Webster Town Board May 1, 2025 A regular meeting of the Webster Town Board was called to order by Supervisor Flaherty at 7:30 p.m. at the Webster Town Board Meeting Room, 1002 Ridge Road, Webster, New York, with the following officials present: Supervisor ................................................................................ Art Petrone *** Supervisor Flaherty led the Pledge of Allegiance to the Flag. *** Supervisor Flaherty announced a Public Hearing to consider an amendment/corrective action to a Progressive Development District (PDD) set up in 2019 at Ridge Commons. At 7:32 p.m. Supervisor Flaherty opened the Public Hearing. Michael Montalto, Costich Engineering, on behalf of his client, Charlie Fox, discussed the zoning issues related to the 26-acre property, noting that prior approvals from 2019 were granted erroneously because a Progressive Development District (PDD) cannot be established on residential zoning per Town code. Mr. Montalto emphasized the need to correct the mistake regarding zoning classifications. The focus is on ensuring that the site’s zoning accurately reflects the intended land use for commercial development, affirming that while the process is complex, the correction is necessary and straightforward. No comments were received, and the Public Hearing was closed at 7:37 p.m. *** The meeting was open to the floor for public comment. Mr. Artuso indicated that while working through a draft of the Town Code relating to Code Enforcement, they identified that making changes would impact other areas of the Town Code, therefore he was proposing that the matter be tabled to the next scheduled Town Board meeting and dates to set the Public Hearing and advertising in the Webster Herald be adjusted when available. The Town Board then considered the following Resolution: Resolution No. 146: MOTION by Supervisor Flaherty, seconded by Councilwoman Cataldi, to table setting a Public Hearing for May 15, 2025, on potential code changes relating to Code Enforcement and to be advertised in the May 7, 2025, edition of the Webster Herald. Aye Motion carried .................... 4-0 *** Resolution No. 148: MOTION by Councilwoman Wright, seconded by Councilwoman Nguyen, to abandon a portion of, and take easement, new portions of, a sanitary sewer easement and stormwater drainage easement, located at 1129 Shallow Brook Terrace, Tax Account No. 095.05-4.10-1; and 3 05-1-2025 Webster Town Board WHEREAS, Kristen Hyland is the owner of property located at 1129 Shallow Brook Terrace and desires to have the Town of Webster abandon portions of an existing sanitary sewer easement and stormwater drainage easement existing on the property and offers by way of easement to the Town of Webster certain portions of property to be used for sanitary sewer and stormwater drainage purposes; and WHEREAS, the Webster Town Board has the authority to convey real property pursuant to Town Law 64; and WHEREAS, a transfer of property pursuant to Town Law 64 is subject to a permissive referendum pursuant to Town Law 91: NOW, THEREFORE, BE IT RESOLVED: 1. That the Webster Town Board approves the abandonment of portions of an existing sanitary sewer and stormwater drainage easement located at 1129 Shallow Brook Terrace and further approves the taking by easement a new sanitary sewer and stormwater drainage easement also located 1129 Shallow Brook Terrace. 2. Aye Motion carried .................... 4-0 *** Resolution No. 149: MOTION by Councilwoman Wright, seconded by Councilwoman Nguyen, to abandon a portion of, and take easement, new portions of, a sanitary sewer easement and stormwater drainage easement, located at 1131 Shallow Brook Terrace, Tax Account No. 095.05-4.9.1; and WHEREAS, Stuart Katz is the owner of property located at 1131 Shallow Brook Terrace and desires to have the Town of Webster abandon portions of an existing sanitary sewer easement and stormwater drainage easement existing on the property and offers by way of easement to the Town of Webster certain portions of property to be used for sanitary sewer and stormwater drainage purposes; and WHEREAS, the Webster Town Board has the authority to convey real property pursuant to Town Law 64; and WHEREAS, a transfer of property pursuant to Town Law 64 is subject to a permissive referendum pursuant to Town Law 91: NOW, THEREFORE, BE IT RESOLVED: 1. Aye Motion carried .................... 4-0 *** Resolution No. 150: MOTION by Councilwoman Cataldi, seconded by Councilwoman Wright, to refer the proposed project located at 633 Basket Road, Tax No. 066.03-1-9.11 to the Planning Board for the purpose of conducting site plan review, pursuant to Section 350-22(D) of the Webster Town Code. WHEREAS, HL Lockwood LLC owns property at 633 Basket Road, Town of Webster; and WHEREAS, Lon Lockwood, as representative of HL Lockwood LLC, seeks to construct a building at 633 Basket Road in the Town of Webster to provide office space, fleet parking and vehicle maintenance facilities for Lockwood Electric, as well as leasable garage spaces and dog daycare facilities; and WHEREAS, the affected lands are in an Industrial District (“I-N”); and WHEREAS, pursuant to Webster Town Code 305-22(D) an industrial use permit is required for any use within an I-N district; and WHEREAS, Webster Town Code, Section 350-22(D)(2) requires referral of applications for Industrial Use Permits to the Town Planning Board; and WHEREAS, the Site Plan and application have been received by the Town Board; and WHEREAS, an Environmental Assessment Form has been received and reviewed by the Town Board; and WHEREAS, after referral from the Town Board to the Town Planning Board, Webster Town Code, Section 350-22(D)(3) requires the Town Planning Board to review application and supporting documentation and submit a report back to the Town Board regarding its findings and recommendations on the application: NOW, THEREFORE, BE IT RESOLVED: 1. That the application, together with all supporting documents to be referred to the Town of Webster Planning Board for its review and recommendation. 2. That the Town Planning Board as soon as practicable, after completion of site plan review procedure under Webster Town Code Chapter 269, shall submit a report of its findings with its recommendation for approval, conditional approval or disapproval of an Industrial Use Permit to the Town Board. 5 05-1-2025 Webster Town Board 3. That the Town Board consents to any request from the Town Planning Board that the Town Planning Board be designated as the lead agency for coordinated review procedures for the proposed action under the New York State Environmental Quality Review Act. Aye Motion carried .................... 4-0 *** Pat Stephens, Highway Superintendent, presented the next matter. Mr. Stephens discussed the completion of a stormwater flood mitigation project that is located in Finn Park along Shipbuilder’s Creek. It’s a unique project and partnership between the Town and Monroe County Sewer and Water in which funding is established through grants. This is the last component of the project. The culvert is designed to have an overflow feature, when Shipbuilder’s Creek rises to a certain level, it will divert the flow to large storage ponds within the park. The Town Board then considered the following Resolution: Resolution No. 151: MOTION by Councilwoman Cataldi, seconded by Councilwoman Wright, to authorize the Town Clerk to advertise and to solicit requests for proposal for a precast concrete box culvert associated with the completion of the Regional Stormwater Facility located in Finn Park off of Gravel Road. Advertisement to be in the Webster Herald on May 7, 2025, with proposals to be opened on Tuesday, June 10, 2025. Vote on motion: Supervisor Flaherty ............ Aye Councilwoman Cataldi ..... She stated that the previous vendor was acquired by Schneider Geospatial, LLC and there is a payment amount required to transition to set up a new community facing system when we move forward with the revaluation. The Town Board then considered the following Resolution: Resolution No. 152: MOTION by Councilwoman Wright, seconded by Councilwoman Cataldi, to authorize the Town Supervisor to sign a Professional Services Agreement with Schneider Geospatial, LLC for online assessment data and hosting, in an amount of Seven Thousand, six hundred thirty-six dollars and fifty cents ($7,636.50) and payments to be made over the course of thirty (30) months, expiring December 31, 2027. Aye Councilwoman Wright...... Aye Motion carried .................... 4-0 *** Art Petrone, Deputy Commissioner of Public Works - Sewer, presented the next matter. Mr. Petrone stated that Barton & Loguidice (B&L) is progressing design and permitting to support and protect the 8-inch sanitary sewer pipe crossing Shipbuilder’s Creek which has been undermined by erosion of the stream. The original intent was for stone stabilization upstream and downstream for the pipeline to be progressed as an emergency action until a more comprehensive stream/infrastructure stabilization project could be progressed. B&L and the Town of Webster representatives met virtually with NYSDEC Region 8 staff for a pre- application permitting meeting on March 4, 2025. The NYSDEC requested a site visit with B&L, which was conducted on March 13, 2025. As a result of these meetings, NYSDEC determined that the work could not progress under emergency authorization and additional design/permitting requirements would be required. Therefore, the amendment to the project is required to continue. The Town Board then considered the following Resolution: Resolution No. 153: MOTION by Councilwoman Cataldi, seconded by Councilwoman Wright, to approve Change Order No. 1 for Barton & Loguidice, D.P.C. contract in regards to Shipbuilder’s Creek. The change order is for additional design work and permitting, as determined to be necessary by the NYSDEC, in the amount of Sixteen Thousand Five Hundred Dollars ($16,500.00). The change order is to replace and/or raise existing storm laterals in the amount of Fifty-Seven Thousand Fourteen Dollars and 60/100 ($57,014.60).
