Aye Motion carried .................... 4-0 *** Resolution No. 128: MOTION by Supervisor Flaherty, seconded by Councilman Cahill, to schedule a Public Hearing to enact a new Local Law to codify Code Enforcement Procedures and to amend Sections 243, 320-22, 324-3, 324-4 and 350-48 of the Webster Town Code. WHEREAS, it has been brought to the attention of the Town Board that there have been complaints of persistent code violations related to vehicle storage, on-street parking, portable storage containers, and vacant properties; and WHEREAS, the Town Board has the authority pursuant to Article 4 of the New York State Town Law to promote the health, safety, morals, or general welfare of the community; and WHEREAS, the Town Board has the authority pursuant to Article 9 of the New York State Town Law to enact, amend, and repeal ordinances, rules, and regulations not inconsistent with law, and more specifically, to enact local laws restraining violations of and compelling compliance with provisions of the Town’s Property Maintenance, Vehicles, Junked and Abandoned, Vehicles and Traffic, and Zoning Codes; and WHEREAS, the Town Board has been requested to adopt a local law further defining requirements regarding vehicle storage, on-street parking restrictions, portable storage containers, to include roll off dumpsters, and vacant properties and further amending the code enforcement procedures to address persistent code violations for the purpose of protection and preservation of properties of the Town and its residents and of peace and good order therein: NOW, THEREFORE, BE IT RESOLVED: That, pursuant to Section 20 of the Municipal Home Rule Law of the State of New York, a Public Hearing shall be scheduled and conducted at a regular meeting of the Town Board of the Town of Webster to be held at the Town Board Meeting Hall, 1002 Ridge Road, in the Town of Webster on Thursday, May 1, 2025, at 7:30 p.m., to consider a Local Law to amending Sections 243, 320-22, 324, and 350-48 of Chapters 243, 320, 324, and 350 of the Webster Town Code, relating to Property Maintenance, Vehicles and Traffic, Vehicles, Junked and Abandoned, and Zoning Codes of the Town of Webster. The entire law to be amended and will be available through the Town Website and at the Town Clerk’s Office. 1. That the determination of significance under the New York State Environmental Quality Review Act is to be considered at the time of such Public Hearing. 2. That the Town Clerk give notice of such Public Hearing at least five (5) days prior to such hearing by publishing a copy of this Resolution once in the Webster Herald, the official newspaper of the Town of Webster and posting a copy thereof on the Town Clerk’s Bulletin Board and the Town’s website. 3 04-03-2025 Webster Town Board Vote on motion: Supervisor Flaherty ............ Aye Motion carried .................... 4-0 *** Resolution No. 129: MOTION by Supervisor Flaherty, seconded by Councilman Cahill, to schedule a Public Hearing for Thursday, May 1, 2025 to consider amending the development plan of lands on the south side of Ridge Road, East of Shoecraft, commonly known as Ridge Commons, as a Progressive Development Overlay District (PDD), which was originally enacted per Resolution Number 199 of 2019, to be advertised in the Wednesday April 16, 2025 edition of the Webster Herald. WHEREAS, Fox Family Business Management, LLC (Charlie Fox, President) is the owner of property with addresses known as 985, 987, 991 and 1013 Ridge Road and identified by Tax Account Numbers 079.15-1-34, 079.15-1-16.001, 079.15-1-16.002 and 079.15-1-16.003, collectively known as Ridge Commons; and WHEREAS, on December 19, 2019 the Webster Town Board adopted and approved a Progressive Overlay District (PDD) for the aforesaid addresses and tax parcels, pursuant to former Webster Town Code Section 225-21, now Webster Town Code Section 350-23; and WHEREAS, the owner of the property desires to make greater than 10% changes to location, siting, dimensions, and use of the structures identified in the originally approved PDD development plan; and WHEREAS, the originally approved PDD development plan included proposed development on a certain parcel of land within the PDD-Progressive Development Overlay District that was inconsistent with the underlying zoning use; and WHEREAS, an application has been made to amend the PDD-Progressive Development Overlay District previously approved and amend the PDD development plan pursuant to Webster Town Code 305-23(G)(4)(b) and 305-23(G)(7): NOW, THEREFORE, BE IT RESOLVED: 1. That a Public Hearing be conducted at a regular meeting of the Town Board of the Town of Webster to be held at the Town Board Meeting Room, 1002 Ridge Road, in the Town of Webster on the 1st day of May 2025, at 7:30 p.m. to consider that the current PDD- Progressive Development Overlay District of ALL THOSE TRACTS AND PARCELS OF LAND located in the Town of Webster, County of Monroe and State of New York, consisting of a total of 26.02+ acres, designated by Tax Account Numbers 079.15-1-1.34, 079.15-1-16.001, 079.15-1-16.002 and 079.15-1-16.003 be amended to remove those certain parcels from the PDD-Progressive Development Overlay District and further amend the PDD development plan. 2. That the requirements of the New York State Environmental Quality Review Act (SEQRA) will be considered at the time of such Public Hearing, and that the applicant shall submit the Environmental Assessment Form (EAF) to the Town Board prior to the Public Hearing. 4 04-03-2025 Webster Town Board 3. That the Town Clerk give notice of such Public Hearing by publishing in the official Town newspaper a certified copy of this Resolution and by posting a copy thereof on the Town Clerk’s Bulletin Board and on the Town’s website, not less than ten (10) days before such hearing. Aye Motion carried .................... 4-0 *** Resolution No. 130: MOTION by Supervisor Flaherty, seconded by Councilwoman Wright, to approve Change Order No. 3 for Morsch Pipeline, Inc. construction contract in regard to the Phillips to Tebor Road Conveyance Pipe Project (H0237). The change order is to reroute the sewer for Monroe County Water Authority in the amount of Seventy-Six Thousand Eight Hundred Sixty-Eight Dollars ($76,868.00). Aye Motion carried .................... 4-0 *** Resolution No. 131: MOTION by Supervisor Flaherty, seconded by Councilman Cahill, to approve Change Order No. 5 for Morsch Pipeline, Inc. construction contract in regard to the Phillips to Tebor Road Conveyance Pipe Project (H0237). The change order is for Asbestos Concrete Pipe (ACP) removal from Section 1 to Section 3 near Phillips Road in the amount of Three Hundred Eighty-Two Thousand Five Hundred Three and 01/100 Dollars ($382,503.01). Aye Motion carried .................... 4-0 *** Supervisor Flaherty reminded the Board about the March 20, 2025 Workshop presentation which emphasized the urgency of design work for the Vosburg Pump Station, leading to a Resolution to begin this design process. Paul Chatfield, MRB Senior Project Manager, discussed clear differentiation in costs and assurances that the final designs will be bid-ready, leading to more accurate budgeting for the project. Mr. Chatfield predicted a completion timeline of four to six months before bidding could commence. It was discussed that the Town is applying for a Federal Earmark Grant which is required to be submitted by April 4, 2025. The Town received thirty-three letters of support. The Town Board then considered the following Resolution: 5 04-03-2025 Webster Town Board Resolution No. 132: MOTION by Councilwoman Wright, seconded by Councilwoman Nguyen, to authorize the Town Supervisor to sign a contract with MRB Group for the engineering and design on the Vosburg Pump Station pending attorney review and not to exceed an amount of $369,635.00.
