VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street December 16, 2024 6:00 PM Meeting Minutes CALL TO ORDER The December 16, 2024 Village Board meeting was called to order by Village President Kristin Runge at 6:00 p.m. ROLL CALL Present: Nila Frye, Tricia Braun, Sam Kaufmann, Kristin Runge, Joe Zitzelsberger and Robert McPherson. Absent: Erin Moran Also Present: Todd Schmidt, Renee Meinholz, Bill Frederick, Lauren Dietz and Jared Heyn CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and online availability) Public postings, official notices, and online availability were confirmed by Village Clerk Karla Endres for open meeting compliance. PUBLIC COMMENT* Maria Patt, 1000 Wexford Dr, spoke in opposition to hiring a coordinator for WaunaFest. Joe Zitzelsberger commented on the new pet licensing software and the positive experience. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Robert McPherson, second by Sam Kaufmann to approve consent agenda items 1-3. Motion passed. For: 6, Against: 0. 1 Approve Schedule of Bills approve Kwik Trip payment in the amount of $6,853.33, check numbers 88833-88881 totaling $644,277.48, 88882-88912 totaling $323,661.34, and Costco payment in the amount of $198.55. 2 Approval of the Village Board Meeting Minutes from December 2, 2024 Approve Village Board Meeting Minutes from December 2, 2024. 3 Appointment of Create Waunakee Committee Members Motion to approve appointment of Hannah Nies and Emilie Steinmann to the Create Waunakee Committee as recommended by the Village President. Terri Teeter explained how WaunaFest is funded and how service groups use the event as a fundraiser. Motion by Kristin Runge, second by Robert McPherson to approve $6,000 to provide start-up funding for a WaunaFest Coordinator to be hired and managed through the Chamber of Commerce as a one-time disbursement. Motion passed. For: 6, Against: 0. 2 Discuss and Take Action on Purchase of Property located at 105 E. 2nd Street Todd Schmidt briefed the Board on the idea of purchasing the entire site. It is listed at $600,000. Molly Murphy was not interested in portioning off the parcel but rather to sell it as a whole. Motion by Tricia Braun, second by Kristin Runge to direct staff and council to proceed with negotiations on the sale of property at 105 E. 2nd Street. Motion passed. For: 5, Against: 0, Abstained: 1 (Robert McPherson). 3 Discuss and Take Action on Proposed Ordinance Amending Section 30-54 of the Waunakee Code of Ordinances Regarding Appointment of a Fire Chief Todd Schmidt briefly explained what is required by state statute. Motion by Kristin Runge, second by Robert McPherson to adopt “Ordinance Amending Section 30-54 of the Waunakee Code of Ordinances Regarding Appointment of a Fire Chief.” Motion passed. For: 6, Against: 0. 4 Discuss and Take Action on Proposed Second Amendments to Development Agreements (Brewery Expansion Project TID 9 and Warehouse Expansion Project TID 9) Related to Octopi Projects and Facilities Motion by Joe Zitzelsberger, second by Tricia Braun to enter closed session to discuss and take action on proposed second amendment to development agreements (Brewery Expansion Project TID 9 and Warehouse Expansion). Kate Crowley was included in the closed session discussion. 5 Discuss and Take Action on Town of Westport Notice of Intent to Incorporate Petition Bryan Kleinmaier gave a brief update from the initial court hearing. Erin Moran joined the meeting. Motion by Sam Kaufmann, second by Robert McPherson to enter closed session to discuss and take action on Town of Westport Notice of Intent to Incorporate Petition. Roll call vote: Joe Zitzelsberger: yay, Robert McPherson: yay, Tricia Braun: yay, Erin Moran: yay, Kristin Runge: yay, Nila Frye: yay, Sam Kaufmann: yay. 7 Discuss and Take Action on Matters Regarding Waunakee Area Fire Protection Agreement and Waunakee Area Fire Protection Operating Agreement Motion by Robert McPherson, second by Nila Frye to enter closed session to discuss and take action on matters regarding Waunakee Area Fire Protection agreement and Waunakee Area Fire Protection Operating Agreement. Roll call vote: Sam Kaufmann: yay, Tricia Braun: yay, Robet McPherson: yay, Kristin Runge: yay, Erin Moran: yay, Nila Frye: yay, Joe Zitzelsberger: yay. Entered into closed session at 6:47 pm. Sam Kaufmann recused himself at 6:47 pm. Sam Kaufmann rejoined the Board at 7: 15 pm. Motion by Joe Zitzelsberger, second by Robert McPherson to reconvene into open session. Motion passed. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. 6 Discuss and Take Action on Administrator Review, Compensation, and Benefit Adjustments The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(c) for the purpose of considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. 7 Discuss and Take Action on Matters Regarding Waunakee Area Fire Protection Agreement and Waunakee Area Fire Protection Operating Agreement The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the investing of public funds or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The Village Board may reconvene in open session and take action on the closed session item. IN-PERSON: Public comment forms are available at the Board Room entrance. Please fill out and hand to staff prior to start of meeting. Comments are limited to three-minutes per person and must be delivered at the gallery podium for recording purposes. Accommodations can be provided for those unable to access the podium. VIRTUAL: When public comments are allowed, attendees on Zoom wishing to participate should click “raise hand” if on video or press *9 if on phone call. Attendees will be called on in the order in which hands are raised. Those wishing to provide oral comments remotely must have their full name displayed within the Zoom application and must state address of residence. Virtual comments are only allowed for those who reside, own or lease property in the Village of Waunakee. Anonymous comments will not be allowed. *As permitted by the Wisconsin open meetings law and while not required, the Village Board has chosen to allow public comments during their meetings. This is specifically listed on the agenda as PUBLIC COMMENT. The Village Board may not engage in discussion or take action during this period but may consider deferring the subject to a later meeting with notice. State statute and/or Village Code require the Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at their own discretion allow limited public comments. Land Acknowledgment: The Village of Waunakee acknowledges that the land we occupy is Teejop, ancestral territory of the Hoocąkra (Ho-Chunk Nation), People of the Sacred Voice. Hoocąkra are stewards of these lands and waters since time immemorial. Settlers attempted to forcibly remove them from their homelands by exploiting a series of land cessions and treaties, including the Treaty of 1832. However, the Hoocąkra resisted these conquests and asserted their sovereignty as a nation. We address this trend of dispossession by upholding Hoocąk woošgąra (way of life), sovereignty, culture, language, and environmental practices. Acknowledging these atrocities is only the first step towards reconciliation. Through relationship building, education, and action, the Village will advocate for a shared future with the Hoocąkra Nation. Any person who needs an interpreter or has a qualifying disability as defined by the Americans with Disabilities Act that requires the meeting or materials at the meeting to be in an accessible location or format should contact the Village Clerk at (608) 850-8500 or kendres@waunakee.com at least forty-eight (48) hours prior to the commencement of the meeting.
