NEXT REGULAR MEETING DATE: TUESDAY – JANUARY 7, 2025  Bill #9273 Ordinance #9273 AN ORDINANCE PROVIDING FOR A BOUNDARY ADJUSTMENT BETWEEN THE CITIES OF WEBSTER GROVES AND MAPLEWOOD WHEREAS, Sections 72.400-72.430, RSMo., establish rules and procedures for the annexation of land within St. Louis County including a provision for the adjustment of common boundaries between two municipalities; and WHEREAS, Section 72.401(8) provides that boundary adjustments between municipalities where the municipalities own the area, where the area is contiguous with the municipality and the area is being used for parks and recreation purposes are not subject to review by the Boundary Commission of St. Louis County; and WHEREAS, Section 71.011 RSMo., provides that property of a municipality abutting another municipality may be concurrently detached from one municipality and annexed by the other municipality by the enactment of the governing bodies of each municipality of an ordinance describing the metes and bounds of the property, declaring the property so described to be concurrently detached and annexed and stating the reasons for the purposes to be accomplished by the detachment and annexation; and WHEREAS, the owner of the property hereafter described desires that its property, which is currently within the City of Maplewood, be located within the City of Webster Groves, where the remainder of its property is located, in order to facilitate parks, trail systems and flood plain improvements and to allow for more efficient and effective delivery of public services; and WHEREAS, the governing bodies of Maplewood and Webster Groves have found and hereby declare that the portion of the property hereinafter described to be concurrently detached by the City of Maplewood and annexed by the City of Webster Groves has no residents as of the time of said detachment and annexation; and WHEREAS, the City Council of Maplewood hereby finds, determines and declares that (1) the City of Webster Groves has the capacity to extend public services to the entire parcel of land; (2) that such boundary change will simplify governmental regulation over development of the property in that only a single municipality will have jurisdiction; and (3) the annexed property will be zoned “C” Commercial District as set forth in Section 53.110 et seq. of the Code of Webster Groves. 1  NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. In order to achieve more uniform, regular and recognizable boundaries between the City of Webster Groves and the City of Maplewood, and for the purpose of achieving more efficient and effective regulation over the entire parcel affected and the delivery of public services to such parcel, that tract of land hereinafter described is hereby concurrently detached from the City of Maplewood and annexed by the City of Webster Groves, which will provide public services to the entire parcel from the effective date of this Ordinance forward. Section 2. Upon the effective date of adoption of this ordinance, the annexed parcels of land shall be zoned "C" Commercial District and is more particularly described in Exhibits A- B attached hereto and incorporated by this reference as if fully set forth herein. Section 3. The City Clerk of Webster Groves is hereby authorized and directed to cooperate with appropriate officials in the City of Maplewood to simultaneously file certified copies of this Ordinance and a concurrent Ordinance with the St. Louis County Clerk, the St. Louis County Recorder of Deeds and the Clerk of the St. Louis County Circuit Court in order to finalize and complete the transfer of jurisdiction and concurrent detachment and annexation of the tract of land described herein. Upon such filings by the cities, the courts and all agencies of this state shall be authorized to take notice of the limits of both municipalities as changed hereby. Section 4. Following the effective date of transfer of jurisdiction of the tract of land described herein, the City Clerk is also directed to provide a certified copy of this Ordinance, together with appropriate maps showing the changes accomplished hereby, to the Director of Revenue of the State of Missouri and to the Board of Election Commissioners of St. Louis County. Section 5. This ordinance shall be in full force and effect from and after the date of its passage and approval and according to law. The transfer of jurisdiction shall be complete and final at 12:01 a.m. on the day following completion of the filings described in Section 3 herein by both the City of Webster Groves and the City of Maplewood. Section 6. This ordinance shall not be printed in the Code of Webster Groves. Alexander Councilmember Emily Hixson Shepherd Absent: Councilmember Jamie Hasemeier A quorum was present. Also present: Dr Marie Peoples, City Manager Neil Bruntrager, City Attorney Katie Nakazono, City Clerk REMARKS FROM THE COMMUNITY AND VISITORS Dave Buck, 6 Colonial Village, congratulated Gregory Donovan and Scott Davis for their promotions. He also thanked Neil Bruntrager for the email conversation on peacemaking & mediation. Mr. Buck’s main point was to pose a question to Council about the nature of the current relationship between the City and the School District as 70% of tax funds are directed to the District. He expressed that the relationship should be of a symbiotic nature but instead has a cool – frosty vibe. Tensions seem to have been exacerbated in 2015 with the defeat of Prop S & W by former Councilmember Greg Mueller’s Spend-Wisely initiative. As well, Mr. Buck stated that Council should be concerned, despite Bristol’s recent recognition with the national Blue Ribbon Award, the District ranking has dropped from top 10 regionally to somewhere in the 20s. He believes the School District is a draw for families relocating to Webster Groves. And that maybe the District might benefit from Council input on selection of/for the 3 major positions open within the District: superintendent, high school principal and Bristol principal. NEW BUSINESS – MAYOR, COUNCILMEMBERS, CITY ATTORNEY, CITY MANAGER No New Business. NEW BUSINESS BILL #9273 – FIRST & SECOND READING Councilmember Alexander introduced BILL #9273 - AN ORDINANCE PROVIDING FOR A BOUNDARY ADJUSTMENT BETWEEN THE CITIES OF WEBSTER GROVES AND December 03, 2024 MAPLEWOOD, and at the Councilmember’s request, the bill was read twice, first and second times by title only and placed on the agenda for future consideration of the Council. Prior to the Second Reading, Deputy City Manager of Strategic Innovation Scott Davis presented details about the boundary adjustment between the cities of Webster Groves and Maplewood for the new Oxford Bend Park. [See Exhibit 1]. CONSENT AGENDA A motion was made by Councilmember Franklin, seconded by Councilmember Bliss, to approve the Consent Agenda. Mayor Arnold called for the vote on the Consent Agenda. MAYOR ATTEST: CITY CLERK  RESOLUTION #2024-70 AUTHORIZING AN AMENDMENT TO RESOLUTION 2023-54 TO REALLOCATE EXPENSES RELATED TO THE WATER PARK WITH MULTIPLE VENDORS WHEREAS, the City desires to add a layer of quality assurance and cost savings in the construction of the Water Park by utilizing multiple vendors, including the original contractor, Westport Pools now DBA Landmark Aquatics; and WHEREAS, the amendment to Resolution 2023-54 will reallocate $400,000 of the original $12,000,000.00 solely awarded to Landmark Aquatics to multiple vendors; and WHEREAS, to keep the project on schedule, staff will be authorized to select vendors that comply with Council approved purchasing protocol with appropriate backup and in accordance with the specifications; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, that the City Manager is hereby authorized to reallocate Water Park funds for the sum hereinabove set forth, and to assure that all items are provided in accordance with specifications. MAYOR ATTEST: CITY CLERK  RESOLUTION #2024-71 AUTHORIZING THE CITY MANAGER TO PURCHASE ONE (1) REPLACEMENT VEHICLE FOR THE PARKS AND RECREATION DEPARTMENT WHEREAS, the City of Webster Groves participates in the State of Missouri vehicle purchase program, and desires to purchase a replacement pickup truck for the Parks & Recreation Department; and WHEREAS, Joe Machens Ford Lincoln, 1911 W Worley, Columbia MO 65203, is on the State of Missouri bid contract list, and the City of Webster Groves will purchase one 2024 Ford F350, super cab & chassis, single rear wheel axle, 4x4, V8 gas, power equipment, trailer brake controller, Knapheide bed, with drop sides, beacon lights, and receiver hitch, in the amount of $65,000.00. The State bid was determined to be the most advantageous bid in accordance with specifications. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, that the City Manager be authorized to accept the bid of Joe Machens Ford Lincoln, and to enter into a contract, for the sum hereinabove set forth, and to assure that all items constituting the bid are provided in accordance with specifications. ADOPTED this ______day of _____________, 2024. __________________________ MAYOR ATTEST: ______________________________ CITY CLERK  RESOLUTION #2024-72 A RESOLUTION OF THE CITY OF WEBSTER GROVES, MISSOURI AUTHORIZING THE CITY TO ACQUIRE TWO FLOOD PROPERTIES (843 N FOREST AVENUE, AND 844 E PACIFIC AVENUE) UTILIZING FEMA FUNDS, AND APPOINTING THE PROJECT MANAGER WHO WILL EXECUTE THE CONTRACTS AND RELATED DOCUMENTS WHEREAS, the City of Webster Groves desires to participate with the Federal Emergency Management Agency (FEMA) and the State of Missouri Emergency Management Agency (SEMA) in plans and activities for the improvement of the community under the program; and WHEREAS, the Robert T Stafford Act, as amended, does include provisions for property acquisition and relocation assistance; and, WHEREAS, on August 28, 2023, FEMA announced that the City of Webster Groves had two properties initially selected for voluntary purchase to reduce or eliminate flood damage to buildings through the Flood Mitigation Program (FMA), and WHEREAS, funds in the amount of $578,730 have been approved under the aforementioned program and are intended to be used toward acquisition of residential properties damaged by past flood events; and WHEREAS, the two properties are now approved by FEMA for purchase. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Webster Groves, Missouri, that the City Manager, Marie Peoples, or the Project Manager, Renee Tyler on behalf of the City Manager, is authorized to proceed with the purchase acquisition of the two (2) properties at 843 N FOREST AVENUE, AND 844 E PACIFIC AVENUE affected by the July 2022 floods and identified as substantially damaged, repetitive loss properties. BE IT FURTHER RESOLVED, the funds appropriated shall be from the Special Initiatives Fund. Passed and approved on this day of , 2024. Mayor ATTEST: City Clerk  RESOLUTION #2024-73 AUTHORIZING THE CITY MANAGER TO PURCHASE CIVICREC SOFTWARE ANNUAL LICENSES WHEREAS, the City desires to purchase CivicRec software annual licenses for the Recreation Management Software program for the Recreation Complex, and WHEREAS, CivicPlus LLC, 302 South 4th Street, Suite 500, Manhattan, KS 66502, in the amount of $31,000.00, for the purchase of the CivicRec software annual licenses, was determined to be the most advantageous proposal received in accordance with the specifications. NOW, THEREFORE, BE IT RESOLVED THAT THE COUNCIL OF THE CITY OF WEBSTER GROVES, hereby authorizes the City Manager to enter into a contract with CivicRec, for this purchase/service, for the amount hereinabove set forth, and to assure that all services are provided in accordance with the contract. BE IT FURTHER RESOLVED, that the cost for this purchase/service shall be paid from the General Fund.
