VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street November 18, 2024 6:00 PM Meeting Minutes CALL TO ORDER The November 18, 2024 Village Board meeting was called to order by Village President Kristin Runge at 6:00 p.m. ROLL CALL Present: Nila Frye, Tricia Braun, Sam Kaufmann, Kristin Runge, Joe Zitzelsberger and Robert McPherson. Absent: Erin Moran Also Present: Todd Schmidt, Renee Meinholz, Bryan Kleinmaier, Bill Frederick, Sue McDade, Lauren Dietz and Jared Heyn CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and online availability) Public postings, official notices, and online availability were confirmed by Village Clerk Karla Endres for open meeting compliance. PUBLIC COMMENT* Maria Patt, 1000 Wexford Drive, announced that the Cobblestone Development is up for final approvals in Sun Prairie and asked about Hyvee. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Sam Kaufmann, second by Joe Zitzelsberger to approve consent agenda items 1-6. Motion passed. Kristin and Renee reported the appreciation received from the various different licensed child care providers for the awarded contributions through ARPA funds. PRESENTATIONS 1 Update from Safe Communities Cheryl Wittke, presented updates to the strategic plan for Safe Communities and the mission promoted by the coalition. PUBLIC HEARING* 1 Discuss & Take Action a Request to Rezone 5939 STH 113 (fka Meffert's Dental Offices) from Legacy Non-Conforming A-1 Agricultural to C-1 for Commercial Use Opened the public hearing at 6:21 pm. Don Tierney stated the reason for the requested change is because there was a Montessori school that was interested in the property, but it was not properly zoned to allow it. They would like to have the appropriate zoning when the next opportunity arises. Closed the public hearing at 6:23 pm. Motion by Robert McPherson, second by Nila Frye to approve the rezoning of the property at 5939 STH 113 from Legacy Non-Conforming A-1 Agricultural to the C- 1 General Commercial district conditioned upon the filing of deed restrictions limiting permitted uses to those identified. Motion passed. For: 6, Against: 0. 2 Discuss & Take Action on a Request by First Presbyterian Church, 5763 CTH Q, to Divide by Two Certified Survey Maps, 2.6 Acres to be Included in the Kilkenny Farms West Plat, with the Remaining 7.8 Acres to Remain in the Town & be Rezoned from A-1 to G-1 Opened the public hearing at 6:28 pm No comments Closed the public hearing at 6:28 pm Moved on to item #3 to discuss and take action prior to acting on item #2. Motion by Kristin Runge, second by Joe Zitzelsberger to approve the Certified Survey Map at 5763 CTH Q, rezoning of Lot 1 of the second CSM to from Legacy non-conforming A-1 Agricultural to Village PUD upon Annexation, and rezoning of Lot 1 of the second CSM from Legacy non-conforming A-1 Agricultural to Village G-1 Institutional. Motion passed. For: 6, Against: 0. 3 Discuss and Take Action on Requests by Kilkenny Farms West For:  An Amendment to the Final Plat of Kilkenny Farms West (including the associated releases of certain public utility easements)  An Amendment to the General Development Plan for Kilkenny Farms West,  An Amendment to the Phase 1 Development Agreement for Kilkenny Farms West, and  An Annexation Ordinance (annexing land to be acquired from First Presbyterian Church) Opened public hearing at 6:33 pm. No comments Closed public hearing at 6:33 pm. Motion by Kristin Runge, second by Tricia Braun to approve an Annexation Ordinance, annexing lands to be acquired from First Presbyterian Church subject to execution of the amendment to phase 1 developers agreement. Motion passed. For: 6, Against: 0. Motion by Kristin Runge, second by Sam Kaufmann to approve an amendment to the Phase 1 Development Agreement for Kilkenny Farms West. Motion passed. For: 6, Against: 0. Motion by Kristin Runge, second by Tricia Braun to approve an amendment to the General Development Plan for Kilkenny Farms West. Motion passed. For: 6, Against: 0. Motion by Sam Kaufmann, second by Kristin Runge to approve an amendment to the final plat of Kilkenny Farms West and approval of the access agreement of private sanitary sewer and water main easements and release of easements contained in the packet. Motion passed. For: 6, Against: 0. 4 Discuss and Take Action on Repealing and Replacing Sec. 14-12 and Creation of Sec. 133-1140 Related to Beekeeping Ordinances Opened the public hearing at 6:44 pm No comments Closed the public hearing at 6:45 pm Motion by Robert McPherson, second by Sam Kaufmann to table the agenda item. Motion failed. For: 3, Against: 2 (Nila Frye, Joe Zitzelsberger), Abstained:1 (Kristin Runge). 5 Public Hearing & Discuss & Take Action on 2025 Budget and 5-Year Equipment Replacement Plan and Set the Tax Levy for 2024 Tax Year Opened the public hearing at 7:05 pm. No comments. Closed the public hearing at 7:06 pm. Motion by Kristin Runge, second by Joe Zitzelsberger to approve the resolution approving the 2025 Village of Waunakee budget and the 5-year Equipment Replacement plan. Motion passed. For: 6, Against: 0. Motion by Kristin Runge, second by Nila Frye to approve the resolution approving the Levying of Property Taxes for the 2024 Tax Year (2025 Budget Year) for the Village of Waunakee. Motion passed. For: 6, Against: 0. BUSINESS ITEMS 1 Discuss and Take Action on Town of Westport Notice of Intent to Incorporate Petition Motion by Joe Zitzelsberger, second by Robert McPherson to move into closed session to discuss the town of Westport. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. IN-PERSON: Public comment forms are available at the Board Room entrance. Please fill out and hand to staff prior to start of meeting. Comments are limited to three-minutes per person and must be delivered at the gallery podium for recording purposes. Accommodations can be provided for those unable to access the podium. VIRTUAL: When public comments are allowed, attendees on Zoom wishing to participate should click “raise hand” if on video or press *9 if on phone call. Attendees will be called on in the order in which hands are raised. Those wishing to provide oral comments remotely must have their full name displayed within the Zoom application and must state address of residence. Virtual comments are only allowed for those who reside, own or lease property in the Village of Waunakee. Anonymous comments will not be allowed. *As permitted by the Wisconsin open meetings law and while not required, the Village Board has chosen to allow public comments during their meetings. This is specifically listed on the agenda as PUBLIC COMMENT. The Village Board may not engage in discussion or take action during this period but may consider deferring the subject to a later meeting with notice. State statute and/or Village Code require the Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at their own discretion allow limited public comments. Land Acknowledgment: The Village of Waunakee acknowledges that the land we occupy is Teejop, ancestral territory of the Hoocąkra (Ho-Chunk Nation), People of the Sacred Voice. Hoocąkra are stewards of these lands and waters since time immemorial. Settlers attempted to forcibly remove them from their homelands by exploiting a series of land cessions and treaties, including the Treaty of 1832. However, the Hoocąkra resisted these conquests and asserted their sovereignty as a nation. We address this trend of dispossession by upholding Hoocąk woošgąra (way of life), sovereignty, culture, language, and environmental practices. Acknowledging these atrocities is only the first step towards reconciliation. Through relationship building, education, and action, the Village will advocate for a shared future with the Hoocąkra Nation. Any person who needs an interpreter or has a qualifying disability as defined by the Americans with Disabilities Act that requires the meeting or materials at the meeting to be in an accessible location or format should contact the Village Clerk at (608) 850-8500 or kendres@waunakee.com at least forty-eight (48) hours prior to the commencement of the meeting.
