The City Council met this date in a regular session, in the City Council Chambers, which was
available to the public in person, and via teleconference, at 8:00 p.m.

REMARKS FROM THE COMMUNITY AND VISITORS
Scott MacConnell, 604 W. Glendale, addressed mowing of city-owned property by his home.
Dave Buck, 124 S. Elm, addressed the Arts. (Exhibit 1)
Don Lohman, 810 E. Pacific, addressed flooding and home buyouts. (Comments made during
flood discussions.)
NEW BUSINESS - MAYOR, COUNCILMEMBERS, CITY ATTORNEY, CITY
MANAGER
Mr. Peterson addressed Waste Management's billing error. They have billed monthly, and it
should be quarterly. If residents were billed in error WM will be sending back refunds. If you have
not heard from them, call them at 1-866-909-4458.

Prior to the Third Reading of Bill #9192, a motion was made by Councilmember Bliss, seconded
by Councilmember Franklin, to amend Bill #9 I 92 to reflect the numbers from the County Board
of Equalization as referenced in said Bill dated September 20, 2022.

FLOOD INFORMATION UPDATES - STATE EMERGENCY MANAGEMENT
AGENCY (SEMA)
Karen McHugh addressed PowerPoint (Exhibit 2) and answered questions.
Council questions included:

FLOOD INFORMATION UPDATES - CITY STAFF
Dr. Peoples addressed PowerPoint (Exhibit 3) and answered questions about financial
implications for the City, tax implications, and land use. She stated that MSD is coming 10/4 to
address issues related to their projects.

RELATED THERETO, and at the Councilmember's request, the Bill was read twice, first and
second times by title only, and placed on the agenda for future consideration of the Council.
Prior to addressing the Consent Agenda, Councilmember Hixson Shepherd stated that regarding
Resolution #2022-46, she spoke with Jenny Starkey regarding the printed newsletter for older
residents. They would not be mailed, but distributed to public buildings and communities. It is no
cost to us. Mayor Arnold added that she thinks the goal is, since we've moved to mostly online
communications, this is a way to reach seniors who are less often online.

AN ORDINANCE LEVYING THE COST OF ABATING CERTAIN
NUISANCES (CUT/TRIM, REMOVE TRASH AND DEBRIS, REMOVE TREES,
DUMP FEES, BOARD UP, ETC.) AS SPECIAL TAX BILLS
AGAINST THE PROPERTIES HEREINAFTER DESCRIBED AND
CONSTITUTING LEVIES AS LIENS ON THE RESPECTIVE PROPERTIES
WHEREAS, the City Manager, in compliance with Chapter 31 (the Comprehensive Nuisance
Ordinance) and/or Chapter 30 (Existing Structures Code) of the Code of the City of Webster Groves, did
properly cause the abatement of certain violations and nuisances by removing the growth of grass/weeds,
dead trees, debris, and other dangerous conditions, by and through contracts with:

WHEREAS, Chapters 30 and 31 of the Code of Webster Groves require the City Council to assess
against each lot concerned a special assessment equivalent to the expense incurred in removing such
nuisances for the benefit of each lot concerned and the safety and general welfare of the community; and
WHEREAS, after due notice to each individual property owner, the City Manager has certified
such expense to the City Council, showing the lot and block numbers and dates on which the removal and/or
abatement of the violations and/or nuisances occurred and the names and addresses of each respective
owner, if known.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES AS FOLLOWS:
Section 1: There is hereby assessed against each of the following described lots a special
assessment in the amount shown opposite each lot, which is the sum equivalent to the expense incurred by
the City of Webster Groves in removing and abating each of the violations and nuisances, and the City
Clerk is directed to issue a special tax bill in the amount of the expenses for each respective lot benefitted.
Section 2: The aforesaid special tax bills shall be due and payable thirty (30) days after their
issuance by the City Clerk, shall bear interest at the rate of eight percent (8%) per annum from and after
thirty (30) days after issuance, and shall be a lien against each respective lot against which they are issued
until paid.
Section 3: The City Manager is hereby authorized to enforce the collection of each lien and charge

recording and releasing fees, as provided by law, and the City may also forward all necessary information
and documents to the Collector of Revenue of St. Louis County, Missouri, so as to have each special tax
bill added to the real property tax rolls as provided by law.
Section 4: This ordinance shall not be printed in the Code of Webster Groves.
Section 5: This ordinance shall be in full force and effect from and after its passage and approval
as provided by law.

AN ORDINANCE REPEALING ORDINANCE NUMBER 8270 TO
REMOVE THE LOT SPLIT APPROVAL FOR A NEW LOT AT
452 FOOTE AVENUE AND RETURNING THE PROPERTY TO
ONE LOT ADDRESSED AS 446 FOOTE AVENUE
WHEREAS, On March 19, 2002 the City Council adopted Ordinance #8270, a lot
split plat at the request of Robert Pitlyk the owner of the land at 446 Foote Avenue,
consisting of approximately 40,717 square feet of land (the “Property”) with the intent to
build a second house on the newly established lot at 452 Foote; and
WHEREAS the Property was sold to Jeffrey P. and Amy D. Escott (“Applicants”)
on June 23, 2014 as two lots, 446 and 452 Foote Avenue; and
WHEREAS, no development to build a second house on 452 Foote has occurred
and no plans have been approved to build a new house on said lot; and

WHEREAS, the City of Webster Groves, Missouri (“City”) owns certain real
property located in the City at 33 East Glendale, Webster Groves, St. Louis County,
Missouri, 63119 (the “Property”); and,
WHEREAS, the City is involved in litigation with CCATT, LLC, Crown Castle
International Corp., and New Cingular Wireless PCS, LLC regarding a
telecommunications lease on the Property; and,
WHEREAS, to resolve the issues surrounding the litigation, the City desires to
enter into a settlement agreement with CCATT, LLC, Crown Castle International Corp.,
New Cingular Wireless PCS, LLC, and NCWPCS MPL 27-Year Sites Tower Holdings
LLC (the “Settlement Agreement”) and a lease agreement with NCWPCS MPL 27-Year
Sites Tower Holdings LLC providing for NCWPCS MPL 27-Year Sites Tower Holdings
LLC’s lease of the property for telecommunications purposes (the “Lease”).
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Webster Groves, Missouri hereby
authorizes the Mayor and other designated and authorized City officials to execute the
Settlement Agreement, substantially in the form attached hereto and incorporated herein
by reference as Exhibit “1.”
Section 2. The Council of the City of Webster Groves, Missouri hereby
authorizes the Mayor and other designated and authorized City officials to execute the
Lease, substantially in the form attached hereto and incorporated herein by reference as
Exhibit “2.”
Section 3. The Council of the City of Webster Groves, Missouri hereby grants
the Mayor and other designated and authorized City officials further authority to execute
other documents and take other actions reasonably necessary to carry out the intent of this
Ordinance, the Lease, and the Settlement Agreement.

The NFIP was created in 1968 by the National Flood
Insurance Act to:
• Improve the nation’s basic knowledge about
flood hazards
• Reduce future flood losses
• Reduce federal expenditures for disaster
assistance and flood control projects
• Provide citizens favorably-priced flood
insurance through the federal government

The NFIP is a voluntary program. To participate in the
NFIP, communities must:
1. Adopt a Floodplain Management
Ordinance for regulation of
development in the floodplain.
2. Adopt a Resolution for Participation in
the NFIP
3. Complete an Application for
Participation form.

Communities join the NFIP to:
• Obtain federally-backed loans from banks for
structures located in the floodplain
• Provide some measure of protection for new and
substantially improved development in the floodplain
• Ensure disaster assistance is available to the community
and individuals
• Reduce community’s vulnerability to damage from
flooding events

• Base Flood - The NFIP regulatory flood for floodplain management
(defined as the flood that has a 1% chance of being equaled or exceeded in
any given year)
• Base Flood Elevation (BFE) - Water surface elevation resulting from the
Base Flood event that is tied to a known vertical datum
• Special Flood Hazard Area (SFHA) - Areas subject to the 1% - or greater -
annual chance of flooding in any given year (the “100-year” floodplain)
• Flood Insurance Rate Map (FIRM) - The official map of a community on
which FEMA has defined Special Flood Hazard Areas (SFHAs), Base Flood
Elevations (BFEs), and risk zones applicable to the community
• Development - Any man-made change to improved or unimproved real
estate, including but not limited to buildings or other structures, mining,
dredging, filling, grading, paving, excavation, drilling operations or storage
of equipment or materials.

• Community: - A political entity that has the authority to
adopt and enforce floodplain ordinances for the area under
its jurisdiction
• Note that a city, town, village, Indian tribe, or authorized
tribal organization is a separate community from the
county in which it resides; each must participate in the
NFIP individually
• Structure: - A walled and roofed building, including a gas
or liquid storage tank, that is principally above ground, as
well as a manufactured home.

As a participant in the NFIP, communities agree to:
• Adopt and enforce all applicable NFIP regulations
• Require permits for ALL development in the SFHA
• Require that new and substantially
improved/damaged structures be elevated to or
above the base flood elevation (non- residential
structures can be dry-floodproofed)
• Obtain proof of compliance with local floodplain
management ordinances for all new structures

ICC coverage comes standard with NFIP flood policies
The purpose is to add coverage to pay for the increased cost to
rebuild or otherwise alter flood-damaged structures to conform with

may also be appointed by the Council. The All members shall serve until removed or
discharged by the Council. The Board shall elect its own Chairman and Vice-Chairman, for
such terms as the Board may determine. The Board may adopt from time to time such rules
and regulations, as it may deem necessary to carry out its duties.
Section 4.420 Meetings
Meetings of the Board shall be held at the call of the Chairman and at such other times as the
Board may determine. All meetings of the Board except executive sessions shall be open to
the public. The Board shall keep minutes of its proceedings showing the vote of each member
upon each question or, if absent, or failing to vote, indicating such fact, and shall keep such
other records, as it shall deem necessary. Executive sessions of the Board may be called by
the Chairman.
Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Subject: Dave Buck's Remarks, WG City Council Meeting, 9/6/22
Caution: This is an External Message ‐ Please be cautious when opening links or attachments
This shares an additional thought on Council's upcoming strategic planning, which I
hope remains a top priority and begins in earnest sometime in September.
Setting and achieving goals is an essential element of any strategic plan. I believe
there are TWO kinds of Goals for you to consider for the city.
The FIRST are the "Hard", Rational, Tangible Goals, such as, for example:
Fostering new development
Increasing the tax base
Reversing the decline of our black population
But, tonight, I'd like to focus your attention on the SECOND kind, which are the
"Soft", Emotional, Intangible Goals, which can be just as big and imperative. Here
are three such goals I believe are needed most in our city and all are linked
together.
1. Restoring Trust. As I have said before, communities move forward at the
speed of trust. No trust, no progress. I believe that trust has been damaged
to a degree within City Hall and between City Hall and our community but
that can definitely be restored with effort and commitment.
2. Reclaiming the Values & Character of Our Community. Our personal
character is defined by our values. Same is true of our community, with

values such as honesty, kindness and empathy. But in recent years, our
community seems to have lost its way to a degree. You already have a good
start, as diversity, equity and inclusion are more than just anti‐racist
concepts. They are core human values. My suggestion is that it would be
time very well spent if you learned, adopted and practiced the "Leadership
by Values" model.
3. Keeping the Peace. In the over 20 years I have been a resident, our city has
lived through its share of difficult controversies and deep divisions,
sometimes turning dishonest, ugly and negative and bringing out the worst in
us. Differences of opinion should be welcomed but, sooner or later,
opposing sides have to come together to create win‐win solutions versus
win‐lose and worse yet, lose‐lose. It's called the Peace Process. I believe
Council should remain neutral in such matters but has a fundamental
responsibility to step up and be the Peacemakers who lead the Peace
Process.
4.
Finally, before your strategic planning starts looking ahead, I hope you first look
back and make an honest and fair evaluation of your performance against the 7
Council Goals set four years ago, dated 2018‐19. What grade do you give
yourselves on each goal and WHY? What have you learned? What can you do
differently or better in the future?

ADOPTING THE 2020-2025 ST. LOUIS REGIONAL HAZARD
MITIGATION PLAN AND TO WORK TOWARD BECOMING
A SAFER COMMUNITY
WHEREAS, the City of Webster Groves recognizes the threat that natural hazards pose
to people and property within the City of Webster Groves; and
WHEREAS, the City of Webster Groves has participated in the preparation of a multihazard
mitigation plan, hereby known as the St. Louis Regional Hazard Mitigation Plan (hereafter
referred to as the Plan) in accordance with the Disaster Mitigation Act of 2000; and
WHEREAS, the Plan identified mitigation goals and actions to reduce or eliminate long-term
risk to people and property in the City of Webster Groves from the impacts of future
hazards and disasters; and
WHEREAS, the City of Webster Groves recognizes that land use policies have a major
impact on whether people and property are exposed to natural hazards, the City of
Webster Groves will endeavor to integrate the Plan into the comprehensive planning
process; and
WHEREAS, adoption by the City of Webster Groves demonstrates their commitment to
hazard mitigation and achieving the goals outlined in the Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES, that the final, FEMA approved, St. Louis Regional Hazard Mitigation
Plan is hereby adopted.

AUTHORIZING THE CITY MANAGER TO PURCHASE A 2023 BACKHOE
FOR THE STREET DEPARTMENT
WHEREAS, the City desires to purchase a 2023 backhoe for the Street
Department; and
WHEREAS, the Statewide bid contract of Luby Equipment Services, 2300
Cassens Dr., Fenton, MO 63026, in the amount of $102,900.00, with trade-in, for
a 2023 backhoe, was determined to be the most advantageous bid received in
accordance with the specifications.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES, that the City Manager be authorized to accept the bid, and
to enter into a contract, with Luby Equipment Services, for the sum hereinabove
set forth, and to assure that all items constituting the bid are provided in
accordance with specifications.
BE IT FURTHER RESOLVED, that funds for this purchase shall be paid from the

$160,202.00, with delivery, was determined to be the most advantageous bid
received in accordance with the specifications.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES, that the City Manager be authorized to accept the bid of
Woody’s Municipal Supply Company, and to enter into a contract, for the sum

350 4x4 Pickup Truck Cab and Chassis, was determined to be the most
advantageous bid received in accordance with the specifications.
WHEREAS, in addition, the Statewide bid contract for the accessory package of
the hydraulics, controller, and 8’ snow plow, from Woody’s Municipal Supply,
P.O. Box 432, Edwardsville, IL 62025, in the amount of $19,892.50, was
determined to be the most advantageous bid received in accordance with the
specifications.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
