CALL TO ORDER
The meeting was called to order at 5:48 p.m. Due to technical issues, this meeting was not
recorded.
ROLL CALL:
Present: Kristin Runge, Joe Zitzelsberger, Tricia Braun, Brian Wallace, Chris Zellner,
Absent: Sue Springman.
Also Present: Lauren Dietz, Bryan Kleinmaier, Jared Heyn, Tracy Meinholz, Maria Patt,

BUSINESS ITEMS
1 Public Hearing and Discussion/Action on a Request by El Cuate Restaurant for a
Conditional Use Permit to Allow Outdoor Seating at 350 N. Century Avenue
(Item for final action by the Plan Commission)
The applicant is seeking a Conditional Use Permit for a new restaurant at 350 N.
Century Avenue. They have plans for outdoor seating, which requires a CUP. A CUP
was previously issued at 350 N Century Ave. for outdoor seating. The conditions set
forth in the proposed CUP are consistent with other outdoor seating within the
Village.
The public hearing was opened at 5:50 p.m. With no one wishing to speak, the
hearing was closed at 5:51 p.m.
Motion Zellner, second by Braun, to approve the conditional use permit for El Cuate
Restaurant at 350 N Century Avenue. Motion carried.

2 Discussion and Possible Action on an Amendment to Sec. 133-11 of the Village
Ordinances to Change the Maximum Allowable Size of Accessory Buildings
(Item for recommendation to Village Board)
At the May 6, 2024 Village Board meeting, the Trustees voted to approve an
amendment to the ordinances allowing accessory dwelling units by right. As part of
this deliberation, they also agreed to allow detached ADUs up to 900 square feet to be
in line with other municipalities in Dane County (Sec. 133-1139).
Currently, Sec. 133-11 Use Regulations only allows by right for accessory buildings
up to 800 square feet. In order to reconcile the allowable 100 square foot size
difference between the ADU ordinance and Use Regulations, the Village needs to
update Sec. 133-11.
After questions and deliberation, the Commission took no action at this time. Staff
will bring the item back at a future meeting.
3 Discussion and Possible Action on Amending the Submittal Requirements for
Plan Commission (Item for recommendation to the Village Board)
The Village Ordinances for site plans still require 20 paper copies to be filed along
with an electronic copy. This amendment will update the requirements to only require
one editable PDF copy of the submittal, per our current standards.
Staff have also received feedback from the Plan Commission and Village Board that
submittals and motions should ideally be as clean as possible. To accomplish this,
staff are also recommending that the submittal timeline requirement be removed from
the ordinance and amended by administrative rule to extend out to 8 weeks. This is
similar to other municipalities in Dane County and affords the applicant time to make
adjustments to their submittals based on initial staff comments before the item comes
to the Plan Commission or Village Board.
References to the Utilities Commission have been removed, based on the Tech Staff
review process in which Utilities comments are handled administratively rather than
at the commission level.
Motion Zitzelsberger, second by Wallace, to recommend to Village Board approval of
the resolution changing Article II—Administration and Enforcement and Article III—
Plats and Survey Maps to reflect current Village processes and best practices. Motion
carried.

PUBLIC COMMENT INSTRUCTIONS
WRITTEN: Send written comments by 12:00 p.m. on date of meeting on any matter, either on or not on the
agenda, by emailing tmeinholz@waunakee.com or in writing to Plan Commission, 500 W Main St., Waunakee,
WI, 53597.
IN-PERSON: Public comment forms are available at the Board Room entrance. Please fill out and hand to staff
prior to start of meeting. Comments are limited to three-minutes per person and must be delivered at the gallery
podium for recording purposes. Accommodations can be provided for those unable to access the podium.
VIRTUAL: When public comments are allowed, attendees on Zoom wishing to participate should click “raise
hand” if on video or press *9 if on phone call. Attendees will be called on in the order in which hands are raised.
Those wishing to provide oral comments remotely must have their full name displayed within the Zoom
application and must state address of residence. Virtual comments are only allowed for those who reside, own
or lease property in the Village of Waunakee. Anonymous comments will not be allowed.
*As permitted by the Wisconsin open meetings law and while not required, the Plan Commission has chosen to
allow public comments during their meetings. This is specifically listed on the agenda as PUBLIC COMMENT.
The Commission Members may not engage in discussion or take action during this period but may consider
deferring the subject to a later meeting with notice. State statute and/or Village Code require PUBLIC
HEARINGS on certain specified matters where the public can comment. The meeting chairperson will identify
rules for providing comments. Other items on the agenda which are not listed for public hearing do not require
the Plan Commission to allow public comment, however the meeting chairperson can at their own discretion
allow limited public comments.
