Consideration of a Redevelopment Loan Fund loan application from 23-1276 Midwest Institutional Trust Company related to tenant space located at 10700 W Research Drive Committee may move to convene into closed session for this item pursuant to Wis. Stat. §19.85(1)(e), Wis. Litigation Update for Committee regarding ongoing property tax and 23-950 other litigation activities in which the City is involved in state and Federal Courts · Aurora Health Care Inc. v. City of Wauwatosa, (various case numbers), Milwaukee County Circuit Court (Tax years 2021-23) · Walgreen Co. vs. City of Wauwatosa, Milwaukee County Circuit Court Case No. 23-CV-5489 · WPOA v. City of Wauwatosa, Milwaukee County Circuit Court No. 23-CV-1693 · Various property tax, civil rights and liability cases Committee may move to convene into closed session for this item pursuant to Wis. Stat. §19.85 (1)(g), for the purpose of conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. The Common Council may reconvene into open session to consider the balance of the agenda. Presentation by City Attorney Alan Kesner and Deputy City Attorney Hanna Kolberg . Motion by Ald Fuerst, seconded by Ald Arney, to convene into closed session . Motion carried 8-0. Discussion in closed session. Ald Tilleson left during the discussion. Motion by Ald Fuerst, seconded by Ald Lewis, to reconvene into open session . Motion carried 7-0. Motion by Ald Moldenhauer, seconded by Ald Fuerst, to recommend the Common Council approve a settlement for the Aurora Health Care Inc. v. City of Wauwatosa, (various case numbers), Milwaukee County Circuit Court (Tax years 2021-23) case in the amount of $70 ,000. Motion carried 7-0. Motion by Ald Moldenhauer, seconded by Ald Fuerst, to recommend the Common Council approve a settlement for the Walgreen Co. vs. City of Wauwatosa, Milwaukee County Circuit Court Case No. 23-CV-5489 case in the amount of $24,492.
