclers. The Joas family would like to start a metal recycling operation in Waterford. The plan involves recycling of metals inside and steel roll-offs outside to be moved to an end processor. The complete conditional use application, site plan and details can be found in your packet as a separate attachment. The staff has reviewed the conditional use permit and has addressed any outstanding concerns which are in the Conditional Use Form except Baxter & Woodman’s review which is a separate letter included with the application materials. Motion made by Christensen, seconded by Gahagan to deny the conditional use permit for Waterford Metal Recyclers at 812 Bakke Avenue. Motion carried. [7:0] The Commission members were asked to review and provide recommendation on design elements of the SHT 83-20 plans. The Interim Alternative - At the local officials meeting on 8/5 the DOT reviewed an interim alternative cross-section for a portion of the roadway. This interim alternative would have 19 the same overall roadway width, but would allow for one lane of traffic in each direction separated by a continuous center two-way left turn lane (TWLTL) from Buena Park Road to Jefferson Street. Between Jefferson Street and First Street the interim alternative includes 2 traffic lanes eastbound and one traffic lane westbound with parking on both sides of the street. This interim may be implemented with the construction of the project; however, at some time in the future when safety and traffic volumes warrant the need, the roadway pavement marking would be changed to implement the 4-lane preferred alternative. The interim alternative from Buena Park Road to Jefferson Street would provide dedicated bike lanes in both directions. Motion made by Bryant, seconded by Kosut to approve the temporary change of traffic patterns with the interim alternative with criteria communicated as to when the change will be made in the future. Additional DOT right-of-way from 201 E. Main Street – at the local officials meeting on 8/5 the DOT relayed that they would like to obtain five additional feet of right-of-way from the property owners of 201 E. Main Street (Rogalski’s/Martini Mo’z site) for purposes of enlarging the right hand turn lane for better ease of use. GRAEF did not include this change in design into their concept plan, as they believe it eliminates space that the Village could encourage the property owner to utilize as a public plaza on the corner of the property. Please note information will be sent to the Commissioners via e-mail upon receipt from GRAEF. Motion made by Bryant, seconded by Luth recommended against the DOT purchasing additional right-of-way at this location. Gahagan and Kosut – Nay. Motion carried [5:2] Review and provide direction on the incorporation of signal box within the GRAEF concept plan. a. At the 8/5 local officials meeting, the DOT relayed that the new signal at First/Main Street will require the installation of a new signal box (approximately 5’tall x 3’wide x 4’long) approximately 10’ from the new signal. The box must face the signal and traffic. This would be in the middle of the plaza/historic plaque area on the plan. At the meeting Chitwood was requested to follow-up with GRAEF and the DOT to see how the box could be integrated into the plan. b. GRAEF reviewed the item and are suggesting the control box to be relocated farther west of the intersection with landscaping as indicated on the Riverfront Plan as well as to paint it black to match the future decorative light poles. (see plan attached in packet) c. Motion made by Christensen, seconded by Gahagan to place the control box in the pedestrian park on the north side of the street. Motion carried. September 8, 2014 Water Treatment Plant Planning Study- Project No. 140052.30  The Village needs to increase the capacity from the water plant that serves Wells 4 and 5. This plant was difficult to operate during the drought time of 2012 when Well 5 was removed from service for maintenance. In addition, the water from this plant will violate drinking water standards if Well 4 is out of service for maintenance during the time that water is required in the system.  The plan will complement the needs assessment study recently completed by the Village and will likely provide a two phase approach. The first phase will provide compliant water no matter which well is out of service; the second will increase the supply capacity to match the production capacity from the booster pumps. Treatment options will be evaluated both for financial and water quality impacts and also provide options for the Village to expend impact fee funds. We will have a work order ready for review before the October meetings.  The Village has a June, 2016 deadline for expenditure of collected impact fees. Options for Industrial Land Expansion- Project No. 140211.30  The CDA is seeking input from its businesses.  We submitted a work order to provide more physical data for the two proposed development areas. 2014 Street Improvements – 6th Street  Scope: Pavement replacement on 6th Street between Foxmead Drive and Edmund Street.  The project was awarded to Payne & Dolan, Inc. and the Notice to Proceed was issued on September 3, 2014. We have a preconstruction meeting scheduled for September 17th at the Village Hall. They plan to begin removing pavement (weather pending) the week of September 22, 2014.  The Contractor has 45 days to complete the project after the Notice to Proceed. Main Street Utilities Preliminary Engineering -- Project No. 120491  Scope: Prepare a preliminary design of the water main and sanitary sewer improvements for the Wisconsin Department of Transportation State Road 20 & 83 roadway reconstruction project and a preliminary design of the water main, sanitary sewer, and storm sewer systems on East Main Street through the Milwaukee Street intersection and on South Milwaukee between East Main Street and Elizabeth Street for the Village roadway reconstruction project. The intent of the preliminary designs is to provide information for inclusion into the final design of both the State and Village projects and to provide cost information to the Village for budgeting purposes. September 8, 2014 and Village street reconstruction projects. The intent of this engineering report is to allow the Village to decide whether to fund the sewer lateral repairs by the special assessment process.  The WDOT consultant requested the Village’s design criteria in early June.  The Village will hire their own utility contractor to complete the sanitary sewer and water main improvements the summer prior to the proposed roadway construction.  The WDOT designer has the 60 percent roadway plans available. The roadway construction would begin in 2018 or 2019. In order to meet this schedule, the Village would complete their utility construction contract in the Fall of 2017 in accordance with the following schedule:  Provide sewer televising (storm and sanitary) information by October 1, 2014.  Begin and complete the preliminary engineering by October 1, 2014 and March 30, 2015, respectively.  Hold meetings to discuss the preliminary engineering conclusions before the 2016 budgets are prepared.  Decide whether to use the special assessment process for the sewer lateral repairs by the time the 2016 budgets are prepared.  Begin final design of the sanitary sewer and water main reconstruction with possible sanitary sewer lateral assessments by February 1, 2016 with bidding in 2016, if possible. This information will aid the preparation of the 2017 budgets.  Award the sanitary sewer and water main utility reconstruction project in early spring of 2017.  Complete the sanitary sewer and water main reconstruction by October 31, 2017.
