A regular meeting of the Webster Town Board was called to order by Supervisor Flaherty at
7:30 p.m. at the Webster Town Board Meeting Room, 1002 Ridge Road, Webster, New York,
with the following officials present:

The meeting was open to the floor for public comment.
Anna Taylor, President of the Friends of Webster Trails, came before the Board to address the
consideration of a Progressive Development District (PDD) at 799 Holt Road (former
lumberyard site) which is adjacent to the Hojack Trail. The Friends of Webster Trails Board
Members reviewed the site plans proposed for the former lumberyard site. Their mission is to
advocate for the preservation and the natural character of Webster open spaces and promote this
through sensible management, education, low impact access, and advise and assist the Parks and
Recreation Department by planning, maintaining and promoting recreational trails in the Town
of Webster. The Friends of Webster Trails is recommending site plan changes and suggests a
thick, substantial vegetative buffer along the length of the Hojack Trail. They also suggested
creating a setback to make room for the vegetated buffer setbacks to be increased to 150 feet
from the Hojack Trail property line and not be measured from the middle of the trail. They
strongly oppose clear cutting of lots adjacent to the trails in the parkland to keep the vegetative
buffer and to keep the trail looking like a trail. For the adverse impacts to the trail, they would
recommend a trail budget so that a portion of the project budget be committed to trail
improvements on the section of the Hojack Trail between Holt Road and Hard Road which
would include funds for the purchase of native trees and trail surface replacement as the trail
erodes due to usage. Since the proposed site plans increase traffic by 361 units, they are
proposing that precisely where the Hojack Trail crosses Holt Road, to install a pedestrian
activated crossing flashing light and signage upon the approach so that vehicles are aware of the
pedestrian crossing.

authorize the Town Supervisor to sign an agreement with Troy and Banks Consultants, LLC to
conduct a cable television franchise fee compliance audit for a contingent fee of 50% of the
underpayments identified and recoverable under the Town’s franchise agreement and/or State
and Federal law.

authorize the Town Supervisor to sign an Intermunicipal Agreement (IMA) with Monroe County
for the State and Local Fiscal Recovery Funds (SLFRF) to be used for youth and senior
congregate programming and related equipment between 1/1/2025-12/31/2026.

Resolution No. 336: MOTION by Supervisor Flaherty, seconded by Councilwoman Nguyen, to
apply for Restore New York Funding to demolish and/or restore an area of West Webster
Hamlet, specifically properties located at 600 Ridge Road and 602 Ridge Road, to be published
in three consecutive editions of The Daily Record and to set a Public Hearing on December 5,
2024.
WHEREAS, the 2024-2025 New York State Budget has provided new funding for the Restore
New York Communities Initiative and given Empire State Development the responsibility of
implementing this program for the purpose of revitalizing communities and stabilizing
neighborhoods; and
WHEREAS, municipalities, defined as cities, towns, and villages, have been invited to submit a
Request for Funding Proposal for any project to demolish, deconstruct, rehabilitate and/or
reconstruct vacant, abandoned, condemned and surplus properties; and
WHEREAS, in order to be eligible for such funding, a Restore NY Application must be certified
by the chief elected official of each such municipality, and must, as part of such Application
include a Property Assessment List, among other pertinent items and documents; and
WHEREAS, such Property Assessment List must be published in a local daily newspaper either
in print or online for three consecutive days, and evidence of such publication must be included
in the Application; and
WHEREAS, a Public Hearing is required to be held to discuss the Restore NY Application and
the Property Assessment List; and
WHEREAS, an applying municipality’s legislative body must pass a Resolution finding that the
proposed project is consistent with the municipality’s local revitalization plan; and
WHEREAS, a Resolution must be passed finding that the proposed financing is appropriate for
the specific project, that the project facilitates effective and efficient use of existing and future
public resources so as to promote both economic development and preservation of community
resources; and
WHEREAS, a Resolution must be passed finding that the project develops and enhances
infrastructure and/or other facilities in a manner that will attract, create and sustain employment
opportunities where applicable; and
WHEREAS, the Town Board has considered and is considering an Application to sponsor a
project to demolish and/or rehabilitate a targeted area of (old) Ridge Road and Gravel Road in
the Hamlet of West Webster and, which project includes and involves two vacant, abandoned
and/or unrepaired properties totaling over 10,000 square feet at the corners of (old) Ridge Road
and Gravel Road in the Hamlet formerly known as West Webster; and
WHEREAS, it appears that the age of the structures involved and the size of the lots involved
have made these buildings functionally and economically obsolete, resulting in high vacancy
rates; and
WHEREAS, the Town of Webster has identified the revitalization of the area formerly known as
West Webster to be a priority in its most current Comprehensive Plan; and

WHEREAS, a significant concern is the vacant, abandoned and asbestos/lead contaminated
property at 600 Ridge Road, and the adjacent properties at 602 Ridge Road, all or substantially
all of which will need to be significantly rehabilitated to meet contemporary standards for
commercial and residential uses:
NOW, THEREFORE, BE IT RESOLVED:
1. That a Public Hearing be scheduled and shall be conducted by the Town Board of the Town
of Webster to be held at the Town Board Meeting Room, 1002 Ridge Road, Town of
Webster, on Thursday, December 5, 2024 at 7:30 p.m., to consider pursuing a Restore NY
funding request for West Webster Hamlet Revitalization, specifically properties located at
600 Ridge Road (Tax ID 078.20-1-11) and 602 Ridge Road (Tax ID 078.20-1-16), to
demolish and/or rehabilitate the two (2) properties as follows:

2. That the determination of significance under the New York State Environmental Quality
Review Act will be considered at the time of such Public Hearing.
3. That as the Town of Webster is a municipality that has no publication that can reasonably be
considered a “local daily newspaper”, the Town Clerk will give notice of such Public
Hearing at least ten (10) days prior to such hearing by:
Publishing this Resolution in The Daily Record, a Western New York daily publication, for
three (3) consecutive days.
4. Posting a copy thereof on the Town Clerk’s Bulletin Board and on the Town’s Website.

Resolution No. 337: MOTION by Supervisor Flaherty, seconded by Councilwoman Cataldi, to
schedule a Public Hearing to consider the development plan at 799 Holt Road (former lumber
yard site) establishing a Progressive Development District (PDD). The Public Hearing will be
on December 5, 2024 at 7:30 P.M. and will be advertised in the November 26, 2024 Webster
Herald.
WHEREAS, 799 HOLT ROAD LLC is the owner of real property located on the west side of
Holt Road, west of Webster Road and north of Route 104, consisting of a total of 65.7+ acres,
known as Tax Account Numbers 079.08-1-12 and 079.08-1-13; and

WHEREAS, the lands are currently in an OP CORE AREA NORTH - OFFICE PARK District;
and
WHEREAS, the owner proposes that the lands be developed as a “PDD-Progressive
Development Overlay District”, pursuant to Webster Town Code Section 350-23, and that the
Town Board approve a PDD development plan for said property and authorize the Planning
Board to conduct site plan review of such property; and
WHEREAS, an application has been made to develop said property as a PDD-Progressive
Development Overlay District and approve a PDD development plan:
NOW, THEREFORE, BE IT RESOLVED:
1. That a Public Hearing be conducted at a regular meeting of the Town Board of the Town of
Webster to be held at the Town Board Meeting Room, 1002 Ridge Road, in the Town of
Webster on the 5th day of December 2024, at 7:30 p.m. to consider that the following lands
be developed as a PDD-Progressive Development Overlay District:
ALL THOSE TRACTS AND PARCELS OF LAND located in the Town of Webster, County of
Monroe and State of New York, consisting of a total of 65.7+ acres, known as Tax Account
Numbers 079.08-1-12 and 079.08-1-13.
2. That the requirements of the New York State Environmental Quality Review Act (SEQRA)
will be considered at the time of such Public Hearing, and that the applicant shall submit the
Environmental Assessment Form (EAF) to the Town Board prior to the Public Hearing.
3. That the Town Clerk give notice of such Public Hearing by publishing in the official Town
newspaper a certified copy of this Resolution and by posting a copy thereof on the Town
Clerk’s Bulletin Board and on the Town’s website, not less than five (5) days, nor more than
ten (10) days, before such hearing.

Resolution No. 339: MOTION by Supervisor Flaherty, seconded by Councilwoman Cataldi, to
enter into Executive Session pursuant to New York State Public Officer’s Law §105(1)(d) to
discuss proposed, pending or current litigation.
WHEREAS, New York State Public Officers Law provides that the Town Board may enter into
Executive Session to discuss certain subjects or matters:
NOW, THEREFORE, BE IT RESOLVED:
That the Town Board enter into an Executive Session pursuant to New York State Public
Officer’s Law §105(1)(d) to discuss proposed, pending or current litigation.
That the following persons were authorized to attend: Charles Genese, Town Attorney, Paul
Adams, Finance Director, Brayton Connard, Human Resources Director, Josh Artuso, Director
of Community Development and Planning, Bridget Harvey, Director of Communications, and
