4. Adversely affect the general welfare of the community.
5. Overtax public utilities.

the Marshall Place right of way.

use as a legal, nonconforming structure.
Staff does not recommend placing additional
dimensional regulations upon the proposed use.

Recommendation –
Should the Plan Commission recommend approval of the CUP, staff recommends the
following conditions:
1. All provisions of the City Code shall apply except as expressly modified in this
Ordinance.
2. Hours of operation shall not exceed the following: 6:00 am- 4:00 pm daily.
3. The applicant shall be responsible for pick-up of all litter on their property and litter
generated from their facility onto adjacent properties or rights-of-way.
4. The uses shall not encroach further beyond the south front property line than the
existing legal, nonconforming commercial structure. The Dimensional Regulations of
the “D” Commercial District shall apply.
5. This Conditional Use Permit is personal to the Applicant and shall not run with the
land.

Subject: Dave Buck's "Remarks from the Community & Visitors" in the 12/20/22 Regular City
Council Meeting
Caution: This is an External Message - Please be cautious when opening links or attachments
We celebrated one of our grandkid’s 8th birthday last night, so I was unable to
attend your City Council meeting. Below are the remarks I would have shared had
I been there.
To City Council & City Staff,
Changing “Remarks of Visitors” to “Remarks from the Community & Visitors” was
a positive change to Council’s regular meeting agenda. May I please suggest TWO
more positive changes, borrowed directly from the meetings of the Webster
Groves School Board.
Immediately following Katie’s roll call, open every meeting by adding TWO things
in order:
The PLEDGE OF ALLEGIANCE. Other governmental entities which recite it in their
regular meeting agendas include the United States Senate & House, the Missouri
State Senate & House, and closer to home, the City Councils of Kirkwood, Rock Hill,
Brentwood, Sunset Hills, Manchester, Chesterfield, Ballwin and the list goes on.
But not every government entity includes it. And I have it on good authority that
some of your residents would likely oppose it for various reasons. So, it is your
choice. But the flag is right there on your podium and the Pledge takes

approximately 10 seconds to recite. Speaking personally, I think it’s a good idea &
practice, as every Pledge we make humbles and reminds us that we are all united
as one country and that we are part of something much bigger than ourselves.
CELEBRATIONS FROM CITY COUNCIL & CITY STAFF. The School Board does this at
EVERY meeting. Don’t get me wrong. You routinely recognize the performance of
your different city boards and commissions in your work sessions and make
occasional proclamations during regular meetings of special individual or group
accomplishments, plus retirements, etc.
But I’m talking about standardizing such celebrations at the beginning of EVERY
regular meeting. And in choosing your celebrants, you may wish to take a page
from Sports Illustrated’s great regular feature called “Faces In The Crowd” and
celebrate our unsung heroes & ordinary residents who do extraordinary things
every day for the good of the community.
For example, celebrating our friends, cooks & staff, like Ali, Essa, Carrie & Ashley,
at Webster’s own beloved Boardwalk Café, would be a terrific choice and would
mean so much to them.
In short, it doesn’t take long to do and the celebrated people don’t even have to
be there. But it can go a long way in making your residents feel valued and that
they matter, plus you get to start every meeting on a positive & uplifting note.

DRIVE-THRU USE ON AN APPROXIMATELY
0.45-ACRE TRACT OF LAND IN AN EXISTING STRUCTURE AT
60 N GORE AVENUE IN THE “D” COMMERCIAL
DISTRICT AND MATTERS RELATED THERETO
WHEREAS, the Zoning Code of Webster Groves provides the City Council may, by conditional
use permit issued under the provisions of Section 53.140 and 53.159, authorize the use of property in the
“D” Commercial District for a “Coffee Shop, No Drive-Thru”; and
WHEREAS, the property located at 60 N. Gore Avenue (the “Property”) was used for mixed
commercial and office purposes most recently; and
WHEREAS, Telva, LLC, (the “Applicant”) has applied for a conditional use permit that allows for
a Coffee Shop, on an approximately 0.8 acre tract of land with an existing building at 60 N. Gore Avenue,
in the “D” Commercial District;
WHEREAS, the Application was referred to the City Plan Commission, which, after studying the
Application and the recommendation of the Director of Planning and Development, and holding a public
hearing on December 5, 2022, has recommended approval of the Application subject to certain conditions;
and
WHEREAS, the City Council gave due notice and held a public hearing on the application at City
Hall, on Tuesday, December 20, 2022, at 7:30 P.M., where the Council heard and considered comments
and suggestions by those present;
WHEREAS, the City Council has determined, in accordance with the provisions of Section
53.176.b. of the Zoning Code that the existing building set backs are not being changed and shall continue
to govern structures on the Property; and
WHEREAS, the City Council has determined, in accordance with the provisions of Chapter
53.173.a. of the Zoning Code, that granting the Applicant’s Conditional Use Permit will not:
1. Substantially increase traffic hazards or congestion;
2. Substantially increase fire hazards;
3. Adversely affect the character of the neighborhood;
4. Adversely affect the general welfare of the community; or
5. Overtax public utilities.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES, MISSOURI, AS FOLLOWS:
Section 1. The Conditional Use Permit is hereby granted as set forth in the Application,
cover letter and subject to the following conditions:

AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT
TO TELVA, LLC TO ALLOW BANQUET FACILITY
AND DANCING ACADEMY USES ON AN APPROXIMATELY
0.45-ACRE TRACT OF LAND IN AN EXISTING STRUCTURE AT
60 N GORE AVENUE IN THE “D” COMMERCIAL
DISTRICT AND MATTERS RELATED THERETO,
AND REPEALING ORDINANCE #9150
WHEREAS, Chapter 53 of the Code of Webster Groves, particularly Section 53.159 “D”
Permitted Uses allows for a “Banquet Facility” and “Dancing Academy in the “D” Commercial
Zoning District of the City in accordance with the review standards outlined in Section 53.170 et
seq.; and
WHEREAS, Ordinance #9150 previously granted to McMillian Development LLC a
conditional use permit to operate a “Banquet Facility” and “Dancing Academy at 60 N. Gore
Avenue (the “Property”); and
WHEREAS, Loryn Crowley, owner of Telva, LLC (the “Applicant”), has requested a
transfer of ownership for that Conditional Use Permit to utilize the existing structure for various
events and classes which would fall under a banquet facility or dancing academy use within a “D”
Commercial District at the Property; and
WHEREAS, Section 53.804(d) of the Zoning Code allows the Director of Planning and
Development to directly review a request for a transfer of a CUP due to a change of ownership,
but not a substantial change of use, without Plan Commission or City Council review when the
Director of Planning and Development determines that the transfer will not affect the intensity of
the use approved by the immediately preceding Ordinance granting a CUP; and
WHEREAS, under such direct review, the City Council can approve, without a public
hearing, a new ordinance for approval of the transfer of the CUP.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES:
Section 1. The City Council hereby approves a Conditional Use Permit to Telva, LLC
to operate a banquet facility and dancing academy within an existing structure on an approximately
0.45 acre tract of land at 60 N. Gore Avenue within the “D” Commercial District, subject to the
following conditions:
1. All provisions of the City Code shall apply except as expressly modified in this
Ordinance #9205.
2. All events held under the Banquet Facility use and Dancing Academy use shall be
located within the existing footprint of the greenhouse and second floor of the existing
commercial structure.
3. The uses shall not encroach further beyond the south front property line than the
existing legal, nonconforming commercial structure. The Dimensional Regulations of
the “D” Commercial District shall apply.
4. The maximum occupancy level for events of the Banquet Facility and Dancing
Academy uses shall not exceed seventy-five (75) persons for daytime events held prior
to 5pm and one hundred and fifty (150) persons for evening events held between 5pm
and 11pm.
5. A minimum of sixty-five (65) off-street parking spaces shall be provided. An
equivalent number of off-street parking spaces shall be provided through private
parking lease agreements should existing parking facilities at 61 N Gore Ave and 147
W Pacific Ave be removed or become unavailable.
6. Hours of operation shall be limited to 7AM to 11 PM daily.
7. The applicant shall provide the Fire Department with an emergency egress plan. Fire
Department approval of the emergency egress plan shall be necessary prior to business
license approval.
8. This conditional use permit is personal to the owner and shall not run with the land.
Section 2. Because the terms and conditions of Ordinance 9150 have been
incorporated into this Ordinance, Ordinance 9150 is hereby repealed.
Section 3. This Ordinance shall not be printed in the Code of Webster Groves.
Section 4. This Ordinance shall become effective immediately upon passage and
approval.

WHEREAS, Chapter 53 of the Code of Webster Groves, particularly Section 53.159 “D”
Permitted Uses allows for a “Restaurant, No Drive-Thru” in the “D” Commercial Zoning District
of the City in accordance with the review standards outlined in Section 53.170 et seq.; and
WHEREAS, Ordinance #7761 previously granted to J.D.C. Restaurants, Inc., d/b/a C. J.
Muggs, a conditional use permit to operate a “Restaurant, No Drive-Thru” at 101 W. Lockwood

Director of Planning and Development determines that the transfer will not affect the intensity of
the use approved by the immediately preceding Ordinance granting a CUP; and
WHEREAS, under such direct review, the City Council can approve, without a public
hearing, a new ordinance for approval of the transfer of the CUP.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES:
Section 1. The City Council hereby approves a Conditional Use Permit to Sunmojo,
LLC to operate a restaurant, no drive-thru within an existing structure on an approximately 0.42
acre tract of land at 101 W. Lockwood Avenue within the “D” Commercial District, subject to the
following conditions:
1. All provisions of the City Code shall apply except as expressly modified in this
Ordinance #9206.
2. Hours of operation shall be limited to 7AM to 1 AM daily.
3. Outside dining shall be allowed only to the extent permitted by the City’s Sidewalk
Dining regulations contained in Chapter 43, as amended.
4. The applicant shall be responsible for all pick-up of litter and restaurant related
trash on restaurant property, and neighboring properties, on a daily basis. The area
immediately around the restaurant dumpster(s) shall at all times be free of trash,
debris, and oil waste, with all trash and waste being placed inside the appropriate
dumpsters in appropriate containers.
5. Outdoor speakers are prohibited and Section 53.144 “D” Performance Standards
shall be followed.
6. The existing primary structure setbacks shall be those of the “D” Commercial
District.
7. This conditional use permit is personal to the owner and shall not run with the land.
Section 2. Because the terms and conditions of Ordinance 7761 have been
incorporated into this Ordinance, Ordinance 7761 is hereby repealed.
Section 3. This Ordinance shall not be printed in the Code of Webster Groves.
Section 4. This Ordinance shall become effective immediately upon passage and
approval.

WHEREAS, the City Council of Webster Groves, Missouri, desires to amend language in
Chapter 42, by removing regulations requiring applicants to submit a surety bond to the City of
Webster Groves when making application for a liquor license.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES, MISSOURI, AS FOLLOWS:
Section 1. Chapter 42, “Licensing and Regulation of Liquor”, Article 1, “Intoxicating
Liquor”, Section 42.028 “Bond Required” is hereby deleted, and Section 42.050, “Regulation
of Retail Package Sales; Conditions of License” (a), is hereby amended as set forth below:
Section 42.028. Bond Required.
Before any initial application for a license authorizing the sale of intoxicating liquor at retail
by the drink to be consumed upon the premises shall be approved, the director shall require of
the applicant a bond satisfactory to him to be given to the city in the sum of Two Thousand
Dollars ($2,000.00). The bond shall be written by a surety company authorized to write such
bonds in the state and shall be conditioned that the person obtaining such license shall faithfully
perform all duties imposed by law upon the applicant by the ordinances of the city and laws of
the state, and that he will pay all taxes and license fees provided for by the ordinances of the
city, or the state for the benefit of the city, together with all fines, penalties and forfeitures
which may be adjudged against him. The bond shall provide that it may be sued upon in the
name of the city or the state for the collection of any taxes, license fees, fines, penalties and
forfeitures which may be adjudged against him.
Section 42.050. Regulation of Retail Package Sales; Conditions of License.
a. No license shall be issued except to a person or corporation engaged in and whose principal
business is that of a drug store, cigar and tobacco store, grocery store, general merchandise
store, convenience store without gasoline, specialty food store or delicatessen or
supermarket, and then only if such person shall meet all of the requirements of this Chapter
and have been engaged in the conduct and operation of such bona fide principal business
at the time of issuance of the license, and provided further that at the time of issuance and
continuously thereafter the gross sales of wares and merchandise, exclusive of intoxicating
liquors, tobacco and lottery tickets, must exceed fifty percent (50%) of the business’s gross
sales; each application for license shall be accompanied by appropriate records of the
business documenting compliance with said provision. Such application shall likewise be
accompanied by a surety bond as provided in Section 42.028 hereof. No license shall be
issued in any event to any person engaged, or who expects or intends to engage, principally
in the sale of intoxicating liquors in what is commonly known as “liquor stores.”

reviewed and discussed a request for change of a specific fifteen-minute parking area to
better accommodate curbside pick-up of prepared food in light of the changed economic
conditions as a result of the COVID-19 pandemic.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

Section 1. Schedule H of Chapter 60 of the Code of Webster Groves is hereby
amended to change public parking regulations for select parking spaces in the Old
Webster Special Business District as follows. Each location shall include one parking
space that will be re-designated to provide parking limited to fifteen (15) minutes only for
delivery and pickup to/from local businesses, including delivery and pickup by
customers:

personal property retail sales of adult use marijuana sold in the City of Webster Groves,
Missouri and to submit the same to the voters of the City for approval by a majority of those
voting at the general municipal election to be held on April 4, 2023.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF WEBSTER GROVES,
MISSOURI AS FOLLOWS:
SECTION 1 – ADULT USE MARIJUANA SALES TAX. A sales tax at the rate of three
percent on all tangible personal property retail sales of adult use marijuana sold in the City
of Webster Groves, Missouri, as authorized by Article XIV, section 2.6(5) of the Missouri
Constitution, is hereby imposed. The tax imposed hereunder shall be in addition to any
and all other sales taxes allowed by law.
SECTION 2 – EFFECTIVE DATE. The sales tax imposed by this Ordinance shall not
be effective unless approved by a majority of the votes cast by the qualified voters voting
thereon at the General Municipal Election to be held on April 4, 2023, at which election a
proposal to authorize the City Council of the City of Webster Groves, Missouri, to impose
the tax herein provided for shall be submitted to the voters of the City of Webster Groves.
SECTION 3 – FORM OF BALLOT. The ballot to be used in such election shall

My life has been guided by several simple wisdoms, instilled in me by my
various mentors. Tonight, I briefly share just six of them in the hopes that they
might (or might not) help your strategic planning.
We are all unique and that makes each of us special and beautiful. Webster
Groves is unique, special and beautiful from other cities and municipalities and
I hope this uniqueness is captured, clearly communicated, protected and
celebrated in your final plan.
There is no bound to your potential. At 69 years of age, I believe I have just
scratched the surface of my potential. At 126 years of age, Webster Groves has
only scratched the surface of its potential, in my opinion. Help us define it and
reach for the stars!
The Serenity Prayer: God grant me the serenity to accept the things I cannot
change, the courage to change the things I can, and the wisdom to know the
difference. What are the changes you can’t make in Webster Groves, or
should never try to make, versus those that take courage and are worth
fighting for, and the wisdom to know the difference?
Do only a few fundamental things but do them extraordinarily well. It’s all
about the power, need and value of focus. For example, when you get to
setting specific goals for Webster Groves to be achieved, I wish you would limit
them to only your top 3. Less is more. Fewer is better.
Fun is fundamental. Fun & Play are timeless, universal and essential human
needs we all have. Webster Groves does a terrific job of uniting our residents
and raising them up above the controversies of the day via wonderful
community events and the arts. My question is what is the next big idea to
help keep the fun factor in our community alive and well?
Carpe Diem! Seize the day! Gather ye rosebuds while ye may! The game is
afoot and if I have a chief complaint in my 21 years in Webster Groves, it is that
city government tends to move slower than faster. Thus, in my opinion, you
can and need to be more aggressive and move faster on your top priorities and
opportunities.

ADOPTING AN INVESTMENT POLICY
WHEREAS, the City of Webster Groves is reviewing its financial policies and desires to
update its Investment Policy as previously adopted by Resolution 2010-17.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of Webster Groves, Missouri,
that the attached Exhibit A, be adopted as the City’s Investment Policy and Resolution
2010-17 is hereby repealed.

CITY OF WEBSTER GROVES INVESTMENT POLICY

I. Scope
This policy applies to the investment of all operating funds and the pension fund of the City of
Webster Groves, with the exception of the City’s 457 deferred compensation funds and any other
employee benefits funds held by the City or other entities, not explicitly stated here.
1. Pooling of Funds
Except for cash in certain restricted and special funds, the City of Webster Groves will
consolidate cash balances from all funds to maximize investment earnings. Investment
income will be allocated to the various funds based on their respective participation and in
accordance with generally accepted accounting principles.
2. External Management of Funds
Investment through external programs, facilities and professionals operating in a manner
consistent with this policy will constitute compliance.
II. General Objectives
The primary objectives, in priority order, of investment activities shall be safety, liquidity, and
yield:
1. Safety
Safety of principal is the foremost objective of the investment program. Investments shall be
undertaken in a manner that seeks to ensure the preservation of capital in the overall
portfolio. The objective will be to mitigate credit risk and interest rate risk.
a. Credit Risk
The City of Webster Groves will minimize credit risk, the risk of loss due to the failure of
the security issuer or backer, by:
• Pre-qualifying the financial institutions, broker/dealers, intermediaries, and advisors
with which the City of Webster Groves will do business.
• Diversifying the portfolio so that potential losses on individual securities will be
minimized.
b. Interest Rate Risk
The City of Webster Groves will minimize the risk that the market value of securities in the
portfolio will fall due to changes in general interest rates, by:
• Structuring the investment portfolio so that securities mature to meet cash
requirements for ongoing operations, thereby avoiding the need to sell securities on
the open market prior to maturity.
• Investing operating funds primarily in shorter-term securities.
2. Liquidity
The investment portfolio shall remain sufficiently liquid to meet all operating requirements
that may be reasonably anticipated. This is accomplished by structuring the portfolio so that
securities mature concurrent with cash needs to meet anticipated demands (static liquidity).
Furthermore, since all possible cash demands cannot be anticipated, the portfolio should
consist largely of securities with active secondary or resale markets (dynamic liquidity). A
portion of the portfolio also may be placed in bank deposits or repurchase agreements that
offer same-day liquidity for short-term funds.
3. Yield
The investment portfolio shall be designed with the objective of attaining a market rate of
return throughout budgetary and economic cycles, considering the investment risk
constraints and liquidity needs. Return on investment is of secondary importance compared

to the safety and liquidity objectives described above. The core of investments is limited to
relatively low risk securities in anticipation of earning a fair return relative to the risk being
assumed. Securities shall not be sold prior to maturity with the following exceptions:
• A security with declining credit may be sold early to minimize loss of principal.
• A security swap would improve the quality, yield, or target duration in the portfolio.
• Liquidity needs of the portfolio require that the security be sold.
III. Standards of Care
1. Prudence
All participants in the investment process shall act responsibly as custodians of the public
trust. The standard of prudence to be applied by the personnel of the Investment Division is
the “prudent investor” rule, which states, “Investments shall be made with judgment and care,
under circumstances then prevailing, which persons of prudence, discretion and intelligence
exercise in the management of their own affairs, not for speculation, but for investment,
considering the probable safety of their capital as well as the probable income to be derived.”
2. Ethics and Conflicts of Interest
Officers and employees involved in the investment process shall refrain from personal
business activity that could conflict with the proper execution and management of the
investment program, or that could impair their ability to make impartial decisions.
Employees and investment officials shall disclose any material interests in financial
institutions with which they conduct business. They shall further disclose any personal
financial/investment positions that could be related to the performance of the investment
portfolio. Employees and officers shall refrain from undertaking personal investment
transactions with the same individual with which business is conducted on behalf of the City
of Webster Groves.
3. Delegation of Authority
Authority to manage the investment program is granted to the Director of Finance &
Administration, hereinafter referred to as investment officer and derived from the charter
powers as described in Article V of the Webster Groves City Charter. Responsibility for the
operation of the investment program is hereby delegated to the investment officer, who shall
act in accordance with the established written procedures and internal controls for the
operation of the investment program consistent with this investment policy. Procedures
should include references to safekeeping, delivery vs. payment, investment accounting,
repurchase agreements, wire transfer agreements, and collateral/ depository agreements. No
person may engage in an investment transaction except as provided under the terms of this
policy and the procedures established by the investment officer. The investment officer shall
be responsible for all transactions undertaken and shall establish a system of controls to
regulate the activities of subordinate officials.
IV. Investment Transactions
1. Authorized Financial Dealers and Institutions
A list will be maintained of financial institutions authorized to provide investment transactions.
In addition, a list will also be maintained of approved security broker/dealers selected by
creditworthiness as determined and approved by the investment officer. These may include
“primary” dealers or regional dealers that qualify under Securities and Exchange Commission
(SEC) Rule 15C3-1 (uniform net capital rule).

All financial institutions and broker/dealers who desire to become qualified for investment
transactions must supply the following as appropriate:
• Audited financial statements.
• Proof of National Association of Securities Dealers (NASD) certification.
• Proof of state registration.
• Completed broker/dealer questionnaire.
• Certification of having read and understood and agreeing to comply with the City of
Webster Groves’ investment policy.
An annual review of the financial condition and registration of qualified financial institutions
and broker/dealers will be conducted by the investment officer.
2. Internal Controls
The investment officer/internal auditor/director of accounting is responsible for establishing
and maintaining an internal control structure that will be reviewed annually with the City of
Webster Groves’ independent auditor. The internal control structure shall be designed to
ensure that the assets of the City of Webster Groves are protected from loss, theft, or misuse
and to provide reasonable assurance that these objectives are met. The concept of
reasonable assurance recognizes that (1) the cost of control should not exceed the benefits
likely to be derived and (2) the valuation of costs and benefits require estimates and
judgments by management.
The internal controls shall address the following points:
• Control of collusion.
• Separation of transaction authority from accounting and record keeping.
• Custodial safekeeping.
• Avoidance of physical delivery securities.
• Clear delegation of authority to subordinate staff members.
• Written confirmation of transactions for investments and wire transfers.
• Development of a wire transfer agreement with the lead bank and third-party
custodian.
3. Delivery vs. Payment
All trades where applicable will be executed by delivery vs. payment (DVP) to ensure that
securities are deposited in eligible financial institutions prior to the release of funds. All
securities shall be perfected in the name or for the account of the City of Webster Groves and
shall be held by a third-party custodian as evidenced by safekeeping receipts.
V. Suitable and Authorized Investments
1. Investment Types
In accordance with and subject to restrictions imposed by current statutes, the following list
represents the entire range of investments that City of Webster Groves will consider and
which shall be authorized for the investments of funds by the City of Webster Groves.
a. Governmental and Agency Debt
Those securities issued by and or guaranteed by the Federal Government or an Agency
or Instrumentality of the Federal Government:
• United States Treasury Securities. The City of Webster Groves may invest in
obligations of the United States government for which the full faith and credit of the

United States are pledged for the payment of principal and interest.
• United States Agency Securities. The City of Webster Groves may invest in obligations
issued or guaranteed by any agency of the United States Government as described in
V. (2).
b. Fixed Income investments secured by FDIC insurance and/or Collateral:
• Repurchase Agreements. The City of Webster Groves may invest in contractual
agreements between the City of Webster Groves and commercial banks or primary
government securities dealers. The purchaser in a repurchase agreement (repo)
enters into a contractual agreement to purchase U.S. Treasury and government
agency securities while simultaneously agreeing to resell the securities at
predetermined dates and prices.
• Collateralized Public Deposits (Certificates of Deposit). Instruments issued by financial
institutions which state that specified sums have been deposited for specified periods
of time and at specified rates of interest. The certificates of deposit are required to be
backed by acceptable collateral securities as dictated by State statute.
c. Other Fixed Income Debt issued by Commercial Enterprises
It should be noted that investments in the following instruments require an additional
level of care and prudence when undertaken by the investment officer. Because these
investments are in commercial credits as opposed to governmental credit, or subject to
the added safety of collateral, the risk of loss of principal is significantly higher for the
following investments than in the four prior categories. Added financial training and
education is recommended for the Investment Officer wishing to participate in and/or
manage a commercial paper program. Outside professional management of your
commercial paper program is highly recommended.
• Bankers Acceptances. The City of Webster Groves may invest in bills of exchange or
time drafts on and accepted by a commercial bank, otherwise known as bankers’
acceptances. An issuing bank must have received the highest letter and numeral
ranking (i.e., A1 / P1) by at least two nationally recognized statistical rating
organizations (NRSRO’s). Bankers Acceptances must be issued by domestic
commercial banks.
• Commercial Paper. The City of Webster Groves may invest in commercial paper which
has received the highest letter and numeral ranking (i.e., A1 / P1) by at least two
nationally recognized statistical rating organizations (NRSRO’s). Eligible paper is
further limited to issuing corporations that have a total commercial paper program size
in excess of $250,000,000 and have long term debt ratings, if any, of “A” or better
from at least one NRSRO. Approved commercial paper programs should provide
some diversification by industry. Additionally, purchases of commercial paper in
industry sectors that may from time to time be subject to undue risk and potential
illiquidity should be avoided. The only asset- backed commercial paper programs that
are eligible for purchase are fully supported programs that provide adequate
diversification by asset type (trade receivables, credit card receivables, auto loans,
etc.) No securities arbitrage programs or commercial paper issued by Structured
Investment Vehicles (SIV’s) shall be considered. Commercial paper issuers must be
subject to weekly credit review and daily news research and analysis and a
monitoring program must be established to promulgate best practices credit
monitoring.
2. Security Selection
The following list represents the entire range of United States Agency Securities that the City
of Webster Groves will consider and which shall be authorized for the investment of funds by
the City of Webster Groves. Additionally, the following definitions and guidelines should be

used in purchasing the instruments:
• U.S. Govt. Agency Coupon and Zero-Coupon Securities. Bullet coupon bonds with no
embedded options.
• U.S. Govt. Agency Discount Notes. Purchased at a discount with maximum maturities of
one (1) year.
• U.S. Govt. Agency Callable Securities. Restricted to securities callable at par only with
final maturities of five (5) years.
• U.S. Govt. Agency Step-Up Securities. The coupon rate is fixed for an initial term. At
coupon date, the coupon rate rises to a new, higher fixed term. Restricted to securities
with final maturities of five (5) years.
3. Investment Restrictions and Prohibited Transactions
To provide for the safety and liquidity of the City of Webster Groves’ funds, the investment
portfolio will be subject to the following restrictions:
• Borrowing for investment purposes (“Leverage”) is prohibited.
• Instruments known as variable rate demand notes, floaters, inverse floaters, leveraged
floaters, and equity- linked securities are not permitted. Investment in any instrument,
which is commonly considered a “derivative” instrument (e.g. options, futures, swaps,
caps, floors, and collars), is prohibited.
• Contracting to sell securities not yet acquired in order to purchase other securities for
purposes of speculating on developments or trends in the market is prohibited.
4. Collateralization
Collateralization will be required on two types of investments: certificates of deposit and
repurchase agreements. The market value (including accrued interest) of the collateral should
be at least 100%.
For certificates of deposit, the market value of collateral must be at least 100% or greater of
the amount of certificates of deposits plus demand deposits with the depository, less the
amount, if any, which is insured by the Federal Deposit Insurance Corporation, or the National
Credit Union Share Insurance Fund.
All securities, which serve as collateral against the deposits of a depository institution, must
be safekept at a non-affiliated custodial facility. Depository institutions pledging collateral
against deposits must, in conjunction with the custodial agent, furnish the necessary custodial
receipts within five business days from the settlement date.
The City of Webster Groves shall have a depositary contract and pledge agreement with
each safekeeping bank that will comply with the Financial Institutions, Reform, Recovery, and
Enforcement Act of 1989 (FIRREA). This will ensure that the City of Webster Groves’ security
interest in collateral pledged to secure deposits is enforceable against the receiver of a failed
financial institution.
5. Repurchase Agreements
These securities for which repurchase agreement will be transacted will be limited to U.S.
Treasury and government agency securities that are eligible to be delivered via the Federal
Reserve Fedwire book entry system. Securities will be delivered to the City of Webster
Groves’ designated Custodial Agent. Funds and securities will be transferred on a delivery vs.
payment basis.

1. Diversification
The investments shall be diversified to minimize the risk of loss resulting from over
concentration of assets in specific maturity, specific issuer, or specific class of securities.
Diversification strategies shall be established and periodically reviewed. At a minimum,
diversification standards by security type and issuer shall be:
• U.S. treasuries and securities having principal and/or interest guaranteed by the U.S.
government: 100%
• Collateralized time and demand deposits: 100%
• U.S. Government agencies, and government sponsored enterprises: No more than 60%
• Collateralized repurchase agreements: 50%
• U.S. Government agency callable securities: No more than 30%
2. Maximum Maturities
To the extent possible, the City of Webster Groves shall attempt to match its investments with
anticipated cash flow requirements. Investments in repurchase agreements shall mature and
become payable not more than ninety days (90) from the date of purchase. All other
investments shall mature and become payable not more than two (2) years from the date of
purchase. Because of inherent difficulties in accurately forecasting cash flow requirements, a
portion of the portfolio should be continuously invested in readily available funds such as in
bank deposits or overnight repurchase agreements to ensure that appropriate liquidity is
maintained to meet ongoing obligations.
VII. Reporting
1. Period
The City of Webster Groves shall consider its fiscal year the reporting period for its
investment portfolio.
2. Methods
The investment officer shall prepare an investment report quarterly, including a management
summary that provides an analysis of the status of the current investment portfolio and
transactions made over the last quarter. This management summary will be prepared in a
manner that will allow the City of Webster Groves to ascertain whether investment activities
during the reporting period have conformed to the investment policy. The report should be
provided to the City Council of the City of Webster Groves and the City Administration. The
quarterly report will include the following:
• Listing of individual securities held at the end of the reporting period.
• Average weighted yield to maturity of portfolio on investments as compared to applicable
benchmarks.
• Listing of investment by maturity date.
• Percentage of the total portfolio which each type of investment represents.
Once annually, the investment officer shall include in the report to the City Council and City
Administration, the following:
• Realized and unrealized gains or losses resulting from appreciation or depreciation by
listing the cost and market value of securities over one-year duration in accordance with
GASB 31 requirements.

The investment portfolio will be managed in accordance with the parameters specified within
this policy. The portfolio should obtain a market average rate of return during a
market/economic environment of stable interest rates. A series of appropriate benchmarks
may be established against which portfolio performance shall be compared on a regular
basis.
4. Marking to Market
The market value of the portfolio shall be calculated at least quarterly and a statement of the
market value of the portfolio shall be issued at least annually to the City Council of the City of
Webster Groves. This will ensure that review of the investment portfolio, in terms of value and
price volatility, has been performed.
VIII. Policy Considerations
1. Exemption
Any investment currently held that does not meet the guidelines of this policy shall be
exempt from the requirements of this policy. At maturity or liquidation, such monies shall be
reinvested only as provided by this policy.
2. Adoption & Review
This policy shall be adopted by resolution of the City Council of the City of Webster Groves’.
The policy shall be reviewed biennially by the City Council with any recommended changes
provided for the Council’s consideration.

ATTACHMENT 1 – MISSOURI STATE TREASURER’S ACCEPTABLE SECURITIES
The securities described below are hereby designated as acceptable collateral for state funds
on deposit, as required by Section 30.270 RSMo (as amended). The State Treasurer reserves
the right to refuse to accept as collateral any security or securities on this list, or to request
the submission of an alternate acceptable security or securities, if, in the sole discretion of
the State Treasurer, the State Treasurer determines that such action will provide greater
security for the deposit of state funds.
The securities described below are designated as acceptable collateral for the deposit of state
funds. The listing is not intended to serve as, and should not be considered as a listing of legally
authorized investment instruments.
1. Marketable Treasury securities of the United States.
2. Bonds or certificates of participation (COP’s) issued by the State of Missouri with an
investment grade long-term rating from one of the Nationally Recognized Statistical
Ratings Organizations (NRSRO’s) or are secured by a federal agency guarantee
(directly or through guaranteed loans), to include the following:
a. General obligation debt securities issued by the State of Missouri.
b. Revenue bonds issued by the Missouri Board of Public Buildings or
Department of Natural Resources.
c. Revenue bonds of the Missouri Housing Development Commission, Missouri
Health and Education Facilities Authority, Missouri Higher Education Loan
Authority, Missouri Environmental Improvement and Energy Resources Authority,
Missouri Agricultural and Small Business Development Authority, Missouri
Industrial Development Board, or State-owned educational institutions.
d. Certificates of Participation issued by the Missouri Board of Public Buildings or
Public Fund Commissioners.
3. Bonds or certificates of participation with an investment grade long- term rating from
one of the NRSRO’s issued by of any of the following agencies:
a. Any city in this state having a population of not less than two thousand
b. Any county of this state
c. Any school district situated in this state
d. Any special road district in this state
e. Bonds of any political subdivision established under the provision of Article
VI, Section 30 of the Constitution of Missouri (City and County of St. Louis)
f. Any of the fifty states within the United States of America
4. Debt securities guaranteed by the United States or its agencies or
instrumentalities, as follows:
a. Debt securities of the Federal Farm Credit System
b. Debt securities of the Federal Home Loan Banks
c. Debt securities of the Federal National Mortgage Association (“Fannie Mae”)
d. Debt securities of the Tennessee Valley Authority (TVA)
e. Debt securities of the Federal Agricultural Mortgage Corporation
(“Farmer Mac”)
f. Debt securities of the Government National Mortgage Association (“Ginnie
Mae”).
g. Debt securities of the Federal Home Loan Mortgage Corporation
(“Freddie Mac”)
h. Guaranteed Loan Pool Certificates of the Small Business Administration
(SBA)
i. Federal Home Administration insured notes (CBOs).
j. Public housing notes and bonds (“project notes and bonds”) issued by public
housing agencies, guaranteed as to the payment of principal and interest by
the government of the United States or any agency or instrumentality thereof.
k. Debt securities of the Resolution Funding Corporation (REFCORP).
Collateralization margins for pass-through mortgage-backed securities, SBA pool
certificates, and collateralized mortgage obligations shall differ from debentures issued
by such agencies. The only type of Collateralized Mortgage Obligations (CMO) that the
Treasurer’s Office will accept are Exchangeable (EXCH), Floaters (FLT), Mandatory
Redemption (MR), Nonaccelerating Security (NAS), Overcollateralized (OC), Planned
Amortization (PAC), Prepayment Penalty (PIP), Pass Through (PT), Scheduled Pay (SCH),
Semi-annual Pay (SEMI), and Sequential Pay (SEQ) classes.
Furthermore, Collateralized Mortgage Obligations must have a weighted average life
not to exceed five years and pass the FFIEC High Risk Stress Test. No Strips, Z bonds,
Subordinated or Support Bonds, Mortgage Derivatives or Zeros are acceptable.
5. Tax anticipation notes issued by any county of class one in Missouri with an investment
grade short-term rating from one of the Nationally Recognized Statistical Ratings
Organizations (NRSRO’s)
6. Surety bonds issued by an insurance company licensed under the laws of the State of
Missouri whose claims-paying ability is rated in the highest category by Duff & Phelps,
A.M. Best, Standard & Poor’s, or Moody’s. The face amount of such surety bond shall
be at least equal to the portion of the deposit to be secured by the surety bond.
7. Irrevocable standby Letter of Credit issued by a Federal Home Loan Bank.
8. Bonds or certificates of participation issued by local government agencies within the
fifty states, provided such instruments are rated in one of the four highest rating
categories (investment grade) by at least one NRSRO.
9. Brokered or negotiable certificates of deposit that are fully insured either by the
Federal Deposit Insurance Corporation (FDIC) or the National Credit Union Share
Insurance Fund.
The State Treasurer shall determine the collateralization margin (or “haircut”) for each security

The total market value of collateral must be equal to or greater than the collateralization
margin set by the State Treasurer of the total amount of state time deposits (including accrued
interest to maturity) plus demand deposits with the depository, less the amount, if any, which is

AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR
ROOF RESTORATIONS AT CITY HALL AND THE SERVICE CENTER, AND
AMENDING THE BUDGET FOR FISCAL YEAR 2023
WHEREAS, the City of Webster Groves desires to enter into a contract for roof
restorations at City Hall and the Service Center; and
WHEREAS, the bid of Shay Roofing, 400 South Breese Street, Millstadt, IL
62260, in the amount of $258,100.00, was determined to be the most
advantageous bid in accordance with specifications.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES, that the City Manager be authorized to accept the bid of
Shay Roofing, and to enter into a contract, for the sum hereinabove set forth, and
to assure that all items constituting the bid are provided in accordance with
specifications.
BE IT FURTHER RESOLVED, that funds for this purchase shall be paid from the
Capital Improvement Sales Tax Fund.
FURTHERMORE, the FY-2023 Budget shall be amended by an increase of

WHEREAS, the Public Works staff reviewed the approved consultant pre-
qualified list on file for roadway design through MoDOT for engineering services
for the Elm Avenue Project between Glendale Road and Watson Road; and
WHEREAS, the proposal from George Butler Associates (GBA), 16305 Swingley
Ridge Road, Suite 300, Chesterfield, MO 63017, in the amount not to exceed
$19,375.00, was determined to be the most advantageous proposal in
accordance with the specifications.
NOW, THEREFORE, BE IT RESOLVED, BY THE COUNCIL OF THE CITY OF
WEBSTER GROVES, that the City Manager be authorized to accept the
proposal of George Butler Associates (GBA), and to enter into a contract, for the

FRATERNAL ORDER OF POLICE, LODGE 15, FOR THE POLICE OFFICERS, POLICE
SERGEANTS, AND POLICE LIEUTENANTS, RESPECTIVELY; AUTHORIZING THE CITY
MANAGER TO ENTER INTO A LETTER OF UNDERSTANDING WITH THE EASTERN
MISSOURI COALITION OF POLICE, FRATERNAL ORDER OF POLICE, LODGE 15; AND
AMENDING THE BUDGET FOR FISCAL YEAR 2023
WHEREAS, the City of Webster Groves has reached agreement with the Eastern Missouri
Coalition of Police, Fraternal Order of Police, Lodge 15 related to three (3) Collective
Bargaining Agreements which have been unanimously endorsed by the Police Officers,
Sergeants, and Lieutenants; now therefore
BE IT RESOLVED, by the City Council of Webster Groves, Missouri, that the City Manager
be authorized to enter into three separate Collective Bargaining Agreements with the
Eastern Missouri Coalition of Police, Fraternal Order of Police, Lodge 15 for the Police
Officers, Police Sergeants, and Police Lieutenants, attached as Exhibit A, B, and C,
respectively; and
BE IT FURTHER RESOLVED, by the City Council of Webster Groves, Missouri, that the
City Manager be authorized to enter into a letter of understanding with the Eastern
Missouri Coalition of Police, Fraternal Order of Police, Lodge 15 attached as Exhibit D;
and
BE IT FURTHER RESOLVED, that the budget for Fiscal Year 2023, commencing July 1,
2022 be amended to include an increase in appropriations in the General Fund of
$101,682 dollars and an increase in appropriations in the Police & Fire Pension Fund of
$41,760 dollars.
