NEXT REGULAR MEETING DATE: TUESDAY – NOVEMBER 1, 2022  BILL # 9199 ORDINANCE # 9199 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR TELLE IV PROPERTIES, LLC TO PERMIT THE OPERATION OF AN AUTOMOTIVE REPAIR AND SERVICES FACILITY ON AN APPROXIMATELY 0.8 ACRE LOT AT 7982-7984 BIG BEND BOULEVARD IN THE “C” COMMERCIAL DISTRICT, AND MATTERS RELATED THERETO WHEREAS, the Zoning Code of Webster Groves provides the City Council may, by conditional use permit issued under the provisions of Section 53.110 and 53.159, authorize the use of property in the “C” Commercial District for an “Automotive Repair and Services Facility”; and WHEREAS, Telle IV Properties, LLC, (the “Applicant”) has applied for a conditional use permit that allows for an Automotive Repair and Service Facility, on an approximately 0.8 acre tract of land with an existing 12,210 sq ft building at 7982-7984 Big Bend Boulevard (the “Property”), in the “C” Commercial District; WHEREAS, the subject property has been used previously for an Automobile Dealership with an accessory repair service facility; WHEREAS, the Application was referred to the City Plan Commission, which, after studying the Application and the recommendation of the Director of Planning and Development, and holding a public hearing on September 12, 2022, has recommended approval of the Application subject to certain conditions; and WHEREAS, the City Council gave due notice and held a public hearing on the application at City Hall, on Tuesday, October 4, 2022, at 7:30 P.M., where the Council heard and considered comments and suggestions by those present; WHEREAS, the City Council has determined, in accordance with the provisions of Section 53.176.b. of the Zoning Code that the existing building setbacks are not being changed and shall continue to govern structures on the Property; and WHEREAS, the City Council has determined, in accordance with the provisions of Chapter 53.173.a. of the Zoning Code, that granting the Applicant’s Conditional Use Permit will not: 1. Substantially increase traffic hazards or congestion; 2. Substantially increase fire hazards; 3. Adversely affect the character of the neighborhood; 4. Adversely affect the general welfare of the community; or 5. Overtax public utilities. A minimum of fifty-one (51) off-street parking spaces shall be maintained on the site. Reductions in this number can be made with the provision of additional bike parking spaces as limited in the City Code. 4. Any changes or improvements to the curb cuts or sidewalks along Big Bend Boulevard shall obtain permits from the St. Louis County Department of Highways and Traffic. 5. Hours of operation shall not exceed the following: 7:30 am-5:30 pm daily. 6. No derelict or inoperable vehicles or vehicles with extensive damage shall be stored on the premises. 7. Any new pole mounted or wall mounted lighting shall meet light levels in the City Code. 8. No outside amplified speakers shall be allowed on the premises. 9. The applicant shall be responsible for pick-up of all litter on their property and litter generated from their facility onto adjacent properties or rights-of-way. 10. The primary and accessory structure setbacks shall be those set in the underlying “C” Zoning District setbacks and the Additional Minimum Street Setbacks in the Zoning Code. 11. A Lot Consolidation Plat shall be undertaken to consolidate all properties for this use. 12. This Conditional Use Permit is personal to the Applicant and shall not run with the land. Section 2. Additionally, the recent move of a hydrant to the front of this address allows for this removal. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. PASSED AND APPROVED this _____ day of ____________________, 2022. _________________________________ MAYOR ATTEST: _________________________________ CITY CLERK  BILL #9201 ORDINANCE #9201 AN ORDINANCE REPEALING ORDINANCE NUMBER 9190 TO REMOVE THE SUBDIVISION APPROVAL FOR THREE LOTS AT 820 MARSHALL AVENUE AND 828 MARSHALL AVENUE RETURNING THE PROPERTY TO TWO LOTS WHEREAS, on August 2, 2022 the City Council adopted Ordinance #9190, a subdivision plat at the request of Blue Properties, LLC (Tim Dolan) and Joshua Hill and Elizabeth Goodbrake (the “Owners”) -- who own certain property that is approximately 0.631 acres of land commonly referred to as 820 Marshall Avenue and 828 Marshall Avenue; and WHEREAS, the Lender for the property at 828 Marshall Avenue would not give approval for the sale of land to the owner at 820 Marshall Avenue; and WHEREAS, the inability to sell the land renders the ability to split 820 Marshall Avenue into two lots as void; and WHEREAS, the applicants are now requesting the City Council repeal the subdivision of the Property to restore it back to the original two lots. Chapter 60, Article VII, Section 60.975, Schedule H of the Code of Webster Groves, “Parking Prohibited”, is hereby amended to create a “No Parking, Stopping or Standing Monday – Friday 7:00 a.m. through 5:00 p.m.” zone on the north side of Lockwood Court beginning just east of the existing passenger loading and unloading zone to a distance of 72 feet. From that point extending eastward, this ordinance shall establish a “No Parking Anytime” zone which extends eastward for 105 feet to the west side of the driveway of 661 Lockwood Court, thus prohibiting parking within the intersection of Lockwood Court and Westborough and within 20 feet of the crosswalk. Section 2. The City Manager is hereby authorized and directed to erect the appropriate signs carrying out the intention of this ordinance. Section 3. This ordinance shall be printed in the Code of Webster Groves. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. This ordinance shall take effect and be in force from and after its passage and approval as provided by law. PASSED AND APPROVED this ___ day of _____________, 2022. __________________________________ MAYOR ATTEST: ____________________________ CITY CLERK  BILL NO. 9203 ORDINANCE NO. 9203 AN ORDINANCE AUTHORIZING THE CITY OF WEBSTER GROVES TO ENTER INTO AN INTERGOVERNMENTAL COOPERATION AGREEMENT FOR THE INVESTMENT OF PUBLIC FUNDS THROUGH THE MISSOURI SECURITIES INVESTMENT PROGRAM WHEREAS, the City of Webster Groves, Missouri is a Constitutional Charter City and a political subdivision of the State of Missouri, organized and existing under the Constitution and laws of the states; and, WHEREAS, Article VI, Section Sixteen of the Constitution of Missouri provides that any municipality or political subdivision of the state may cooperate under contract to provide a common service as provided by law; and, WHEREAS, Sections 70.210 - 70.320 RS.Mo. provide that political subdivisions, including cities, towns and villages, may jointly exercise their authority to provide a common service so long as the subject and purposes of such contract are within the scope of the powers of each such participating subdivision; and, WHEREAS, the City Council of the City of Webster Groves, Missouri, deems it to be in the best interests of the City and its citizens to enter into an intergovernmental cooperation agreement for the investment of public funds through the Missouri Securities Investment Program. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Authorization of Intergovernmental Cooperation Agreement. The City Council of the City of Webster Groves, Missouri hereby authorizes the City to enter into the amended and restated Missouri Securities Investment Program Intergovernmental Cooperation Agreement, in substantially the form attached to this Ordinance and marked Exhibit A (the "Agreement') submitted to and reviewed by the governing body of the City, a copy of which shall be filed with the minutes of the meeting at which this Ordinance is adopted, with such changes therein as shall be approved by the representatives of the City executing the Agreement, such representatives signatures thereon being conclusive evidence of their approval thereof. Section 2. Execution of Documents. The City Manager, Assistant City Manager/Director of Finance and Administration and the Clerk of the City are hereby authorized and directed to execute and attest, respectively, and deliver the Agreement for and on the behalf of and as the act and deed of the City. Such officers are further authorized to execute and attest, respectively, such other documents, certificates and instruments and to take and perform such further acts on behalf of the City as may be necessary or desirable to carry out and comply with and  give effect to the intent of this Ordinance and the Agreement. Section 3. Authorization of Investments. Public Hearing – Telle IV Properties, LLC (7982-7984 Big Bend Boulevard): An application by Telle IV Properties LLC for a Conditional Use Permit to allow an Automotive Repair and Services Facility use in the existing structure located on a 0.8 acre lot at 7982-7984 Big Bend Boulevard in the “C” Commercial District Mayor Arnold opened the public hearing, and Mara Perry, Director of Planning and Development, gave a presentation. [Exhibit A-Copy in City Clerk’s office] on the Conditional Use Permit application. The Plan Commission voted unanimously to move it forward to Council. Ms. Perry reviewed the existing zoning of the property, existing conditions, history, comprehensive plan analysis, zoning analysis, use analysis, parking, hours of operation, dimensional regulations, and staff recommendations. Council asked questions about the alley and parking maximums. Mayor Arnold asked about community disappointment regarding this use in that spot as some people were hoping for mixed use in the location. Ms. Perry stated that staff met with four different applicants who had contract on the property at some time, and each determined it wasn’t exactly the right site. We weren’t specifically privy to what those reasons were. It came down to the final negotiations between the buyer and seller and they made the final decision on which to go with. Councilmember Bliss asked if this was relocating. Ms. Perry stated that it was, from Richmond Heights. October 4, 2022 Aaron Telle, applicant, stated that this is their 80th anniversary, and this will be their new corporate office space. Dave Buck, 124 S. Elm Ave. stated that the demand for a good tire store in Webster Groves is strong and he thinks it will be a great new business in that spot. It meant a lot to all of us. It was a true collaborative effort! HERE ARE MY REMARKS I CAME TO THE MEETING INTENDING TO DELIVER I believe that three of the most timeless, universal and needed words in the world today are LOVE THY NEIGHBOR. That's ALL our neighbors! Although City Council members and I are fellow Webster Groves residents, we are not neighbors. NEIGHBORS are a special classification who live in close proximity to one another in a NEIGHBORHOOD that can, over time, create and build a such a strong emotional connection, identity and love between neighbors that it often surpasses that with Webster Groves as a whole. Through Porchfest, I have experienced first-hand three important, unique and special neighborhoods in our city: 1) S. Gore & Gray two years ago, 2) North Webster last year, and 3) Tuxedo Park this past Sunday, which may just be the most extraordinary neighborhood I have ever seen, including the great neighborhood where I grew up in Wichita, KS. In short, these neighborhoods & their people know what it means to love thy neighbor & how to show it, and why I am convinced that our city's true strength & character ultimately lies not within City Hall, our businesses or our schools, but within our enduring neighborhoods above all else. 1 So, consider for a moment three of the election campaign priorities and promises many of you made early this year: 1) responsive government, 2) smart development, and 3) sound budget management. All rational and all important. But, now, wonder if there was a fourth one. An emotional one: LOVE THY NEIGHBOR. What would this look like? What would this feel like? What unique ideas & actions might you take to foster & nurture it across all of our city's different neighborhoods? Who knows? It could just be the most important thing you can do for the love & well-being of our city. After all, as the Beatles sang, "All You Need Is Love." NOW, GIVEN THAT I CHANGED GEARS AND SPOKE OFF THE CUFF, HERE ARE MY PARAPHRASED REMARKS AFTER SEEING THE CITY BUDGET NUMBERS SHARED IN THE CITY COUNCIL WORK SESSION Part of what Marie shared in the work session about City Council's Strategic Planning included an early survey of Council and separately of Staff on what they felt were the city's top goals. Both listed "Ensure Financial Security" as their #1 goal among 6-7 goals they listed. Just to be clear, "Ensure Financial Security" is not just one of the 7 top goals identified, it was THE indisputable #1 most important goal above all others! Further, the last time Council set formal goals was back 4 years ago in 2018-19. "Ensure Financial Security" was their #1 most important goal. In fact, in the 20+ years I have lived in Webster Groves, "Ensure Financial Security" has ALWAYS been the consistent, #1 most important goal of EVERY City Council as chief stewards of our city's finances and primary caretakers of our city's financial health & well-being. Now, I am a marketer and creator of new ideas. I am no financial genius by any means. I know that. But I have developed and managed plenty of brand budgets and profit & loss statements in my 40-year career. And the numbers Eric shared with Council SCARE THE HELL OUT OF ME as a resident of our city. Unless I am way off base, I do not ever remember the city facing such a budget crisis. Three major observations: 1) the city budget is far from balanced and is now operating in the red, with budget losses currently projected to INCREASE every year for at least the next 4-5 years, roughly estimated to total over $12 million during that time, 2) current expenses are projected to increase three times the rate of revenue, and 3) based on the imperfect, incomplete and perhaps inaccurate information I have read, I am just not aware of any of our neighboring sister cities facing this same budget crisis. My metaphor is that this budget crisis is like Hurricane Ian slamming into City Hall. And what is Florida's immediate & focused response: to keep their citizens safe, restore vital services, clean-up the mess and rebuild to get their cities back to normal again.....BEFORE thinking about the future. In short, first things first and, as such, given Council's #1 goal to "Ensure Financial Security", my own advice would be for Council's immediate priority to be to fully focus on solving our budget crisis before planning our future in strategic planning, even if it was delayed 6 months to a year in order to right the ship once again. 2 As I departed, my good friend, Laura (Mayor Arnold), said my assessment and view of the numbers is likely inaccurate and that they do not yet reflect tangible, meaningful and significant actions to be taken by the Council. I hear that. Great. But it underscores my point. Whatever these actions are, we need them NOW, not later. Time to focus, Carpe Diem and seize the day to get the budget in order before things possibly get much worse. In closing, I am not being critical. But I am very SCARED for our city!!! I have seen brands and businesses totally collapse & close down because budgets could not be controlled. ANNUAL AUDIT • An independent annual audit will be performed by a public accounting firm, which will issue an official opinion on the annual financial statements and a management letter detailing areas needing improvement. DISCLOSURES • Full disclosure will be provided in the financial statements and bond representations. • Communications between auditors and other outside officials and city officials shall remain confidential until the City Council determines to release such information, pursuant to Missouri law. EXECUTIVE/LEGISLATIVE OVERSIGHT • Financial systems will be maintained to monitor revenues and expenditures/expenses on a monthly basis, with an analysis and adjustment of the Annual Budget at appropriate times. • The Finance Department will monitor the financial systems with reports presented monthly for administrative review.  RESOLUTION 2022-54 ADOPTING A CAPITAL IMPROVEMENT PLAN POLICY WHEREAS, the City of Webster Groves is reviewing its financial policies and desires to codify stated capital improvement policies in accordance with the purpose statement of the City’s financial policies; NOW, THEREFORE, BE IT RESOLVED, by the City Council of Webster Groves, Missouri, that the attached Exhibit A, be adopted as the City’s Capital Improvement Plan Policy; and BE IT FURTHER RESOLVED, that the City Manager is directed to prepare the FY2024 budget with a new fund created for large capital asset replacement pursuant to the attached policy. Future operating costs associated with new capital improvements will be projected and included in the operating budget forecast. • The City will determine and use the most effective and efficient method for financing all new capital projects. LARGE CAPITAL ASSET REPLACEMENT • The City identifies large capital assets as any capital expenditure that has a replacement value over $300,000, or, any component of building infrastructure with a replacement life-span separate or distinct to that of the building (HVAC, electrical, plumbing, roofs, etc.). • The standard street repair program (Annual Chip Seal and Mill and Overlay) is not part of the Large Capital Asset Replacement program, however, any other street- related public works infrastructure that meets the definition of the program is so identified. CAPITAL ASSET MANAGER • The City shall document and input all capital assets into a Capital Asset Manager portfolio and provide a schedule for replacement with needed funding amounts for the years scheduled. CAPITAL IMPROVEMENT RESERVES & SCHEDULES • Beginning in FY2024, the City shall appropriate funds for its yearly capital expenditures and begin reserve accumulation as necessary to fund the schedule of capital asset replacement. • The city shall create a large capital asset replacement reserve fund for banking one-time funds for use in the capital replacement schedule. • At the close of each fiscal year, 50% of the annual unexpended appropriations in the Capital Improvement Fund will be transferred to the fund for large capital asset replacement. • All unexpended appropriations in any fund, other than the Capital Improvement Fund, shall remain in the fund balance of their respective funds. • The City may, from time-to-time as the City Council determines, deposit other one- time funds to the Large Capital Asset Replacement fund.  RESOLUTION 2022-55 ADOPTING A FIVE-YEAR FISCAL PLAN POLICY WHEREAS, the City of Webster Groves is reviewing its financial policies and desires to codify stated accounting policies in accordance with the purpose statement of the City’s financial policies; NOW, THEREFORE, BE IT RESOLVED, by the City Council of Webster Groves, Missouri, that the attached Exhibit A, be adopted as the City’s Five-Year Fiscal Plan Policy. UPDATES AND POLICY DECISION SCHEDULE • The five-year plan shall be updated with current fiscal year actual amounts and revised estimates for both revenues and expenditures for every quarterly budget update. RECURRING REVENUE & EXPENDITURE • Each fund represented in the plan shall clearly have any predicted one-time revenues or expenditures indicated in the fiscal year expected so as to accurately reflect the nature of structural surplus/deficit in each fund. • One-time revenues or expenditures are those items that may not reasonably be expected to occur to again in the next fiscal year with a reasonable similarity in amount and nature to the current year. FUND BALANCE • The plan shall show the actual and/or estimated opening and closing fund balance of each fund for each fiscal year contained in the plan. PENSION FUND • A five-year plan forecast of budgeted and/or expected revenues and expenditures for the fiduciary pension fund of the City. • The plan years shall be the current fiscal year and the four following fiscal years. • The plan estimates and assumptions shall be based on the actuarial assumptions and estimates commonly used by the Missouri Local Area Government Employees Retirement System (LAGERS), as best available, and generally accepted accounting principles. • The plan shall be considered a separate plan from the City’s Five-Year Fiscal Plan for the governmental funds. • The Pension Fund Five-Year Plan shall be reviewed annually during the course of budget consideration and adoption. • The plan, in its latest iteration, along with past iterations, shall be publicly available.  RESOLUTION 2022-56 AUTHORIZING ADDITIONAL EXPENDITURES FOR THE 2022 MILL AND OVERLAY PROGRAM AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER WHEREAS, Resolution 2022-15 authorized expenditures of $848,394.65 to NB West Contracting for the 2022 Mill and Overlay Program; and WHEREAS, a change order in the amount of $32,712.30 is necessary to complete work on the program for the year; and NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Webster Groves, Missouri, that the authorized expenditure to NB West Contracting, as originally approved by Resolution 2022-15, be increased by $32,712.30 (payable from Street Improvement Fund) for a total value not to exceed $881,106.95; and BE IT FURTHER RESOLVED, that the City Manager is authorized to execute Change Order No. 1 pursuant to the original contract. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, that the City Manager be authorized to pay AXON Enterprise Inc., the sum hereinabove set forth, and to assure that all items are provided in accordance with specifications.
