VILLAGE OF WAUNAKEE PLAN COMMISSION MINUTES A regular meeting of the Waunakee Plan Commission was held Monday November 24, 2014, at the Waunakee Village Hall, 500 W. Main Street, Waunakee, WI. CALL TO ORDER Meeting called to order at 7:30 p.m. ROLL CALL Members Present: John Laubmeier, Steve Kraus, Mark McGuire, Brad Zeman. Members Absent: Pat McGowan, Gary Herzberg, Bill Pellino. Also Present: Kevin Even, Tracy Meinholz, Mike King, Tim Herlitzka, Bryan Kleinmaier, Alan Hembel, Tom Kaiser, Jemssy Alvarez, Jerry Sholts, Steve Shulfer, Steve Day, Sandy Taylor, Robert Arntz, Randy Guttenberg, Wes Arnett, Hy Miller, Mary Ellen Kearney, Kevin Tebrinke, Roberta Baumann, Chris Richards, Kevin Abercrombie, Bruce Hollar, Matt Wackholz, Jerry Tierney, Gene Post, Jeff Smith, Rob & Carriaine Basler. APPROVAL OF MINUTES Motion Kraus, second Zeman, to approve the minutes from the October 27, 2014 meeting. Motion carried. PUBLIC COMMENT On a request by Laubmeier, with consensus from those present, the future meeting time was changed from 7:30 p.m. to 7:00 p.m. NEW BUSINESS INITIAL CONSULTATION ON PROPOSED PET DAYCARE IN THE ARBORETUM OFFICE PARK After a presentation by Wes Arnett, members of the commission recommended that he speak with the neighbors before moving forward. No action necessary. DISCUSS AND TAKE ACTION ON FAÇADE IMPROVEMENT FOR WAUNAKEE FURNITURE ETC. Motion Zeman, second McGuire, to approve the site plan for façade improvement to Waunakee Page 1 of 4 Furniture ETC. Motion carried. PUBLIC HEARING AND DISCUSSION / ACTION ON AN AMENDMENT TO CHAPTER 106 REGARDING OUTDOOR SEATING Mr. Laubmeier opened the public hearing at 7:50 p.m. No one had any comments or concerns. The public hearing was closed at 7:51 p.m. Motion Kraus, second McGuire, to approve the amendment to Chapter 106 regarding outdoor seating. Motion carried. PUBLIC HEARING AND DISCUSSION / ACTION ON A REQUEST BY PIZZA HUT OF WAUNAKEE FOR A CONDITIONAL USE PERMIT FOR A DRIVE-THRU AT 324 N. CENTURY AVE Mr. Laubmeier opened the public hearing at 7:52 p.m. No comments were made by the public. The public hearing was closed at 7:53 p.m. Motion Kraus, second McGuire, to approve the conditional use permit for “pick-up” window for Pizza Hut at 330 N. Century Avenue. Motion carried. PUBLIC HEARING AND DISCUSSION / ACTION ON A REQUEST BY KEVIN ABERCROMBIE FOR A CONDITIONAL USE PERMIT FOR OUTDOOR SEATING AT 114 E. MAIN STREET Mr. Laubmeier opened the public hearing at 7:54 p.m. After a brief presentation and no comments from the public, the public hearing was closed at 7:59 p.m. Motion McGuire, second Zeman, to approve the CUP with the following conditions: 1) Limitation of outdoor service to 9:00 p.m. Sunday to Thursday, and 10:00 p.m. Friday and Saturday, with the condition that if there are noise or other nuisance complaints from neighboring residents or property owners, the Plan Commission may review the conditional use. The Police Chief may grant a waiver to this restriction for special events. 2) Amplified music limited to 10:00 p.m. 3) Fire pits must be approved by the Fire Department. 4) Any capacity controls set by the Fire Department and/or State requirements. 5) Any expansion of seating or conversion of “play/game area” would trigger a Plan Commission review if deemed necessary by either the Village Engineer or Police Chief. 6) If parking becomes an issue the Plan Commission has the right to revisit the CUP. Motion carried. PUBLIC HEARING AND DISCUSSION / ACTION ON REQUEST BY ERDMAN HOLDINGS FOR REZONE AND CERTIFIED SURVEY MAP OF PROPERTY LOCATED AT 500 S. DIVISION STREET Mr. Laubmeier opened the public hearing at 8:01 p.m. After a presentation by Tom Kaiser, president of Guardian Glass, and questions by Kevin Tebrinke of SPL, the public hearing was closed at 8:17 p.m. Motion Zeman, second McGuire, to recommend approval to the Village Board with the following conditions: 1) All necessary easements are approved by the Village Engineer and Utility Manager. 2) The Plan Commission authorizes the Village Engineer to finalize the CSM configuration to accommodate any necessary changes for the applicant and Village of Waunakee. 3) The Plan Commission authorizes the Village Engineer and Village Attorney to finalize the final text and modify the GDP for Board approvals that are necessary for the Village of Waunakee and applicant. 4) A maintenance agreement for the shared sewer line. Motion carried. PUBLIC HEARING AND DISCUSSION / ACTION ON A REQUEST BY MR. BREWS TAPHOUSE FOR A CONDITIONAL USE PERMIT FOR OUTDOOR SEATING AT 300 N. CENTURY AVENUE. Mr. Laubmeier opened the public hearing at 8:30 pm. No comments came from the public and the hearing was closed at 8:32 p.m. Motion Kraus, second McGuire, to approve the CUP for outdoor seating Page 2 of 4 with the following conditions: 1) Plans are modified to comply with section 106-12. 2) Restricting hours at which alcohol can be served outside to 11:00 a.m. to 9:00 p.m. Sunday through Thursday and 11:00 a.m. to 10:00 p.m. on Fridays and Saturdays. 3) The CUP is revocable if there are significant complaints from neighboring residences or police calls or violations of the Villages noise standards. 4) Residential noise restriction shall apply to all amplified music. 5) Lighting to be approved by the Village Engineer. Motion carried. DISCUSS AND TAKE ACTION ON PRAIRIE ELEMENTARY SCHOOL ADDITION SITE PLAN Motion McGuire, second Zeman, to approve the site plan for the four-classroom addition to Prairie Elementary School with the following conditions: 1) The applicant grants a water main easement approved in form by the Utility Manager. 2) The Stormwater plans approved by the Village Engineer. 3) A determination by the Building Inspector and the State Inspector on the requirements of sprinkling the building. Motion carried. DISCUSS AND TAKE ACTION ON FINAL SITE PLAN FOR OCTOPI BREWING, LOT 23 OF WAUNAKEE BUSINESS PARK Motion Kraus, second McGuire, to approve the site plan with the following conditions: 1) All comments in Strand letter dated 11/18/14 completed to satisfaction of Village Engineer. 2) A CUP will be required for outdoor service and consumption of alcohol. 3) Approval from the Utility Manager for easements and sewer connection for extraordinary discharge. 4) Signage can be approved Motion carried. DISCUSS AND TAKE ACTION ON TIERNEY / SMITH CERTIFIED SURVEY MAP 1513 FAIRFAX MEWS After a brief presentation by the homeowner, motion Zeman, second Kraus, to recommend approval of the proposed CSM to the Village Board with the condition that the easement state that there can be no buildings or structures allowed. Motion carried. PUBLIC HEARING AND DISCUSSION / ACTION ON AN ORDINANCE AMENDING SEC. 86-16 AND 86-17 REGARDING CERTIFIED SURVEY MAPS AND ADMINISTRATIVE APPROVAL OF LOT LINE ADJUSTMENTS Mr. Laubmeier opened the public hearing at 8:47 p.m. Hearing no public comments it was closed at 8:48 p.m. Motion Kraus, second McGuire, to approve the ordinance amendment as presented. Motion carried. DISCUSSION / RECOMMENDATION ON AMENDMENT TO SHORELAND WETLAND ZONING ORDINANCE Motion Zeman, second McGuire, to recommend approval of the amendment to the Shoreland Wetland Zoning Ordinance amendment to the Village Board. Motion carried. ADJOURN Motion Kraus, second McGuire to adjourn the meeting at 8:49 p.m. Motion carried.
